Report of Special Town Meeting OCTOBER 28, 1948


In accordance with the warrant, as posted, the voters of the Town assembled in Fisk Hall, Wilbraham Academy, Wilbraham, Mass., at eight o'clock p. m., October 28, 1948. Two hundred fifty registered voters in attendance.


ARTICLE 1. Frank Auchter was elected Moderator by ballot and was sworn in by the Town Clerk.


ARTICLE 2. Voted by secret printed ballot, to accept an Act passed by the General Court in the year nineteen hun- dred and forty-eight, entitled, "An 'Act to authorize the Town of Wilbraham to borrow money for the purpose of constructing, equipping and furnishing a school building.'" Polls opened at 8 o'clock p. m. and closed at 9 o'clock p. m.

215 voted YES, 19 voted NO. Also, the report of the Board of Selectmen relative to the acceptance of the above Act was heard.


ARTICLE 3. Voted unanimously to appropriate and transfer from the unexpended balance in the Board of Health appropriation, the sum of seven hundred dollars ($700.00), to add to the Library appropriation of the cur- rent year.


ARTICLE 4. Voted unanimously to appropriate and transfer from the unexpended balance in the Water De- partment - Installations appropriation, the sum of one thousand dollars ($1,000), to add to the Miscellaneous High- ways appropriation of the current year.


ARTICLE 5. Voted unanimously to appropriate and transfer from the unexpended balance in the Water Depart- ment - Installations appropriation, the sum of five hundred dollars ($500), to add to the Town Officers' and Employees' Salaries appropriation of the current year.


ARTICLE 6. Voted to appropriate and transfer from the unexpended balance in the Water Department - Installa- tions appropriation, the sum of fifteen hundred dollars ($1,500) to add to the Old Age Assistance appropriation of the current year.


ARTICLE 7. Voted unanimously to receive the report of the Board of Selectmen relative to site location on the Town lot on Main Street for the proposed elementary school and auditorium building, and to instruct and indicate the preference at this meeting as to the choice of locations on this lot.


Voted that the proposed new school building should be located on the higher elevation site of the Town lot on Main Street. (Unanimously)


ARTICLE 8. Voted to consider new plans for school submitted by the Architects since the last Town Meeting.


Voted that the latest school plans submitted at this meeting by the Selectmen are a distinct improvement over the set previously submitted, and represent progress in the right direction.


ARTICLE 9. Voted unanimously to thank Mr. Stevens, Headmaster of Wilbraham Academy for his kindness in granting the Town of Wilbraham the use of Fisk Hall for this and other Town Meetings.

To either of the Constables of the Town of Wilbraham in the County of Hampden:


GREETING :


In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of the Town of Wilbraham qualified to vote in Town affairs to meet in Fisk Hall, Wilbraham Academy in said Town on Saturday, the twenty-sixth day of March next at 8.30 a. m. to bring in their votes for Town Officers and act on the fol- lowing articles. The polls will open at 8.30 a. m. and may be closed at 6.30 p. m. All business of said meeting and election of Town Officers except the election of such officers and the determination of such matters as by law are re- quired to be elected or determined by ballot shall be con- sidered after 10 o'clock a. m.


ARTICLE 1. To choose a Moderator to preside in said meeting.


ARTICLE 2. To choose a Moderator, a Town Clerk, a Town Treasurer, Tree Warden for the ensuing year, one Selectman for three years who shall be a member of the Board of Public Welfare, one Assessor for three years; five Constables for the ensuing year; one Auditor for the ensu- ing year; one School Committee member for three years; Town Collector for the ensuing year; one Cemetery Com- missioner for three years; one Water Commissioner for three years; one Library Trustee for three years; one Play- ground Commissioner for three years; one member of the Planning Board for five years. All on one ballot. Also all other Town Officers.


ARTICLE 3. To hear and act on reports of the Select- men, Board of Public Welfare, Treasurer, School Committee and other officers.


ARTICLE 4. To fix the compensation of all elected Town Officers for the ensuing year.


ARTICLE 5. To raise such sums of money as may be deemed necessary for defraying the expenses of the Town for the ensuing year and appropriate the same and vote how the same shall be raised.

