That this article be referred back to the Committee for further study and report; that the sum of $500.00 be and hereby is appropriated for their use in obtaining expert con- sulting engineering advice. Said sum to be raised by general tax. And the Committee be increased by the addition of the Chairman and Secretary of the Planning Board.


Mr. Harris offered an amendment to the substitute mo- tion which was acceptable to Mr. Hayes, and on being put to a vote was declared carried. The substitute motion as offered by Mr. Hayes and amended by Mr. Harris was then put to a vote and declared carried; and on motion, duly made and seconded, it was

Voted : That the Town do not amend its Zoning By-Law by altering the zoning map therein referred to so as to include in a Business District the area now included in a Single Resi- dence District as more particularly described and set forth in Article 40 of the Warrant for the Annual Town Meeting of March, 1938.


There being no further business under Article 40, the Moderator declared Article 40 disposed of.


Article 41 taken up. Annual Rental for Arlington Post 1775, V. F. W.


On motion duly made and seconded, it was unanimously


Voted: That the sum of four hundred (400) dollars be and hereby is appropriated for the purpose of providing head- quarters for Arlington Post 1775, Veterans of Foreign Wars of the United States; and that said sum be raised by general tax and expended under the direction of the Board of Select- men.


There being no further business under Article 41, the Moderator declared Article 41 disposed of.


Article 42 taken up. Annual Rental for Arlington Chap- ter No. 49, D. A. V.


The Finance Committee recommended the following:


"That the Town do not provide headquarters for Arlington Chapter No. 49, Disabled American Veterans of the World War and that no appropriation be made for such purpose," but

Article 43 taken up. Bath House at Heights Reservoir.


Mr. Hooley offered the following substitute motion, which was duly seconded.


"That the Town appropriate the sum of two thousand five hundred dollars ($2,500) for the erection of a building to be used as a public bath house upon land of the Town adjoining the beach at the Reservoir at Arlington Heights, said sum to be raised by general tax and expended under the direction of the Board of Park Commissioners ;


And on being put to a vote it was carried.


Mr. Murphy offered a motion to amend Mr. Hooley's sub- stitute motion by adding, "That the bath house be built on a competitive bidding basis," and on motion, duly made and seconded, it was declared carried; and thereupon, on motion duly made and seconded, it was

Article 44 taken up. Amendment to By-Laws of the Town.


Mr. McManus offered the following substitute motion :


Strike out 'Article 8, Section 1, Town By-Laws, Finance Committee, and substitute therefor the following :


ARTICLE 8


FINANCE COMMITTEE


Section 1. The Advisory Committee to be called the Finance Committee, shall be composed of fourteen registered voters of the Town, one from each of the fourteen precinct, who shall be appointed promptly by the Town Meeting Members in each precinct in not less than forty days from the date of the annual election. In every precinct the Town Meeting Mem- bers from that precinct shall, before the expiration of forty days after the date of the annual election appoint one voter of the precinct for appointment to said committee. Such name shall be chosen by written or printed ballot at a regular meeting of such Town Meeting Members or at a special meet- ing thereof called for the purpose by their chairman, by the Town Clerk or in such other manner as such members shall determine; shall be so chosen from names presented by a nominating committee and/or by any such member; and shall be the name of the person receiving the largest number of votes.


On being put to a vote the Moderator was in doubt as to the result and called for a standing vote, resulting in 55 voting yes and 99 no, and the Moderator declared the motion lost.

Voted: That the Town do not amend its by-laws by strik- ing out Section 1 of Article 8 relating to the Finance Com- mittee and inserting in place thereof the proposed section set forth in Article 44 of the Warrant.


Mr. Hennessy offered the following substitute motion, which was duly seconded :


"That a committee of five be appointed by the Moderator to study the by-law of the Town relating to the Finance Com- mittee for the purpose of drawing up a model by-law; said committee to report at the next Annual Meeting";


And on being put to a vote the Moderator declared it lost.


There being no further business under Article 44, the Moderator declared it disposed of.


Article 45 taken up. Regulation of Hours for Barber Shops.

Voted : That no action be taken under Article 45 of the Warrant.

The ballots were counted by the election officers in the voting places, the tally sheets and total tally sheets prepared by the Town Clerk being used.


The ballots after being counted were sealed in their en- velopes, placed in their respective boxes, locked and sealed and by direction of the Town Clerk were returned to the vault at the Police Station to be preserved during the time required by law.


Messrs. Clarence Needham, Timothy J. Buckley, and Ar- thur W. Sampson assisted the Town Clerk in canvassing the returns as made by the election officers. The result was as follows :
