Article 6. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1950, and to issue a note or notes therefor, payable within one year and to re- new any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Voted: That the Town Treasurer with the approval of the Selectmen be authorized to borrow money from time to time in anticipation of the revenue of the financial year be- ginning January 1, 1950, and to issue a note or notes there- for, payable within one year and to renew any note or notes as may be given for a period of less than one year in accord- ance with Section 17, Chapter 44, General Laws.

Article 7. To see if the Town will vote to conduct ser- vices on Memorial Day, the Thirtieth of May, appoint a committee, raise and appropriate money, or take any other action relative thereto.


Voted: That the Moderator appoint a committee of five to plan and carry out exercises on Memorial Day, thirtieth of May next and that the Town raise and appropriate the sum of two hundred and twenty-five dollars ($225.00) for the use of such committee in connection with these exercises. Committee appointed: Rev. Thomas E. Conlon, Mrs. Gladys de Y. Herman, Leonard C. Larrabee, Mrs. Edith A. Cullen and Edward D. Rooney.


Article 8. To see if the Town will vote to raise and appro- priate money for printing and mailing an official Town Bulletin, or take any other action relative thereto.


Voted: That the sum of $236.15 be raised and appropriated for the printing and mailing of an official Town Bulletin and that the Selectmen appoint a Committee to edit the Bulletin, of said sum $200.00 to be taken from free cash and $36.15 from the unexpended appropriation for 1949 for the "Gazette". Committee appointed: Mrs. Elizabeth J. Snelling, Mrs. Emily K. Kubik and Mrs. Alexandra T. C. Cowles.


Article 9. To see if the Town will vote to raise and appro- priate a sum of money for the use of the Building Code Com- mittee, or take any other action relative thereto.


Voted: That the present Building Code Committee be discharged with thanks and that the Moderator appoint a new committee of five to recommend revision of the present Town Building Code, and report its recommendations at the next Annual Town Meeting and that the sum of $100.00 be appropriated for the use of this Committee of which sum $35.00 is to be appropriated from the unexpended appro- priation balance of the old committee and $65.00 from Free Cash. Committee appointed: Norman F. Brisson, Robert Bygrave, William M. Dean, Manning W. MacRae and Henry B. Hoover.

Article 10. To see if the Town will vote to authorize the Selectmen to sell or lease a portion of the property purchased by the Town for a Highway Building, grant a license to use a portion of said property, or take any other action relative thereto.


Voted: That the Town grant to Leonard A. Rooney and Helen L. Rooney or the survivor a license, revocable by the Board of Selectmen of the Town by letter addressed to the licensee or licensees and mailed by registered mail, to use the strip of land in said Lincoln hereinafter described for all purposes for which the owner of the fee might use the same on condition that the said licensee or licensees shall hold the grantor harmless from all liability arising out of or in connection with any injury to any person or property occurring on said premises, and the grantee or grantees, in consideration of the within grant hereby agree to hold the grantor harmless as aforesaid, said strip of land being part of the land purchased Town Highway Building and bounded : Northwesterly by land of said Rooneys 138.46 feet: North- easterly by land of the Boston and Maine Railroad 35.00 feet: Southeasterly by remaining land of the Town of Lincoln 138.46 feet: and Southwesterly by remaining land of the Town of Lincoln 35.00 feet.


Article 11. To see if the Town will vote to appropriate the balance of the deCordova Fund in the amount of $505.24, for the purchase of furniture and equipment for the school, or take any other action relative thereto.


Voted: That the Town appropriate the balance of the DeCordova Fund in the amount of $505.24 for the purchase of furniture and equipment for the school.


Article 12. To see if the Town will vote to raise and appropriate the sum of $4,000.00 for the replacement of the worn out boiler in the Center School or take any action rel- ative thereto.


Voted: That the Town raise and appropriate the sum of $4,000.00 for the replacement of the worn out boiler in the Center School, said sum to be taken from Free Cash.