ARTICLE 6. To see if the Town will vote to authorize the Town Treasurer with the approval of the Selectmen to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1949, and to issue a note or notes therefor payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


ARTICLE 7. To see if the Town will vote to raise and appropriate the sum of $7,050.00 or any sum for the main- tenance of Chapter 81 Roads, provided that the State con- tribute toward the same, in accordance with the provisions of Chapter 81, General Laws, or take any action relative thereto.


ARTICLE 8. To see if the Town will vote to appropriate and transfer from unappropriated available funds in the treasury the sum of $7,050.00 or any sum for the mainte- nance of Chapter 81 Roads (an amount equal and in addition to the amount appropriated under Article 7), to meet the State's share of the cost of the work, the reimbursement from the State to be restored upon receipt to unappropriated funds in the treasury.


ARTICLE 9. To see if the Town will vote to raise and appropriate the sum of $1,000.00 or any sum for the main- tenance of Chapter 90 Roads, provided the State and County contribute toward the same, in accordance with the provi- sions of Chapter 90, General Laws, or take any action rela- tive thereto.


ARTICLE 10. To see if the Town will vote to appropri- ate and transfer from unappropriated available funds in the treasury the sum of $2,000.00 for the maintenance of Chapter 90 Roads or any other sum (in an amount which will be double and be in addition to the amount appropriated under Article 9) to meet the State and County shares of the cost of the work, the reimbursement from the State and County to be restored upon receipt to unappropriated available funds in the treasury.


ARTICLE 11. To see if the Town will vote to appropri- ate and transfer from unappropriated available funds in the treasury the sum of $6,300.00 (which is triple the amount transferred from the Reserve Fund on September 17, 1948) for the improvement or rebuilding of Chapter 90 Roads, to meet the State and County's share of the cost of such work, the reimbursement from the State and County to be restored upon receipt to unappropriated available funds in the treasury.

ARTICLE 12. To see if the Town will vote to raise and appropriate the sum of $3,000 or any sum for the improve- ment or rebuilding of Chapter 90 Roads, provided the State and County contribute toward the same, in accordance with the provisions of Chapter 90, General Laws, or take any action relative thereto.


ARTICLE 13. To see if the Town will vote to appropriate and transfer from unappropriated available funds in the treasury the sum of $9,000.00 for the improvement or re- building of Chapter 90 Roads, or any other sum (in an amount which will be triple and in addition to the amount appropriated under Article 12) to meet the State and Coun- ty shares of the cost of the work, the reimbursement from the State and County to be restored upon receipt, to unap- propriated available funds in the treasury.


ARTICLE 14. To see if the Town will accept the follow- ing Cemetery Trust Funds left to the Town since the last Annual Town Meeting: $200, Speare-Pease Lot, East Wil- braham Cemetery; $200.00, Dasco Lot, East Wilbraham Cemetery, or take any action relative thereto.


ARTICLE 15. To see if the Town will vote to appropri- ate and transfer from unappropriated available funds in the treasury the sum of $10,275.00 or any sum to be spent by the Water Department for additional household and business installations of water service, the cost of which is collected by the Town from the individuals or concerns requesting the installations, and which is returned to sur- plus funds, or take any action relative thereto.


ARTICLE 16. To see if the Town will vote to appropri- ate and transfer from unappropriated available funds in the treasury the sum of $1,500.00 or any sum to pay to the garbage collection contractor the amounts received by the Town Collector from garbage collection subscribers, said receipts to be restored as received by the Town Collector to unappropriated available funds in the treasury, or take any action relative thereto.


ARTICLE 17. To see what disposition the Town will make of the Dog Tax of 1948.


ARTICLE 18. To see if the Town will vote to appropri- ate the sum of $5,500.00 or any sum for a Reserve Fund, with $4,000.00 or any sum to be transferred from the Over- lay Surplus Account, and the balance to be raised by taxa- tion, or take any action relative thereto.


ARTICLE 19. To see if the Town will authorize the Selectmen to institute or defend suits and employ counsel for the purpose of protecting the interests of the Town, or take any action relative thereto.

ARTICLE 20. To see if the Town will vote to authorize the Selectmen to sell at public auction, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town, 14 days at least before sale, property taken by the Town under tax title procedure, provided that the Selectmen, or whomsoever they authorize to hold such public auction, may reject any bid which they deem inadequate, or take any action relative thereto.


