Sect. 65. When bonds given for duties fhall become due, and not difcharged, the collector to profecute without delay ; and, in cafe of in- folvency or death, the United States to be the firft creditor, "and if a- ny executor, adminiftrator, afsignee, or any other perfon, fhall pay a- ny debt due by the person or effate, from whom, or for which they are acting, previous to the debt or debts due to the United States being firft fully fatisfied and paid, he or they fhall become anfiverable in their own perfon and eftate for the fame, or part thereof remaining unfatisfied."
Sureties on all bonds given for duties, fhall in cafe of infolvency or death of the principal, " have and enjoy the like advantages, priority or preference for the recovery and receipt of the faid money, out of the eftate and effects of fuch infolvent, or deceafed principal, as are referved to the United States."
When bonds are profccuted for the recovery of duties due to the U. Restrictions on Importations.
Sect. 92. No goods, wares, or merchandize, of foreign growth or manufacture, fubject to the payment of duties, fhall be brought into the United States from any foreign port or place in any other manner than by fea ; nor in any fhip or veffel of lefs than Thirty Tons bur- then, agreeable to the mode ofafcertaining American tonnage, except in certain diftriets on the Northern, Northweftern, and Weftern bounda- ries of the United States, adjoining to the dominions of Great Britain in Upper and Lower Canada, and the diftricts on the rivers Ohio and Mifsifsippi.
Sect. 103. No beer, ale, or porter, to be imported in cafks of lefs capacity than forty gallons, beer meafure, or, if in bottles, in pack- ages lefs than six dozen, under penalty of forfeiture, with the fhip or veffel.
No refined lump or loaf fugar, fhall be imported into the United States, from any foreign port or place, except in fhips or veffels of the burthen of one hundred and twenty tons and upwards, and in cafks or packages containing each, not lefs than six hundred pounds, on pain of forfeiting the faid fhip or veffel, and the loaf and lump fugar imported therein, except in fuch cafks or packages as aforefaid.
No diftilled fpirits, arrack and fiveet cordials excepted, to be impor- ted in cafks or veffels of lef's capacity than ninety gallons, wine med- Jure, on pain of forfeiture, with the fhip or veffel ; nor in cafks or veffels which have been marked purfuant to any law of the U. Sect. 24. For all goods not included in the manifeft, the inafter for- feits a fum of money equal to their value, and all merchandize not in- cluded in fuch manifeft, belonging or configned to the Master, Mate, Officers or Crew of fuch veffel, fhall be forfeited, unlet's it is made appear to the fatisfaction of the collector, naval officer, and furveyor, or the major part of them, or to the court on trial, that no part was un- fhipped, except what is mentioned in the report, or that the manifeft has been loft or miflaid, without fraud, or defaced by accident, or incor- rect by miftake.
Sect. 25. The mafter of any veffel, or other perfon having charge thereof, belonging in whole or in part to a citizen or citizens, inhabitant or inhabitants, of the United States, on arrival within four leagues of the coaft, or within any bays, harbors, ports, rivers, creeks, or inlets thereof, to have a manifeft on board, and on demand made by any offi- rer of the cuftoms, firft coming on board to produce fuch manifeft and deliver him a copy thereof, figned by the mafter or other perfon having charge of fuch veffel, and the officer fhall certify on the original the day and year the fame was produced ; the faid copy to be provided and fub- fcribed by the mafter, or fuch other perfon having command ; the copy of which is to be compared with the original, and certified by fuch officer on the back thereof ; the day and year fuch copy or copies was or were delivered to him-the original manifeft to be delivered af- terward by the mafter to the collector .- Provided, that not more than one copy of each manifeft fhall be required by any officer or officers who fhall firit come on board, within four leagues of the coaft of the United States, and one other copy to any officer or officers who fhall first come on board, within the limits of any district for which the cargo, or any part thereof fhall be deftined.
Sect. 26, The penalty on mafters, for not producing manifeft, and delivering copy thereof to the proper officer or officers on demand, or for not informing fuch officer the true destination of fuch veffel, is 500 dollars for each offence, and the like penalty is incurred by fuch officer, who fhall neglect or refufe to certify fuch manifeft; and the offi- cer is required to make a return in writing, of the name of the veffel, and mafter, offending in any or all of the particulars required, to the collector of the diftrict where fuch veffel may be bound.
Sect. 27. Any veffel within four leagues of the coaft, or within the limits of any diftrict, unloading goods without authority from proper officers, the mafter and mate forfeit 1000 dollars for each offence, and the goods forfeited, except in cafe of accident, necefsity or ftrets of wea- ther-which Shall be proved before the collector, by the mafter, mate, and one other officer or mariner.
Sect. 28. Mafters of velfels receiving goods fo unladen, except as be- fore excepted, to forfeit treble the value of fuch goods-and the ship. boat, or veffel receiving them to be forfeited.
Sect. 29. If any veffel having arrived within any diftrict, fhall de- part, or attempt to depart from the fanc, unlefs to fomc more interior

port, or by ftrefs of weather, without report to the collector, the n af- ter forfeits 400 dollars.
Sect. 30. Any velfel arriving from a foreign port, the mafter is to report to the colk ctor, within 24 hours after his arrival, and within 24 hours thereafter, further to report the name, bur ben, &c. in writing, agreeably to the directions of feetron 23d, and fhall make oath or af - firmation to the truth of the fame, in words following --

