SPECIAL TOWN MEETING - JULY 29, 1965
At a legal meeting of the inhabitants of the Town of Westford, qualified by law to vote in Town affairs, held at the Town Hall on Thursday, July 29, 1965 at 8:00 P.M., the following business was transacted :
Ben W. Drew, Town Moderator, called the meeting to order and declared the presence of a quorum. The attendance was 384.
Election Officers, using voting lists, acted as Tellers at the doors.
Voted to dispense with the reading of the Warrant in its entirety.
ARTICLE 1. Voted unanimously that the Town accept a gift made to it by William E. Schlusemeyer, of a parcel of vacant land situated in Nabnasset, shown on a plan entitled "Plan of Land in Westford, Mass., belonging to William E. Schlusemeyer, compiled from existing plans and surveys, March 15, 1965, Richard L. McGlinchey", which plan is re- corded with Middlesex North District Registry of Deeds, and thus bounded :
Northerly in part by land now or formerly of one Towne et ux, in part by Salem Road and in part by land now or formerly of one Holmes et ux, a total distance of one hundred fifty- eight and 43/100 (158.43) feet;
Easterly in part by land of one Terenzio et ux and in part by Cypress Road, a total distance of one hundred twenty-six and 3/10 (126.3) feet;
Southerly in part by land now or formerly of one Dinsmore, in part by Sycamore Road and in part by land of one Crockett et ux, a total distance of one hundred fifty-two and 2/10 (152.2) feet; and
Westerly by land now or formerly of Mitchell F. Balas et ux, one hundred twenty-three and 5/10 (123.5) feet, more or less. Containing, according to said plan, 19,375 square

ARTICLE 2. Voted unanimously that the sum of $15.19 be appropriated from Unappropriated Available Funds in the Treasury for payment of the following unpaid bill of 1964: Crossroads Service Station (Fire Department 1963-1964) $15.19 Finance Committee approved.
ARTICLE 3. Voted unanimously that the sum of $9,000.00 be trans- ferred from Unappropriated Available Funds in the Treasury to the Account entitled "Veterans' Benefits."

ARTICLE 4. Voted unanimously
(a) that the Town accept as and for a Town Way,
Newport Drive as laid out by the Selectmen, as shown by their Report

Salem Road as laid out by the Selectmen, as shown by their Report and Plan duly filed in the office of the Town Clerk, said way to be known as Salem Road.
ARTICLE 5. Voted unanimously that ARTICLE V of the Town By-Laws, governing the operations of the Water Department, be amended by adding at the end of Section 5 the following new Section: -
Section 6. It shall be unlawful for any person not authorized by the Town, to turn on or shut off any Town Hydrant or to tamper with, alter or injure any such hydrant.
Voted to take up ARTICLE 10.
ARTICLE 10. Voted that the sum of Ten Thousand (10,000) Dollars be appropriated from Unappropriated Available Funds in the Treasury to defray the cost of a Master Plan of the Town to be made by the Planning Board, said sum to be expended under the supervision of said Board.

ARTICLE 6. Voted that the Town should not further amend its Protective By-Law and Protective By-Law Map by rezoning from a Residence A District to a Business District a certain parcel of land, situated in Parker Village, belonging to William D. Connell. Planning Board disapproved this Article.
ARTICLE 7. Voted that the Town should not further amend its Protective By-Law and Protective By-Law Map by rezoning from a Residence A District to a Business District a certain parcel of land, situated in Nabnasset, belonging to Lionel J. Boisvert et als. Planning Board disapproved this Article.
ARTICLE 8. Voted that the Town should not further amend its Protective By-Law and Protective By-Law Map by rezoning from a Residence A District to a Business District the following two parcels of land, belonging to Benjamin W. Drew and Sarah W. Drew: First Parcel by Interstate Route 495, land of Polesayka, Prescott, Drew and Boston Road. Second Parcel by Boston Road, land of Drew and Wilson. ARTICLE 9. Voted unanimously that the following amendments to the Protective By-Law of the Town be and they are hereby adopted:
1. Delete Section 3, Paragraph 1, Sub-Paragraph 8, which now reads as follows:
Soil, loam, sod, sand, or gravel removal not to in- clude, however, the washing or crushing of gravel and/or rock, pro- vided the use is not injurious, noxious or offensive to the neighbor- hood and provided that a permit is obtained from the Selectmen.

