Hamond's 1722/3 the Deponent was in Company with Capt
Test John Leighton now Deed & Mr Robert Cutt At the same Time Mr John Gowen a Surveyer was present in order to make Partition or Division of a certain Tract of Land & Priviledges web gd Leighton & Cutt Pur- chased in Partnership of the Heirs of Capt John Frost of Boston Deed & accordingly they did measure & make a Di- viding Line between them of the South Part of s4 Land & did measure the remaining Part in Order to a Division of the same I also assisted the sa Surveyor in making a Draught or Plat of s4 Land I also remember that Mr Cutt was to be allowed more Land than Mr Leighton in Lien of some other Land weh Leighton had near his Dwelling I also remember that about Two Years since I was present with the same Surveyer & Mr Cutt & Messrs John & Tobias Leighton when they measured several Spotts of Meadow within the Bounds of sd Land & the sª Cutt & Leightons did then dis- course in what Manner to divide the sa Remainder & MIr Cutt then told me that He had no other Interest nor never had but sd there was an Accompt between Him & Capt Leighton unsettled & that He would first settle sª Accompt or to that Purpose

Traet of Land belonging or in any wise appertaining and whereas ye said Parties being willing and Desirous that Each of them may know have and Enjoy his Respective fourth part of the Several Tracts of Land aforesª in Severalty have condescended Covenanted and agreed and by these Presents Do mutually for themselves their Heirs and Assigns respee- tively Condescend Covenant and Agree each to and with the other to make Division and Partition of the Said Three Tracts of Land & premisses with the Appurces in Manner & form following That is to say Imprimis That the said Thom- Thomas Salters as Salter his Heirs and Assigns shall and may part from henceforth and forever hereafter have hold use occupy possess and Enjoy as his & their fourth part or Share of and in the three Pieces of Land aforesd in Severalty forever That part of the first mentioned piece of Land marked Nº 1 in the least of ye Said Platts with the Name Salter wrote thereon containing on the North- westerly Side twenty Rods and on the South Easterly Side thirteen Rods as the same is delineated and described in the said Plat adjoining to the Lott of the said Adams and Little Also that part of the Second mentioned piece of Land marked Nº 1 in the biggest of the so Platts with the name Salter wrote thereon adjoyning to the said Pendletons or Gordons Land on the North west Side & to the lott of the Said Ad- ams and Little on the South East Side containing the whole Length of ye sa Piece of Land & in Breadth at Each End Fifty Six Rod as the same is delineated & described in the sª Platt Also that part of the Last mentioned piece of Land held in Common by the said Parties as aforesd marked No 1 in the biggest of ye said Platts with the Name Salter wrote thereon adjoyning to the Line Setled between the said Town of Biddeford and the said William Phillips as aforest on the South East Side and the Lott of the sª Adams & Lit- tle on the Northwest Side containing the whole Length of ye said Piece of Land and in breadth at Each End Sixty rod eight feet as ye same is delineated and described in the Said Platt Together with the Rights members Profits priviledges & Appuipres whatsoever to the same and every part thereof belonging or in any wise appertaining and the said Samuel Adams and Tristram Little Edward Bromfield & William Pepperrell for themselves their Heirs Executors and Ad- ministrators Do hereby Remise Release and for ever Quit Claim unto the said Thomas Salter his Heirs and Assigns for ever all their Right Title Interest property claim & De- mand whatsoever in & to the Part or Share of the said Lands and Premisses with the Apparees herein Assigned & Set off
