In an effort to seek reimbursement to the Town for certain assistance rendered to Old Age Assistance recipients, this office has instiuted action in the District Court of East Norfolk to compel children of aged parents to contribute to their support, thereby partially relieving the Town of this financial responsibility. In this connection, the following cases are pend- ing or have been settled:


TOWN OF WEYMOUTH VS. GEORGE WILLIS: Pending in the Dis- trict Court of East Norfolk.

TOWN OF WEYMOUTH VS. FRANCIS TARR: Court decreed that Francis Tarr pay to the Town of Weymouth the sum of $5.00 each and every week.


TOWN OF WEYMOUTH VS. HARRY M. ALGER: Court decreed that Harry Alger pay the sum of $500.00 for past aid rendered, which has been received, and the Court further decreed that he pay $30.00 each and every month, in favor of the Town.


TOWN OF WEYMOUTH VS. MCCARTHY: Action in District Court of East Norfolk to compel contribution by son to support parent on Old Age Assistance. Judgment for Town compelling payment of $60.91 per month toward support of parent.


TOWN OF WEYMOUTH VS. ESTATE OF EVERETT M. HOLBROOK : Action to recover Old Age Assistance payments. Payment to Town of $1,500.00.


TOWN OF WEYMOUTH VS. CHARLES DOWNING: Action to com- pel son to contribute to support of aged parent on Old Age Assistance. Settled by child agreeing to support parent, thus saving the Town $65.00 a month.


In connection with the widening of Commercial Street in the vicinity of Washington Square, the claim of Oman Realty Inc. vs. Town of Wey- mouth for damages sustained in the taking of property of the so called Weymouth Theatre property was settled for the sum of $5,000.00. Under the terms of the settlement, owner is to remove or cause to be removed any structures on the premises or any portion thereof without expense to the Town.


During the year this office rendered various legal services to the Police Department, School Department, Department of Public Works, Fire De- partment, Peronnel Board, Public Works Building Committee, Treasurer's Office, Tax Collector and Department of Public Welfare and Old Age As- sistance.


In an effort to standardize the procedure in connection with purchases and contracts of various Town departments, a standard contract form was prepared for use by all Town Departments. It was received with ap- probation and is currently being used by all departments. It provides for a copy of the contract to the department head, to the contractor or vendor, and to the office of the Town Accountant so that he may at all times be aware of the financial commitments of all Town Departments.


In accordance with Article 29, of the Annual Town Meeting of 1959, and at the request of the Department of Public Works, an Order of Taking was executed by the Board of Selectmen taking by eminent domain ap- proximately 110 acres of land in South Weymouth for the protection of the water supply. Although the said Town Meeting appropriated the sum of $25,000.00 for said takings, thus far this office has been able to nego- tiate settlements of claims for approximately 108 acres of the taking for $10,625.00 or a per acre cost of $98.38. There remains only one claim to be settled which is for approximately 134 acres.


During the course of the year, many written legal opinions have been rendered to various Departments an committees of the Town. Many certificates of entries were prepared for the Public Works Department in connection with highway projects and all land owners notified.

In cases involving payment of Town funds, the Honorable Board of Selectmen has been consulted and its approval secured in all cases. In all cases which involved claims by the Town, the Board of Selectmen was consulted and its approval received before settlement.


In reference to tort claims against the Town, due consideration of liability was given and settlement made only when in the best interest of the Town.


Many contracts from various Town Departments were submitted for approval as to form.


Many cases involving taking of land in Weymouth for highway pur- poses by the County of Norfolk and Town of Weymouth have been re- ferred to this office and releases prepared and executed by the land owner in payment of the amount awarded in the Order of Taking.


In conclusion, I wish to express my sincere thanks to each and every department, Board, and department superintendent for the cuortesy and splendid cooperation they have extended to me during the past year.

Gentlemen:


During the year 1960, there were 101 applications heard by the Board of Zoning Appeals. All hearings were advertised in the local papers in accordance with Section 15 of Chapter 40A of the Zoning Enabling Act.


There was a total of 1,661 notices sent out to applicants and abutters. This included notices of hearings to be held and notices of decisions of the Board after the hearings.


Each application was given due consideration; 55 were granted, 27 were denied, 1 was granted in part and denied in part, 2 were withdrawn and 16 were continued. Of the 16 continued, at later hearings, 8 were granted, 5 were denied and 3 remained continued.


Total application fees received and deposited with the Town Treasurer $1,860.00.


In the year 1960, a new law was passed regarding procedure in the Board of Appeals, which requires the recording of all affirmative de- cisions with the Registry of Deeds. A special form is filled out in duplicate for all affirmative decisions, signed by the Chairman and Secretary of the Board, and sent to the Town Clerk for recording in Dedham.

REPORT OF THE FIRE DEPARTMENT

Gentlemen:


I herewith submit the annual report of the Fire Department for the year ending December 31, 1960.


The department responded to ten hundred and fifty-one calls during the year, a reduction of sixty-four from the previous year. Ninety-eight were for fires involving buildings. A complete breakdown of all calls is on the accompanying sheet.


All Civil Service examinations made necessary to fill positions created by the forty-eight-hour schedule have been held. There was one resig- nation and one retirement from the department during the year.


The educational program on fire prevention carried on in the schools of the Town by the personnel of the department is now in its ninth year. The personnel of the department made eleven hundred and nine inspec- tions throughout the Town during the year.


An extensive training program for all members of the department was carried out throughout the year.

We wish to submit to your Board and through your Board to the Townspeople our Annual Report for the year 1960.


Our financial cost has been higher than usual this year. This was due to the Bethlehem Steel Shipyard strike on which a total of $97,389.86 was expended and economic conditions in the area. This amount is above the regular departmental expenditure. The total expenditure for the year was $238,254.00. We are asking for $153,400.00 for 1961 which at this time we feel will be sufficient to take care of the responsibilities of the depart- ment.


Because all town departments are covered by our Town Accountant we are not giving a detailed account of expenditures by this office in this report. However, it should be borne in mind that the town is reimbursed fifty perecen't of all expenditures for Veterans' Benefits and State Burial Allowance.


We wish to take this opportunity to express our thanks to all those who assisted us in the performance of our duties in 1960. Also we wish to thank your Board and various Town Departments for their kind co- operation.

Large scale maps and brochures were distributed to many potential industries.


Flyers advertising Weymouth were sent to a large list of garment firms. A survey on stitchers in this area was polled and we have a list of 300 applicants.


We have contacted Industrial Realtors who are presently asking sur- veys of the land.


Through the efforts of the Commission an Armory will be erected on Town granted land on the Expressway.


We wish to take this opportunity to thank the Board of Selectmen and all other persons for their co-operation during the past year.

REPORT OF PARK COMMISSIONERS

Honorable Board of Selectmen Town Hall East Weymouth, Massachusetts


Gentlemen:


We submit herewith the annual report of the Park Commissioners for the year ending December 31, 1960.


The summer playground program was arranged to include activities at seventeen supervised playgrounds. The program started on June 27th and extended through September 2nd with a staff of one supervisor, spe- cialists in Archery, Tennis and Crafts, and twenty-nine instructors. A competitive examination was given to fifty-four applicants to fill fourteen vacancies.


A one-week training institute was held at Central Junior High School for the Playground Personnel.
