GENERAL LAWS, CHAPTER 207


Section 36. If a marriage is solemnized in another state between parties living in this Commonwealth, who return to dwell here, they shall within seven days after their return, file with the clerk or re- gistrar of the town where either of them lived at the time of their marriage, a certificate or declaration of their marriage including the facts required in a notice of intention of marriage.


Section 55. Whoever violates Section 36 shall forfeit ten dollars.


The Town Clerk hereby gives notice that he is prepared to fur- nish parents, householders, physicians and registered hospital med- ical officers applying therefor with blanks for return of births as re- quired by law.

The attention of owners and keepers of dogs is called to the fol- lowing extracts from Chapter 140 of the General Laws as amended by Chapter 320, Acts of 1934.


Section 137. The owner or keeper of a dog which is three months old or over shall annually, on or before March thirty-first, cause it to be registered, numbered, described and licensed for one year from April first following . .. in the office of the clerk . .


The owner or keeper of a licensed dog shall cause it to wear around its neck or body a collar or harness of leather or other suitable ma- terial, to which shall be securely attached a tag ..... and upon which shall appear the license number, the name of the town issuing such license and the year of issue.


Section 138. The owner or keeper of a dog may at any time have it licensed until April first following; and a person who after April first becomes the owner or keeper of a dog which is not duly licensed, and the owner or keeper of a dog which becomes three months old after March thirty-first in any year, shall, when it is three months old, cause it to be registered, numbered, described, licensed, collared or harnessed and tagged as required by Section 137.

ANNUAL TOWN MEETING, FEBRUARY 18, 1935


At a legal meeting of the inhabitants of the Town of Westford, qualified by law to vote in Town affairs, held at the Town House, Monday, February 18, 1935, the following business was transacted:


Roger H. Hildreth, Town Moderator, was sworn in by the Town Clerk, Charles L. Hildreth, and called the meeting to order.


1. Voted to reject the report for the fiscal year of 1934 made by the Westford Water Company, Inc., and that in lieu thereof said Company shall file with the Board of Selectmen on or before April 1st, 1935, an attested copy of the certificate of business condition filed by said Company with the Secretary of State for the fiscal year of 1934.


Voted that the Reports of the Finance Committee, other Committees, Boards and Officers, with the exception of the West- ford Water Company report, be accepted as printed.


2. Voted that the compensation of the Town Officers be as follows: Selectmen, Chairman $135.00; Other two $115.00 each; Board of Public Welfare, Chairman $15.00, Other two $10.00 each; Town Treasurer $450.00; Town Clerk $90.00; Collector of Taxes .675 of 1% of amount collected; Tree Warden $.53 per hour; Asses- sors $4.50 per day.


3. Voted that under this article each item be considered sep- arately.

A motion that the sum of $300.00 be appropriated for in- stalling a fire alarm system in the local central telephone exchange and that the Selectmen act as a Committee with the Fire Engineers on installing the same, was lost.


5. A motion that the sum of $3,440.00 be appropriated for Hydrants was lost by a vote of Yes 41; No 48.


Voted that the sum of $2,150.00 be appropriated for Hy-


drants.


6. Voted that the sum of $125.00 be appropriated for the · Sealer of Weights and Measures.


7. Voted that the sum of $80.00 be appropriated to defray the compensation and expenses of the Fish and Game Warden.


8. Voted that the sum of $750.00 be appropriated to defray the expenses of fighting Forest Fires.


9. Voted that the sum of $75.00 be appropriated to defray the expenses of the Maintenance of the Town Forest.


10. Voted that the sum of $300.00 be appropriated to defray the expenses of the Tree Warden.


11. A motion that the sum of $1,776.50 be appropriated to de- fray the expenses of the Moth Department was lost by a unanimous vote.


Voted that the sum of $350.00 be appropriated to defray the expenses of the Moth Department.


12. Voted that the sum of $4,950.00 be appropriated to defray the expenses of the Health Department; $375.00 of this amount to be used to pay the expense of milk furnished underweight and un- dernourished children.


13. Voted that the sum of $150.00 be appropriated to defray the compensation and expenses of the Cattle Inspector.


14. Voted that the sum of $5000.00 be appropriated for the Maintenance of the existing State and County Roads on condition that like amounts be contributed by the State and County respec- tively to be used in conjunction therewith.

Voted to take up the item of Town Roads and Snow and .

Voted 60 to 34 that the sum of $12,000.00 be appropriated for Town Roads.


. Voted that the sum of $7,500.00 be appropriated for Snow and Ice Removal.


Voted that the sum of $5,500.00 be appropriated to defray the Town's share of E. R. A. expenses.


Voted to take up Article 8 before taking action under Item 15 of Article 3.


8. Voted that the Welfare Board be authorized to investigate the present conditions at the Infirmary and by either letting or making other arrangements reduce the cost of maintaining the In- firmary to the Town.


3. 15. Voted that the sum of $23,000.00 be appropriated for the Welfare Department to be divided as follows: Welfare Depart- ment Expenses $18,100.00; Old Age Assistance Expenses $4,900.00.


16. Voted that the sum of $4,800.00 be appropriated for Sol- diers' Benefits.


17. A motion that the appropriation for the School Depart- ment be made under the headings as listed on page 94 of the Finance Committee's Report with a separate motion and vote for each was lost by a vote of Yes 28; No 72.


Voted that the sum of $66,000.00 be appropriated for the School Department, this sum to include the expenses of reshingling the Sargent School.


18. Voted that the sum of $2,500.00 be appropriated for Vo- cational Tuition.


19. Voted that the sum of $1,800.00 and the receipts from Dog Licenses in 1934 be appropriated for the expenses of the Public Library.


