TOWN WARRANT


The Commonwealth of Massachusetts, Middlesex, ss.


To the Constables of the Town of Arlington, in said County :


Greeting:


In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the legal voters of the Town of Arlington, to meet in the Town Hall in said Town on Monday, the nineteenth day of October, 1936, at 8-00 o'clock, P.M., to act on the following Articles, viz .:


Article 1. To hear and act upon the reports of the Finance and other committees heretofore appointed.


Article 2. To see if the Town will appropriate the sum of eight thousand forty-six and 60/100 (8,046.60) dollars or any other sum or sums for the purpose of making the payment required to be made by the Town under the provisions of chapter 377 of the Acts of 1936 entitled "An Act Providing for the reconstruction of a Bridge and its Approaches over the Mystic River in the City of Medford

and the Town of Arlington," other than the proportionate part of the cost payable on account of the Town's member- ship in the metropolitan parks district (said bridge being at Medford Street); will determine in what manner the money shall be raised and expended (by borrowing or otherwise); or will take any other action in any way relating to anything mentioned hereinbefore or in said chapter 377.


Article 3. To see if the Town will vote to appropriate a sum or sums of money to meet expenditures for public welfare, old age assistance and state and military aid; pro- vide for these appropriations by borrowing under authority of and in accordance with the provisions of Chapter 49 of the Acts of 1933 as amended by Chapter 300 of the Acts of 1935 and Chapter 281 of the Acts of 1936, or otherwise, or take any action relative thereto.


Article 4. To see if the Town will make an additional appropriation for the removal of Ashes, Offal and Rubbish; determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 5. To see if the Town will make an appropria- tion for the extension of Water Mains in Pleasant View Road and Brunswick Road; determine in what manner the money shall be raised and expended; or take any action relating thereto.


Article 6. To see if the Town will make an appropria- tion or appropriations for the Extension of Water Mains and/or for the Extension of the Sewerage System in all or any portion or portions of the parcel of land within the town, fifteen (15) feet in width, with the center line of which is described substantially as follows:


Beginning at a point on the southerly side line of Appleton Street, said point being about 270 feet south-

westerly of the intersection of the said southerly side line of Appleton Street with the easterly property line of land of Margaret Henderson et al, thence southeasterly through land of said Margaret Henderson et al, about 180 feet to an angle point; thence southwesterly through land of said Margaret Henderson et al, about 360 feet to an angle point; thence southerly through land of said Mar- garet Henderson et al, about 330 feet to an angle point; thence southwesterly through land of said Margaret Henderson et al, about 680 feet to an angle point; thence southerly through land of said Margaret Henderson et al, about 40 feet to an angle point; thence southeasterly through land of said Margaret Henderson et al and land of the Arlmont Country Club, about 170 feet to the northerly side line of Concord Turnpike; thence southerly across said Concord Turnpike about 80 feet to an angle point; thence northwesterly on said Concord Turnpike about 530 feet to an angle point; thence southwesterly on said Concord Turnpike and land of Arlmont Housing Cor- poration about 60 feet to Standish Road; thence south- easterly through said Standish Road, about 820 feet to proposed sewerage pumping plant; all as shown upon a plan on file in the office of the Town Engineer;


or in any other land of the said Margaret Henderson et al, the said Arlmont Country Club, or the said Arlmont Hous- ing Corporation or in any other land on or adjacent to the said Concord Turnpike or the said Appleton Street; will authorize the acquisition, by purchase, eminent domain or otherwise of land, easements and/or rights for or relating to any or all such extensions; will make an appropriation for such acquisition; or will take any action in any way relating to anything hereinbefore mentioned.


Article 7. To see if the Town will transfer the sum of two hundred seventy (270) dollars from (Mt. Pleasant Cemetery) Sale of Lots and Graves Fund to the (Mt. Pleasant Cemetery) Perpetual Care Fund; will appropriate

the sum of seventy-five (75) dollars to be expended from said Sale of Lots and Graves Fund or otherwise, for the acquisition of an unused lot or rights therein, in said cemetery, or take any action relating thereto.

