ARTICLE 9. (At request of Board of Public Works). To see if the Town will vote to raise and appropriate or borrow the sum of $250,000.00 for the construction of the Major Highway Program for reconstruction of main streets and roads including Broad, Pleasant and Commercial Streets, provided that Chapter 90 funds, if any, may be used for this purpose, or take any other action in relation thereto.


ARTICLE 10. (By Request of Board of Public Works). To see what sum of money the Town will vote to raise and appropriate by taxa- tion or otherwise for the purpose of acquiring by gift, purchase, or take by right of eminent domain in fee or as otherwise specified, lands along Church St., Gibbens St., and Commercial St., Weymouth, Massachusetts, in accordance with Chapter 79 of the General Laws for the purpose of Alteration, Widening and Reconstruction of said streets, or take any other action in relation thereto.


ARTICLE 11. (By Request of Board of Public Works). To see if the Town will vote to raise and appropriate a sum of money for the con- struction of sidewalks and curbing and repairs of existing sidewalks and curbing and any retaining walls necessitated by construction of sald side- walks, under a Sidewalk Building Program to be set up by the Board of Public Works, said money to be under the jurisdiction of the Board of Public Works, or take any other action in relation thereto.


ARTICLE 12. (By Request of Board of Public Works). To see if the Town will vote to raise and appropriate a sum of money for the con- struction of particular sewers and determine whether the money shall be provided for by taxation, by appropriation from available funds including sewer assessment funds, and by borrowing under authority of Chapter 44 of the General Laws, or take any other action in relation thereto.


ARTICLE 13. (By Request of Board of Public Works). To see if the Town will vote to raise and appropriate a sum of money for the con- struction of common sewers and determine whether the money shall be

provided for by taxation, by appropriation from available funds including sewer assessment funds, and by borrowing under authority of Chapter 44 of the General Laws, or take any other action in relation thereto.


ARTICLE 14. (By Request of Board of Public Works). To see if the Town will vote to raise and appropriate by taxation or otherwise a sum of money to be used for the purpose of completing Mountain View Road, or take any other action in relation thereto.


ARTICLE 15. (By Request of Board of Public Works). To see if the Town will vote to raise and appropriate by taxation or otherwise a sum of money to be used for the purpose of completing Oak Cliff Road, or take any other action in relation thereto.


ARTICLE 16. (By Request of the Public Works Garage Building Committee). To see what sum of money the Town will vote to raise by taxation or otherwise and appropriate and/or borrow for the construction of a Public Works Building on land purchased on Winter Street for this purpose, or take any other action in relation thereto.


ARTICLE 17 (By Request of Board of Public Works). To see if the Town will vote to raise and appropriate by taxation or otherwise a sum of money to be used for the purpose of constructing a Town Landing and Marina, or take any other action in relation thereto.


ARTICLE 18. (By Request of the Board of Public Works). To see if the Town will vote to raise and appropriate by taxation or otherwise the sum of $15,000.00 for Dutch Elm Disease Control, or take any other action in relation thereto.


ARTICLE 19. (By Direction of Selectmen and At Request of the Drainage Committee). To see what sum of money the Town will vote to raise, by taxation or otherwise, and appropriate for 50% of the land damage costs in the Pond Meadow area of Braintree for flood control purposes of the Weymouth Landing area, including Smelt Brook area, in conjunction with the Town of Braintree and the Soil Conservation Service of the Federal Government, under Public Law No. 566; monies to be made available provided proper legislation is enacted as voted under Article 11 of the Special Town Meeting, September 15, 1958; and, provided, further that the Town of Braintree make available a like amount therefor; or take any other action in relation thereto.


ARTICLE 20. (By Request of Pubic Work and Drainage Com- mittee). To see what sum of money the Town will vote to raise and appropriate, by taxation or otherwise and/or borrow, for drainage pur- poses (for stream improvement) from Weymouth Back River to Whit- man's Pond, consisting of floodflow conduit and channel and work at dams, as recommended by Metcalf and Eddy, Engineers, in report to Weymouth Drainage Committee dated March 11, 1957.


That the sum of money named shall be made available only if the State, under General Laws, Chapter 91, will pay a sum of money propor- tionate to the cost of construction under the provisions of said chapter. Provided further, that such work shall be done by private contract under the direction of the Board of Public Works and/or the State Department of Public Works.