2. Delete that portion of Section 3, Paragraph 1, Sub-Paragraph 9, Sub-sub-paragraph 1, which reads as follows:
--- the use, by the resident of a room or rooms in a dwelling or in any accessory building for the pursuit of a home occupation, provided that no substantially continuous employment is required and that there is no external evidence of occupation other than the permitted sign.

(c) The use does not substantially change the character of the dwelling or accessory building or adversely affect the uses permitted in the residential district; and no home occupation shall be permitted when the same is objectionable due to noise, dust, smoke, odor or other causes.
(d) The use will not create substantial additional traffic or require additional parking space.
(e) An area no greater than 1/3 of the area of one floor of the dwelling structure is used for such uses.
(f) There is no externally visible evidence of such occupation other than the permitted sign.
(g) The uses shall be limited in time for a period no longer than the period of occupancy or ownership, whichever is shorter, of the premises by the applicant.
(h) No more than one commercial type vehicle shall be used or parked on the premises in connection with the home occupation.
3. Delete Section 3, Paragraph 1, Sub-Paragraph 9, Sub-sub-Paragraph 5, which now reads:
"storage of 3 commercial vehicles (except farm
vehicles)" and insert in place thereof the following:
Parking of one commercial vehicle and the storage, so as not to be visible from any street or way, of not more than two additional commercial vehicles. Nothing herein shall be construed to prohibit the parking or storage of farm vehicles.
4. Add a new Paragraph numbered 6 under Section 3, Paragraph 1, Sub-Paragraph 9 to read as follows:
The use of a room or rooms in a dwelling for a nursery school, for which part time care or instruction of less than 5 children other than those resident on the premises, whether or not for compensation.

5. Add a new Paragraph numbered 7 under Section 3, Paragraph 1, Sub-Paragraph 9 as follows:
The stabling of horses for non-commercial purposes after a permit has been issued by the Board of Health with such restrictions as it shall deem necessary.
6. Add a new Paragraph under Section 3, Paragraph 1, Sub-Paragraph 10 as follows:
Nursery School for five or more children other than those resident on the premises for the purposes of care or instruction whether or not for compensation.
7. From Section 7, Paragraph 1, which now reads as

8. From Section 9, Paragraph 1 strike wherever it appears, the word "Selectmen" and insert in place thereof the words "Building Inspector" and further strike from Section 9, Paragraph 1 the following sentences :
"They shall issue no permit for the erection or alteration of any building, or part thereof, plans and specifications and intended use of which are not in all respects in conformity with the provisions of this By-Law. No building shall be erected, externally altered or changed in use without a permit from the Board of Selectmen, for which permit the Selectmen shall charge a fee to be determined by them. With each application for a permit to build there shall be filed a plan showing the lot and the location of the building thereon."
So that Section 9, Paragraph 1 is amended to read as follows:
1. Enforcement: This By-Law shall be enforced by
the Building Inspector. The Building Inspector shall issue no permit for the construction and/or alteration of any building which creates a new dwelling unit unless written approval from the Board of Health for the sanitary disposal system or systems has first been procured. If

the Board of Health neither approves nor disapproves a written appli- cation for approval of such sanitary system within ten (10) days of the receipt thereof by the Board of Health, the Building Inspector may then issue a permit for such construction or alteration without such approval. For the purposes of this Paragraph, a dwelling unit shall be construed to mean one or more rooms arranged for the use of one or more individuals living together as a single housekeeping unit with cooking, living, sanitary and sleeping facilities."
9. Amend Section 9, Paragraph 3 so as to strike therefrom wherever it appears, the word "Selectmen" and insert in place thereof the words "Building Inspector" so that Paragraph 3 reads, as amended, as follows:
In addition to appeals by aggrieved applicants for permits, provided for by Section 13 of Chapter 40A of the General Laws, appeals may be taken to the Board of Appeals by any officer or board of the Town, or by any person aggrieved by any order or decision of the Building Inspector in violation of any provision of said Chapter 40A or any provision of this By-Law. Any such appeal shall be taken within 30 days after the date of the order or decision of the Building Inspector appealed from, by filing with the Building Inspector and the Board of Appeals a notice of appeal specifying the grounds thereof. The Board may approve or revoke the permit or affirm or reverse in whole or in part or modify the permit, order, requirement, ruling or decision appealed from so that the same shall conform to the provisions of this By-Law.

A Report was given by Lawrence S. Johnston, Chairman of the Finance Committee. Said Committee opposed to such expenditures at a Special Town Meeting and stating that it properly should be brought before an Annual Town Meeting.

