ANNUAL TOWN MEETING - MARCH 11, 1967


At a legal meeting of the inhabitants of the Town of Westford, qualified by law to vote in Town affairs, held at Westford Academy on Saturday, March 11, 1967 at 10:00 A.M., the following business was transacted :


Ben W. Drew, Town Moderator, called the meeting to order, a quorum being present.


Election Officers, using voting lists, acted as tellers at the doors. The attendance was 333.


Rev. Merlin C. Levering gave the invocation.


Voted to dispense with the reading of the Warrant in its entirety.


Alice A. Hildreth, Town Clerk, read the list of newly elected officers at the Annual Town Election of March 6, 1967. The Town Clerk then administered the oath of office to a number of the duly elected officials.


ARTICLE 1. For reports of various boards, committees and depart- ments, reference is made to the Annual Town Report.


An Informational Summary from the Board of Health was given to the Moderator and placed on file.

ARTICLE 4. Voted unanimously that the Treasurer be authorized, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue for the financial years beginning January 1, 1967 and January 1, 1968, in accordance with the provisions of Section 4 of Chapter 44 of the General Laws, and to renew any note or notes as may be given for a period of less than one year, in ac- cordance with the provisions of Section 17 of said Chapter 44. Finance Committee approved.


ARTICLE 5. Voted unanimously that the Planning Borad be and it hereby is authorized, in the name and behalf of the Town, to acquire such options as it, in its discretion, shall deem to be in the best interests of the Town for the purchase of land for minicipal use in- cluding, without limiting the generality of the foregoing, parks, municipal buildings and wild life refuges.

ARTICLE 6. Voted unanimously that the sum of $939 be raised and appropriated to pay the Town's share of the costs and expenses of the Greater Lowell Regional Planning District.

ARTICLE 7. Voted unanimously that the sum of $10, 500 be raised and appropriated to meet the Town's share of the cost of Chapter 81 Highways and that, in addition, the sum of $23,100 be transferred from Unappropriated Available Funds in the Treasury to meet the State's share of the cost of the work, the reimbursements from the State to be restored, upon their receipt, to Unappropriated Available Finds in the Treasury.

ARTICLE 8. Voted unanimously that the sum of $1, 500 be raised and appropriated for maintenance of Chapter 90 Roads, on condition that like amounts be contributed by either or both the State and County respectively, to be used in conjunction therewith and that, in addition, the sum of $3,000 be transferred from Unappropriated Available Funds in the Treasury to meet the State's and County's shares of the cost of the work, the reimbursements from the State and County to be restor- ed, upon their receipt, to Unappropriated Available Funds in the Treasury.

ARTICLE 9. Voted unanimously to dismiss this article relative to raising and appropriating a sum of money to be deposited in and become a part of the Stabilization Fund created under Article 19 of the Warrant for the Annual Meeting of 1961.


Finance Committee recommend no appropriation to this fund at this time.


ARTICLE 10. Voted unanimously that the sum of $8,500 be raised and appropriated to meet the Town's share of the cost of Chapter 90 Highway Construction, contingent upon either or both the State and County contributing towards the cost thereof, and that the additional sum of $25, 300 be transferred from Unappropriated Available Funds in the Treasury to meet the State's and County's shares of the cost of said construction, the reimbursements from the State and County to be restored, upon their receipt, to Unappropriated Available Funds in the Treasury.

ARTICLE 11. Voted unanimously that the sum of $3,662.40 be raised and appropriated for the Highway Equipment Account and, in addition, that the sum of $6,057.60 be transferred from the Highway Machinery Fund to said Highway Equipment Account.

ARTICLE 12. Voted unanimously that the sum of $3,500 be raised and appropriated for the purpose of purchasing Two New Cruisers for the Police Department, said purchases to be made under the supervi- sion of the Board of Selectmen and that the said Board be and hereby is authorized, in the name and behalf of the Town, to transfer by a good and sufficient Bill of Sale title to one or both of the cruisers now being used by said Department and to apply the sum or sums receiv- ed therefor against the purchase price of the New Cruisers.

ARTICLE 13. Voted that the sum of $300 be raised and appropri- ated for the purpose of providing suitable quarters for the Nabnas- set American Legion Post No. 437 and the Auxiliary of said Post; and the further sum of $300 be raised and appropriated for the purpose of providing suitable quarters for the Veterans of Foreign Wars Post No. 6539 and the Auxiliary of said Post; and that the further sum of $300 be raised and appropriated for the purpose of providing suitable quarters for the Frederick S. Healy American Legion Post No. 159 and the Auxiliary of said Post, all for the calendar year 1967.

ARTICLE 14. Voted unanimously that the sum of $300 be raised and appropriated for the purchase of a Water Cooler for the Town Hall, said purchase to be made under the supervision of the Board of Select- men.