Article 8. To see if the Town will amend its Zoning By-Law by altering the zoning map therein referred to so as to include in a Business District the area now included in a Single Residence District, bounded and described as follows: To Wit-


A certain parcel of land shown as Lots No. 1 and 2 on a Plan of Land in Arlington, Mass., dated September 14, 1936, Fred A. Joyce, Surveyor. Said lots, taken together, are more particularly bounded and described as follows:


Northwesterly by Cedar Ave., as shown on said plan, One Hundred Eighty-two and 91/100 (182.91) Feet.


Northeasterly by Lot No. 3, as shown on said plan, One Hundred Ninety-eight and 66/100 (198.66) Feet.


Southeasterly by Park Ave., as shown on said plan, One Hundred Eighty and 16/100 (180.16) Feet.


Southeasterly again by said Park Ave. on a portion of the curved line at the junction of said Park Ave. and the State Highway, Thirty-four and 42/100 (34.42) Feet, more or less.


Southwesterly by a line parallel with and Six (6) Feet distant northeasterly from the northeasterly side line of said State Highway, as shown on said plan, Three Hundred Fifty-six (356) Feet, more or less.


Westerly by said Cedar Ave. on a portion of the curved line at the junction of said Cedar Ave. and the

Containing according to said plan Fifty-seven Thous- and Three Hundred Six (57,306) Sq. Ft. of land, more or less.

Article 9. To see if the Town will acquire for park purposes or for any other purpose or purposes, Elizabeth Island so-called, situated in Spy Pond, in said Arlington, and containing about one and three-quarters acres; make an appropriation for such acquisition; determine in what manner the money shall be raised and expended; or take any action in any way relating to the said island or any portion thereof.

And you will notify and warn the voters of the Town of Arlington to meet at the time and place herein specified by leaving at every dwelling house in the Town a printed copy of this warrant, and also by posting a copy of the same at the doors of the Town Hall, and in a conspicuous place in each of the fourteen precincts of the Town, seven days at least prior to the time of said meeting.


Hereof, fail not, and make due return of this War- rant, with your doings thereon, to the Town Clerk, on or before said day and hour of meeting.

CONSTABLE'S RETURN


Arlington, Mass., Oct. 10, 1936.


Middlesex County :


By virtue of this warrant I have notified and warned the legal voters of the Town of Arlington to meet at the time and place and for the purposes herein named by causing a printed attested copy of the same to be left at every dwelling house in the Town, and by posting an attested copy at the doors of the Town Hall seven days at least before said day of meeting and by posting attested copies in two or more conspicuous places in each voting precinct in the Town. A notice of the time, place and objects of the meeting was published in the local papers.

SPECIAL TOWN MEETING


Arlington, Mass., Oct. 19, 1936.


Pursuant to the Warrant of the Selectmen served according to law upon the inhabitants of the Town of Arlington, by a Constable of the said Town, and notices sent by mail by the Town Clerk seven days before the day of meeting to the Town Meeting Members duly elected and qualified to act in Town Meetings in Arlington, the Town Meeting Members met at the Robbins Memorial Town Hall in said Town on Monday, October 19, 1936, at eight o'clock in the evening.

Lists of the duly qualified Town Meeting Members were used at the entrance of the meeting place and were in charge of Philip T. Robinson and James E. Sweeney.


The check lists filed with the Town Clerk at the close of the meeting showed that one hundred and sixty-one members attended the meeting.


James C. Carr, stenographer, was sworn by the Town Clerk to impartially and correctly report the proceedings of the meeting to the best of his ability.


The Moderator called the meeting to order at 8:20 P.M.


The Moderator asked if there were any Town Meeting Members who had not already been sworn to stand, ap- parently all had been sworn.


There being no objections, the Board of Selectmen, clerk of the Board, Chairman of the Board of Public Works, and the Town Counsel, were permitted to sit within the voting enclosure.


The Clerk read the call and the Constable's Return of the Warrant, the reading of the remainder of the War- rant being waived by the unanimous consent of the meeting.


