Article 80. (Reconstruction - Crosby School.)


By general consent, the motion of the Finance Committee under Article 80 was considered withdrawn, and on the new motion of Town Manager Monahan, which was seconded, it was


VOTED: That the additional sum of Sixty-Seven Thousand Dol- lars ($67,000.) be and hereby is appropriated for the purpose of re- constructing the Crosby School including any and all alterations, repairs, renovations and improvements, including furnishings and equipment; said sum to be raised by general tax and expended under the direction of the School Committee and the Town Manager.


There being no further business under Article 80, the Moderator declared it disposed of.


Article 81. (Heating Unit - Parmenter School.)


On the substitute motion of Carl F. Allen, Chairman of the School Committee, to amend the motion of the Finance Committee, which was seconded and was declared by the Moderator to have carried, it was


VOTED: That the sum of $12,900. be and hereby is appropriated for the purpose of providing for the conversion to oil of the present boilers and to provide an incinerator and gas water heating unit at the Parmenter School; said sum to be raised by general tax and expended under the direction of the School Committee, the Town Manager and the Parmenter Building Committee.


There being no further business under Article 81, the Moderator declared it disposed of.

After lengthy discussion of the substitute motion presented under Article 79 by Carl F. Allen, Chairman of the School Committee, at the meeting on March 25, 1955, which was declared by the Moderator to have carried, it was


VOTED: That the sum of $24,200. be and hereby is appropriated for the purpose of providing new oil-burning boilers and an incinera- tor at the Crosby School; said sum to be raised by general tax and expended under the direction of the School Committee and the Town Manager.


There being no further business under Article 79, the Moderator declared it disposed of.


Article 82. (Acquisition of Land for School Purposes - Pleasant Street and Academy Street.)


VOTED: ( Unanimously) That the School Committee be and hereby is authorized and empowered on behalf of the Town to purchase or take in fee by eminent domain or otherwise acquire for school purposes, all or any portion of the land within the Town (with or without the buildings thereon) hereinafter described, any interest or easements therein, and any rights or easements of way or otherwise as appurtenant thereto, and subject to or with any reservations or any rights or easements therein, said land being bounded and described as follows:


FIRST PARCEL: Beginning at the westerly corner of the premises numbered 129 Pleasant Street thence northeasterly on the bound- ary line between premises numbered 129 Pleasant Street and premises numbered 54 Academy Street a distance of 77.05 feet to a point, thence southeasterly through said premises numbered 129 Pleasant Street a distance of 93.20 feet to an angle point, thence southwesterly through said premises numbered 129 Pleasant Street a distance of 66.16 feet to the easterly corner of the Par- menter School lot, thence northwesterly by said school property distances of 92.46 feet and 15.9 feet respectively to the point of beginning and containing about 7,150 square feet.

That the School Committee be and hereby is authorized and empowered on behalf of the Town to purchase or take in fee by eminent domain or otherwise acquire for school purposes, all or any portion of the land within the Town (with or without the buildings thereon) herein- after described, any interest or easements therein, and any rights or easements of way or otherwise as appurtenant thereto, and subject to or with any reservations or any rights or easements therein, said land being bounded and described as follows:


Beginning at a point on the northwesterly side line of Tufts Street 127.13 feet northeast of a point of tangency at Massachu- setts Avenue thence North (31°-16'-33") thirty-one degrees - sixteen minutes - thirty-three seconds west through Lot B a distance of 146.40 feet to an angle point thence north (59°-30'-27") fifty-nine degrees - thirty minutes - twenty-seven seconds east and by Lots 82A, 81 and 80 a distance of 106.25 feet to an angle point thence south (30°-30'-53") thirty degrees - thirty minutes - fifty-three seconds east by land of Town of Arlington a dis- tance of 144.96 feet to the northwesterly side line of Tufts Street thence south (58°-43'-27") fifty-eight degrees forty-three minutes - twenty-seven seconds west on said northwesterly side line of Tufts Street a distance of 104.31 feet to the point of begin- ning and containing 15,336 square feet and being a portion of Lot B shown on Land Court Plan 8906B.

Article 84. (Arlington Heights Reservoir Beach.)


