(b) Any lawful sign displayed by the town, or any sign displayed by the United States, the state or the county relative to government business.
(c) At any boundary line of the town a lawful sign not exceeding five square feet in area indicating the meetings of any civic organization located therein.
(d) On property owned or principally occupied by a re- ligious, civic or charitable organization, asso- ciation of war veterans or the like, any lawful ac- cessory sign displayed by written permission of the Selectmen, with approval of the inspector of build- ings if any, for a limited period of not exceeding sixty days.
Section 7. Administration. Whenever notice of an application to a state authority for a permit for an ad- vertising device to be erected or displayed in the town is received by the Town Clerk or any other Town official, he shall immediately transmit it to the Inspector of Buildings (or other officer charged with the adminis- tration of this by-law). Such officer, or, in the lack of other responsible officer, the Town Clerk, shall there- upon make an examination of the case and, as prompt- ly as possible, within thirty days of the receipt of the ap- plication by the Town, shall send written notice to the state authority to whom the application is addressed, stating whether or not the proposed advertising device would violate any provisions of this by-law, and, if he finds such violation, specifying what provisions would be violated. In case of such violation, he shall send like notice also to the applicant and to the owner or tenant of the proposed location of the device.
Any person desiring to erect a sign in the town may file a description thereof and of its proposed location with the officer charged with the enforcement of this by- law, who shall thereupon make an examination of the case and shall give written notice to the applicant

whether or not the proposed advertising would violate any provision of this by-law, and if so, what provision.
Said officer shall preserve for record all descriptions, notices of application, letters and other papers received by him and copies of all notices issued and letters sent by him relating to out-door advertising.
Section 8. Penalties and Enforcement. The se- lectmen or any officers charged with the enforcement of this by-law shall give written notice of any violation of Sections 4, 5 or 6 of this by-law to the party violating the same and to the owner or tenant of the property con- cerned, with orders to remove promptly any device in violation thereof, and shall cause any party who con- tinues such violation for fifteen days after such notice to be prosecuted ; shall pursue appropriate legal processes to restrain the erection or maintenance of devices in vio- lation of this by-law and to cause their removal or abate- ment in accordance with Chapter 93, Sections 29, 31 and 33; and shall also notify the state regulatory author- ity of outdoor advertising of any known violations of lawful state regulations that come to his notice.
Section 9. If any provision of this by-law is de- clared unconstitutional or illegal by any Court, the valid- ity of the remaining provisions shall not be affected thereby.
Section 10. No provision of this by-law shall be construed in such a manner as to be inconsistent with the rules and regulations now or hereafter in force, concerning outdoor advertising of any state authority having jurisdiction;
agreeable to the petition of the Planning Board.
Art. 3. To see if the Town will vote to adopt the fol- lowing by-law:
Section 1. No person, either by himself or by his employees, shall engage in the distribution of hand bills or other printed matter, intended exclusively for advertising purposes, within the Town of Saugus, or go

about or send employees about in the streets, alleys and public places in said Town for the purpose of such dis- tribution without first having obtained a license so to do from the Board of Selectmen of said Town. Said li- cense may contain such conditions as may be deemed expedient and shall be revokable at the pleasure of said board. Any person so licensed may send out employees, for whom he shall be responsible, provided that no such employee shall be less than sixteen (16) years of age.
Section 2. Every license granted under the pro- visions hereof unless sooner revoked, shall expire on the first day of May after the date thereof, and every person so licensed shall be required to leave with the Chief of Police a sample of each handbill or other piece of adver- tising matter before distributing the same. The fee for every license granted under the provisions hereof shall be five dollars ($5.00) per annum.
Section 3. Any person offending against any of the provisions of this ordinance shall be subject to a fine not exceeding twenty dollars ($20.00) for each offence.
Section 4. All by-laws or parts of by-laws incon- sistent herewith are repealed;
agreeable to the petition of Arthur P. Smith and others.
Art. 4. To see if the Town will adopt a by-law provid- ing that the existing Board of Appeals under the building and zoning by-law shall be the Board of Appeals under Sec- tion 811 of Chapter 211 Acts of 1936. Planning Board.
Art. 5. Voted that the Board of Playground Commis- sioners be authorized to petition the General Court to enact the following: That the land in the Town of Saugus known as Stackpole's Field, under the jurisdiction of the Board of Playground Commissioners of said Town, may be used as an enclosed athletic field. Said board shall establish and main- tain said athletic field, with suitable equipment, and may in their discretion permit its use for athletic games and other entertainments of a public nature, to which an admission fee:

