Annual Town Meeting assembled in the Auditorium of the High School at one o'clock P. M., according to the call of the Warrant, meeting called to order by the Moder- ator George W. Porter.
Moved and seconded that this meeting be adjourned to Saturday, March 1, 1947, at one o'clock P. M.

Annual Town Meeting assembled in the Auditorium of the High School at one o'clock P. M. According to the call of the warrant, meeting was called to order by the Moderator George W. Porter and under
Article 1. William H. Lester and James W. Cesan were chosen for fence viewers.
William S. Halladay and George H. Reed chosen as field drivers.
Article 2. Voted to accept the reports of the Town Officers as listed in the Annual Town Report. Errors and omissions noted.
Article 3. Voted that the care of Public Welfare be left in the hands of the Board of Public Welfare for the ensuing year.
Article 4. Voted to appropriate the sum of $300.00 for the proper observance of Memorial Day. To be ex- pended under the direction of the American Legion.
Article 5. Voted to appropriate the sum of $600.00

for the payment of a charge of an Insurance Co. for act- ing as surety on the official bond of its officers.
Article 6. Voted to appropriate the sum of $1,300.00 for Liability Insurance of its employees.
Article 7. Voted to appropriate the sum of $2,600.00 for the employment of a District Nurse and expenses of the Department.
Article 8. Voted to appropriate the sum of $200.00 for enforcement of the dog law.
Article 9. Voted to appropriate the sum of $67.73 for bills contracted in 1946 and not previously presented ; and that the same be taken from surplus revenue. Unani- mous vote.
Article 10. Voted to authorize the Town Treasurer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1947, and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chap- ter 44 of the General Laws.
Article 11. To see if the Town will vote any sum of money for the purchase of a new fire truck.
Voted to pass over.
Article 12. To see if the Town will vote to raise and appropriate any sum of money to increase the per- manent fire force.
Voted to pass over.
Article 13. To see if the Town will raise and appro- priate the sum of $2,600.00 for the building of a sidewalk on the Westerly side of Main Street from Lealand Ave- nue, southerly to Elm Street.
Voted to pass over.
Article 14. Voted to appropriate the sum of $5,000.00 from Road Machinery Fund to Road Machinery Account for the purchase of a new truck.
Article 15. Voted that the Town accept the gift of an ambulance from the Wilson Thompson Post 185, American Legion, Inc., and that a vote of thanks be here-

by extended the said American Legion; and that the Board of Selectmen be authorized to appoint a Commit- tee to regulate its use.
Article 16. To see if the Town will take any action looking towards the adoption of Representative form of Town Meeting.
Voted that the Town retain its present form of Town Meeting.
Article 17. Voted that in the 1948 election and thereafter the Collector of taxes be elected for a term of three years, and all former votes which are contrary to this be hereby repealed.
Article 18. Voted that the Town authorize the Board of Selectmen to sell the old school property at 808 Suffield Street at Public Auction and that sufficient deeds be given therefor.
Article 19. Voted that the Town authorize the Board of Selectmen to sell the school property situated on North West Street, and that sufficient deeds be given therefor.
Article 20. To see if the Town will vote to raise and appropriate the sum of $600.00 for Surface Drainage on Suffield St. from Silver St. northerly to the old School Property.
Voted to pass over.
Article 21. Voted that the Town release the Sur- plus War Bonus Fund of $2,701.14 in order that a Veteran Memorial Park may be established on Springfield Street, between Taft and Mckinley Streets, Agawam, on land donated by Wilson Thompson Post 185, the American Le- gion ; said fund to be expended by a Committee of three World War I veterans appointed by the Moderator.

Article 22. To see if the Town will authorize the Plan- ning Board to approve the acceptance by the Town of ex- isting streets which were established by record in the Hampden County Registry of Deeds (and on which houses have been built) prior to January 1, 1945, and which do

not comply with the minimum requirements of streets for Town acceptance as established by vote of the Town :- provided that new street lines complying as nearly as possible with the Town's bylaws and regula- tions are established by and with the written consent of the owners abutting property, and also provided that the new street lines thus established are to govern the location of buildings hereafter erected thereon in accord- ance with the zoning bylaws of the Town.
Voted to pass over because of illegal procedure.
Article 23. Voted that a Committee of three be ap- pointed by the Moderator to study the records of the town's bylaws (with the exception of those pertaining to building, plumbing and zoning) and make a full re- port thereon with such recommendations for recodifica- tion as they deem desirable at a subsequent town meet- ing but not later than the annual town meeting in 1948, and that the sum of $300.00 be appropriated for legal and clerical expenses of this Committee.
Article 24. Articles 24 through 31 inclusive pertaining to the acceptance of Liberty St., Senator Ave., North- wood St., Fruwirth Ave., Columbus St., Melrose Place, Pomeroy St. and James St. as public streets.
Voted to pass over.
Article 32. Voted that the Zoning bylaws adopted in 1928 be further amended by inserting under Section 3- "General" the following paragraph "L",-
In districts as shown on the Building Zone Map as amended, the removal for sale of sod, loam, clay, sand, gravel or quarried stone, except when incidental to and in connection with the construction of a building for which a permit has been issued, or except where it is to be used within the limits of the town, shall be deemed a non-conforming use of land and shall be permitted only if written permission of the Board of Appeals be obtained, and under such conditions as the Board of Appeals may impose and make a part of the permit. The Board of Appeals shall in each instance impose such con- ditions as will protect the neighborhood and the town against permanent and temporary hazards because of conditions which may be left after operations are com- pleted or because of the methods of handling such mate-