On the substitute motion of Arthur D. Saul, Jr. of the Finance Committee to amend the motion of the Finance Committee, which was seconded and was declared by the Moderator to have carried, it was


VOTED: That the sum of one thousand five hundred (1500) dollars be and hereby is appropriated for the purpose of obtaining technical skill and advice to improve the quality of the water and swimming facilities, and to determine whether there is adequate water supply in gravel sub stratas to remedy supply and color of water in the area of the Arlington Heights Reservoir; said sum to be raised by general tax and expended under the direction of the Town Manager and the Committee relating to swimming conditions at Arlington Heights Reservoir Beach appointed under Article 81 of the Annual Meeting of 1954.


There being no further business under Article 84, the Moderator declared it disposed of.


Article 85. (Appointment of Committee - Arlington Brotherhood Committee. )


On the substitute motion of Margaret H. Spengler of Precinct 8 to amend the proposed resolution of the Finance Committee, which was seconded and was declared by the Moderator to have carried, it was


VOTED: That the Town appoint a committee to be known as the Arlington Brotherhood Committee, the purposes of which shall be to promote understanding and amicable relations between persons and groups, juvenile and adult, in the Town and to advise and assist other agencies, both public and private, concerned with such matters; said committee to consist of seven (7) citizens of the Town of Arlington who shall be appointed by the Moderator and who shall serve without compensation and shall, so far as practicable, be so selected as to provide representation on the committee of all major racial, religious and economic interests in the Town; the initial appointments to said committee to be made in the manner following: two (2) members to be appointed to serve for a term of one year, two (2) for a term of two years and three (3) for a term of three years and until their respective successors are appointed, and there- after the Moderator to appoint annually such number of members as there are terms expiring in such year to serve for a period of three years and until their successors shall be duly appointed and qualified, vacancies to be filled by appointment in the same manner as original appointments for the period of the unexpired term, said committee to choose annually from its members such officers as it shall deem desirable; and for this purpose the sum of One Hundred ($100.00) dollars be and hereby is appropriated for the use of said committee; said sum to be raised by general tax.


There being no further business under Article 85, the Moderator declared it disposed of.

Article 86. (Amendments - Town Manager Act.)


VOTED: That the Moderator be and hereby is authorized and empowered to appoint a committee of five (5) registered voters of the Town to investigate, study, consider and make recommendations of amendments to Chapter 503 of the Acts of 1952 entitled An Act Estab- lishing A Town Manager Form of Government for the Town of Arlington; said committee to report its recommendations to the Town at the next Special Town Meeting, if any, but not later than the Annual Town Meeting of 1956; and that the sum of fifty ($50.00) dollars be and hereby is appropriated for the necessary expenses to be incurred by said committee; said sum to be raised by general tax.


There being no further business under Article 86, the Moderator declared it disposed of.


Article 87. (Appointment of Committee Re - Town's By Laws.)


VOTED: That the Moderator be and hereby is instructed to appoint a committee of five (5) registered voters of the Town, for the purpose of studying, investigating, considering and making recom- mendations for the revision of the By-Laws of the Town of Arlington; said Committee to report at the next Special Town Meeting, if any, but not later than the Annual Town Meeting of 1956; and that the sum of one hundred (100) dollars be and hereby is appropriated for the use of said committee; said sum to be raised by general tax.


There being no further business under Article 87, the Moderator declared it disposed of.


Article 88. (Advertising Town By-Laws.)


VOTED: That the sum of one hundred seventy five (175) dollars be and hereby is appropriated for the purpose of defraying the expense of advertising and other costs relating to the By-Laws voted at this meeting; said sum to be raised by general tax and expended under the direction of the Town Clerk.


There being no further business under Article 88, the Moderator declared it disposed of.


Article 89. (Ornamental Lighting - Christmas Holiday Season.)


VOTED: That the sum of three thousand two hundred fifty (3,250) dollars be and hereby is appropriated for the purpose of providing ornamental and additional light to the Town during the Christmas Holiday Season; said sum to be raised by general tax and expended under the direction of the Town Manager.


There being no further business under Article 89, the Moderator declared it disposed of.

