ARTICLE 13. Voted: That the Board of Selectmen and/or the Sewer Committee is hereby authorized and directed to make application under the National Industrial Recovery Act and under Chapter 366 of the Acts of 1933 of the Massachu- setts General Court (a) for approval of a project to lay out and to construct a system or systems of main drains or com- mon sewers and a system of sewage disposal with such con- nections, sub-drains, and other works as may be required for a system of sewage disposal for the Town and to construct such sewers or drains over and under land or tide water in said Town and in the City of Lynn as may be necessary to conduct the sewage to the filter beds, treatment works and/or to the outfall sewer of the City of Lynn and/or to purchase such right, title and interest in and to the outfall sewer of the City of Lynn as may be advisable, and (b) for allocation by the United States of the sum of $500,000 or any part thereof for carrying out a part or the whole of the aforementioned pro- ject. 10.43 P. M.

"That the sum of $6,000.00 be and the same is here- by appropriated for the expenses, including counsel fees, of defending proceedings brought in the Board of Tax Appeals against the Board of Assessors concerning 1932 assessments, same to be expended under the direction of the Board of Select- men and to meet said appropriation the sum of $3,000.00 be and the same is hereby transferred from the account of Inter- est on Temporary Loans and the sum of $3,000.00 be and the same is hereby transferred from the Overlay Reserve Account, such expenses being extraordinary and unforseen. Yeas 29. Nays 71. 9:30 P. M.


The Town Treasurer was permitted to offer the following so that the sense or opinion of the Town Meeting might be obtained :


ARTICLE 2. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money for general Municipal purposes under authority of and in accordance with the provisions of Chapter 49 of the Acts of 1933 or take any action relative thereto.


Voted : "That the Treasurer, with the approval of the Select- men be and he hereby is authorized to borrow for general municipal purposes the sum of $100,000 but in no event a sum in excess of the amount of tax titles taken or held by the town, and to issue a note or notes of the Town therefor, all in ac- cordance with the provisions of Chapter 49 of the Acts of 1933. The said sum of $100,000 is hereby appropriated to meet outstanding revenue loans of 1932.


The foregoing was unanimously approved by the meeting.

Voted: To amend Section 1 of Chapter 1 by striking out the same and substituting therefor the following:


(1) Every person intending to erect, construct, repair, demolish or alter any foundation, structure or building within the limits of the Town of Saugus before proceeding with such work shall file with the Inspector of Buildings an application for a permit on such forms as said inspector shall furnish The application must be signed either by the owner of the property, a tenant, the builder or their agent. The appli- cation must be accompanied by a plan in such detail as shall satisfy said inspector and by such specifications as said in- spector shall require. Where deemed expedient, said in- spector may require the applicant to furnish a sworn state- ment of a reputable engineer or architect that the plans are properly designed for the purpose intended.

Voted : To amend by the addition of Chapter 20 the follow- ing: Chapter 20.


1. No parts of a building other than those mentioned in this division shall project over any street, square or public way.


Fire escapes required or permitted by this ordinance, may project according to regulations of the Inspector of Buildings, but no projection shall occur less than ten feet above the level of the curb.


No person, firm or corporation shall erect or hereafter main- tain any sign or other advertising or illuminated structure so as to overhang any portion of any street or sidewalk, nor erect or hereafter maintain any tank or pump in any street or sidewalk unless such person, firm or corporation has received a permit issued by the Inspector of Buildings, with the ap- proval of the Board of Selectmen, application for which permit shall be in writing in such form as said inspector may require. No such permit may be granted for a period beyond one year from its date and said permit shall annually be renewed for a period not longer than one year from its date, such renewal to be by endorsement upon the permit by said inspector following the payment of the fee prescribed herein. No such permit or renewal shall be given or made until the applicant shall have deposited with the Town Clerk a bond in the sum of four thousand dollars conditioned to indemnify and save harmless the Town of Saugus from any and all claims for or by reason of the erection and maintenance of either said sign or other advertising or illuminated structure, tank or pump, under said

permit or any renewal thereof, which bond shall be first ap- proved by the Town Counsel. A fee of two dollars is hereby fixed for each new permit and a fee of one dollar for all re- newals of such permits.


No awnings shall be erected and maintained which shall project over any street, square or other public way, any part of which shall be less than six feet six inches from the level of the curb and all of such awnings so maintained shall be of a type which may be raised and lowered at will.


Any violation of this section shall be punished by a fine of not more than twenty dollars for each offence.

Voted: To amend by addition of Chapter 21, the following:


CHAPTER 21. Upon the acceptance of the foregoing regula- tions or ordinances by the town and the publication as required by law of such thereof as shall be duly approved, all building regulations heretofore existing, excepting the rules and regu- lations of the Board of Health and rules, regulations and by- laws relating to plumbers, shall be annulled and repealed ; pro- vided that this repeal shall not apply to or affect any vote heretofore adopted, accepting or adopting the provisions of any statute of the Commonwealth, and, further, shall not revive any regulations, ordinances or by-laws in force before or at the time when the repeal took effect.

The following is a true copy of the Building Ordinances of the Town of Saugus, as adopted by the Limited Town Meeting of October 24, 1933, which was an adjourned session of the Special Town Meeting of October 10, 1933.


"Be it ordained by the Representative Town Meeting of the Town of Saugus as follows:


SECTION 1. For the purpose of securing the prevention of fire and the preservation of life, health and morals a Building Department is established in the Town of Saugus. The Build- ing Department shall be presided over by the Superintendent
