The Selectmen having appointed John B. Fisher and John F. Reilly as inspectors, under the provisions of Sec. 20, Acts of 1889, said inspectors were sworn to the faithful performance of their duties by the Town Clerk, and acted as ballot clerks under the provisions of said act. The deputy inspectors appointed by the Selectmen were Andrew J. Norris and M. Gardner Boyd, and they were also duly sworn by the Town Clerk, and in the absence of the inspectors acted in their place as ballot clerks.
Twenty voting shelves, or compartments, were provided by the Town according to the requirements of said act, and guarded as therein required, and one set of the ballots furnished by the Secretary of the Commonwealth was by the Town Clerk (before the opening of the polls on said day) delivered sealed to the chairman of the Selectmen, and his receipt taken therefor. At the opening of the polls the seals of said package were publicly broken by the chairman, and the same were delivered to the bal- lot clerks, and cards of instruction, and specimen ballots, were posted in the compartments in the polling room as required by said act. Upon the delivery of the ballots to the voters by the ballot clerks the check list was used, and the name of each voter receiving a ballot checked thereon. The ballot as delivered to each voter was by him marked in the voting compartments and deposited by him in the ballot box called the Standard, furnished and certified to by the Secretary of the Commonwealth, but on account of some unknown defect in said box. its register did not correctly register the ballots as cast, and the following certificate

Town Meeting, Dedham, Nov. 5, 1889.
The undersigned, Selectmen of Dedham, hereby certify that the Standard Ballot Box, used this day at the election in said Dedham, through some unknown defect in its machinery, did not correctly register the ballots this day cast at said election, but in many instances registered two numbers for one ballot, but that all the ballots cast were duly cancelled by said box, and all the ballots cast at said election were by the voters deposited in said box.

The Selectmen appointed Fred. J. Stimson, Edward L. Bur- dakin and Julius H. Tuttle as tellers to aid them in sorting and counting said ballots, and before entering upon their duties as such tellers they were duly sworn by the Town Clerk. The whole number of ballots cast was 1053, and the check list used at the ballot box showed 1053 names checked thereon.
On motion the polls were closed at twenty minutes past four o'clock, p. m.
After the declaration of the vote, all the ballots cast at said election were sealed up in an envelope and indorsed thereon by the Selectmen, and the check lists used were also sealed up, and all placed in the custody of the Town Clerk. Certificates of said ballotings, signed by the Selectmen, and attested by the Town Clerk, were sealed up in open town meeting ; after which, on motion, at 8.50 o'clock, p. m., the meeting was dissolved.

We, the undersigned, legal voters of the Town of Dedham, respectfully represent that we have reason to believe that the re- turns of the Selectmen of said town are erroneous, in the return of the vote cast for District Attorney for the Southeastern Dis- trict, in said town, at the election held on Tuesday, Nov. 5, 1889. Wherefore we pray that this statement may be transmitted to the Selectmen, and a recount of the votes cast for the candidates for said office be had, according to the provisions of Chapter 262 of the Acts of 1886.

Pursuant to the foregoing petition, the Selectmen gave no- tice by mail to Harvey H. Pratt of Abington and Charles W. Sumner of Brockton, and a personal notice to said Feely, that Tuesday, the 12th day of November, 1889, at nine o'clock A.M., at Memorial Hall in said Dedham, was the time and place ap- pointed for recounting the votes cast in said town at the election, the 5th day of said November, for District Attorney for the Southeastern District, at which time and place a majority of the Selectmen, with the Town Clerk and the tellers appointed at said election met, and no party appearing to represent either of said candidates, the Town Clerk delivered the envelope containing said ballots to the Selectmen, who broke the seal thereof and re- counted the votes for said office, and it was found that said Har- vey H. Pratt had four hundred and eighty-two votes and said Charles W. Sumner had four hundred and forty-two votes, and a certificate of the result of such recount was made out and signed by a majority of the board of Selectmen and attested by the Town Clerk and sealed up in an envelope and delivered to the Town Clerk to be forwarded to the Secretary of the Commonwealth, and all said ballots cast at said election were thereupon again sealed up in an envelope and endorsed by the Selectmen and placed in the custody of the Town Clerk.