ARTICLE 21. To hear and act on the report of the com- mittee appointed under Article 28 of the 1948 Annual Town Meeting to study the matter of a sidewalk on Boston Road from Chapel Street to the #8 school, or take any action relative thereto.


ARTICLE 22. To see if the Town will vote to raise and appropriate the sum of $1,200.00 or any sum to erect a side- walk on the east side of Chapel Street, around the corner and along North Mountain Road (or Glendale Road) on the north side, together with a curbing, a distance of ap- proximately 200 feet, or take any action relative thereto.


ARTICLE 23. To see if the Town will vote to accept as a public way the street now known as Delmor Circle as shown on a plan of land in Wilbraham surveyed for Wil- liam Decorie by Merrill & Sears, Civil Engineers, May 16, 1941, beginning at Main Street and running westerly for a distance of approximately 350 feet and being 50 feet in width throughout said length, which 50 feet is made up of the 40 feet width shown on said plan plus an additional 5 feet on the south side and an additional 5 feet on the north side, with all of said additional land to be deeded to the Town by each abuttor for the consideration of $1.00; thence running northerly for approximately 465 feet to the inter- section of the street now known as Delmor Avenue, and being 35 feet in width throughout the latter distance, which 35 feet is made up of the 30 feet width shown on said plan plus an additional 5 feet on the westerly side, with all of said additional land to be deeded to the Town by each abuttor for the consideration of $1.00, and to raise and appropriate the sum of $1,200.00 or any sum to defray the expense thereof, or take any action relative thereto.


ARTICLE 24. To see if the Town will vote to accept as a public way the street now known as Delmor Avenue, as shown on a plan of land in Wilbraham surveyed for Wil- liam Decorie by Merrill & Sears, Civil Engineers, May 16, 1941, beginning at Main Street and running westerly to the intersection of Delmor Circle for a distance of approxi- mately 465 feet, being 50 feet in width throughout its en-

tire length, and to raise and appropriate the sum of $600.00 or any sum to defray the expense thereof, or take any action relative thereto.


ARTICLE 25. To see if the Town will vote to accept as a public way that portion of Dalton Street now a private way, as shown on plan surveyed by William Hennessey, Land Surveyor, May 1947, beginning at the southerly end of that portion of Dalton Street now accepted as a public way, to the private way now known as Severyn Street, for. a distance of 300 feet more or less, and being 50 feet in width throughout its entire length, and to raise and appro- priate the sum of $600.00 or any sum to defray the expense thereof, or take any action relative thereto.


ARTICLE 26. To see if the Town will vote to accept as a public way the street now known as Mountain View Street, as shown on plan entitled "Mountain View Park" by Durkee, White & Towne, Engineers, April 1916, begin- ning at the intersection of Boston Road and running south- erly for a distance of 750 feet more or less to the private way known as Grant Street, and being 50 feet in width throughout its entire length, and to raise and appropriate the sum of $700.00 or any sum to defray the expense there- of, or take any action relative thereto.


ARTICLE 27. To see if the Town will vote to accept as a public way the street now known as Wilson Street, as shown on plan entitled "Mountain View Park" by Durkee, White & Towne, Engineers, April 1916, beginning at Bos- ton Road and running southerly for a distance of approxi- mately 550 feet more or less, and being 50 feet in width throughout its entire length, and to raise and appropriate the sum of $650.00 or any sum to defray the cost of same, or take any action relative thereto.


ARTICLE 28. To see if the Town will vote to accept as a public way the street now known as Hillcrest Drive, as shown on plan entitled "Lake Shores, Section C" by Phil- lips, Dudley, Sullivan, Surveyors, April 1929, beginning at the intersection of Manchonis Road and Lake Drive and run- ning southerly for a distance of approximately 450 feet more or less, and being 40 feet in width throughout said length, which 40 feet is made up of the 18 feet width shown on said plan plus an additional 11 feet on the easterly side and an additional 11 feet on the westerly side, with all of said additional land to be deeded to the Town by each abuttor for the consideration of $1.00, and to raise and appropriate the sum of $400.00 or any sum to defray the cost of same, or take any action relative thereto.