Article 13. To see if the Town will accept as a public way the private road known as Hillside Road, as shown on a plan in the Land Registration Office being plan numbered 4470 and approved by the Planning Board of the Town of Lincoln, September 13, 1949.


Voted: That the Town accept as a public way the private road known as Hillside Road, as shown on a Plan approved by the Planning Board September 13, 1949, and filed in the Land Registration Office September 21, 1949, being Land Registration Office Plan 447 - "0",


Article 14. To see if the Town will vote to raise and appropriate a sum of money to control poison ivy on the public ways of the Town, or take any other action relative thereto.


Voted: That the sum of $500.00 be appropriated to be expended by the Tree and Moth Department for the spray- ing of poison ivy on the roadsides said sum to be taken from Free Cash.


Article 15. To see if the Town will vote to raise and appropriate a sum of money for repairs to the upper hall in the Town House, or take any action relative thereto.


Voted: That the sum of $1,200.00 be appropriated for re- pairs to the upper Town Hall, said sum to be taken from Free Cash.


Article 16. To see if the Town will vote to change the name of any Town Roads, or take any other action relative thereto.


Voted: To postpone indefinitely.


Article 17. To see if the Town will vote to raise and appropriate money for the use of the School Building Com- mittee to provide facilities connected with the new school building, or take any action relative thereto.

Voted: That the sum of $844.00 be appropriated to be expended by the School Building Committee for additional original equipment for the new elementary school building, said sum to be taken from free cash.


Article 18. To see if the Town will vote to raise and appropriate money for re-surfacing the Town Tennis Courts or take any other action relative thereto.


Voted: That the sum of $1,200.00 be appropriated to re- surface the Town Tennis Courts, said sum to be taken from Free Cash.


Article 19. To see if the Town will vote to take any action to prohibit the Town of Concord from drawing water from Sandy Pond in the Town of Lincoln.


Voted: That the Town approves the action taken by the Water Commissioners with respect to the drawage of Sandy Pond water by the Town of Concord (as covered in the annual report of Water Commissioners) and instructs the Com- missioners to retain counsel and engineers for preparing a case to present before the proper tribunal for the purpose of prohibiting Concord from drawing water from Sandy Pond.


Article 20. To see if the Town will appoint a Committee to bring in plans for a Memorial in honor of the men of Lincoln who died in World War 2, raise and appropriate money or take any other action relative thereto.


Voted: That the Moderator appoint a Committee of five to bring in plans at the next Annual Town Meeting for a Memorial in honor of the men of Lincoln who died in World War II, and that the sum of $50.00 be appropriated for the use of the Committee, said sum to be taken from free cash. Committee appointed : Rev. Rollin J. Fairbanks, Mrs. Edith B. Farrar, John J. Kelliher, Lawrence B. Anderson and George G. Tarbell.


Article 21. To see if the Town will vote to accept as a public way, all or any part of the Town owned driveway from Codman Road to the new Highway Building.

Voted: That the Town accept as a public way, a section of land purchased for the Town Highway Building, con- sisting of a strip 60 feet wide extending along the northern boundary from Codman Road easterly for a distance of 534.52 feet, as shown by plan of land in Lincoln dated July 1948, by Snelling and Hilton.


Article 22. To see if the Town will accept a gift of five hundred dollars to be expended under the direction of the School Committee for such equipment for the schools as the School Committee may deem expedient, or take any action relative thereto.


Voted: That the Town accept with thanks a gift of $500.00 to be expended under the direction of the School Committee, as the School Committee may deem expedient.


Article 23. To see if the Town will vote to raise and appropriate the sum of $406.05 to pay the following unpaid 1949 bills.

Article 24. To see if the Town will appoint a committee of three to make a study of the feasibility of employing a Town Manager, to serve this Town and/or one or more other Towns.