Also, to see if the Town will assume liability in the manner pro- vided by Section 29 of Chapter 91, of the General Laws, as amended by Chapters 516 and 524, Acts of 1950, for all damages that may be incurred

by work to be performed by the Department of Public Works of Massa- chusetts for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tidewaters, foreshores, and shores along a public beach outside of Boston Harbor, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Board of Public Works to execute and deliver a bond of indemnity there- for to the Commonwealth; monies to be provided in accordance with Chapter 481, Acts of 1958, Section 1 through 4, or take any other action in relation thereto.


ARTICLE 21. (By Request of the Board of Public Works and Drain- age Committee). To see what sum of money the Town will vote to raise and appropriate by taxation or otherwise and/or borrow, for Drainage Improvements of Phillips Creek (Partial - Fore River to Green St.) cut through Naval Ammunition Reservation to Back River, Sunrise Drive and Hinston Road area (Partial), or take any other action in relation thereto.


ARTICLE 22. (By Request of the Board of Public Works). To see if the Town will vote to raise and appropriate by taxation or otherwise the sum of $10,000.00 for the continuation of the shore protection from the Fort Point area to Driftway, or take any other action in relation thereto. (Chapter 91).


ARTICLE 23. (By Request of the Board of Public Works). To see what sum of money the Town will vote to raise and appropriate for the purpose of shore protection, sea walls, jetties, drainage, beach develop- ment and other improvements at Wessagusset Beach, or take any other action in relation thereto. (Chapter 91).


ARTICLE 24. (By Request of the Board of Public Works). To see what sum of money the Town will vote to raise and appropriate by taxa- tion or otherwise for the purpose of extension of Wessagusset Beach parking area, necessary drainage, grading, sealing, or take any other ac- tion in relation thereto.


ARTICLE 25. (By Request of Board of Public Works). To see what sum of money the Town will vote to raise and appropriate for the construction and installation of the Wessagusset and Fort Point Sewer- age Pumping Stations, force mains, and intercepting sewers; such funds to be used with whatever Federal aid is available; that the work shall be done under the direction of the Board of Public Works which shall be authorized to submit an application for Federal participation in the above project, or take any other action in relation thereto.


ARTICLE 26. (By Reavest of the Board of Public Works). To see if the Town will vote to authorize and direct the Board of Selectmen to release the Town's interest in and to re-transfer and convey to the owner a portion of the sewer easement 10 ft. wide and 120 ft. long located in Lot 21. Block 166, Sheet 14. as shown on a Plan by Frank S. Lagrotteria, Town Engineer, entitled "Plan showing release of a portion of Town of Weymouth Sewer Easement" dated January 11, 1960, Plan No. 790-B, or take any other action in relation thereto.


ARTICLE 27. (At Request of School Committee). To see what sum of money the Town will vote to raise and appropriate by taxation, or otherwise, for the purpose of establishing a revolving fund to be used for a so-called Avtrmobile Parts Fund in the Vocational School as required by the State Department of Education, or take any other action in rela- tion thereto.

ARTICLE 28. (At Request of School Committee). To see if the Town will vote to transfer title to a portion of the land taken under Ar- ticle 3 of the Special Town Meeting of November 18, 1957, for a new high school, containing 5,655 sq. ft. (more or less) back to Wallace D. and Mabel F. Cowing, the previous owners, in exchange for a portion of land of the same owners containing 5,402 sq. ft. (more or less) to be used for school purposes, or take any other action in relation thereto.


ARTICLE 29. (At Request of Committee for Alterations of the Police Station). To see what sum of money the Town will vote to raise and appropriate by taxation or otherwise and/or borrow for alterations, repairs, and additions to the Police Station, including the construction of a parking area and the necessary grading; also including furniture and equipment; or take any other action in relation thereto.


ARTICLE 30. (At Request of Park Commissioners). To see if the Town will vote to raise and appropriate by taxation or otherwise a sum of money for the following items, money to be spent under the direction of the Department of Public Works, or take any other action in relation thereto:

ARTICLE 31. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate by taxation or otherwise the sum of $2,500.00 for emergency mosquito control, no part of said sum to be ex- pended until requested by South Shore Mosquito Control Superintendent and/or the Weymouth Moth Superintendent and approved by the Board of Selectmen, or take any other action in relation thereto.


