ANNUAL TOWN MEETING, FEBRUARY 17, 1936


At a legal meeting of the inhabitants of the Town of Westford, qualified by law to vote in Town affairs, held at the Town House, Monday, February 17, 1936, at one o'clock P. M., the following business was transacted :


Roger H. Hildreth, Town Moderator, was sworn in by the Town Clerk, Charles L. Hildreth, and called the meeting to order.


Article 1. Voted that the reports of the Finance Committee, other Committees, Boards and Officers be accepted as printed.


Article 2. Voted that the compensation of the Town Officers be as follows: Selectmen, Chairman $135.00; other two members $115.00 each; Board of Public Welfare, Chairman $15.00, other two members $10.00 each; Town Treasurer $550.00; Town Clerk $90.00; Collector of Taxes .675 of 1% of the amount collected; Tree Warden 53 cents per hour; Assessors $4.50 per day.


Article 3. Voted that under this article each item be considered separately.


1. Voted that the sum of $6575.00 be appropriated for General Government, to be divided as follows: Selectmen $500.00; Treasurer $950.00; Town Accountant $875.00; Assessors $1,000.00; Tax Collector $1,600.00; Town Counsel $200.00; Town Clerk $350.00; Registration and Election $1,000.00; Licenses Expenses $100.00.


2. Voted that the sum of $1600.00 be appropriated for the Town Hall.


3. Voted that the sum of $4800.00 be appropriated for the Police Department and that the Selectmen be instructed to appoint another full time police officer.


Voted that the sum of $200.00 be appropriated for Street Safety Signs.


4. Voted that the sum of $3000.00 be appropriated to defray the ex- penses of the Fire Department.


5. Voted 72 to 60 that the sum of $3440.00 be appropriated to meet the expenses of Hydrant Service:


6. Voted that the sum of $125.00 be appropriated to defray the ex- penses of the Sealer of Weights and Measures.


7. Voted that the sum of $75.00 be appropriated to defray the expenses of the Fish and Game Warden.

8. Voted that the sum of $1000.00 be appropriated to defray the expenses of Fighting Forest Fires.


9. Voted that the sum of $75.00 be appropriated to defray the ex- penses of the maintenance of the Town Forest.


10. Voted that the sum of $250.00 be appropriated to defray the expenses of the Tree Warden.


11. A motion that the sum of $1783.35 be appropriated to defray the expenses of the Moth Department was lost.


Voted that the sum of $350.00 be appropriated to defray the ex- penses of the Moth Department.


12. Voted that the sum of $4825.00 be appropriated to defray the expenses of the Health Department; $375.00 of this amount to be used to pay the expense of milk furnished underweight children.


13. Voted that the sum of $150.00 be appropriated to defray the compensation and expenses of the Cattle Inspector.


14. Voted that the sum of $5000.00 be appropriated for the Main- tenance of the Existing State and County Roads on condition that like amounts be contributed by the State and County respectively to be used in conjunction therewith.


Voted that the sum of $11,500.00 be appropriated for Town Roads.


Voted that the sum of $4,000.00 be appropriated for Snow and Ice Removal.


15. Voted that the sum of $26,500.00 be appropriated for the Wel- fare Department to be divided as follows: Welfare Department Expenses $19,000.00 ($8,000.00 of this to be taken from Surplus Revenue) ; Old Age Assistance Expenses $7,500.00.


16. Voted that the sum of $5,000.00 be appropriated for Soldiers' Benefits.


17. Voted that the sum of $65,000.00 be appropriated for the School Department.


18. Voted that the sum of $2,500.00 be appropriated for Vocational Tutition.


19. Voted that the sum of $2,000.00 and the receipts from Dog Li- censes in 1935 be appropriated for the expenses of the Public Library.


20. Voted that the sum of $175.00 be appropriated for the Care of the Common.

21. Voted that the sum of $250.00 be appropriated to Commemorate Memorial Day.


22. Voted that the sum of $575.00 be appropriated to defray the expenses of publishing and distributing the Town Reports.