may be charged, upon such terms and conditions as said Playground Commissioners may impose; or to see what ac- tion the Town will take in the matter, agreeable to the peti- tion of the Board of Playground Commissioners.
Art. 6. To see if the Town will vote to instruct its re- presentatives in the General Court to introduce legislation in that body which will permit the Town to place the office of Building Inspector under the provisions of Civil Service. Planning Board.
Art. 7. To see if the Town will authorize the Board of Selectmen to establish a minimum wage rate of 70 cents (seventy cents) per hour for all Town laborers hired by all Town Departments, and to have added to that rate a cost of living adjustment which is declared every three months by the indices of the United States Division of Labor; or to see what action the Town will take in the matter, agreeable to the petition of John J. Bucchiere and others.
Art. 8. To see if the Town will vote to amend the Zon- ing By-Law and the Zoning Map so that the property shown as Lots numbered A-520, A-20, A-21, A-22, A-23, A-537, A-530, A-40, A-41, A-42, A-43, A-44, A-533, A-534, A-535, A-536 on Assessors' Plan 2502 and Lots numbered A-20, A-21, A-22, A-23, A-537, A-539, A-40, A-41, A-42, A-43, A-45, A-46 on Assessors' Plan 2053, said land being located at the junction of Broadway, Felton Street, and the Frank P. Bennett Highway, be zoned for business, or to see what. action the Town will take in the matter.
Art. 9. To see if the Town will vote to authorize the Selectmen to purchase or take by eminent domain for street purposes the following parcels of land for the purpose of extending Smith Road from its present terminus to Clifton Avenue, viz :

Art. 10. To see if the Town will vote under authority granted by Chapter 107 of The Acts of 1937 to appropriate the sum of $5,000, the same to be expended for Federal Emergency Unemployment Relief Projects and to authorize the Treasurer of the Town to issue bonds or notes therefor which shall bear on the face the words "Town of Saugus Municipal Relief Loan Acts of 1937." Art. 10-A. To see if the Town will vote to transfer from the sum of $3,500 appropriated at the annual town meeting

Art. 11. To see if the Town will vote to appropriate the sum of $800 for the purpose of laying 250 feet of water main on Prospect Avenue; or to see what action the Town will take in the matter, agreeable to the petition of Achillo De F'ronzo and others.
Art. 12. To see if the Town will vote to amend the zoning by-law and the zoning map so that property shown as lot A-4 on Plan 2030 on file in the Assessors' Office, said land being located on the Newburyport Turnpike, at 681 Broad- way, shall be zoned for business purposes; agreeable to the petition of Henry Gibbs and others.
Art. 13. To see if the Town will vote to amend the Zon- ing Plan and Zoning By-Laws so that the property shown as lots A-872 and A-271 on Broadway and Lots A-289 and A-288 on Bow St. on Assessors' plan 1042, be zoned for busi- ness; or to see what action the Town will take in the mat- ter, agreeable to the petition of Clement Fearns and others.
Art. 14. To see if the Town will appropriate a sum not exceeding $500.00 for action through the Courts to estab- lish and assess for damages sustained to the Town of Saugus caused by illegal excavations and to instruct the Board of Selectmen to institute legal proceedings upon passage of this article, agreeable to the petition of Walter S. Dyer and others.
Article 15. To see if the Town will vote to amend the Zoning By-law so that the first sentence of Section 17-A shall read as follows :
"Section 17-A. The removal for sale or for any purpose other than construction upon the location in- volved, of sod, loam, sand, gravel and stone from single or general residence districts shall be deemd non-con- forming use of premises." Planning Board.