ARTICLE 15. Voted unanimously that the sum of $1, 565.25 be ap- propriated from the Account entitled "State Aid for Libraries", said sum to be in addition to the amount appropriated for the J. V. Fletcher Library under Items 67 and 68 of Article 3 of the Warrant for this meeting.

ARTICLE 16. Voted unanimously that the sum of $600 be raised and appropriated for renovations to the office of the Board of Public Welfare and for the installation of new lights in said office, said project to be under the supervision of the Board of Selectmen.

ARTICLE 17. Voted unanimously that the Trustees of the J. V. Fletcher Library be and they hereby are authorized, in the name and behalf of the Town, to engage the services of an architect or Library consultant whose function shall be to advise the Trustees concerning the highest and best use to be made of the present library facilities and how and at what cost the need for future or additional library facilities may best be met to further the interests of the Town and, for the purpose aforesaid, that the sum of $1,000 be raised and ap- propriated to pay for such services and any incidental costs and ex- penses incurred in connection therewith. .

ARTICLE 18. Voted unanimously that the sum of $7,334 be raised and appropriated to pay the last installment due under the contract for the Expert Appraisal of taxable real estate voted under Article 35 of the Warrant for the Annual Meeting of 1965.

ARTICLE 19. Voted YES 103 and NO 95 that ARTICLE VI of the Town By-Laws be amended by


(1) Striking the present caption of said ARTICLE, "Dog Licenses" and inserting in place thereof the word "Dogs", and

(2) Adding after SECTION 1 the following four sections:


SECTION 2. As used in this and subsequent sections,


(a) "Owner " shall be intended to mean any person or persons, firm, association or corporation owning, keeping, or harboring a dog owned or kept in the town.


(b) "At large" shall be intended to mean off the premises of the owner, and not under the control of the owner or authorized escort either by leash, cord, chain or otherwise.


SECTION 3. No owner or keeper of any dog shall permit such dog to run at large if unlicensed, nor shall a dog be permitted to run at large at any time between the hours of 7:00 A.M. and 7:00 P.M., licensed or unlicensed. The pro- visions of this section shall not be intended to apply to dogs participating in any dog show, nor to "seeing-eye" dogs properly trained to assist blind persons when such dogs are actually being used by blind persons for the pur- pose of aiding them in going from place to place, nor to any dogs being trained for or actually being used for hunting purposes.


SECTION 4. Nothing contained in the foregoing two sec- tions shall prevent the Selectmen from passing any orders authorized by Section 167 of C. 140 at such times as they shall deem it necessary to safeguard the public.


SECTION 5. Whoever violates any provisions of this By- Law shall be punished by a fine of not more than ten dollars for each breach thereof.


ARTICLE 20. Voted unanimously to dismiss this Article relative to raising and appropriatine $5,000 for the Conservation Fund as said fund now exceeds this amount and the Commission will spend less in 1967.


Finance Committee disapproved as there is no need to build up the Fund at this time.


ARTICLE 21. Voted unanimously that the Town adopt the following By-Law: - -


ARTICLE XXI


COUNCIL ON AGING


SECTION 1. There is hereby established a Council on Aging for the purpose of coordinating or carrying out programs designed to meet the problems of the aging in coordination with programs of the Com- mission on Aging established under Section 73 of Chapter 6 of the General Laws, as most recently amended, or as the same may be here- after amended.

SECTION 2. The Council on Aging established hereunder shall con- sist of five (5) members to be appointed by the Selectmen, and all of said members shall be residents of the Town. When said Council is first established two (2) members shall be appointed for terms of three (3) years each, two (2) members shall be appointed for terms of two (2) years and one (1) member shall be appointed for the term of one (1) year ; and their successors shall be appointed for terms of three (3) years each. A vacancy occurring other than by expiration of term shall be filled in the same manner as an original appointment.


SECTION 3. The Council shall submit an annual report to the Town for inclusion in the Annual Reports and shall send a copy thereof to the State Commission on Aging. The Council may appoint such clerks and other employees as it may require.


Finance Committee disapproved this Article because of the large increase in welfare costs due to State and Federal dictation and oppose creating another agency subject to regulations out of the con- trol of the Town.


ARTICLE 22. Voted that the sum of $1,000 be raised and appropri- ated for the purpose of coordinating or conducting programs dealing with problems of the aging as authorized by Clause 49 of Section 5 of Chapter 40 of the General Laws.


Finance Committee disapproved for same reasons as given under Article 21.


ARTICLE 23. Voted unanimously that the Board of Selectmen be and they hereby are authorized to negotiate with the Boston and Maine Railroad and private owners, if necessary, for the acquisition of a new access road to the former Town Farm property now occupied by the North Middle School.


Finance Committee approved.