23. Voted that the sum of $1,500.00 be appropriated for Liability Insurance.


24. Voted that the sum of $800.00 be appropriated for Fire In- surance.


25. Voted that the sum of $1,200.00 be appropriated for the care of the Cemeteries.


26. Voted that the sum of $7,500.00 be appropriated for General Loans.


27. Voted that the sum of $2,165.37 be appropriated for Interest on General Loans.


28. Voted that the sum of $1,000.00 be appropriated for Interest on Revenue Loans.


29. Voted that the sum of $5,994.00 be appropriated for Street Lights.


30. Voted that the sum of $4,000.00 be appropriated in accordance with the provisions of Section 6 of Chapter 40 of the General Laws as a Reserve Fund.


31. Voted that the sum of $2,291.56 be appropriated for Over-Drafts of 1935.


32. Voted that the sum of $3,236.30 be appropriated to pay Out- Standing Bills of previous years to be divided as follows: Soldiers' Benefits 1932 $211.77; 1933 $653.55, 1934 $920.83, 1935 $143.92, total $1,930.07; Selectmen 1933 $12.50, 1934 $26.00, total $38.50; Election and Registration 1933 $7.50, 1934 $44.00, 1935 $12.00, total $63.50; C. W. A. 1933 $5.50, 1934 $2.00, total $7.50; Welfare 1934 $13.53, 1935 $1,098.20, total $1,111.73; Old Age Assistance 1935 $85.00


Article 4. Voted that the sum of $10.00 be appropriated for Demons- tration Work in Agriculture and Home Economics and a Director be elected under the provisions of Section 40-45 of Chapter 128 of the Gen- eral Laws. John A. Kimball was elected Director.


Article 5. Voted unanimously that the Town Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1936, and to issue a note or notes therefor, payable

within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17 of Chapter 44 of the General Laws.


Article 6. Voted that the sum of $1,000.00, this being the Town's share of the principal of the Middlesex County Tuberculosis Hospital Funding Loan, Acts of 1932 bonds maturing in 1936, be and the same is hereby appropriated, and that a further sum of $276.25 be and hereby is appropriated on account of interest and other charges on account thereof. That a further sum of $721.63 be and hereby is appropriated for the Town's share of the net cost of care, maintenance, and repairs of the Middlesex County Hospital, including interest on temporary notes issued therefor, in accordance with Chapter 111 of the General Laws applicable thereto.


Article 7. Voted that the sum of $400.00 be appropriated for Band Concerts for the current year, said concerts to be held in Forge Village, Graniteville, Brookside and Westford Centre.


Article 8. Voted that the Selectmen be instructed that the hiring of all trucks shall be from citizens of Westford and shall be divided equal to all and not more than one truck to any company, corporation or individual.


Article 9. A motion to dismiss the article relative to the installa- tion of additional street lights was lost.


Votedto take up each light separately.


Voted to instal an additional light on the Boston Road near the house of Edwin B. Currier.


Voted not to instal a light at the junction of the Forge Village Road and Patten Road.


Voted not to instal a light at the culvert on the Patten Road.


Voted to instal a light on the Lowell Road in front of the Club House of the Fish and Game Association.


Voted that the sum of $36.00 be appropriated for the two addition- al street lights voted under this article.


Article 3. Item 29. Voted 74 to 5 to reconsider item 29 of Article 3. Voted to rescind the vote previously taken to appropriate $5,994.00 for Street Lights.


Voted that the sum of $6,138.00 be appropriated for Street Lights.


Article 10. Voted that the Selectmen be instructed to enter into a contract with the Westford Water Company for two additional hydrants on North Street.

A motion that the Town appropriate $80.00 for these two hydrants was lost.


Article 11. Voted that the Town accept as a gift the deed from Bertha A. Williams of land as an addition to the School House lot at Brookside and that a vote of thanks be extended to those who contribut- ed to the purchase of this land and made the gift possible.