Art. 16. To see if the Town will vote to amend the zon- ing Map and the Zoning By-Law so that the property on the Lynn Fells Parkway shown as Lot 74, Section A, now zoned for business purposes, shall hereafter be zoned as residen- tial. Planning Board.
Art. 17. To see if the Town will vote to amend Section 17-A of the Zoning By-Law by inserting after the words, "shall be made a part of the permit" a new phrase as fol lows, "The board shall require of the petitioner a suitable bond or surety to secure the proper compliance of condi- tions as laid down by the Selectmen." Art. 18. To see if the Town will vote to amend the By- Laws of the Town by inserting therein a new section as fol- lows:
"Persons, firms or corporations conducting overnight cabins, camps or lodging places shall keep and main- tain, or cause to be kept and maintained therein a reg- ister in which shall be inscribed the true name of each and every person renting or occupying such cabin, camp, or room. Such register shall be signed by the person renting such cabin, camp or room or by someone under his direction. The proprietor or his agent shall write opposite each name the number or name of each cabin, camp or room assigned to and occupied by each guest; also he or his agent shall enter the state license number of any automobile being used or operated by the regis- trant. The proprietor or his agent shall keep and pre- serve the record showing the date of registration and the time when the registrant entered and quit the cabin, camp or room. Any violation of this section of the by- laws shall be subject to a fine of twenty dollars. A copy of this by-law shall be conspiciously placed in each cabin, camp or lodging place as mentioned above." Planning Board.
Art. 19. To see if the Town will vote to amend the zon- ing By-Law and the zoning map of the Town of Saugus for

business purposes; a certain parcel of land, being a part of lot A-35 as shown on plan number 2014 on file at the Asses- ors' Office; bounded northerly by Lincoln Avenue one hun- dred feet, easterly by the remaining portion of lot A-35 one hundred and eight feet, southerly by the remaining portion of lot A-35 one hundred feet and westerly by lots A-2 and A-3 as shown on said plan one hundred and eight feet; or to see what action the Town will take in the matter, agreeable to the petition of Chester S. Nickerson and others.
Art. 20. To see if the Town will vote to amend Section 10, Paragraph 2, of the Zoning By-Law of the Town, so that it shall read as follows: "For a one family house not un- der five thousand (5000) square feet, except that in the area marked 'A' west of the Newburyport Turnpike, as in- dicated on a map filed with the Town Clerk, 1937, the mini- mum area shall be ten thousand (10,000) square feet." Art. 21. To see if the Town will vote to amend the zon- ing map and zoning by-law so that the premises situated on the Newburyport Turnpike and shown as lots A-6 on As- sessors' Plan 1042 will be zoned for business, or to see what action the Town will take in the matter, agreeable to the petition of Alice E. Lewis and others.
Art. 22. To see if the Town will vote to raise and ap- propriate the sum of $1000 for the improvement of Main Street; said money to be used in conjunction with any money which may be allotted by the State or County, or both, for this purpose; or take any other action thereto, agreeable to the petition of Frank B. Newhall and others .
Art. 23. To see if the Town will vote to raise and ap- propriate or by bond issue the sum of $1,000 for the im- provement of Central Street, in conjunction with any money which may be allotted by the State and county, or both, for this purpose, or take any action thereto. Board of Select- men.

To see if the Town will vote to raise and ap- propriate or by bond issue the sum of $1,000 to be used for the improvement of Essex Street, to be used with any funds which may be allotted by the State and county, or both, for this purpose, or take any other action relating thereto. To see if the Town will vote to amend the zon- ing map and zoning by-law so that the premises situated on the Newburyport Turnpike and shown as lots A-33 and A-14 on Assessors' Plan 1039 will be zoned for business, or to see what action the Town will take in the matter, agreeable to the petition of Thomas Pecuikonis and others.
Art. 31. To see if the Town will vote to amend the zon- ing map and zoning by-law so that the premises situated on

the Newburyport Turnpike and shown as lots A-33 and A-14 on Assessors' Plan 1039 will be zoned for business; or to see what action the Town will take in the matter, agreeable to the petition of William J. Wilcox and others.
Art. 32. To see if the Town will vote to amend the By-Laws of the Town of Saugus, by striking out the amend- ment as adopted under Article 16 of the Warrant of the Special Town Meeting held March 16, 1936, and which was approved by the Attorney General March 20, 1936. Special Committee.
Art. 33. To see if the Town will vote to amend the Zoning By-Law by inserting under Section Twelve, the fol- lowing new paragraph:
Front Yards for Business Establishments.
On all land used for business purposes on all state high- ways there shall be a set-back or open space of at least forty feet between the inside street line and the front of the building, or to see what action the Town will take in the matter. Planning Board.

