MOTION: That the Town accept the Laying-out as a public Town way the relocation of a portion of Cochituate Road as described in the Order of Laying-out of the Board of Selectmen dated February 25, 1963, and as shown on a plan entitled "Relocation of a Section of Route 126 in Wayland, Mass., dated December 28, 1962, MacCarthy Engineering Service, Inc., 200 West Central Street in Natick, Mass. ", on file with the Town Clerk; that the Board of Selectmen be authorized to acquire the necessary land, including easements for drainage and slope, as shown on said plan, by purchase, gift, eminent domain or otherwise; and that there be appropriated and assessed the sum of $3, 000 for the acquisition of such land, for the construction of such way and for other costs in connection therewith.


A Motion offered by Mr. Blanchard, "To amend this Motion by pro- viding that Chapter 90 funds be used in connection with the project re- ferred to in this Article" was RULED OUT OF ORDER because of vagueness of the wording.

Mr. Blanchard challenged the phrase in the foregoing Motion, point- ing out that the Warrant Article expressly had stated, "without any ap- propriation for construction". Accordingly, the phrase in question was deleted from the Motion, with the unanimous consent of the Meeting.

Article 23. To see if the Town will authorize the Board of Select- men to acquire by purchase or gift from the Metropolitan District Com- mission, a parcel of land on Stonebridge Road, as shown on a M. D. C. Plan entitled "Plan of Land in Wayland, Mass. ", showing the Reloca- tion and Widening of a Part of Stonebridge Road, dated April 30, 1958, by Everett M. Brooks Co., Civil Engineers; or take any action relative thereto.


In making the following Motion, Mr. Loker, with the unanimous consent of the Meeting, omitted a detailed reading of the description of the parcels of land dealt with in this Article, but the Moderator briefly indicated the areas of land involved in each parcel:

Brooks Co., Civil Engi- neers, and bounded and described as follows:

Acton, Mass., on file with the Town Clerk; that the Board of Sel- ectmen be authorized to acquire the necessary land, including ease- ments for drainage and slope, as shown on said plan, by purchase, gift, eminent domain or otherwise; and that there be appropriated and assessed the sum of $1, 000. for the acquisition of such land, for the construction of such way, and for other costs in connection therewith.


Again Mr. Blanchard challenged the phrase, "for the construction of such way"; since the Article in the Warrant had specifically pre- cluded any appropriation of money for construction; and again the phrase was deleted from the Motion, with unanimous consent of the Meeting.

(2) Sears Road -- from Station 24 + 43. 93 to Station 42 + 50 as shown on "Subdivision Plan of Land in Wayland, Mass. , Feb- ruary 28, 1958, by Everett M. Brooks Co., C. E. " and on "Sub- division Plan of Land in Wayland, Mass., February 18, 1960, by Everett M. Brooks Co., C. E. "


(3) Cole Road Extension -- from Station 0 + 0 to Station 2 + 50 as shown on "Plan of Land in Wayland, Mass., belonging to William Richards -- June, 1960 by S. & P. Engineering Co., Wayland";

VOTED: Unanimously: That the Town accept as public Town ways Squirrel Hill Road (from Station 0 + 0 to Station 9 + 0), Sears Road (from Station 24 + 43. 93 to Station 42 + 50), and Cole Road Extension (from Station 0 + 0 to Station 2 + 50), as described in the Orders of Laying-Out of the Board of Selectmen dated February 25, 1963, and as shown on plans described in the article and on file with the Town Clerk; that the Board of Selectmen be authorized to acquire any nec- essary land, including easements for drainage, by purchase, gift, eminent domain or otherwise, and that the sum of $30. be appropriated and assessed for the acquisition of such land and easements and for other costs in connection therewith, without any appropriation of money

for construction of said roads under the Betterment Act, or otherwise.


Article 27. To see if the Town will authorize the Board of Road Commissioners to remove all obstructions to and otherwise improve the free flow of water in Snake Brook from Commonwealth Road to the North Main Street bridge; to transfer, appropriate or borrow money to pay for the same; or otherwise act thereon.


Upon a Motion of Mr. Francis A. Fisher, duly seconded, it was VOTED: That this Article be passed over.