Voted YES 240 and NO 4 that the Town accept the provisions of sections sixteen to sixteen I, inclusive, of Chapter seventy-one of the General Laws providing for the establishment of a Regional School District together with the Towns of Groton, Chelmsford and Littleton, and the construction, maintenance and operation of a Regional School by the said District in accordance with the provisions of a proposed agreement filed with the Selectmen.

AN ACT VALIDATING CERTAIN PROCEEDINGS TAKEN AT A SPECIAL TOWN MEETING OF THE TOWN OF WESTFORD.
Be it enacted by the Senate and House of Representatives in
General Court assembled, and by the authority of the same, as follows:
SECTION 1. The proceedings taken by the town of Westford at the special town meeting held on October fourth, nineteen hundred and sixty-five, relating to the establishment of the Vocational Regional School District consisting of the towns of Chelmsford, Groton, Littleton and Westford are in all respects validated and confirmed, notwithstanding the failure of the town of Westford to comply with the provisions of its by-laws requiring publication of a notice of said meeting.
SECTION 2. This act shall take effect upon its passage.

REPORT OF THE BOARD OF SELECTMEN
The Board of Selectmen met and organized on March 2, 1965; present were George S. Fletcher, Horace F. Wyman, John J. Kavanagh. George S. Fletcher was elected Chairman and Horace F. Wyman Secretary.
Reports submitted by departments, committees and individuals under the jurisdiction of the Selectmen appear elsewhere in the Town Report.
The Selectmen have continued the practice of holding joint meetings with various departments, boards and committees to the end of providing an open forum for the discussion of common problems affecting the present and future needs and interests of the Town. Such meetings con- tinue to be of significant value, particularly in obviating some of the controversies publicized in certain other towns of the area.
Through the concerted effort of all town officers concerned and with the cooperation of abutting owners, the Selectmen were able to secure property damage releases for the reconstruction of South Chelmsford Road, thus enabling Chapter 90 Construction work to proceed as scheduled. By thus avoiding the expense and delays experienced in many other towns, state and county reimbursement funds will be received by the Town in normal course.
After a series of meetings with the Selectmen and others, the Plan- ning Board, as authorized by vote of the Town, has engaged the services of Metcalf & Eddy to develop a Master Plan and Program for the Town. The Selectmen deem such Plan essential to the orderly development of the Town and to informed planning for the future.
The books of the Town were audited as of March 8, 1965, by state auditors, and were found to be in order.
The Selectmen accepted with regret the resignation of Carl R. Nylund as Fire Engineer. Mr. Nylund has served the Town well and faithfully for many years; and his latest special assignment was to the building com- mittee for the Nabnasset Fire House. During the year 1965, regular police officers Alvin J. Knowlton and Keith C. Kiberd resigned from the force.
The Selectmen are pleased to record, with their personal thanks, the gift of land made by Miss Marian F. Winnek for library purposes, and the gift of 18 acres of land off Groton Road made by C. G. Sargent's Sons Corporation.
In keeping with their policy of steady but not too burdensome improve- ment of the Town House, the Selectmen, as authorized by vote of the Town, have converted the old kitchen into a new office for the Police Depart- ment; and have tiled the lower hall. It is expected that in the near future demands for space will require the construction of new offices in the upper hall.
Under the federal Economic Opportunity Act of 1964, a regional non- profit corporation, called Community Teamwork, Inc., has been organized. Mr. Fletcher, as Chairman of the Board, was an incorporator and has been active in liaison work with the Lowell Office of Economic Opportunity. As requested by that office, the Selectmen appointed a Westford

Community Action Advisory Committee consisting of The Reverend William Mawhinney, Chairman, The Reverend Father Richard S. DeVeer, Secretary, Mrs. Edith M. Lowney, Director of Public Assistance, Robert A. Noy, principal of the Nabnasset School, Warren G. Michaelsen, and Raymond F. Conway . Opportunities, economic or otherwise, for the Town and its residents await the future.
The Selectmen record with sorrow the untimely death of Elroy A. Field, former Selectmen and most recently Building Inspector. "Spider", as he was affectionately known, was a devoted and able public servant. The Town and its people are the poorer for his passing.
All residents are requested to report improperly functioning or dead street lights to the Clerk of the Board or to any police officer.
The registered voters of the Town are again reminded that annual town meetings begin at ten o'clock in the morning.