Voted: That the Moderator appoint a Committee of 3 to make a study of the possibility of employing a Town Manager, to serve this and other towns; and complete report by January 1, 1951 and that it be published separately. Committee appointed Sumner Smith, John W. Carman and Louis C. Farley, Jr. Meeting adjourned at 11 P.M.

SPECIAL TOWN MEETING October 30th, 1950


Pursuant to a Warrant duly served the meeting was called to order by the Moderator at 7:30 o'clock P.M. The return of the Warrant was read and the following business transacted :


Article 1. To see if the Town will vote to raise and appropriate a sum of money for the use of the Fire Depart- ment, or take any action relative thereto.


Voted: That the Town appropriate the sum of $1,543.67 for the use of the Fire Department as follows: Labor at fires $1,397.50, Operation of Equipment $146.17, and that this appropriation be taken from Free Cash.


Article 2. To see if the Town will vote to adopt the follow- ing by-law pursuant to the provisions of Section 15 B, Chapter 102 of the General Laws to the end that motor boats shall not be operated upon that portion of certain rivers and inland lakes within the Town in a manner which endangers the safety of the public or is detrimental or injurious to the neighbor- hood or to the value of property therein, namely: (1) No motor boat shall be operated upon that portion of the Con- cord River or of its tributaries, or of any inland lake, lying within the Town in a manner which endangers the safety of the public or is detrimental or injurious to the neighborhood or to the value of property thereon. (2) It shall be prima facie evidence of the violation of this by-law if such motor is operated by a motor not having an under-water exhaust, or in a noisy or obnoxious manner, or at an unreasonable rate of speed, or without slowing down and exercising due caution while approaching and passing persons bathing or any other water craft. (3) Any person violating any provision of this by-law shall be subject to a fine exceeding $20.00 for each offence. (4) The Town may join with any other Town through which said Concord River or any of its tributaries flows, in the enforcement of this by-law or a similar by-law adopted by such other towns in so far as such by-laws relate to said river or its tributaries, and may appropriate money for the enforcement in whole or in part of any or all of such by-laws.

Voted: That the following by-law be adopted by the Town: (1) No motor boat shall be operated upon that portion of the Concord River or of its tributaries, or of any inland lake lying within the Town, in a manner which endangers the safety of the public or is detrimental or injurious to the neighborhood or to the value of property therein. (2) It shall be prima facie evidence of the violation of this by-law if such motor boat is operated by a motor not having an under-water exhaust, or in a noisy or obnoxious manner, or at any unreasonable rate of speed, or without slowing down and exercising due caution while approaching and passing persons bathing or any other water craft. (3) Any person violating any provision of this by-law shall be subject to a fine not exceeding $20.00 for each offence. (4) The Town may join with any other town, through which said Concord River or any of its tributaries flows, in the en- forcement of this by-law or a similar by-law adopted by such other town, in so far as such by-laws relate to the said river or its tributaries, and may appropriate money for the enforce- ment in whole or in part of any or all of such by-laws.


The foregoing By-law was approved by the Attorney Gen- eral with the exception of the words - prima facie - which were disapproved, on January 12th, 1951.


Article 3. To see if the Town will make the following revisions and additions to the Zoning By-Laws, or take any action relative thereto: To strike out and delete Section 15 (f), to strike and delete Section 5 (m), to add to Section 5 a new clause to read: "(m) Sand or gravel pits or the removal of soil, loam, sand or gravel from a property not in public use provided that a permit has been issued by the Building In- spector after a public hearing has been held by the Board of Appeals and the Board shall have approved such activities and found that they will not be detrimental to the public good. The Board shall specify limitations and safeguards as it may deem appropriate. This provision shall not limit such activities when they are incidental to the construction of a building for which a permit has been issued or to the construction of a street or way in a subdivision which has been approved conditionally by the Planning Board." To add to Section 5 a new clause to read: "(n) Such accessory as are customarily incidental to any of the above uses."