ARTICLE 32. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate by taxation or otherwise the sum of $8,000.00 for the Town's share in the South Shore Mosquito Control Dis- trict, or take any other action in relation thereto.


ARTICLE 33. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate by taxation or otherwise the sum of $500.00 for the purpose of maintaining during the ensuing year, the mos- quito control works as estimated and certified to by the State Reclamation Board in accordance with the provisions of Chapter 112, Acts of 1931, or take any other action in relation thereto.


ARTICLE 34. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate by taxation or otherwise the sum of $300.00 to be expended under the direction of the Board of Selectmen for

the purpose of stocking the ponds and inland waters, located within the Town limits, with fish and/or liberating game, all in accordance with General Laws (Ter. Ed.), Chapter 10, Section 5, Clause 41, or take any other action in relation thereto.


ARTICLE 35. (At Request of the Personnel Board). To see if the Town will vote to amend Article 4, Section 409, of the Town By-Laws, by accepting changes in the administration and classification and pay plan, or take any other action in relation thereto.


ARTICLE 36. (By Request of Board of Public Works). To see if the Town will vote to amend Article 4, Section 409 of the Town By-Laws, by accepting the changes or additions to Classifications of Pay Grades under Schedule A as follows; or take any other action in relation thereto.


1. To establish a Public Works Secretary, S-4.


2. Highway Division - To establish Welder and related work, W-3-K.


3. Highway Division - To add 2 W-2 (Light Equipment) Classifi- cations.


4. Highway Division - To esstablish W-1-A semi-skilled labor classi- fication 8 (reducing 8 W-1).


5. Tree Division - Reclassification of 2 W-3 to W-4 Forestry Work- ing Foreman.


6. Water Division - To add 3 W-4 classifications.


7. Water Division -To add 2 W-2 classifications (reducing 4 W-3's 3 W-1's).


ARTICLE 37. (At Request of American Federation of State, County and Municipal Employees, Local 772, A. F. of L.) To see if the Town will vote to amend Article 4, Section 409 of the Town By-Laws by accepting changes in the Salary and Wage Scale Designated as Schedule 1, 2, 3; or take any other action in relation thereto. (Request 10% cost of Living raise.)


ARTICLE 38. (On Petition of Erle R. Starratt and Others). To see if the Town will vote to accept Chapter 120 of the Acts of 1959 and Chapter 427 of the Acts of 1957. "AN ACT INCREASING THE AMOUNT OF PENSION OF CERTAIN RETIRED POLICE OFFICERS AND FIRE FIGHTERS WHO HAD NOT ATTAINED AGE SIXTY AT THE TIME OF RETIREMENT".


ARTICLE 39. (By Direction of Selectmen). To see if the Town will vote to instruct the Senator and Representatives from this district to file the necessary legislation to allow the Laban Pratt Hospital Trust Fund to grow from $1,000,000 to $1,500,000.


ARTICLE 40. (On Petition of George E. Lane, 92 Mt. Vernon West and Others). To see if the Town will instruct the Laban Pratt Hospital Trustees to take the necessary and proper action to provide a legal and mutually satisfactory agreement with the Trustees of the South Shore Hospital for the construction of a Laban Pratt Memorial Wing with the Laban Pratt Hospital Trust Funds; and that the Laban Pratt Hospital Trustees also be instructed to seek legal authority from the court to al- low the use of the Laban Pratt Trust Funds for such an addition to the South Shore Hospital on land adjacent to that institution.

ARTICLE 41. (At Request of Committee on Council for the Aging). To see if the Town will vote to add section 634 to the By-Laws of the Town to create a council for the aging in accordance with section 8B of Chapter 40 of the General Laws and acts in amendment thereto, or take any other action in relation thereto. Said section to read as follows:


There is hereby established in the Town of Weymouth a council for the aging for the purpose of co-ordinating or carrying out programs designed to meet the problems of the aging in co-ordination with pro- grams of the Massachusetts Council for the aging established under sec- tion 73 of Chapter 6 of the General Laws. The council shall consist of the chairman of the board of public welfare, chairman of the board of health, chairman of the park Commissioners, chairman of the housing authority, and chairman of the school committee, and not less than (4) nor more than (8) additional members appointed by the Board of Select- men from the voters and residents of the town for a term to be deter- mined by the Board of Selectmen. The Chairman of the Council shall hold office until successors are designated. The council may appoint such clerks and other employees as it may require.