ARTICLE 29. To see if the Town will vote to accept as a public way the right of way running easterly from the

southerly end of Hillcrest Drive to Lake Drive for a distance of approximately 150 feet more or less, said way being 50 feet in width throughout said length, which 50 feet is made up of the 15 feet width shown as right of way on said plan plus additional land on both the northerly and southerly sides of said way as shown on plan filed with the Town Clerk on February 15, 1949, with all of said additional land to be deeded to the Town by each abuttor for the consideration of $1.00, and to raise and appropriate the sum of $200.00 or any sum to defray the cost of same, or take any action relative thereto.


ARTICLE 30. To see if the Town will vote to accept as a public way the street now known as Highland Avenue as shown on Profile Plan of Highland Avenue and approved by the Wilbraham Planning Board, December 1948, begin- ning at Springfield Street and running northerly for a dis- tance of approximately 600 feet more or less, and being 50 feet in width throughout its entire length, and to raise and appropriate the sum of $650.00 or any sum, to defray the expense thereof, or take any action relative thereto.


ARTICLE 31. To see if the Town will vote to raise and appropriate the sum of $5,000.00 or any sum to purchase and install about 1100 feet of 6-inch water pipe with ap- propriate hydrants on Nokomis Road from Boston Road toward Main Street, or take any action relative thereto.


ARTICLE 32. To see if the Town will vote to raise and appropriate the sum of $2,200.00 or any sum to purchase and install about 550 feet of 6-inch water main on Wilson Street, or take any action relative thereto.


ARTICLE 33. To see if the Town will vote to raise and appropriate the sum of $4,000.00 or any sum to extend the 6-inch water main westerly on Manchonis Road for a dis- tance of approximately 1,000 feet, or take any action rela- tive thereto.


ARTICLE 34. To see if the Town will vote to extend the existing water main on Maple Street so as to serve the inhabitants of Mountain Road to a point near the property now or formerly of Winfield Bennett, thence across to the Boston Road near the foot of Butler Hill and along the Boston Road to the Palmer line as proposed in a plan made August 1, 1946 by Tighe & Bond, Consulting Engineers, and to raise and appropriate the sum of $50,200.00 or any sum, or take any other action relative thereto.


ARTICLE 35. To see if the Town will vote to raise and appropriate the sum of $18.75 (an annual recurring ex- pense) or any sum to establish a street light on Dalton Street in the section described under Article 25 of this

warrant, and provided said section has been accepted as a public way, or take any action relative thereto.


ARTICLE 36. To see if the Town will vote to raise and appropriate the sum of $18.75 (an annual recurring ex- pense) or any sum to establish a street light at the inter- section of Nokomis and Pond Road, or take any action rela- tive thereto.


ARTICLE 37. To see if the Town will vote to raise and appropriate the sum of $18.75 (an annual recurring ex- pense) or any sum to establish a street light on Glendale Road near the residence of John Nelsson, or take any action relative thereto.


ARTICLE 38. To see if the Town will vote to raise and appropriate the sum of $500.00 or any sum for operating costs of the Legion quarters in the Perry Building to pro- vide for such expenses as heat, light and janitor service, or take any action relative thereto.


ARTICLE 39. To see if the Town will vote to raise and appropriate a sum of money for the purpose of construct- ing and originally equipping and furnishing a new school building including auditorium, determine whether the money shall be provided for by taxation, by appropriation from available funds in the treasury including the Post- War Rehabilitation Fund, and/or the Surplus War Bonus Fund and Accumulations, and/or the Sale of Real Estate Fund, and by the issuance of loans under authority of Chap- ter 163 of the Acts of 1948 and Chapter 44 of the General Laws, and to determine whether or not the raising of such appropriation shall be deferred until agreement between the Town and the School Building Assistance Commission on a specific basis for State assistance, or take any other action relative thereto.


ARTICLE 40. To see if the Town will vote to raise and appropriate a sum of money for the purpose of construct- ing a sidewalk and/or installing curbing along part or all thereof in connection with the Chapter 90 highway con- struction of that section of Main Street between Bulkley Road and the residence of Doctor Arthur Goodwin, or take any action relative thereto.