ARTICLE 24. Voted unanimously that the Board of Selectmen be and they hereby are authorized and directed to appoint a permanent committee of five (5) members, to be known as the Capital Outlay Com- mittee, whose function and duty whall be to make continuing surveys and studies of the needs of the Town for new public buildings or improvements, other than school buildings, and to report its findings and recommendations to the Town at least annually. When said Commit- tee is first established two (2) members shall be appointed for terms of three (3) years each, two (2) members shall be appointed for terms of two (2) years each and one (1) member shall be appointed for the term of one (1) year; and their successors shall be appointed for terms of three (3) years each. A vacancy occurring other than by expira- tion of term shall be filled in the same manner as an original appoint- ment .

/ ARTICLE 25. Voted unanimously that SECTION 5 of the Abandoned Vehicle By-Law adopted under Article 25 of the Warrant for the Annual Meeting of 1965 be amended by adding the Building Inspector as one of the enforcing authorities, so that said Section, as amended, will

read as follows:


SECTION 54 Impounding. The Building Inspector, Fire Chief, Chief of Police, Superintendent of Highways, or any member of his department designated by him is hereby authorized to remove or have removed any vehicle left at any place within the Town which reasonably appears to be in violation of this By-Law or lost, stolen, or unclaimed. Such vehicle shall be impounded until lawfully claimed or disposed of in accordance with G.L. (Ter. Ed. ), Chapter 135 relative to unclaimed or abandoned property.

ARTICLE 26. Voted unanimously that the Board of Selectmen be and they hereby are authorized to acquire by purchase, eminent domain, or otherwise, in fee simple, a certain parcel of land, containing 16.8 acres, more or less, now or formerly of James E. Farmer, situated on the northwesterly side of the New England Power Company right of way in Graniteville near the Town Highway Garage, as and for the proposed site of a new Well-Field, said premises being shown on a plan entitled, "Plan of Land in Westford, Mass., Belonging to James E. Farmer, Survey- ed in June 1966, Richard L. McGlinchey, Proposed Well Field Site, Town of Westford"; and for the purpose of acquiring said land and for all necessary and incidental expenses in connection therewith, that the sum of $1, 000 be raised and appropriated; hereby authorizing said Selectmen, in the event that said land is acquired by purchase, to accept in the name and behalf of the town a good and sufficient quit- claim deed of said premises on such terms, conditions, restrictions and reservations as they shall determine to be in the best interests of the town.

ARTICLE 27. Voted unanimously that the Planning Board be and it hereby is authorized to secure from the United States Department of Agriculture, Soil Conservation Services, a detailed soil survey for the Town, including an interpretive report, and for the purpose afore- said, that the sum or $5,150 be raised and appropriated.


Denis Maguire, Esq., Chairman of the Planning Board, gave a report on this Soil Survey and the benefits to be derived by the Town from such a project with particular regard to drainage and sewerage dispos- al for new building developments.


Finance Committee approved.


ARTICLE 28. Voted unanimously that the care, custody, manage- ment and control of that portion of the former Town Farm property situated on the southeasterly side of Prescott Street and on the east- erly and westerly sides of the Town Farm Road, be transferred from the Board of Public Welfare to the Town generally, pursuant to the provisions of Sections 3 and 15A of Chapter 40 of the General Laws, said premises being more particularly described as Parcel 'A', Parcel 'B' and Parcel 'C' on a plan entitled "Plan of Land in Westford, Mass., belonging to Town of Westford, surveyed in November, 1966, Richard L. McGlinchey", which plan is to be recorded with Middlesex North District Registry of Deeds.

ARTICLE 29. Voted unanimously that the sum of $6,000 be raised and appropriated for the repair, alteration, reconstruction or remodel- ing of the former Town Infirmary, and that the Board of Selectmen be and they hereby are authorized and empowered, in the name and behalf of the Town, to enter into and execute all contracts and agreements incidental to and in connection with said project including, but not limited to, preparation of plans and specifications and the procurement of professional services and technical advice, hereby authorizing and empowering said Board to invite all necessary bids for said project and to determine the lowest, responsible and eligible bidder from the bids submitted, approve all expenditures and vouchers for services ren- dered and for material supplied in connection with said project.

ARTICLE 30. Voted unanimously that the sum of $156.45 be raised and appropriated for payment of the following Unpaid Bills of previous years :

ARTICLE 31. Voted unanimously that the Town accept a gift of $4, 500 made to it by The Murray Printing Company and that the Town Clerk express to said Company the appreciation of the Town for said gift.

ARTICLE 32. Voted unanimously that the sum of $600 be raised and appropriated for the development of the Town Forest off of Old Lowell Road, comprising 65 acres more or less, by conservative prac- tices that will help make the area of value as a Nature and Recreation Center for all citizens of the Town, said sum to be expended by the Town Forest Committee.


Finance Committee opposed to another project similar to establish- ing a town beach at Forge Pond.


ARTICLE 33. Voted unanimously that the sum of $1, 000 be raised and appropriated for the preservation and improvement of the Forge Village and Graniteville Ball Fields, said sum to be expended by the Recreation Commission.

ARTICLE 34. Voted unanimously that SECTION 2 of the Plumbing Code of the Town be amended by adding at the end thereof the following sentence :