ARTICLE 42. (At Request of Committee for the Aging). To see what sum of money the Town will vote to raise and appropriate by taxa- tion or otherwise for the use of the council for the aging described in the previous article, or take any action in relation thereto.


ARTICLE 43. (By Direction of Selectmen). To see what sum of money the Town will vote to raise and appropriate by taxation or other- wise for the removal of two (2) abandoned barges on the beach at the foot of Aspinwall Avenue and Rosemont Road, or take any other action in relation thereto.


ARTICLE 44. (At Request of Town History Committee). To see if the Town will vote to raise and appropriate by taxation or otherwise the sum of $2500.00 to be expended under the direction of the Town His- tory Committee, for the purpose of hiring a qualified person to compile a manuscript of our town history, or take any other action in relation there- to.


ARTICLE 45. (On Petition of Walter F. Johnson and Others). To see if the Town will vote to authorize the Board of Selectmen to acquire by purchase or take by right of eminent domain for street and highway purposes, the parcel of land hereinafter described, the same to be used for the lay-out, widening and construction of that portion of Gilbert Road extending westerly from Middle Street for a distance of two hundred feet, more or less, to the present accepted portion of said Gilbert Road; to ac- cept the same for street purposes, and to raise and appropriate a sufficient sum of money therefor; or take any other action in relation thereto.


ARTICLE 46. (On Petition of Morningside Heights Civic Associa- tion). To see if the Town will vote to rescind the vote of Town under Article 27 of the March 1954 Annual Town Meeting relating to the regu- lation of motor boats and that Section 628 of the By-Laws of the Town be amended by inserting in place thereof the following:


1. Section 628 to the end that motor boats shall not be operated in a manner which endangers the safety of the public or is detrimental or injurious to the neighborhood or to the value of the property therein, the following rules and regulations shall apply to the operation of motor boats or any pond within the territorial limits of the Town of Weymouth.

(a) Row boats, canoes, and sailboats shall have the right of way at all times.


(b) No person shall operate a boat unless he shall have first regis- tered the same with the Chief of Police and obtained a cer- tificate of registration together with a registration number for the boat which shall be displayed on both sides of the bow in numerals at least six inches high. Said numerals may be painted on removal boards.


(c) No motor boat shall be operated unless the motor has an un- derwater exhaust or is equipped with a muffler which com- plies with the standards set up by the Department of Public Safety.


(d) No motor boat shall be operated between the hours of 9 P.M. and 6 A.M. at a speed in excess of five miles per hour except in case of emergency.


(e) During the period commencing one-half hour after sunset and ending one-half hour before sunrise every motor boat shall display a fully visible white light.


(f) No motor boat shall be operated recklessly or negligently so that the lives or safety of the public may be endangered.


(g) No motor boat shall be operated at an unreasonable rate of speed or shall fail to slow down and exercise due caution when approaching other water craft or persons bathing.


(h) No motor boat shall be operated in a noisy or obnoxious man- ner.


(i) No motor boat shall be used to tow persons on water skis or aquaplanes between the hours of 6 P.M. and 9 A.M. at any time. Each boat so used shall be occupied by two persons, one of whom shall give his full attention to the operation of the boat and the other of whom shall give his full attention to the safety of the person or persons being towed. No tow line shall exceed seventy-five feet in length.


(j) During the time the bathing beaches are open, no motor boat shall land at the beach or shall come within fifty feet of the swimming area as marked by the board of Public Works.


(k) During the time the bathing beaches are open, no motor boat shall be operated at a speed in excess of five miles per hour within one hundred feet of the swimming area as marked by Board of Public Works.


(1) The use and operation of motor boats on any pond within the the limits of the Town shall be confied to residents of the Town only.


2. The rules and regulations in Section 1 of this Article shall be en- forced by the Police Officers of the Town authorized to make arrests.


3. The violation of any rule or regulation in Section 1 of this Article shall be punished by a fine of not more than fifty dollars for each offense.


4. The Chief of Police may revoke the registration of any boat, the operator of which has been convicted of violating any rule or regulation in Section 1.