Article 28. To see if the Town will vote to adopt the use of Voting Machines at all Primaries and Elections held in the Town of Wayland; to raise and appropriate a sum of money for the rental and/or pur- chase of the required number of such machines; to determine how such sum of money shall be raised; or take any action relative thereto.


Duly seconded, Mr. Ela offered the following


MOTION: That a committee of three, consisting of one Selectman, one member of the School Committee, each to be designated by their respective boards, and the Town Clerk, be set up and authorized to investigate and make recommendations to the next Town Meeting as to the feasibility of the purchase and use of voting machines at all elec- tions; that they be directed to investigate the advisability of dividing the Town into three or more precincts, and that they be further direct- ed to investigate proper storage facilities for such equipment, that there be appropriated and assessed $500. for the use of the Committee in preparing necessary plans, and that there be appropriated and ass- essed $10, 000 for ultimate purchase and/or rental of machines, such funds not to be expended without further vote of the Town.


At the request of the Moderator, the clause, "that they be directed to investigate the advisability of dividing the Town into three or more precincts" was deleted from the Motion, because it went beyond the scope of the Article.


Upon a Motion of Mr. Laurence S. Fordham, duly seconded, it was VOTED: To amend Mr. Ela's Motion by


1. Increasing the membership of the Committee to five (5), to include two (2) members at large, to be appointed by the Moderator; and


2. Adding the words, "and advisability" after the word " feasi- bility " . . . of the purchase and use, etc.


Upon Motion of Mr. Howard C. Weeks, duly seconded, it was VOTED: To delete the appropriation of $10, 000. 00 from the Motion.

Article 29. To see if the Town will vote to authorize the Board of Selectmen to purchase, take by eminent domain, gift and/or other means, on behalf of the Town of Wayland, water easements through and over certain land as follows:


(1) As shown on a Plan, now on file with the Town Clerk, en- titled "Plan of Land in Wayland, Mass. , (showing Town of Way- land Water Easement)" by Everett M. Brooks Co., C. E. dated August 18, 1962;


(2) As shown on a Plan, now on file with the Town Clerk, en- titled "Plan of Land in Wayland, Mass. , (showing Town of Way- land Water Easement)" by Everett M. Brooks Co., C. E. dated August 20, 1962;


(3) As shown on a Plan, now on file with the Town Clerk, en- titled "Plan of Land in Wayland, Mass. , (showing Town of Way- land Water Easement)" by Everett M. Brooks Co., C. E. dated August 21, 1962;

To see if the Town will vote to authorize the purchase, take by eminent domain, gift, or otherwise, of an easement for exist- ing water main through and over certain parcels of land shown as Ease- ment for Existing Water Main on Plan of Land in Wayland, Mass., dated December 14, 1962, by Everett M. Brooks Co., Civil Engineers, situ- ated on Northerly side of Old Connecticut Path as shown on said Plan and bounded and described as follows:

Brooks Co., Civil Engineers, situated on the Northerly side of Old Connecticut Path as shown on said Plan and bounded and described as set forth in the article, together with the right to enter upon such premises and construct and maintain pipes, hydrants, and ditches, and appurtenant structures therein, and that there be appro- priated and assessed therefor the sum of $10. 00.


Article 31. To see if the Town will vote to authorize the purchase, take by eminent domain, gift, or otherwise, of a drainage easement through and over a certain parcel of land shown as "Drain Easement" on Plan of Land in Wayland, Mass., dated December 14, 1962, by Everett M. Brooks Co., Civil Engineers, bounded and described as follows:


Commencing at the intersection of the Southerly side line of Old Connecticut Path and Easterly side line of said drain easement, thence running SOUTH 47º 05' 40" East, 220. 09 feet; thence running SOUTH 42º 54' 20" West, 30 feet; thence running NORTH 470 05' 40" West, 230. 31 feet to the Southerly side line of Old Connecticut Path; thence running NORTHEASTERLY by said South- erly side line, 31. 69 feet, to the point of beginning, excepting so much thereof as is owned by the Commonwealth of Massachusetts, Weston Aqueduct, shown on said plan; together with the right to enter upon said premises and lay and maintain pipes, sewers, drains and manholes, therein, and to raise and appropriate a sum of money therefor; or take any action relative thereto.