20. Voted that the sum of $175.00 be appropriated for the Care of the Common.


21. Voted that the sum of $250.00 be appropriated to defray the expenses of Commemorating Memorial Day.


22. Voted that the sum of $600.00 be appropriated to defray the expenses of publishing and distributing the Town Reports.


23. Voted that the sum of $1,500.00 be appropriated for Liabil- ity Insurance.

32. Voted that the sum of $1,430.52 be appropriated for Bills Outstanding December 31, 1934, to be divided as follows: Snow and Ice Removal $13.65; Town Clerk $38.00; Assessors $22.50; Care of Common $23.59; Welfare Department $1,125.36; Soldiers' Benefits $131.42; Health Department $76.00.


4. Voted that the sum of $10.00 be appropriated for Demon- stration Work in Agriculture and Home Economics and a Director be elected under the provisions of Section 40-45 of Chapter 128 of the General Laws. John A. Kimball was elected Director.


5. Voted that the Town allow damages to John Psarias oc- casioned by the relocation of the Tyngsboro Road and further that the sum of $150.00 be appropriated to cover the same.


6. Voted unanimously that the Town Treasurer, with the ap- proval of the Selectmen, be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the finan- cial year beginning January 1, 1935, and to issue ,a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


7. Voted that the sum of $1,000.00, this being the Town's share of the principal of the Middlesex County Tuberculosis Hospital Fund- ing Loan, Acts of 1932, bonds maturing in 1935, be appropriated, and that a further sum of $318.75 be appropriated on account of

interest and other charges on account thereof; that a further sum of $548.72 be appropriated for the Town's share of the net cost of care, maintenance and repairs of the Middlesex County Hospital including interest on temporary notes issued therefor, in accordance with Sections of Chapter 111 of the General Laws applicable thereto.

REPORT OF SELECTMEN


Citizens of Westford:


We refer you to the Highway Superintendent's report for details of the work accomplished on the highways.


The trucking for the highway and E. R. A. work was divided among the seventeen truck owners in Westford who applied.


The Tyngsboro Road was completed to the Tyngsboro town line. In completing the work it was necessary to obtain an additional al- lotment from the State and County, and we are appreciative of their favorable consideration of our request.


The State did not grant us the usual allotment for Chapter 90 maintenance. in fact we received a 33% cut, and this of course car- ried the same reduction in the County and our own appropriation.


We received an allotment under the new State Bond issue and with approval of the State Public Works Department started the recon- struction of Pine Street. The work will be finished in the spring.


The street has been widened and a drainage system installed and when completed a long needed improvement will have been accom- plished.


A notice has been received of an allotment of Federal money to be used for improvement of "Farm to Market Roads."


The money will be spent under the direction of the State Engineer- ing Department.


For the coming year we are asking for the usual allotments under Chapter 90 and Chapter 81.


The Accounts of the Town were audited by the State Division of Accounts. Owing to the length of the report submitted we are not printing it in full but present herewith a summary of the work which is a copy of the Balance Sheet submitted.


Any citizen desiring to read the report may do so as a copy will be on file at the Selectmen's Office.


We call your attention to the report of the Police Department.

REPORT OF HIGHWAY DEPARTMENT


The following is the annual report of the Highway Department for the year ending December 31, 1935.


Chapter 81, and General Highway Maintenance


During the year the usual maintenance was carried out in such a manner as to serve every portion of the Town.


My attention was especially directed toward a further extension of our gravel and oil road system, which has been increasing each year until now a comparatively few miles of dirt road remain. The sooner all the dirt roads in the Town are graveled and oiled, the better it will be because this reduces Maintenance to a minimum, and gives an excellent riding surface, and are much safer in gen- eral, because it permits a speedy removal of snow during the winter months.


Among the additions to our list of gravelled and oiled roads during 1935 are:


Leland Road-from Whitneys Hill to Main Street.


Providence Road-from Main St., to State Road at Nixons.


Chamberlain Road-Chamberlain Corner to Chelmsford Line. Howard Road-from Littleton Line to Concord Road.


Gould Road-from Gould Hill to Tyngsboro Line.


Plain 'Road-from Reginers to Nabnassett School.


Nutting Road-from Plain Road to Nuttings Cemetery.


Several new Culverts and Catch Basins were installed; corregated iron coated pipe was used.


All the dirt roads with few exceptions were scraped and others were improved.


Roads which had been broken up in various places, after the winter months, were re-shaped and then given a coat of tar.


Special Appropriations-Pine Street.


The specifications call for drainage and a 24 ft. gravel road. A trench was dug along the northerly side of the highway, and twelve inch pipe plain concrete, open joint pipe line, constructed to care for excessive water which has been so prevalent along this stretch of road. Ten catch basins were necessarily constructed.


Work was commenced in November and on December 28, practi- cally all the graveling was completed, except about two hundred feet at one end where excavation is necessary, and this will be done in the spring.

Chapter 90, Maintenance


This appropration which provides for the maintenance of all chap- ter 90 highways in the Town, again proved itself a great value in keeping these routes in excellent shape.


Among the items covered by this allotment are patching, resur- facing, dragging shoulders, maintenance of guard rails. Drainage systems and culverts are taken care of.


The Tyngsboro road was completed from the residence of Mr. Carr to the Tyngsboro Line.


This now completes the rebuilding of the entire length of the Tyngsboro road from Westford Depot to Riley's Grove, Tyngsboro.


The following is the amount of gravel and sand used on all roads during 1935.


Gravel-15,226 Cubic yards or 7,613 loads.


Sand-4,240 Cubic yards or 2,120 loads.