Article 12. John Fisher was elected a Member of the Committee in charge of the Whitney Playground to fill the vacancy caused by the death of Herbert V. Hildreth.


Article 13. Voted unanimously that the Town accept the devise of the land located in Westford, owned by Martina A. Gage, late of Lowell, at the time of her decease, and devised to the Town under the terms of her will, duly admitted to Probate and now on file in the Probate Office for this County, and that the Town Clerk be authorized and instructed to notify the executors of the will of said deceased of such acceptance by the Town, and further extend to the executors the appreciation of the Town for this munificent gift.


Article 14. Voted that the sum of $4,000.00 be appropriated to meet the expenses of the W. P. A.


Article 15. Voted that the sum of $6,000.00 be appropriated to meet the expenses of future W. P. A. or similar projects.


Article 16. Voted that the Selectmen be and hereby are authorized and empowered on behalf of the Town to purchase the land to enlarge Fairview Cemetery bounded on the east and south by the Cemetery, on the north by Main Street, and on the west by Tadmuck Road, at a price not to exceed $1,000.00, and voted to appropriate the sum of $1,000.00 to meet this expense, providing a Federal Project can be obtained to grade the same.


In the event, however, the Selectmen are unable to purchase said land at said price, they are authorized and instructed to make a written petition to the County Commissioners to take the same by right of eminent domain.


Article 17. Voted that a committee be appointed with full power and authority to enter into a contract with the Westford Water Com- pany on such terms and conditions as may seem advisable for water service for a period not to exceed five years, at a price not to exceed $40.00 per hydrant unless during the life of the contract the assessment be materially increased. The Moderator appointed as said Committee, W. Otis Day, Mark A. Palmer and Ben W. Drew.

Article 18. Voted that the Town accept the provisions of Section 97 of Chapter 41 of the General Laws relative to the appointment of a Chief of Police and the establishment of a Police Department by the Board of Selectmen.


Article 19. Voted that the Town authorize the Board of Selectmen to introduce on its behalf a bill in the General Court providing for the placing of the Chief of Police of the Town of Westford under the juris- diction of the Civil Service laws.


Article 20. Voted that the Town accept the bequest under the will of Albert E. Prescott, late of Boston (consisting of one-fifth of the rest and residue of the property of the deceased) for the benefit of the J. V. Fletcher Library, and that the Town Treasurer be and hereby is author- ized to receive and receipt on behalf of the Town for such bequest when the same is distributed, and further on behalf of the Town assent to the allowance of the final account of the executor of the will of said deceased.


Voted that the Town Clerk be authorized and directed to extend to the executor of the will of Albert E. Prescott, late of Boston, deceased, the appreciation of the Town for the thoughtful consideration and gen- erosity of the deceased in making this bequest for the use and benefit of his native Town.


Article 21. Voted to accept the minutes of the meeting.


Article 22. Voted to dissolve the meeting.

REPORT OF SELECTMEN


Citizens of Westford:


For the work accomplished on the highways we refer you to detailed report of the Highway Superintendent.


The trucking work for the W. P. A. and highways was appor- tioned among the owners of trucks in Westford who requested work.


This year as last, our allotment for Chapter 90 maintenance was cut by the State Department of Public Works and because of the Town's vote covering our appropriation the County and Town allot- ment was reduced in like amount each.

Late in the summer we requested and were granted an allotment from the County for the specific repairs of a section of Carlisle Road near the Carlisle Station which was settling badly and becoming dangerous.


Work is continuing on improvement to "Farm to Market Roads" under an allotment of Federal money, the work being done under the direction of the State Engineering Department.


We have been advised by the State Department of Public Works of a change in the policy regarding the highway equipment owned by towns. Hereafter repairs and upkeep of equipment cannot be charged to Chapters 90 and 81 allotment. It will be necessary for the Town to set up a special appropriation for this purpose. On the other hand the Town will receive credit for town equipment whenever it is in use. This appears to be a very fair arrangement and should work to the advantage of the Town.
