Pursuant to the vote of adjournment on March 22, 1933 the Town Meeting Members met in the Town Hall on Wednesday evening, March 29, 1933, notices having

been sent by mail by the Town Clerk seven days before the meeting and posted at two places in each precinct. A notice was published in the local paper.


Lists of the duly qualified Town Meeting Members were used at the entrances of the meeting place and were in charge of Philip T. Robinson and James E. Sweeney.


The check lists filed with the Town Clerk at the close of the meeting showed that two hundred and eight members attended the meeting.


James C. Carr, stenographer, was sworn by the Town Clerk to the faithful performance of his duties.


The Moderator declared a quorum present.


The meeting was called to order at 8.10 o'clock P. M. by the Moderator, William P. Barry.


On motion of Arthur P. Wyman:


Voted: (Unanimously) That if the business calling this meeting is not disposed of on this date, the meeting adjourn to Wednesday evening, April 5, 1933, at eight o'clock.


Town Meeting Members not already sworn were sworn by the Moderator.


Article 19 taken up. (Acquisition of Easements).


Voted: (Unanimously) That the Town do not auth- orize the acquisition of any land, easements, or rights therein, under Article 19 of the Warrant.

Voted. (Unanimously) That sums be appropriated and expended in the following manner to pay debts, ob- ligations, and expenses incurred for the following pur- poses prior to January 1, 1933; in connection with snow and ice removal, the sum of eighty-five hundred (8500) dollars to be expended under the direction of the Board of Public Works; in connection with the Public Welfare Department for welfare aid, the sum of eight thousand eight hundred eight and 99/100 (8808.99) dollars to be expended under the direction of the Board of Selectmen ; and in connection with soldiers' relief, the sum of three thousand seventy-five and 90/100 ($3,075.90) dollars, to be expended under the direction of the Board of Select- men ; and that all said sums be raised by general tax.


Article 21 taken up. (Board of Survey Plans-Stone Bounds).


Voted: (Unanimously) That the sum of two thou- sand one hundred forty-seven and 87/100 ($2,147.87) dol- lars be and hereby is appropriated to defray the expense of setting stone bounds as shown upon various Board of Survey plans heretofore approved by the Board of Sur- vey; and that said sum be raised by general tax and ex- pended under the direction of the Joint Board of Select- men and Board of Public Works.


Article 22 taken up. (High School Repairs) .


Considerable discussion ensued relative to the con- struction of the new High School building and on the amended motion of the Finance Committee it was


Voted: That the sum of six hundred (600) dollars be and hereby is appropriated for repairing the walls of the new high school building; and that said sum be raised by general tax and expended under the direction of the School Committee.

Article 24 taken up. (Brattle Street Resurfacing).


On the substitute motion of Robert N. Boyd :


Voted: (Unanimously) That the sum of One Hun- dred Fifty Dollars be and hereby is appropriated, said sum to be paid to the Brattle Hill Improvement Associa- tion, as its share of the cost of the resurfacing of Brattle Street, formerly Brattle Park.


Article 25 taken up. (Sewerage System-Newland Road).


Voted : (Unanimously) That the Town do not make any appropriation under Article 25 of the warrant, for the extension of the sewerage system in Newland Road, but recommend that the Board of Public Works give this Article consideration under the general appro- priation for sewer extensions in 1933.


Article 26 taken up. (Sewerage System-Alpine Street).


Voted: (Unanimously) That the Town do not make any appropriation under Article 26 of the warrant, for the extension of the sewerage system in Alpine Street, but recommend that the Board of Public Works give this Article consideration under the general appropriation for sewer extensions in 1933.

Voted: (Unanimously) That the Town do not make any appropriation under Article 27 of the warrant, for the entertainment of the citizens through the medium of a series of musical concerts.

Article 28 taken up. (Gift for Library Books).


Voted : (Unanimously) That the Town accept the gift of the late Dexter Rawson Fay contained in his trust agreement with N. Emmons Paine dated December 6. 1922 and in his will, described in Article 28 of the war- rant; that any sum received by virtue of said gift be managed, and the income thereof expended in accordance with the terms of the gift, by the Trustees of the Robbins Memorial Library; and that said Trustees be requested to place in said library a memorial as requested by the donor.


Article 29 taken up. (Gift of Christmas Tree).


Voted: (Unanimously) That the Town accept the gift of the "George Washington Memorial Committee", of the Christmas Tree now planted on the Cemetery De- partment lot at the junction of Broadway and Massachu- setts Avenue.


Article 30 taken up. (Gift of Scion of the Washing- ton Elm).


Voted: (Unanimously) That the Town accept the gift of the Arlington Girl Scouts, of the scion of the Washington Elm now located upon the Town House Grounds, but make no appropriation for transportation and setting of said tree.


Article 31 taken up. (Gift of Clock) .


Voted: (Unanimously) That the Town accept the gift of the Misses Ida and Caira Robbins, provided for in the will of the late Josephine Robbins Wallace, of the clock now located in the Hearing Room in the Robbins Memorial Town Hall.

Article 32 taken up. (Gift of Portrait).


