Arlington is situated six miles northwest of Boston, in latitude 42 deg., 25 min. north; longitude 71 deg., 09 min. west, at an elevation above mean tide of from 4 to 377 feet.

REPORT OF THE TOWN COUNSEL


December 31, 1933.


Honorable Joint Board of Selectmen and Board of Public Works


Gentlemen :


On March 28, 1933, the present Town Counsel was appointed to succeed Paul M. White, Esq. At that time many actions and claims against the town were pending in Court or were in process of settlement, in connection with which Mr. White had done considerable preparatory work. There were also several cases which had been previ- ously referred by Mr. White to Damon Hall, Esq., and several to John Morrison, Esq., some of which were about ready for trial and some in varying stages of settlement. In view of this it was deemed expedient by the Board of Selectmen to allow such cases to be carried to completion by the attorneys originally engaged and this was done with my approval. All matters which have arisen during 1933 since March 28th have been attended to by the pres- ent Town Counsel.


A petition for assessment of damages filed in the Superior Court of Middlesex County by the Lowell Build- ing Wrecking Co., Inc., in connection with the taking of 52075 sq. ft. of land near the corner of Mystic and Sum- mer Streets which was assessed for $7500 and for which the town meeting appropriated $7500 was finally settled out of Court for $7800 the town taking a confirmatory deed to the land.

ARLINGTON TOWN REPORT


Pursuant to Warrant Article 6 of the Town Meeting held March 22, 1933, a bill was filed in the legislature by the Town Counsel on behalf of the town for authority to sell a strip of land containing 855 sq. feet of the Ethel Wellington Playground which bill became Chapter 218 of the Acts of 1933. Thereafter the strip was conveyed to Gerardo Riccardi and another parcel in the rear of the Riccardi land containing 1710 sq. feet was acquired by the town by deed from Gerardo Riccardi as authorized by Warrant Article 5.


A parcel of land containing 3900 square feet situated in the center of Lockeland Avenue, but which had never been assessed by the town to anyone as owner, was con- veyed to the town by deed of the Lockeland Real Estate Trust and dedicated for Park purposes as authorized at the special town meeting held June 7, 1933.


The appeal of Francis Henderson from the Assessors' valuation of $14,000 on 201/2 acres of land on Hutchinson Road was tried before the State Board of Tax Appeals and the town's valuation was sustained.


The appeal of Americo Chaves was withdrawn by the appelant before trial.


The appeal of Max Benshimol from an assessment of $9600 upon a two family house on Randolph Street was tried and the Board of Tax Appeals reduced the valuation to $8500.


The appeal of Marion Garcelon from an assessment of $10,400 on a single family residence on Falmouth Road was tried and the town's valuation sustained.


The appeal of Sarah F. Niles from an assessment of $78,800 on 867,245 square feet of land and buildings

REPORT OF TOWN COUNSEL


thereon on Mystic Street bordering Mystic Lake was tried and the value was set at $75,000 by the Board of Tax Appeals.


There are several other tax appeals pending which may be reached for trial in the early part of 1934.


Several cases resulting from alleged defective side- walks have been settled out of Court with the approval of the Board of Selectmen, including the cases of Evelyn M. Russell, Mary F. Nolan, John W. Gates, Ellen Brown and Mary F. Moore.


Many bills due the town for damage by automobiles to police and fire signals and various other claims have been collected including a balance of $2794.50 overdue on the garbage contract dated June 27, 1927, which amount was collected in full from the bonding company.


Actions were brought in the Superior Court of Mid- dlesex County against the cities of Boston, Cambridge, Somerville and Revere for money paid by the Welfare De- partment on cases for which the town should be reim- bursed by those cities. The Town Counsel has been kept in close touch with the Welfare Department by Welfare Agent Clifford Cook. Due to the constant and efficient supervision by Mr. Cook of each individual case it was necessary to institute only one court prosecution for fraud during the year and in that case the defendant was found guilty and placed on probation with the stipulation that restitution be made to the town.


The Town Counsel has been present at all regular meetings of the Board of Selectmen and the Joint Board, has rendered opinions to the School Committee, Board of Health and other boards, has attended hearings at the State House before various State Boards and Commis-

sions and has attended to divers other matters affecting the town.


The Town Counsel wishes to express his thanks to each and every department of the town for the splendid co-operation extended by each of them throughout the year. The prompt and intelligent reports of investiga- tions of damage claims against the town rendered by Police Officer James J. Flynn have been most helpful and the excellent photographs and detailed plans submitted by Town Engineer James M. Keane have been of great practical value in many cases which have been or will be tried in the courts.


To Representative Nelson B. Crosby who has faith- fully kept the Town Counsel informed of all matters pend- ing before the legislature and at the State House affect- ing the interests of the town I wish to express my sincere appreciation as well as to each and every member of the Board of Selectmen and the Board of Public Works for their courtesy and co-operation.

REPORT OF WIRE DEPARTMENT January 12, 1934


To the Honorable Joint Board of Selectmen and Board of Public Works:


Gentlemen :


I respectfully submit my report as Superintendent of Wires for the year ending December 31, 1933.


STREET LIGHTING


During the year there were nineteen (19) lamps in- stalled as follows: one (1) on Alpine Street; two (2) on Colby Road; two (2) on Eastern Avenue; two (2) on Heard Road; one (1) on Henry Street; one (1) on Hillside Avenue; one (1) on Kenilworth Road; two (2) on Lan- caster Road, one (1) on Lowell Street; one (1) on Moun- tain Avenue; one (1) on Park Avenue; one (1) on Pond Terrace; one (1) on Upland Road; one (1) on Washington Avenue; one (1) on Winchester Road. The number 20 lamp at the end of Schouler Court was replaced with a number 70 lamp; and one number 20 lamp on Chestnut Street was discontinued.

INSPECTION OF WIRES IN BUILDINGS


One thousand two hundred and twenty eight (1,228) permits for electrical construction were issued at fifty (50) cents for each permit.


There were two thousand and fourteen (2,014) in- spections made, and twelve hundred (1,200) installations approved.


There were no fires caused by defective wiring during the year.


POLES AND WIRES ON STREETS


The Edison Company, the Telephone Company, and the Boston Elevated replaced one hundred and ninety (190) poles during the year.