Article 90. (Proposed Alteration of Zoning Map - Area off Garden Street. )


William R. Dunn reported for the Planning Board on this article and on his motion, it was


VOTED: (Unanimously) That the Town amend its Zoning By- Laws and alter the Zoning Map by including in the Industrial District the area now included in the Residence B District, bounded and described as follows:


Beginning at a point at the southwesterly end of the boundary line between lots 25 and 26, said point being 185 feet easterly of the easterly side line of Mystic Street, thence northeasterly on the boundary line between lots 25 and 26 a distance of 98.8 feet to the westerly side line of Garden Street, thence southeasterly along the westerly side line of Garden Street, a distance of 12.8 feet to the southeasterly boundary line of lot 25, thence south- westerly along the southeasterly boundary line of Lot 25 a dis- tance of 99.38 feet to the southwesterly boundary line of Lot 25, thence northwesterly along the southwesterly boundary line of Lot 25 a distance of 70 feet, thence turning and running north- easterly along the boundary line of Lot 25 a distance of seven feet more or less to the point of beginning.


There being no further business under Article 90, the Moderator declared it disposed of.


Article 91. (Proposed Alteration of Zoning Map - Area in Rear of Massachusetts Avenue, between Daniels Street and Richardson Avenue. )


William R. Dunn reported for the Planning Board on this article and on his motion, it was


VOTED: (Unanimously) That the Town amend its zoning by- laws by altering the zoning map therein referred to so as to include in the Residence C District the area now included in the Residence B District, consisting of a portion of land in the rear of a lot on Massa- chusetts Avenue, as shown on Assessors' Block Plan 165-E-9, between Daniels Street and Richardson Avenue, bounded and described as follows:


Beginning at the point southwesterly of the intersection of the corner of lot 6A and lot three thence running northeasterly by lot 6A a distance of fifty feet to the sideline of lot seven and part eight, thence along the sideline of lot seven and part eight a distance of sixty one feet plus or minus thence turning and going southwesterly a distance of fifty feet to a point on the sideline of lot one thence along the sideline of lot one and three

southeasterly a distance of sixty one feet plus or minus to the point of beginning containing 3050 sq, feet plus or minus.


There being no further business under Article 91, the Moderator declared it disposed of.


Article 92. (Proposed Alteration of Zoning Map - Area off Norcross Street. )


William R. Dunn reported for the Planning Board on this article and on his motion, it was


VOTED: (Unanimously) That the Town amend its Zoning By- Laws and alter the Zoning Map by including in the Residence C District the area now included in the Residence B District, and bounded and described as follows:


Northeasterly by Norcross Street, 100 feet;


Northwesterly by Lot 15 as shown on a plan hereinafter men- tioned, 193.50 feet;


Northeasterly again by said Lot 15 as shown on said plan, 24 feet;


Northwesterly again by Heath Road, as shown on said plan, 313.44 feet;


Southwesterly by Lots 17, 18 and 19 as shown on said plan, 146.61 feet;


Southeasterly by Lots 6 and 7, by Hilton Street and by Lot 20, as shown on said plan, 266.30 feet;


Northeasterly again by Lot 18 as shown on said plan, 22.38 feet; and Southeasterly again by said Lot 18, as shown on said plan, 214 feet.


Said premises being shown on a plan entitled, "Plot Plan in Arling- ton", dated January 9, 1955, by Kenneth B. Oates, C. E.


There being no further business under Article 92, the Moderator declared it disposed of.


Article 93. (Proposed Alteration of Zoning Map - Area in Rear of Broadway, between Silk Street and Sunnyside Avenue.)


William R. Dunn read the report of the Planning Board recom- mending the approval of the amendment to the Town's Zoning By-Laws.

