deCordova and Dana Museum and Park Physical Condition


The program of spraying, fertilizing, pruning and replacing trees and shrubs was continued, and the results have been very satisfactory. No repairs or changes are being made in the buildings, except those which are essential, and none are contemplated until the final decision on the cy-pres petition is handed down.


The Town passed votes under Articles 16 and 17 at the last annual meeting, instructing the Board to employ counsel to perform certain acts under those votes. Samuel Hoar, Esq. of Goodwin, Proctor and Hoar was retained and hearings were held before a master, Nelson Vanderhoof, Esq. The Selectmen and the Advisory Committee were represented throughout the two weeks' duration. The Selectmen recommend that the present Committee be continued.

REPORT OF ADVISORY COMMITTEE


deCORDOVA AND DANA MUSEUM AND PARK ADVISORY COMMITTEE Report for 1947


The main efforts of our Committee during 1947 were di- rected toward assisting the attorneys for the Town in securing relief through the courts from the conflicts and difficulties in- herent in the will of Julian deCordova and the deed of 1930 to the Town of Mr. deCordova's property in Lincoln.


After many conferences and in accordance with the approval of the Town at the Annual Meeting in March, a petition for Cy Pres action was filed with the Massachusetts Supreme Ju- dicial Court for Suffolk County. The Court appointed Mr. Nelson B. Vanderhoof of Boston, a member of the Bar, to sit as Master. Hearings before the Master began in July and continued well into August. At least one member of the Com- mittee was present throughout the hearings and several mem- bers were called on to testify. Some idea of the complexities of the case may be gathered from the fact that the stenographic record of the testimony and arguments covers approximately 1,000 pages.


In September the attorneys for the Town and for the de- Cordova Trustees filed briefs and presented arguments before the Master who then took the whole question under advise- ment. Subsequently he asked for two supplementary briefs on technical legal questions involved and these were duly prepared and filed.


The petition to the Court had three main objectives:


1. To secure for the Town or its agent sole authority and responsibility for the managing and operation of the Museum and Park, the disbursing of the available in- come, and the adoption of a vital and worthwhile pro- gram which would benefit the Townspeople;


2. To secure from the two deCordova trusts an assured in- come sufficient to permit the adoption and carrying out of a long-range program; and


3. To secure court approval of varied activities in accord- ance with modern Museum practice.

At the time of writing this Report, the Master has not yet filed his final draft of findings and recommendations to the Court. He has, however, submitted a draft Report to the attorneys which indicates that he looks with favor on our principal contentions and recommendations. We are in hopes that some time in 1948 a final decree will be handed down so that it will be possible to set up a non-profit corporation to act as agent of the Town to manage the project, that funds will be made available so that the Museum may be remodelled to comply with fire and safety laws and regulations and to make Museum activities possible, and a worthwhile and varied program may be adopted which will add greatly to the recrea- tional and cultural life of the Town.


During the past year little could be done pending the out- come of the court proceeding. In the Town Treasurer's Re- port will be found a detailed schedule of the money disbursed by the Selectmen during 1947 for the Museum and Park. For the most part the only funds available over and above the balance of cash carried forward from 1946 were advances from what is left of the two $10,000 gifts made by Mr. deCor- dova during his lifetime for Museum expenses. Income from both deCordova trusts was held up pending the outcome of the Court's findings in the case referred to above. Total dis- bursements of 1947 were approximately $11,200 of which about $6,100 was for care of the grounds (including the care- taker's salary), $3,400 was for maintenance of the buildings and contents, and $1,700 was for miscellaneous expenses in- cluding Mr. Robinson's fee as advisor and appraiser.


One of the most important groups of art objects in the Museum is the collection of tapestries. As previously reported, these were found to be in very poor condition. During 1947 these were cleaned and moth-proofed and repaired to the ex- tent that there would not be further.deterioration. Complete restoration will be a very expensive job. The coin collection was appraised by an expert who reported that it had a mini- mum value of at least $2,000. Many valuable and interest- ing pieces were found particularly of Medieval Europe indi- cating that some day a detailed catalog might well be prepared.


Much effort has been expended and many conferences held to secure from the Executors and residuary Trustees under

the will of Mr. deCordova complete title to all contents of the Museum. Under the terms of the deed of 1930, Mr. deCordova gave the Town only certain of the contents then in the build- ings, and objects which he later acquired in all probability do not belong to the Town but to the Estate or Trustees. The difficulty lies in ascertaining just what objects are the Town's and what the property of the Estate or Trustees. Certain classifications such as "bric-a-brac" are difficult to define exactly, and there are few records of the dates of acquisition of the thousands of articles. The simple method of solving this difficulty would be for the Executors and Trustees to deed their interest, whatever that may be, to the Town. Otherwise an exhaustive study will have to be made of the thousands of objects and Court sanction secured before the Town can know exactly what it owns and what it does not own.


So far, despite our full co-operation with the Executors and Trustees and their counsel, both in court and outside, on pro- ceedings and forms to protect them, and despite repeated assurances from them, we have been unable to get them to agree either to a donation or a sale to the Town of their inter- est in Museum contents without restrictive clauses which would involve the same difficulties of differentiation, and it may become necessary for the Town to take positive action to protect its interests.

REPORT OF THE FINANCE COMMITTEE


The Finance Committee has held numerous conferences with the Selectmen and the other administrative officers of the Town concerning their needs for funds. The Town officers have cooperated splendidly in attempting to keep down the cost of Town operations. As a result, the Finance Committee believes that the appropriations recommended in the accom- panying tabulation represent the minimum amounts required to carry on satisfactorily the regular services of the Town under present conditions, despite the fact that Town costs continue to rise.


Excluding the Water Board, which is financed from pay- ments by water users and not by Town appropriations, the total recommended appropriations for regular Town services for 1948 represents an increase of approximately $29,300 over the appropriations for 1947.


This increase is brought about principally by larger outlays for the School Department, up approximately $11,600 and the Highway Department, up approximately $9,700. The in- creased cost of schools is accounted for chiefly by some further increase in salaries, by higher high school tuition charges, by the addition of another teacher, and by the increased cost of transportation. Higher highway costs are due chiefly to the much greater expense for snow removal, to the higher prices for tar and oil, and to the need for an additional workman in the department. It may also be noted that the introduction of a pension plan for Town employees (adding approximately $1,000) and the need for raising the insurance on Town prop- erty (adding a $1,600 premium), helps to explain the increase in required funds.


Of this increase, approximately $10,400 will be met by in- creased receipts from the Commonwealth and other sources. This will leave approximately $18,900 more to be raised from taxation in 1948 than in 1947 for regular Town services.


It should be pointed out that the $18,900 increase includes nothing for appropriations under various articles in the war- rant, notably for plans and specifications for a new school building, for the purchase of land for a Town barn, for the

purchase of a truck for the Highway Department, for a new heater for the Town Hall, and for Highway improvements on Mill Street.


The Finance Committee expresses no opinion here as to the advisability of these proposals but will attempt to discharge its duty, to give advice on all proposed Town expenditures, during the discussion at Town Meeting.


It should be noted that, on the basis of 1947 valuations, every $3,738 of appropriations to be raised from taxes means $1.00 on the tax rate.