On motion of Chairman Davis:


Voted: (Unanimously) That if all the business of the meeting as set forth in the Warrant is not disposed of on this date the meeting adjourn to Monday, October 26, 1936, at 8 o'clock P.M.


On motion of Chairman Davis:


Voted: That Article 1 be taken up.

Article 2 taken up. (Reconstruction of Bridge over Mystic River in Medford and Arlington)


Voted: (Unanimously) That the sum of eight thous- and forty-six and 60/100 (8,046.60) dollars be and hereby is appropriated for the purpose of making the payment required to be made by the Town under the provisions of chapter 377 of the Acts of 1936 enitled "An Act Pro- viding for the reconstruction of a Bridge and its Ap- proaches over the Mystic River in the City of Medford and the Town of Arlington," other than the proportionate part of the cost payable on account of the Town's member- ship in the Metropolitan parks district (said bridge being at Medford St.); that said sum be taken from available funds now in the Treasury and expended under the direc- tion of the Board of Selectmen.

Article 3 taken up. (Additional Appropriations: Public Welfare, Old Age Assistance, State and Military Aid.)


Voted: (Unanimously) That the following amounts be appropriated to meet expenditures for public welfare, old age assistance and state and military aid :


a) Public Welfare, aid . $30,000.00


b) Old Age Assistance. 8,000.00


c) State and Military Aid 1,000.00


and that to meet said appropriations the treasurer, with the approval of the selectmen, be and hereby is authorized to borrow the sum of thirty-nine thousand dollars, and to issue a note or notes of the Town therefor, all in accordance with the provision of Chapter 49 of the Acts of 1933, as amended by Chapter 300 of the Acts of 1935 and Chapter 281 of the Acts of 1936; and that all said amounts be ex- pended under the direction of the Board of Selectmen.


There being no further business under Article 3 the Moderator declared Article 3 disposed of.

Mr. Bixby presented the following report of Progress.


REPORT OF THE COMMITTEE ON PLAYGROUNDS TO THE SPECIAL TOWN MEETING ON OCTOBER 19, 1936


The Committee of ten members appointed by the Moderator to consider playgrounds in the town expects to

submit a complete report with definite recommendations at the next annual town meeting.


Our committee has held six meetings as a whole com- mittee and its members as sub-committees have investi- gated the need of playgrounds in all sections of the town. We have been making a study of the situation on the basis of the recommendations of the National Recreation Association which states that no child should walk over a half mile to a playground.


We find a great need of playgrounds in various sections.


The impending improvement in building conditions warrants the belief that much of our vacant land will be soon unavailable and we feel that there is the urgent necessity to purchase suitable sites while the price is still reasonable. We shall report on this matter in more detail in March.


We also believe that in some manner there should be a more unified control of playground and recreational activities in the town.


The Committee makes this report as one of progress and is considering the situation not only as to the present but as to the future development of our community.

Voted: (Unanimously) That the additional sum of five thousand (5,000) dollars be and hereby is appropriated for the removal of ashes, offal and rubbish; that for this purpose the sum of four thousand two hundred (4,200) dollars be taken from the unexpended balance of the appropriation made for the construction of ways by vote passed March 27, 1935, under article twenty (20) of the warrant for the annual meeting of 1935 and the sum of eight hundred (800) dollars be taken from the unexpended balance of the appropriation made for the construction of ways by vote passed April 15, 1936, under article twenty- two (22) of the warrant for the annual meeting of this year; and that said appropriation hereby made be ex- pended under the direction of the Board of Public Works.


There being no further business under Article 4 the Moderator declared Article 4 disposed of.


Article 5 taken up. (Extension of Water Mains in Pleasant View Road and Brunswick Road)


Voted: (Unanimously) That the sum of three thou- sand two hundred (3,200) dollars be and hereby is appro- priated for the extension of water mains in Pleasant View Road and Brunswick Road; that for this purpose the sum of three thousand two hundred (3,200) dollars be taken

from the unexpended balance of the appropriation made for the construction of ways by vote passed April 15, 1936, under article twenty-two (22) of the warrant for the annual meeting of this year; and that said appropriation hereby made be expended under the direction of the Board of Public Works.


