Article 23. To determine whether, pursuant to Final De- cree After Rescript in Briggs et al. and the Town of Lincoln v. The Merchants National Bank of Boston et als., in the Supreme Judicial Court for Suffolk County, No. 67558 in equity, the Town shall elect and confirm the action of the Selectmen in electing that payments of income now and hereafter payable to the Town by the respective trustees of the trusts under paragraphs 12 and 13 of the will of Julian deCordova, as modified by said decree, shall be made by said trustees directly to deCordova and Dana Museum and Park rather than di- rectly to the Town, and whether the Town shall confirm the action of the Selectmen and Treasurer in paying over to said corporation the income or the unexpended balance thereof previously received by the Town from said trustees or the executors under said will, and in turning over to said corpora- tion the possession, custody, management and control of said museum and its contents and said park, or to take any other action relative thereto.

Annual Town Meeting Monday, March 7, 1949


WARRANT


COMMONWEALTH OF MASSACHUSETTS MIDDLESEX, ss.


To either of the Constables of the Town of Lincoln in said County: GREETING:


In the name of the Commonwealth of Massachusetts, you are hereby required to notify the legal voters of said Town of Lincoln, qualified to vote in Town Meeting for the Transaction of Town affairs, to meet in the Town Hall in said Lincoln, on Monday, the Seventh day of March next at 7:30 o'clock P.M., then and there to act on the following articles except Article 1 and also to meet in said Town Hall on Saturday the twelfth day of March next, at 12 o'clock Noon, then and there to act on the following Article 1, by posting a copy of this Warrant, by you attested in each of the Post Offices, and in some other public place in said Town seven days at least before the first day of March next.


The polls for voting the Australian ballot on Saturday, March twelfth will be open at 12 o'clock Noon, and may be closed at 7 o'clock P.M.


Article 1. To bring in their votes for the following Town Officers and any other officers required by law, to be elected by Australian Ballot, Viz:

Article 7. To see if the Town will vote to raise and appro- priate the sum of $7,750.00 to purchase the following High- way Equipment.

Article 16. To see if the Town will vote to raise and appro- priate money for the use of the School Building Committee to provide facilities connected with the new school building, or take any action relative thereto.


Article 17. To see if the Town will vote to raise and appro- priate the sum of $150.00 to place street lights on Lincoln Road from route 117 to the Wayland line, or take any other action relative thereto.


Article 18. To see if the Town will vote to raise and appro- priate a sum not to exceed $500.00 for the purchase and in- stallation of an adequate range and install the same in the kitchen of the Town Hall and that the Moderator be in- structed to appoint a Committee consisting of a representative from St. Anne's Church - one from St. Joseph's Church - one from the Lincoln Grange and two to be chosen by the Moderator to purchase the same.


Article 19. To see if the Town will vote to raise and appro- priate the sum of $1,500.00 for the provision of bookshelves, catalogue cabinets, such other furniture as deemed necessary, and improved toilet facilities in the Library, or take any other action relative thereto.


Article 20. To see if the Town will amend the second paragraph of Section 12 of the Zoning By-Law by eliminating the words "every such lot shall have at least a forty (40) foot

frontage along the right of way" and substituting therefore the words "every such lot shall have a frontage of at least eighty (80) feet along a street line, and a distance of at least eighty (80) feet in any direction from side lot line to side lot line between said street line and any dwelling on said lot."


Article 21. To see whether the Town will adopt a By-Law regulating and limiting the use of motor-propelled craft upon the waters of any river within the limits of the Town, or take any other action relative thereto.


Article 22. To see if the Town will vote to revise the By- Laws by adding the following: "No person shall fire or dis- charge any firearm or explosives of any kind within the limits of any highway, park, or other public property, or on any private property, except with the consent of the owner or legal occupant thereof; provided, however, that this by-law shall not apply to the lawful defense of life or property, nor to any law enforcement officer acting in the discharge of his duties.

ANNUAL TOWN MEETING Monday, March 7, 1949


In accordance with the above Warrant the meeting was called to order by the Moderator at 7:30 o'clock P.M. The return of the Warrant was read, the Moderator called attention to Article 1 and tested the microphones with the lower hall Proctor.


Article 2. Voted: That Harold S. Cousins and Joseph R. Tracey be elected Measurers of Wood and Bark for the ensuing year.


Article 3. Voted: That the reports of the Town Officers, Committees, Commissioners and Trustees as printed in the Town Report be accepted, and that the following resolution · be adopted.


Resolved: (Unanimously) By the People of Lincoln in Annual Town Meeting assembled, that an overhead power line across land of the Town of Lincoln as proposed by the Boston Edison Company would be detrimental to the rights of abutters to the enjoyment of their property; would depre- ciate the value of real estate adjacent to and in view of the power line; would reduce as a result of takings for the right of way the amount of land within the confines of the town potentially suitable for assessable house lots and buildings; would destroy the rural beauty of a substantial area of the town thereby in effect nullifying those parts of the town's zoning law which have been in force for many years to protect the countrified, residential character of the community. Be it also Resolved: That it is the sense of this meeting that the estimated additional cost for placing the proposed power line underground is warranted in view of the disadvantages re- sulting to the town by an over-head line as expressed above, be it further Resolved: That a copy of this Resolution be transmitted to the Department of Public Utilities of the Commonwealth.
