The qualified voters of each county elect a circuit clerk for that county, who holds his office for four years, and until his successor is elected and qualified.


All vacancies in supreme and circuit courts are filled by election, except when the unexpired term does not exceed one year, when the executive may appoint.


Judges of supreme and circuit courts are not eligible to any office of public trust or profit in this state or the United States, during the term for which they are - elected, and one year thereafter.


II. County Courts .- In each county there is a court called the county court, which has one judge elected for four ycars, etc. Its jurisdiction extends to all probate matters, such as granting letters of administration and testamentary, allowing claims against estates of deceased persons, and settling said estates ; also in insol- vent debtors' cases, etc.


The county court is a court of record, with a clerk and seal. It has concurrent jurisdiction with the circuit court in hearing and determining all applications for the sale of real cstate of deceased persons for payment of their debts.


The county judge is a conservator of the peace, and has the same civil and crimi- nal jurisdiction as justices of-the peace, and has the same power to preserve order and punish contempts when in session as the circuit courts. The county court acting as a probate court, sits regularly on the first Monday of every month, except the months of December, March, June, and September, and on the third Mondays of said months. It sits with two associate justices of the peace elected for such purpose, in each county not having the township organization, for the transaction of county business, on the first Mondays of December, March, June, and Septem- ber, in every year. In counties having the township organization, the board of supervisors perform its functions in relation to county matters, such as assessing and levying taxes, etc., allowing claims against counties, and supervising county property.


Appeals and writs of certiorari may be taken from the county court, sitting as a court of probate and insolvency, to the circuit court of the county.


There is elected by the electors in the several counties, at the same time that the county judge is elected, a county clerk, who holds his office for four years, and until his successor is elected and qualified. He is to keep his office at the county scat, and must give bonds in $3,000 to perform his duties faithfully.


By statute, the clerk of the circuit court is recorder of deeds in each county.


In each of the judicial circuits of the state there is a state's attorney elected, who holds his office for four years, and until his successor is commissioned and qualified. It is his duty, upon request, to attend all examinations for felonious crimes, and

upon writs of habeas corpus ; and also, it is his duty to attend all the circuit courts in his circuit, and to commence and prosecute all actions, suits, process, indictments, and prosecutions, civil or criminal, in which the people of the state or any county may be concerned ; and upon request, is to give his opinion upon matters of law to any county court, or justice of the peace, where the people of the county are concerned.


A sheriff is elected in each county in the state, who holds his office for two years, and in addition to his duties as sheriff, in counties where the township organization does not prevail, is ex-oficio, collector of taxes. Where the township organization prevails, town collectors perform this duty.


All judges and state's attorney's are commissioned by the governor.


County judges, clerks, sheriffs, and other county officers, for wilful neglect of duty or misdemeanor in office, are liable to indictment by grand jury, and trial by petit jury, and, on conviction, to removal from office.


All processes, writs, and other proceedings, shall run " in the name of the people of the state of Illinois." All prosecutions shall be carried on " in the name and by the authority of the people of the state of Illinois," and conclude "against the peace and dignity of the same."


Besides the foregoing courts, which are common to the whole state, there is estab- lished in the county of Cook, a court, called the " Cook County Court of Common Pleas," having the same general jurisdiction as the circuit court, and from whose judgments, appeals and writs of error lie to the supreme court, and which is also specially authorized to enter up judgments by confession in vacation, which cannot be done in the circuit courts. This court has eight terms in each year, six of said terms being called vacation terms, (at which any business is in order except trial by jury, and even that, by consent of parties, may be had,) and two trial terms.


The circuit court of Cook county has four terms, two of them being vacation, and two trial terms. There is also an inferior court of limited jurisdiction established in the city of Chicago, called the Recorder's Court of the city of Chicago. It is a court of record, having a clerk and seal; has concurrent jurisdiction in the city with the circuit court in all criminal cases, except treason and murder, and in civil cases where the amount in controversy does not exceed $100, and in cases of ap- peals from justices of the peace within said city. Appeals may be taken therefrom to the circuit court. The judge of this court is called the " Recorder of the City of Chicago," and, with the clerk, is elected for five years.


The Cook county court of common pleas is a court of record, having a seal and clerk. The judge and clerk of this court are each elected for the term of four years.


III. Justices' Courts .- In each county of the state justices of the peace are elected ; in counties where the township organization prevails, two for each town, together with a like number of constables, and in the other counties, two for each precinct, except that in which the county seat is located, where three are elected, together with a like number of constables. Justices and constables hold their offices for four years, and until their successors are elected and qualified.


The jurisdiction of justices of the peace in civil matters extends to actious of debt and assumpsit, where the amount claimed does not exceed $100.