ARTICLE 47. (At Request of Swimming Pool Committee). To see if the Town will vote to raise and appropriate by taxation or otherwise the

sum of twenty-five hundred dollars ($2,500.00) for the purpose of taking borings, making a topographical survey and for preliminary architectural services relating to the proposed construction of an outdoor swimming pool on the grounds of the William Seach School, said sum to be expended by the swimming pool committee, or take any other action in relation thereto.


ARTICLE 48. (On Petition of Theresa O'Meara, of Off St. Margaret Street, and Others). To see if the Town will authorize Theresa O'Meara, located at 32 St. Margaret Street in Weymouth, to build a street a distance of 500 feet in the southerly distance from St. Margaret Street, or take any other action in relation thereto.


ARTICLE 49. (By Direction of Selectmen). To see if the Town will vote to appoint a committee of three to draft a bill authorizing the ap- pointment of a superintendent of buildings who shall have jurisdiction over all new construction and supervision of old, said draft to be submitted to a future Town Meeting for action.


ARTICLE 50. (By Direction of Selectmen). To see if the Town will vote to raise and appropriate a sum sufficient to establish a purchasing department and instruct the Selectmen to appoint an agent.


ARTICLE 51. (By Direction of Selectmen). To see what action the Town will take to appoint a committee of nine (9) consisting of one Selectman, one member of the Board of Public Works, a member of the Appropriation Committee, another elected Town Official, and five regis- tered voters of the Town. This committee will review the administration of our Town Government and report back to the next Annual Town Meeting in 1961.


ARTICLE 52. (By Direction of Selectmen). To see what action the Town will take to appoint a committee of three (3) to make a study of the conditions of the bridge which is over the New Haven railroad tracks to Idlewell Section. This Committee to consist of one Selectmen, Super- intendent of Public Works, and one Town Meeting member from Precinct No. 8.


ARTICLE 53. (By Direction of Selectmen). To see if the Town will vote to accept by gift from the South Weymouth Naval Air Station a F9F6 Krueger Fighter Plane, as a memorial, site to be determined by the Board of Selectmen; or take any other action in relation thereto.


You are hereby required to notify and warn said inhabitants of Wey- mouth qualified to vote in Town affairs in case all the Articles in the foregoing warrant shall not have been acted upon at the meeting called for the seventh day of March, 1960. to meet in adjourned session at the hall of the Weymouth High School on


WEDNESDAY, THE NINTH DAY OF MARCH, 1960


at seven o'clock and forty-five minutes in the evening, then and there to act upon such of the foregoing Articles as shall not have been acted upon March seventh, or action upon which may at said meeting March seventh have been deferred until said adjourned session.


You are further requested to notify and warn the inhabitants of Weymouth qualified to vote in elections to meet at the polling place of their respective precincts, to wit:


In Precinct 1-In the Bicknell School Hall;

In Precinct 2-In the American Legion Hall on Commercial Street; In Precinct 3-In the Charles Y. Berry Auditorium in the Hunt School Building on Broad Street;


In Precinct 4-In the building of the Citizens' Association, Inc., on Front Street;


In Precinct 6-On the ground floor of the Pingree School, 1250 Com- mercial Street;


In Precinct 7-In the Lovell's Corner Improvement Association Build- ing on Washington Street;


In Precinct 8-In the Weymouth Heights Club Building on North Street;


In Precinct 9-On the ground floor of the Nevin School, 851 Main Street;


In Precinct 10-In the Homestead School on Front Street;


In Precinct 11-In the Elden Johnson School on Pearl Street.


ON MONDAY, THE FOURTEENTH DAY OF MARCH, 1960, at Eight o'clock in the forenoon, then and there to bring in to the wardens of their several precincts their votes on one ballot, for the following named Public Officers, to wit:


One (1) Selectman and Board of Public Welfare for three (3) years;


Two (2) Board of Public Works for three (3) years;


One (1) Assessor for three (3) years;


One (1) Park Commissioner for three (3) years;


Two (2) School Committee for three (3) years;


Three (3) Trustees of Tufts Library for three (3) years;


One (1) Board of Health member for three (3) years;


Two (2) Planning Board members for five (5) years;


One (1) Annual Moderator for one (1) year;