Art. 36. To see if the Town will vote to adopt the fol- lowing By-Laws and Ordinances Regulating Auto-Trailer, Tourist Camp and Park Sites in the Town of Saugus:

Section 1. For the purpose of this ordinance, cer- tain words and phrases are defined, and certain provis- ions shall be construed, as herein set out, unless it shall be apparent from the context that a different meaning is intended.
Section 2. Tourist Camp and Park Site Defined. A "tourist camp or park site" is any place where two or more over-night cabins, tents or trailers are located, or any premises designed or intended for the purpose of supplying to the public a location for over-night cabins, so-called, tents or trailers.
Section 3. Over-night Cabin, Tent and Automobile Trailer Defined. An "overnight cabin, tent and trailer" under this ordinance are construed to mean any build- ing, tent, or structure, house car, or automobile trailer, used for, or adaptable to use for, living quarters.
Section 4. Unit Defined. A "unit" is a section of ground in any tourist camp used, or designed for use, as a location for a single over-night cabin, house car, tent or trailer.
Section 5. Restricted Areas. No tourist camp or trailer parking site shall be permitted to be located upon any land, park or beach land owned or controlled by the Town of Saugus, except on such spaces as shall be especially provided for the same.
Section 6. Over-Night Cabin, Tent and Trailer Reg- ulations. No unit shall contain less than six hundred (600) square feet in area, and no unit shall be permitted to accommodate more than one (1) overnight cabin, tent or trailer.
The provisions of this section shall not, however, be construed to prohibit any property owner, residing upon his land, from accommodating auto trailers of non- paying guests; nor shall they be construed as abroga- ting the right of any property owner to erect overnight cabins, as they are commonly known, under the above unit rules and under such sanitary restrictions as the

Town may establish. In such cases permits must be obtained. [See Section seven. (7) ].
Section 7. Tourist Camp Permit. It shall be un- lawful for any person to establish, or maintain, or to per- mit to be established or maintained, upon any property owned or controlled by him, a tourist camp in the Town of Saugus, unless there exists a valid permit therefor granted by the Board of Health and existing in compli- ance with the provisions of this ordinance. The applica- tion for such a permit shall be accompanied by plans of the proposed or existing tourist camp, showing the loca- tion of all buildings, driveways, toilet facilities, baths, laundry facilities, slop sinks and other improvements, and such permit may be granted to anyone meeting the requirements as outlined. A minimum annual permit fee of ten dollars ($10.00) per ten units or fraction thereof tourist camp shall be paid before such permit shall be issued.
Section 8. Plumbing and Sanitary Requirements. All tourists camp units shall be provided with a mini- mum for each sex of one (1) toilet, one (1) bath tub or shower, for every ten (10) units, or fraction thereof; a two compartment laundry tub, a slop sink and a wash basin with running water, for every ten (10) units or fraction thereof.
No dry or chemical toilet closets shall be installed or used within the limits of any tourist camp site and all such closets shall be sealed while within the limits of the Town of Saugus.
Section 9. Garbage. A sufficient number of tight- ly covered cans for garbage disposal shall be installed. Garbage so collected shall be deposited in the town gar- bage disposal area daily by the management.
Section 10. Limitation of Residence. It shall be unlawful to remain or live in any tourist camp for more than ninety days in any six months period, excepting, of course, bona fide employees.

Section 11. Record of Guests. The manager of every tourist camp shall require all persons using the same to register his name, home address and car license number. Such record shall be available at all times for inspection by the Police Department or the Board of Health.
Section 12. Lighting. Every tourist camp shall be adequately lighted by electricity.
Section 13. The Board of Health of the Town of Saugus shall have the power to promulgate rules and regulations for the enforcement of the provisions of this ordinance ;
agreeable to the petition of the Board of Health.
Art. 37. That the Zoning By-Laws and Zoning Map of the Town be changed so that the land of Konrad Berthold at Lynn Fells Parkway shown as Lot A-98 on Plan 1025 on file in the Assessors' Office containing 14080 feet shall here- after be zoned for business purposes, agreeable to the pe- tition of Delmont E. Goding and others.
Art. 38. That the Zoning By-Laws and Zoning Map of the Town be changed so that the land of Edward B. and Elizabeth G. Carlson at 520 Broadway shown as Lot A-29 on Plan 1029 on file in the Assessors' Office containing 10600 feet shall hereafter be zoned for business purposes, agree- able to the petition of Frederick Bancroft Willis and others.
Art. 39. To see if the Town will authorize the Board of Fire Engineers to use funds now in the Fire Department expense account for the purchase of a car for the Chief of the Fire Department. Board of Fire Engineers.
Art. 40. To see if the Town will vote to raise and ap- propriate by bond issue, or otherwise, or by transfer from unexpended balances the sum of $425 for a fire alarm box at Burrill and Hesper streets; one at Alden and Hesper streets, and a tapper. Board of Fire Engineers.
