Sect. 57. And be it further enacted, That every perfon obtaining a difcharge from his debts, by certificate as aforefaid, granted under a com- mitsion of bankruptcy, fhall not on any future commission be entitled to any other certificate than a difcharge of his perfon only ; unlefs the nett proceeds of the eftate and effects of fuch perfon fo becoming bank- rupt a fecond time fhall be fufficient to pay feventy-five per cent. to his or her creditors on the amount of their debts refpectively. "


Sect. 58. And be it further enacted, That any creditor of a perfon againft whom a commiffion of bankruptcy fhall have been fued forth, and who fhall lay his clain before the commissioners appointed in pur- fuance of this act, may at the fame time declare his unwillingnefs to fubniit the fame to the judgment of the faid commissioners, and his wifh that a jury may be impanelled to decide thereon ; and in like manner the afsignee or afsignees of fuch bankrupt may object to the confidera- tion of any particular claim by the commifsioners, and require that the fame fhould be referred to a jury. In either cafe faich objection and requeft fhall be entered on the books of the commifsioners, and there- upon an iffue fhall be made up between the parties, and a jury thall be impanelled as in other cafcs, to try the fame in the circuit court for the diftrict in which fuch bankrupt has ufually refided. The ver- dict of fuch jury mhall be fubject to the control of the courts, as in fuits originally inftituted in the faid court, and when rendered, if not fet afide by the court, thall be certified to the commissioners, and thall afcertain the amount of any fuch claim, and fuch creditor or creditors fhall be con- fidered, in all refpoet, as having proved their debts under the commifsion.


Sect. 59. And be it further enacted, That the lands and effects of any perfon becoming bankrupt, may be fold on fuch credit and on fuch fecurity as a major part in value of the creditors may direct : Provided, nothing herein contained fhall be allowed fo to operate, as to retard the granting the bankrupt's certificate.


Sect. 60. And be it further enacted, That if any perfon becoming bankrupt fhall be in prifon, it fhall be lawful for any creditor or credi- tors at whofe fuit he or fhe fhall be in execution, to difcharge him or her from cuftody, or if fuch creditor or creditors fhall refufe to do fo, the prifoners may petition the commifsioners to liberate him or her ; and thereupon, it in the opinion of the commissioners the conduct of fuch bankrupt fhall have been fair, fo as to entitle him or her, in their opin-

ion, to a certificate when by law fuch certificate might be given, it fhall be lawful for them to direct the difcharge of fuch prifoner and to enter the fame in their books ; which being notified to the keeper of the goal in which fuch prifoner may be confined, fhall be a fufficient authority. for his or her difcharge: Provided, That in either cafe fuch difcharge fhall be no bar for another execution, if a certificate fhall be refufed to fuch bankrupt : And provided alfo,. That it fhall be no bar to a fubfe- quent imprifonment ,of fuch bankrupt, by order as the commissioners, in conformity with the provisions of this act.


Sect. 6r. And be it further enacted, That this act fhall not repeal or annul, or be conftrued to repeal or annul the laws of any flate, now. in force, or which may be hereafter enacted for the relief of infolvent debtors, except fo far as the fame may refpeet perfons who are, or may be clearly within the purview of this act, and whofe debts fhall amount, in cafes fpecified in the 2d fection thereof, to the fums therein mentioned ; and if any perfon within the purview of this act shall be imprifoned for the fpace of three months for any debt or upon any contract, unlefs the creditors of fuch priloner fhall proceed to profecute a commifsion of bankruptcy, againft him or her, agreeably to the provifions of this act, fich debtor may and fhall be entitled to relief under any fuch law for the relief of infolvent debtors, this act notwithftanding.


Sect. 62. And be it further enacted, That nothing contained in this Jaw fhall in any manner affect the right of preference to prior fatisfac- tion of debts due to the United States, as fecured or provided by any. Raw heretofore paffed, nor fhall be conftrued to leffen or impair any right to or fecurity for money due to the United States or to any of chem.


Sect. 63. And be it further enacted, That nothing contained in this n& fhall be taken or conftrued, to invalidate or impair any lien exifte ang at the date of this act, upon the lands or chattels of any perfon who may become a bankrupt.


Sect. 64. And be it further enacted, That this act fhall continue in force during the term of five years, and from thence to the end of the next fefsion of Congrefs thereafter and no longer : Provided, that the cxa. piration of this act fhall not prevent the complete execution of any commission which may have been previoufly thereto iffued.