rials at the site or of transporting such materials through the town.
Article 33. Moved that the following described area be rezoned by changing it from Residence A and Residence B to business.
Beginning at a point on the easterly side of Suffield Street 200 feet northerly from the northeast corner of the intersection of South Street and Suffield Street; then running northerly along Suffield Street 200 feet; thence easterly 200 feet on a line parallel with the north side of South Street; thence southerly 200 feet to the northeast corner of the present Business zone; thence westerly 200 feet to the place of beginning.
Voted: Yes, 206; No, 13.
Article 34. Voted to change the zone of the prop- erty on the northwesterly side of Springfield Street de- scribed as follows :
Beginning at the southerly intersection of Springfield and Portland Streets, thence running along the westerly side to Springfield Street, to Annable Street; thence west- erly along Annable Street 200 feet; thence northeasterly, parallel with Springfield Street, to Portland Street; thence easterly 200 feet along the southerly side of Portland Street to the place of beginning, from Res. B to "Business."
Voted: Yes, 263; No, 1.
Article 35. Voted to change the zone of the property on the easterly side of Walnut Street, described as follows :
Beginning at the easterly intersection of Spring- field and Walnut Streets; thence running along the east- erly side of Walnut Street about 550 feet to a point oppo- site the northerly line of property on the westerly side of the street belonging to one Keefe; thence running easterly at right angles to the previous course to the Westfield River; thence southerly along said river to the present Business Zone; thence southwesterly along the line of the present Business zone to the place of begin- ning, from Residence B to "Business". Voted unani- mous.
Article 36. Voted Yes-307 No-10 to change the

zone of the property on the southerly side of Springfield Street described as follows :
Beginning at a point on the southerly side of Spring- field Street at the easterly line of property of one Taddia; thence continuing westerly along Springfield Street to a point about 340 feet easterly of Maple Street; thence southerly 200 feet at right angles to Springfield Street; thence easterly and parallel with Springfield Street to the easterly line of property of said Taddia; thence 200 feet northerly to the point of beginning from Residence A to Business. Also beginning at a point on the southerly side of Springfield Street about 340 feet easterly of the intersection of Springfield and Maple Streets; thence southerly 200 feet at right angles to Springfield Street; thence westerly 100 feet to the easterly line of the present Business zone; thence 200 feet northerly along the east- erly line of the present Business zone to Springfield Street; thence easterly 100 feet along Springfield Street to the point of beginning; from Residence B to "Business."
Article 37. To see if the Town will accept Franklin Street as a public street. Voted to pass over.
Article 38. Moved to amend Paragraph 2 of Section 4 of the by-law concerning the Board of Appeals by strik- ing out the words "at least one of the Springfield, Mass., daily newspapers" and inserting the words "a newspaper published in Hampden County having a substantial cir- culation in the Town of Agawam.
Article 39. To see if the Town will amend its zoning by-laws as adopted April 6, 1928, by changing from Resi- dential "A" zoning to Industrial "A" zoning the property of the Precision Engineering Corporation at 590 North Street, easterly of land of the Springfield Swiss Club, de- scribed as follows:
Beginning at a stone bound in the northerly line of North Street, at the southwesterly corner of the described premises, at the southeasterly corner of land now or for- merly of the trustees of the Springfield Swiss Club and running thence North 25 degrees East along last named land, 100 feet to land now or formerly of Mary Sulborski, thence South 69 degres 57 minutes East, along last named land, in a line parallel to said North Street 150.00 feet to a point, thence South 25 degrees West, in a line

parallel with the first course, 100.00 feet to North Street, thence North 69 degrees 57 minutes West, along North Street, 150.00 feet to the place of beginning, being the property conveyed to the Precision Engineering Corpora- tion April 6, 1942 and April 18, 1942 and recorded in the Hampden County Registry Deed Book 1735, P. 382 and Book 1736, P. 282. Voted to pass over.
Article 40. To see if the Town will accept Federal Street Extension as a public street.
Voted to pass over.
Article 41. Voted to appropriate the sum of $5,000.00 for the payment of Donald M. Macaulay, Attorney's fees in the case of the bankruptcy of the Agawam Racing and Breeding Association; the same to be taken from Sur- plus Revenue.
Article 42. Voted to accept the report, as read, of the committee appointed to select a site and to bring in preliminary plans for a new school in Feeding Hills.
Article 43. To see if the Town will vote to authorize the Board of Selectmen to procure by Eminent Domain or otherwise, a plot of land now owned by William Drenow- ski, consisting of 10 acres, more or less, on Springfield Street; and to raise and appropriate the sum of $8115.00 or any other sum to pay for same. Voted to pass over.
Article 44. To see if the Town will appropriate any sum of money to prepare final plans and working draw- ings for the erection of a new school in Feeding Hills, or take any other action thereon. Voted to pass over.
Article 45. Voted to appoint a committee, or con- tinue the same committee, to direct the preparation of working drawings and final plans and to report not later than June 1, 1947, and to recommend one or more suit- able sites for such building. And to add to the committee three who shall be parents of school children attending the Feeding Hills District School. The Committee added are:

Article 46. Voted to transfer the unexpended bal-

ance of the Administration Building Construction account of $20.34 to the Available Funds.
Article 47. Voted to transfer the sum of $5,000.00 from the Overlay Reserve to the Reserve Fund.
Article 48. Moved that the sum of $1,200.00 be raised and appropriated to meet the Town's share of the cost of Chapter 90 Highway Maintenance and that, in addition, the sum of $2,400.00 be transferred from un- appropriated available funds in the Treasury to meet the State's and County's share of the cost of the work, the reimbursements from the State and County to be restored upon their receipt, to unappropriated available funds in the Treasury.