Voted: (Unanimously) That the Town accept the gift of the Atlantic National Bank of Boston, of the por- trait of the late Nathan Robbins, now located in the Hear- ing Room in the Robbins Memorial Town Hall.


Article 33 taken up. (Sale of Horses).


Voted: (Unanimously) That the Board of Public Works be and hereby is authorized to sell, convey or otherwise dispose of the three horses owned by the Town and now under the control of the said Board.


Article 34 taken up. (Sale of Building upon the Great Meadows).


Voted: (Unanimously) That the Board of Public Works be and hereby is authorized and empowered in the name and on behalf of the Town to sell at public auction or private sale, the old brick building situated upon land of the Town known as the Great Meadows in Lexington, for the minimum amount of one dollar and upon such other terms as said Board shall consider proper, or to otherwise dispose of the same, and to execute, acknowl- edge and deliver any proper document; and further that the sum of one hundred (100) dollars be and hereby is appropriated for the use of said Board for this purpose.


Article 35 taken up. (Sale of Town Yard Buildings and Equipment) .

Voted: (Unanimously) That the Board of Public Works be authorized to sell, convey or otherwise dispose of any of the buildings which are of no further use to

the town, situated on the land of the town, known as the old town yard, on Summer Street and all or any of obso- lete or useless equipment on said land ; to make such nec- essary grading of land from which all or any of said build- ings may be removed; that the sum of Two Hundred Dol- lars ($200.00) be and hereby is appropriated for the said purposes ; and that said sum be raised by general tax and spent under the direction of said Board of Public Works.


Article 36 taken up. (Cemetery-Perpetual Care).


Voted: (Unanimously) That Article 11 of the Town's By-Laws relating to "Care of Burial Grounds and Lots" be and hereby is amended by altering Section 1 thereof so as to read as follows: Section 1. The Town will accept and forever hold in trust, money or securities, which may hereafter be deposited with the Town Treasurer for the perpetual care, preservation, improvement, or embellish- ment of any public or private burial place, or any graves therein, agreeably to the provisions of the statutes of the Commonwealth; and will so accept for such care, preser- vation, improvement, or embellishment of any lot there- in containing two hundred or more square feet, such sum not less than two hundred dollars ($200) as the board of cemetery commissioners may determine, and of any lot therein containing less than two hundred (200) square feet, the sum of one dollar ($1.00) for each square foot of such lot.


Voted: (Unanimously) That upon the taking effect of the amendment of Section 1 of Article 11 of the Town's By-Laws relating to "Care of Burial Grounds and Lots" as made under this Article 36, the vote of the Town passed on April 22, 1889 relating to the perpetual care of lots in the Town's cemetery set forth in Article 36 of the warrant, shall for all purposes be held to be rescinded.

Article 37 taken up. (Rescission of Vote to Acquire Land for School Purposes).


Voted: (Unanimously) That the vote of the Town passed on April 3, 1929 under Article 42 of the Warrant for the annual meeting of that year authorizing the ac- quisition of land for school purposes, more particularly described in Article 37 of the warrant for this meeting, be and hereby is rescinded; and that the sum of three thousand (3000) dollars appropriated under said Article 42 be and hereby is transferred to the Reserve Fund pro- vided for in Section 6 of Chapter 40 of the General Laws, to be expended under the direction of the Finance Com- mittee.


Article 38 taken up. (Preference to Residents in Town Work).


Voted: (Unanimously) That the Town do not in- struct the Selectmen or other officials of the Town to give preference to residents of the Town in all construc- tion work and improvements to be made, for and by the Town, and especially to the unemployed, who are receiv- ing welfare assistance, unless otherwise instructed by law.

Voted: (Unanimously) That the Town's Zoning By- Law be not amended by altering the Zoning map therein referred to so as to include in a Business District the land on the southerly side of Summer Street between Washington Street and Brattle Street to a depth of One hundred (100) feet except that wherever such depth of One hundred (100) feet would extend beyond the North- erly line of Brattle Street only the actual depth between the southerly line of Summer Street and the Northerly

line of Brattle Street shall be included, and the land on the Northerly side of said Summer Street between Brat- tle Lane and Brattle Street to a depth of one hundred (100) feet not now included in the fourth or Business District.

Voted: (Unanimously) That the Town's Zoning By- Law be not amended by altering the Zoning map therein referred to so as to include in a Business District the area bounded and described as follows :


Beginning at a point on the easterly side line of Pine Avenue at land now or formerly of Patrick F. Toye, thence southeasterly by said land of Patrick F. Toye a distance of 135.27' to the northerly side line of Summer Street, thence easterly, by said northerly side line of Summer Streeet, on a curve to the right with a radius of 495.0' a distance of 112.42' to a point of reverse curve in said northerly side line of Summer Street, thence north- easterly and northerly on said northerly side line of Sum- mer Street on a curve to the left with a radius of 44.0', a distance of 97.99' to a point of tangency in the south- erly side line of Hemlock Street; thence northwesterly on said southerly side line of Hemlock Street a distance of 183.50' to the southerly side line of Pine Street, thence continuing northwesterly on said southerly side line of Pine Street a distance of 167' to the easterly side line of Pine Avenue, thence southwesterly on said easterly side line of Pine Avenue a distance of 223.59' to the point of beginning.