There being no further business under Article 5 the Moderator declared Article 5 disposed of.


Article 6 taken up. (Extension of Water Mains and Sewerage System; Land Situate Concord-Appleton Street.


The following substitute motion of Chairman Davis being put before the meeting was lost by a standing vote, 56 voting in the affirmative and 92 in the negative, Messrs. Felix Cutler, Richard Donovan, and Roderick Peters acting as tellers.


That the sum of five thousand nine hundred thirty- eight and 95/100 (5,938.95) dollars be and hereby is appropriated for the extension of the sewerage system, including land damages, in the parcel of land fifteen (15) feet in width, the center line of which is described sub- stantially in article 6 of the warrant and that the further sum of fourteen thousand sixty-one and 05/100 (14,061.05) dollars be and hereby is appropriated for the extension of water mains, including land damages, in the said parcel of land; that the Board of Public Works be and hereby is authorized and empowered on behalf of the Town to purchase or take by eminent domain or otherwise acquire the rights or easements in said parcel to construct, lay, alter, renew, repair and forever maintain and operate a sewer or sewers therein and to construct, lay, alter, renew, repair and forever maintain and operate water works therein, and in connection with such sewers and/or water works (a) to construct, alter, renew, repair and forever

maintain and use pipes, drains, manholes, pumps, fixtures, attachments and appurtenances, (b) to remove such rocks, stones and soil as may be necessary or proper, (c) to replace materials therein and thereon, and (d) to do any and all other acts and things necessary, convenient or things proper in carrying out or in connection with the foregoing; and that said sums be taken from unappro- priated free cash now in the treasury and expended under the direction of the Board of Public Works.


The recommendation of the Finance Committee being put before the meeting it was


Voted: That under article six (6) of the warrant, the Town do not make any appropriation for the extension of water mains or for the extension of the sewerage system; do not authorize the acquisition of any land, easements or rights relating to any such extension; and do not make any appropriation for such acquisition.


There being no further business under Article 6 the Moderator declared Article 6 disposed of.


Article 7 taken up. (Transfer of Cemetery Funds)


Voted: (Unanimously) That the sum of two hun- dred seventy (270) dollars be transferred from (Mt. Pleasant Cemetery) Sale of Lots and Graves Fund to the (Mt. Pleasant Cemetery) Perpetual Care Fund; and that the sum of seventy-five (75) dollars be and hereby is appropriated for the acquisition of lot No. 664 on Mystic Avenue or rights therein in said cemetery, said sum to be taken from said Sale of Lots and Graves Fund; and that the Board of Cemetery Commissioners be and hereby is authorized to do whatever may be necessary or proper to effectuate such transfer and acquisition.

Article 8 taken up. (Zoning)


The Planning Board presented the following report:


Arlington, Mass., Oct. 19, 1936.


To the Town Meeting, Arlington, Massachusetts.


In connection with the proposed modification or amendment of the Town's "Zoning By-Law" so-called, relating to premises situated on the Cambridge-Concord Highway and Park Ave. in Arlington, as more particularly set forth in Article No. 8 of the Warrant for the meeting of October 19, 1936, the Planning Board reports as follows:


The said Board received a petition for the said pro- posed modification or amendment on September 28, 1936.


The said Board held a public hearing upon the matter of such proposed amendment at the Hearing Room in the Robbins Memorial Town Hall on October 8, 1936, public notice of which hearing was first given by publication in the Arlington Advocate of October 1, 1936, a copy of which is attached hereto.


The area in question is almost entirely surrounded by a residential development and there is no indication but that the future growth will be of the same character. Investigation indicates that the service requirements of the neighborhood are being satisfactorily met at the present time and inasmuch as the owner of this property was the only one appearing in favor of this change while there was strong opposition from the residents of this

locality, the Planning Board feels, that no justification for the change has been shown at this time.


The Planning Board recommends that no change be made.