Allan Roy Kingston of Precinct 9 moved, and it was seconded, to amend the motion of the Planning Board under Article 93 by substituting in place thereof the following:


"That the Town amend its Zoning By-Laws by altering the zoning map therein referred to so as to include in the Business A District the area now included in the Residence B District, and bounded and described as follows:


Beginning at a point on the northwesterly property line of lots situated on the northwesterly side of Sunnyside Avenue, said point being a distance of 100 feet perpendicularly from the north- easterly side line of Broadway and being the point of intersection of, said northwesterly property lines and a line 100 feet from and parallel to the northeasterly side line of Broadway; thence north- easterly along the said northwesterly property lines, the said northwesterly lines being 110 feet from and parallel to the said northwesterly side line of Sunnyside Avenue, a distance of 303.45 feet to a point, said point being the intersection of the north- westerly property line of Lot C and the southwesterly property line of lot 50; thence northwesterly along the southwesterly prop- erty lines of lots 50, 49, R, 47 and Pt. 17, a distance of 212.75 feet to a point, said point being the intersection of the southwesterly property lines of lot 17 and the southeasterly property line of lot 9; thence southwesterly along the southeasterly property lines of lots 9, 10, 11, 12, 13, 14, a distance of 300 feet to a point, said point being the intersection of the southeasterly and southwest- erly property line of lot 14; thence northwesterly along the said southwesterly property line of lot 14 a distance of 92.10 feet to the southeasterly side line of Silk Street; thence southwesterly along said line of Silk Street 48.29 feet to a point, which point is on the line previously designated as being parallel to Broadway and 100 feet therefrom; thence southeasterly along said line, said line also being the division line of the Business A District and the Residence B District, a distance of 298.31 feet to the point of beginning and containing 71,394 square feet more or less area, all as shown on Block Plan No. 33 on file in the office of the Town Engineer, Arlington, Massachusetts."


Considerable discussion ensued and, after the motion of Mr. King- ston to amend was carried, a standing vote was taken on the motion of the Planning Board as amended. 83 having voted in the affirmative and 78 in the negative - less than the required two-thirds, the Moder- ator declared the motion - as amended - lost.


There being no further business under Article 93, the Moderator declared it disposed of.


Article 94. (Amendment Town By-Laws Re - Motor Boats on Spy Pond.)


On the substitute motion of Robert F. Douglas of Precinct 4 to amend the motion of the Finance Committee, which was seconded and was declared by the Moderator to have carried unanimously, it was

VOTED: (Unanimously) That the Moderator be and hereby is authorized and empowered to appoint a committee of seven (7) to consist of the Chief of Police, a representative of the Kelwyn Manor Association, a representative of the Spy Pond Rod and Reel Associ- ation, a qualified engineer and three qualified registered voters, said committee to investigate, study, consider and make recommendations of amendments to the By-Laws of the Town, if they deem necessary, in regard to the aquatic activities and allied conditions on Spy Pond and any other pertinent matters which their investigations may dis- close; said committee to report at the next Special Town Meeting, if any, but not later than the Annual Town Meeting of 1956.


There being no further business under Article 94, the Moderator declared it disposed of.


Article 95. (Erection of a Housing Project.)


VOTED: That no action be taken under Article 95 of the War- rant.


There being no further business under Article 95, the Moderator declared it disposed of.


Article 96. (Headquarters for Lt. Stanley G. Benner Detachment, Marine Corps League of Arlington.)


VOTED: That in accordance with Chapter 40, Section 9 under the General Laws of Massachusetts, as amended by Chapter 409 of the Acts of 1946, the sum of nine hundred (900) dollars be and hereby is appropriated for the purpose of providing headquarters for the "Lt. Stanley G. Benner Detachment, Marine Corps League of Arlington"; and that said sum be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 96, the Moderator declared it disposed of.


Article 97. (Appropriation of Available Funds.)


VOTED: : (Unanimously) That the sum of three hundred and fifty thousand (350,000) dollars voted for appropriations heretofore made under the Warrant for this meeting, and not to be borrowed or to be taken from available funds or from balances of special appro- priations made in other years, shall be taken from any available funds in the Treasury; and that the Assessors be instructed to use free cash in the Treasury in any available funds to that amount in the determi- nation of the, 1955 tax rate.


There being no further business under Article 97, the Moderator declared it disposed of.

To the Citizens of Arlington:


The following annual report of the Town Clerk for the year ending December 31, 1955, is herewith submitted, in accordance with the Town's By-Laws.


The total of fees collected by the department during the year, and deposited with the Town Treasurer, was $14,893.55, an increase of $1,061.56 over the revenue collected in the preceding year. Of this amount, $4,095.25 was for conservation licenses and $4,729.00 was for dog licenses.
