Claims and Litigation
Claims against the Town brought to the attention of the Selectmen during the year whether by court action or otherwise, were, when it appeared to be desirable or necessary, referred to the Town Counsel for advice, report and appropriate action and where disposition was made, it was on approval given.
Conclusion
The foregoing report is intended merely to indicate in part the many and varied activities of your Selectmen during the year 1947.

REPORT OF THE TOWN COUNSEL
The Honorable Board of Selectmen :
Gentlemen :
I herewith submit in summarized form my report of the activities of the law de- partment for the year 1947. A detailed report, showing the nature of the service rendered to the various departments, which could be readily submitted, would indi- cate the frequency with which advice has been sought of this department and the complexity of the problems presented, but would serve no other useful purpose. I, therefore, feel that a general report in summarized form should be submitted.
The large number of special town meetings held during the year necessitated the expenditure of considerable time in the preparation of articles for the warrant and motions to be offered thereunder.
The frequent amendment of the laws applicable to municipal affairs bring re- quests for interpretation of the amending statutes, which require constant study of the new legislation in its relation to our activities in order to competently advise those charged with the conduct of our town government.
Much of the service was in the nature of advice to the various departments to- gether with recommendations and suggestions dealing with the legal aspects of their problems. The scope of this work was wide, embracing practically every phase of municipal activity. Upon request therefor written opinions were submitted. The following departments were served: Selectmen, School Committee, Superintendent of Schools, Town Treasurer and Collector of Taxes, Finance Commission, Board of Health, Board of Assessors, Board of Public Welfare, Planning Board, General Manager, Town Clerk and Accountant, Clerk of Selectmen, Inspector of Buildings, Contributory Retirement Board and Board of Registrars of Voters.
In addition service was rendered through court appearances, attendance at hear- ings and conferences and drafting of various instruments of conveyance and other papers.
Litigation and Claims
Percy vs. Norwood: Claim for property damage to automobile due to alleged defective condition of highway. This claim was settled by compromise without litigation upon approval given.
Burke vs. Norwood: Claim for personal injuries due to alleged defective condition of sidewalk. Claim settled by compromise without litigation upon approval given.
Boston vs. Norwood: Suffolk Superior Court. Suit for welfare assistance rendered persons who allegedly had Norwood settlements. Pending.
Tax Appeals
Bendix Aviation Corporation, Appellant vs. Board of Assessors of the Town of Nor- wood, Appellee: Appeal to Appellate Tax Board for alleged refusal to abate taxes. Appeal dismissed by agreement of parties upon payment by appellant of $21,625.26, and abatement of taxes by the appellee in the amount of $48,011.28.
In addition to the above attention was given to the drafting and approval of notices of hearings, forms of votes, licenses, permits and various miscellaneous matters.

REPORT OF GENERAL MANAGER
REPORT OF THE GENERAL MANAGER
The Honorable Board of Selectmen:
Gentlemen :
I hereby transmit detailed reports of the various departments over which the General Manager has administrative control. These reports contain some of the more important activities of the various departments. The following brief ob- servations in connection with the various departments are offered for consideration:
1. Increasing coal charges in connection with the purchase of electrical energy from the Boston Edison Company would apparently make mandatory an increase in consumers' rates if the Municipal Light Department is to con- tinue operating on a profitable basis.
2. The increasing demand for installation of bituminous and granolithic side- walks throughout the entire Town would make desirable a larger appropria- tion for such purposes.
3. Improvement of our Cemetery which has long been delayed is expected to go forward this year now that we have sufficient help in that department. .
4. The work load of the Public Works Department is becoming increasingly heavy. An example of this is the increase of 30% in rubbish collections in 1947 over those of 1946. The addition of two new trucks this year has brought about a decrease in the cost of collecting on a yard basis and it is expected that the full force of such economy will be felt in the coming year.
5. There seems to be need of an additional patrolman in the Police Department as the demands of the community especially in connection with the traffic problems are becoming greater.
6. The Recreation Department is doing everything possible to keep youngsters busy and it is a reasonable observation to state that the success of this program compares favorably with that of other progressive communities.
7. Maintenance of public buildings proceeds at a pace which covers bare essen- tials only. It would appear desirable to give serious consideration in future budgets to larger outlays in connection with such maintenance. Thought also must be given to a re-appraisal of our public buildings for insurance purposes so that we may be adequately covered in the event of a catastrophe.
8. Competitive bidding in all phases of municipal purchasing has proven to be very helpful and will be continued excepting in those isolated and unusual circumstances where an emergency condition would preclude purchasing on a competitive basis because of possible delays.
The foregoing brief observations cover only the superficial aspects of the depart- ments which come under the General Manager's jurisdiction. Many interesting de- tails are contained in the detailed reports of the various departments which follow.

The following is a brief summary of requisitions, purchase orders and invoices handled by the department during the year ending December 31, 1947:

The foregoing summary reflects some of the activities of the Purchasing Depart- ment during the year. In connection with each and every order, numerous telephone calls, letters and other forms of communication were utilized in order to ascertain proper competitive prices, delivery dates and other important information. In all but emergency cases, the spirit of competitive bidding was utilized to the fullest extent in order that Town purchases be made at lowest possible prices provided quality, service, delivery, etc., were comparable. Local vendors were always con- tacted first in order to give them the opportunity to do business with the Town.
In connection with practically all purchases made during the year 1947, progres- sively higher prices were the rule rather than the exception. Some manufacturers, especially those who make transformers, meters and similar products for the Muni -. cipal Light Department, still follow the wartime policy of inserting escalator clauses in all purchasing and sales agreements whereby regardless of the quoted prices at the time of the purchase order, the actual price does not become known until delivery time which in many cases were anywhere from 10 months to 18 months thereafter. From the standpoint of municipal budgeting and financing, the sooner we can pin vendors down to fixed prices and to eliminate completely the so-called escalator clauses, the sooner we will be able to make our purchases on a more financially prudent basis.
It is to be sincerely hoped that progressively rising prices and escalator clauses will not beset us in the year 1948 as they did in the year just ended.