B. do folemnly, fincerely, and truly fwear, or afirm, that the report and manifeft fubfcribed with my name, and now delivered by me to the collector of the diftrict of contains, to the cei't of my knowledge and belief, a juft and true account of all the goods wares and merchandize, including packages of every kind and nature whatfoever, which were on board the at the time of her failing from the port of or which have been laden or taken on board at any time fince, and that the packages of the faid goods are as particu- Jarly defcribed as in the bills of lading, figned for the fame by me; or with my knowledge ; that I am at profent, and have been during the voyage, malter of the faid veffel ( or how long ) ; that no package whatfocver, or any goods, wares or merchandize have been unladen, landed, taken out, or in any manner whatever removed from on board the faid fince her departure from the faid port of except fuch as are now particularly fpecificd, and declared, in the abftract or account herewith, and that the clearance and other papers now delivered by me to the collector, are all that I now have, or have had, that any way relates to the cargo of the faid vefel. And I do further fwear ( or affirm ) that the feveral articles fpecified in the faid manifeft, as the fra- frores for the cabin and veffel, are truly fuch, and were bona fide put on board the faid for the ule of the officers, crew and paf- fengers thereof, and have none of them been brought and are not in- tended by way of merchandize, or for fale, or for any other purpofe, than above mentioned, and are intended to remain on board for the cor- fumption of the faid officers and crew; I further fwear (or affirm ) that if I fhall hereafter difcover, or know of any other or greater quan- tity of goods, wares and merchandize, of any nature or kind whatfoever, than are contained in the report and manifeft fubfcribed, and now de- livered by me, I will immediately, and without delay, make due report thereof, to the collector of the port or diftrict of and I do likewife fwear ( or affirm ) that all matters whatfoever in the faid re- port and manifeft expreffed, are, to the beft of my knowledge and bt - lief, juft and true ; (The following addition to the oath or affirma- tion is to be inferted in cafes where the manifefts shall not base been certified by fome officer of the cuftoms in manner provided. ) I further fivear ( or affirm ) that no officer of the cuftoms has applied for an infpection of the manifeft of the cargo on board the faid veffel, and that no certificate or indorfement has been delivered to me on any manifeft of fuch cargo .- So help me Ged.

Sect. 31. Ships of war or packets of any prince or flate, not permitted by fuch prince or flate to carry goods in way of trade, are not required to make fuch reports.
Sect. 32. Mafters of veffels, after arrival and entry, may proceed to foreign ports with goods, noted on the manifeft at the time of entry for fuch foreign port, without paying duties thereon, on giving bond that the faid goods fhall be actually re-exported in fuch veffel to a fo- reign port, but bonds are not required when veffels put in in diftrefs.
Sect. 34. Mafters of veffels having goods on board deftined to dif- ferent diftricts, other than the diftrict at which he may arrive, to be furnifhed by the collector with a copy of his report, and a certificate, fhewing on what part of the cargo the duties have been paid or fecured, and give bond for reporting fuch goods on which the duties have not been paid or fecured; which copy the mafter is to produce to the col- lector of the diftrict where bound, within 24 hours after his arrival,

under a penalty of 500 dollars ; and the faid bond be cancelled by pro- ducing from the collector of fuch diftrict a certificate, within fix months, of the due entry and delivery of fuch merchandize, in fuch diftrict or diftricts.
Sect. 35. In addition to the foregoing fection, the mafter to apply to the furveyor or infpector of the port for a copy of his report (where there are diftilled fpirits, wines, or eas on board, to be delivered in dif- ferent diftricts ) the want of which fubjects fuch articles to forfeiture, and 500 dollars penalty on the mafter.
Poft-Office Law.
No fhip or veffel from foreign ports, or coming by fea from any port of the United States, fhall be permitted to report, make entry, or break bulk, till the mafter fhall deliver to the poft-mafter all letters un- der his care, or within his power," other than fuch as are directed to the owner or owners of fuch Ship or veffel, and on oath or affirmation, to be taken of fuch delivery, the mafter to receive two cents for every Letter fo delivered ..
Form of the Oath.
I do folemnly that I have delivered to the poft-mafter of this city, all letters directed to any perfon or perfons within the United States, which, under my care or within my power, have been brought in the myfelf mafter, from thofe directed for the owner or owners, confignee or confignees of the faid veffel excepted. .

Sect. 57. Goods found on board any veffel not noted on the manifeft, the mafter to make poit entry, previous to any permit being granted therefor.
Packages wanting, or goo.ls not agreeing with the manifest, the inf .. ter forfeits 500 dollars, unlefs made appear to the fatisfaction of the principal officers of the cuftoms, that no part of the cargo has been un- lorded fince it was taken on board, except fuch as noted in the report, and parfuant to permits ; and that fuch difagreement arifes from acci- dene or miftake.
Sect. 60. Veffels arriving from any foreign port in diftrefs, at any port in the United States, not being deftined for the fine, proteft to be made by the matter and mate, within 24 hours, and lodged at the cuftom-houfe, and within 48 hours enter his veff. H. as in all other cafes ; and if by certificate of the wardens of the port, o. the necefsity thereof, the veffel may be unladen, and cargo depolited in the public ftore, and re-laden again (except fuch part as may be necefary to be feld, to de- fray the expentes of the repairs of the veDel only, on which the duty fhall be paid as in other cafes ) by permission from the custom-houfe, free from ariy other charge than forage and fees to the officers of the cuitoms, as n' other cafes.

Sect. 93.
