The Society for the Relief of Diftreffed Prifoners, return t thanks to thofe humanc and charitable Citizens who, from time to t have contributed towards the benevolent purpofes of this Inftitutio and beg leave to prefent them with the following concife accoun their tranfactions from the firft of January, 1799, to the firft of J. arv, 1800~


They have, during that period, contributed to the relief of 139 fons confined in the Jail of this City, by diltributing to them the lowing articles-viz. 1193 pounds of pork, 2328 pounds of 1 3037 pounds of bread, 24 bufhels of potatoes, 8 25 quarts of bean loads of wood, and 2 chaldrons of coal .- In purchafing the amo articles and paying fome incidental charges, they have expended the of Eight Hundred and Eighty Dollars Forty-three Cents.


In the courfe of the laft year, the Society have received in foli and voluntary Donations, One Thoufand and Forty-eight Dollars ty-two Cents-and there is now in the hands of the Treafurer a bal of One Hundred and Sixty-eight Dollars and Nineteen Cents. further Donations as their benevolent Fellow-Citizens may choo

BE it enacted by the Senate and Houfe of Reprefentatives of the United States of America, in Congref's affembled, That, from and after the first day of fune next, if any merchant, or other per- fon, refiding within the United States, actually ufing the trade of merchandize, by buying and felling in grofs, or by retail, or dealing in exchange, or as a banker, broker, factor, underwriter, or marine in- furer, fhall, with intent unlawfully to delay or defraud his or her cre- ditors, depart from the flate in which fuch perfon ufually refides, or remain abfent therefrom, or conceal him or herfelf therein, or keep his or her houfe, fo that he or fhe cannot be taken or ferved with procefs, or willingly or fraudulently procure hina or herfelf to be arrefted, or his or her lands, goods, money or chattles to be attached, fequeltered, or taken in execution, or fhall fecretly convey his or her goods out of his or her houfe, or conceal them to prevent their being taken in execu- tion, or make, or caufe to be made, any fraudulent conveyance of his or her lands, or chattles, or make or admit any falfe or fraudulent fecu- rity or evidence of debt, or being arrefted for debt, or having furrendered him or herfelf in difcharge of bail, fhall remain in prifon two months or more, or efcape therefrom, or whofe lands or effects being attached by procefs ifluing out of, or returnable to any court of common law, fhall not, within two months after written notice thereof, enter fpecial bail and diffolve the fame, or in diffrefs in which attachirents are not diffolved by the entry of fpecial bail, being arrefled for debt after his or her lands or effects, or any part thereof, have been attached for a debt. or debts amounting to one thoufand dollars or upwards, fhall not, up- on notice of fuch attachment, give fufficient fecurity for the payment of what may be recovered in the fuit in which he or the fhall be arrefted at or before the return day of the fame, to be approved by the judge of the diftrict, or fome judge of the court out of which the procef's iffued, up-

on which he is arrefted, or to which the fame fhall be returnable, every fuch perfon fhall be deemed and adjudged a bankrupt : Provided, That no perfon fhall be liable to a commifsion of bankruptcy, if the petition be not preferred, in manner hereinafter directed, within fix months after the act of bankruptcy committed.


Sect. 2. And be it further enacted, That the judge of the diftrict court of the United States, for the diftrict where the debtor refides, or ufually refided at the time of committing the act of bankruptcy, upon petition in writing, againft fuch perfon or perfons being bankrupt, to him to be exhibited by any one creditor, or by a greater number, being part- ners, whofe fingle debt fhall amount to one thoufand dollars, or whofe debts fhall amount to one thousand five hundred dollars, or by more than two creditors, whofe debts fhall amouut to two thousand dollars, thall have power by commifsion under his band and feal, to appoint fuch good and lubftantial perfons, being citizens of the United States, and refident in fuch diftrict, as fuch judge fhall deem proper, not exceed- ing three, to be commifsioners of the faid bankrupt, and in cafe of va- cancy or refufal to act, to appoint others, from time to time, as occa- fion may require : Provided always, That before any commifsion fhall iffue, the creditor or creditors, petitioning, fhall make affidavit or folemn affirmation before the faid judge, of the truth of his, her, or their debts, and give bond, to be taken by the faid judge, in the name and for the benefit of the faid party, fo charged as a bankrupt, and in fuch penalty, and with fuch furety a> he fhall require, to be conditioned for the prov- ing of his, her, or their debts, as well before the commissioner, as up- on a trial at law, in cafe the due iffuing forth of the faid commifsion fhall be contefted, and alfo for proving the party a bankrupt, and to proceed on fuch commifsion, in the manner herein prefcribed. And if fuch debt fhall not be really due, or after fuch commifsion taken out, it cannot be proved that the party was a bankrupt, then the faid judge fhall, upon the petition of the party aggrieved, in cafe there be occafion, deliver fuch bond to the faid party, who may fue thereon and recover fuch damages, under the penaltly of the fame, as upon trial at law, he fhall make appear he has furtained, by reafon of any breach of the con- dition thereof.


Sect. 3. And be it further enacted, That before the commif-ioners fhall be capable of acting, they thall refpectively, take and fubfcribe the following oath or affirmation, which fhall be adminiftered by the judge iffuing the commiffion, or by any of the judges of the Supreme Court of the United States, or any judge, juftice or chanceHor of any fate court, and filed in the office of the clerk of the Diftrict Court : " I, A. B do fwear, or afirm, that I will faithfully, impar- tially, and bonefily, according to the best of my fkill and knou- ledge, execute the several powers and truft repofed in me, as a Commiffioner in a commiffion of bankruptcy againft and that without favor or affection, prejudice or malice." And the commiffioners who fhall be fivorn as aforefaid fhall procced, as foon as may be, to execute the fame, and upon due examination, and fufficient coute appearing againft the party charged, fhall and may declare him or

her to be a bankrupt; Provided, that before fuch examination he liad reafonable notice thereof, in writing, fhall be delivered to the perfon charged as a bankrupt, or if he or fhe be not found at his or her ufual place of abode, to fome perfon of the family, above the age of twelve years, or if no fuch perfon appear, fhall be fixed at the front or other public door of the houfe in which he or fhe ufually refides, and there- upon it fhall be in the power of fuch perfon, fo charged as aforefaid, to demand, before or at the time appointed for fuch examination, that a jury be impanelled to inquire into the fact or facts alledged as the caufes for iffuing the commission, and on fuch demand being made the enqui- "ry that be had before the judge granting the commifsion, at fuch time as he may direct, and in that cafe, fuch perfons fhall not be declared bankrupt, unluf's by the verdict of the jury, he or the fhall be found to be within the defcription of this act, and fhall be convicted of fome one of the acts defcribed in the firft fection of this act; Provided alfo, That any commifsion which fhall be taken out as aforelaid, and which fhall not be proceeded in as aforefaid, within thirty days thereafter, may be fuperceded by the faid judge, who fhall have granted the fame, upon the application of the party thereby charged as a bankrupt or of any creditor of fuch perfon, unlefs the delay thall have been unavoidable, or upon a juft occafion.