ARTICLE 41. To see if the Town will vote to appropri- ate the sum of $2,700.00 or any sum to purchase a two-ton dump truck to be used by the highway department, with $2,400.00 or any sum to be transferred from the Road Machinery Account and the balance to be raised by taxa- tion, or take any action relative thereto.


ARTICLE 42. To see if the Town will vote to raise and appropriate the sum of $16,500.00 or any sum to be ex-

pended under the direction of the Board of Fire Commis- sioners for the purchase of a new fire truck to replace the present Maxim triple-combination fire truck now garaged at North Wilbraham, or take any action relative thereto.


ARTICLE 43. To see if the Town will vote to amend the Zoning By-Law to change the zoning from "Al" to Busi- ness on the following property as herein described :


First : An additional depth of fifty feet, one hundred and fifty feet wide adjoining the one hundred feet depth now in business zone on property owned by Florence L. and Howard C. Bogue at 2697 Boston Road.


Secondly : A plot of land starting 150 feet from Boston Road and running south 85 feet along land of Thomas Farnham to an iron pin; thence along property owned by one Eisold 315.53 feet N. 83ยบ 13' 17" to an iron pin ; thence along Nokomis Road 57.34 feet in an arc on a radius of 205.69 feet to an iron pin and continuing along said Noko- mis Road 68.05 feet to an iron pin; thence easterly 326.39 feet to the point of beginning. This piece of land is owned by Florence L. Bogue.


ARTICLE 44. To see if the Town will vote to amend the Zoning By-Law to change the zoning from "Al" to Business on the following property as herein described : A certain tract of land, with the buildings thereon, situate on the southerly side of Boston Road, so-called near the village of North Wilbraham, in said Wilbraham, bounded and described as follows: Beginning at the point of inter- section of the southerly side of said Boston Road and the center of a small brook supplying the watering trough sit- uated westerly from the foot of Butler Hill, so-called, thence easterly along the southerly side of said Boston Road to another small brook; thence on said last named brook east- erly and southerly, crossing the Old Bay Road from the mountain, to a culvert in the northerly location line of the Boston and Albany Railroad; thence westerly on said rail- road company's land and across said Old Bay Road to an- other culvert in said railroad company's line; thence north- erly on the first named brook to the place of beginning, containing about two (2) acres of land, more or less. Also a certain other tract of land lying on the southerly side of the Boston Road, so-called, near the village of North Wil- braham, in said Wilbraham, adjacent to the above described tract, bounded and described as follows: Beginning at the intersection of the westerly line of the Old Bay Road, so- called (now discontinued with the southerly side of said Boston Road to a small brook passing under said road; thence easterly on said brook to the westerly line of said

Old Bay Road; thence northerly on said Old Bay Road to the place of beginning, containing one-1/8 of an acre of land, more or less. Property now owned by Frederick James and Anne Elizabeth Bready.


ARTICLE 45. To see if those attending the Town Meet- ing will vote to adopt the following resolution : -


Whereas, World peace is essential to the survival of civilization, and


Whereas, World order in our state and national com- munities must be founded upon law, and


Whereas, Law in any jurisdiction requires government for its enactment, interpretation and enforcement, there- fore be it


Resolved, that those citizens of Wilbraham who are as- sembled in Town Meeting on March 26, 1949 hereby en- dorse the principle of World Federation and request the Government of the United States, at the earliest propitious moment, to initiate the procedure necessary to transform the United Nations, by implementing Article 109 of the United Nations Charter, into a law-making body with power to prevent war and to enforce justice upon individuals.


ARTICLE 46. To see if the Town will vote to authorize the Cemetery Commissioners to perform labor in the Ceme- teries of the Town and to fix their compensation for such employment, or take any action relative thereto.


ARTICLE 47. To see if the Town will vote to accept the provisions of Chapter 588 of the Acts of 1948 entitled An act authorizing increases of the amounts of pensions pay- able to certain former public employees who have been re- tired and to beneficiaries of certain retired public employees.


ARTICLE 48. To transact such other business as may properly come before said meeting.


And you are directed to serve this warrant by posting attested copies thereof, one at the Post Office at Wilbraham, one at the Post Office at North Wilbraham and one at Glen- dale Church, seven days at least, before the time for holding said meeting. Hereof fail not and make due return of this warrant with your doings thereon to the Town Clerk on or before the time for holding said meeting.
