COMMONWEALTH OF MASSACHUSETTS.

NORFOLK, SS. To either of the Constables of the Town of Ded- ham, in said County, Greeting :
You are hereby required, in the name of the Commonwealth aforesaid, to notify and warn the inhabitants of said town of Dedham, qualified to vote in town affairs, to assemble at Memo- rial Hall, in said town, on the first Monday in March, (being the seventh day of said month), A. D. 1887, at seven o'clock in the forenoon, then and there to act on the following articles, namely :
Article One .- To choose a Moderator to preside at said meeting.
Article Two .- To see if the Town will choose the Selectmen Surveyors of Highways, and authorize and instruct them to em- ploy a Superintendent of Highways.
Article Three .- To vote upon the following question : Shall licenses be granted for the sale of intoxicating liquors in the Town? The vote on this question is to be by a separate ballot, and the ballot shall be "Yes" or "No" in answer to said question.
Article Four .- To choose all necessary town officers. The following are chosen by ballot : Selectmen, Assessors, Overseers of the Poor, Board of Health, Town Clerk, Town Treasurer, Col- lector of Taxes, School Committee, Auditors and Constables- two School Committee for three years each. All other town offi- cers are + be chosen for one year ; all of said votes to be on one ballot.
Article Five .- To hear and act on the Report of the Audit- ors of the Treasurer's and Collector's Accounts.
Article Six .- To see if the Town will accept the List of Ju- rors as prepared by the Selectmen, and posted according to law.
Article Seven .- To see if the Town will authorize the Col- lector of Taxes to use the same means as Town Treasurer may use when acting as Collector.

Article eight .- To see what action the Town will take with reference to the compensation of the Collector of Taxes, as pro- vided in Section 6, Article 3, of the By-Laws.
Article Nine .- To hear and act on the report of the com- mittee on the distribution of the interest of the Damon and Draper donations, and choose a committee to distribute the inter- est the ensuing year.
Article Ten .- To see what sums of money the Town will raise to defray the incidental and other necessary expenses, not otherwise provided for, of the Town for the ensuing year.
Article Eleven .- To see what sums of money the Town will raise and appropriate for the decoration of the Soldiers' graves.
Article Twelve .- To see if the Town will raise and appro- priate money to aid the Dedham Public Library.
Article Thirteen .- To see if the Town will raise and appro- priate money to keep the cemeteries in Dedham Village and West Dedham in repair.
Article Fourteen .- To see what rate of interest the Town will authorize the Collector to charge on all taxes not paid Nov. 1, 1887.
Article Fifteen .- To see what sums of money the Town will raise and appropriate for payment of the salaries of the School Teachers and Superintendent of Schools the ensuing year.
Article Sixteen .- To see what sums of money the Town will raise and appropriate for Repairs and Care of the School-houses, and for Fuel and Supplies for the same.
Article Seventeen .- To see what sum of money the Town will raise and appropriate for School Stationery and Text Books.
Article Eighteen .- To see if the Town will appropriate the amount received from other towns for scholars attending the Public Schools in Dedham, for contingent expenses of the Public Schools.
Article Nineteen .- To see what sum of money the Town will raise and appropriate for furnishing the new High Schoolhouse.
Article Twenty .- To raise and appropriate money to pay for water for Hydrants and Public Buildings required by the contract with the Dedham Water Company.
Article Twenty-one .- To see what sums of money the Town

will raise and appropriate for repairs of highways, sidewalks, and for lumber for the repairs of bridges and railings.
Article Twenty-two .- To see if the town will accept Ash street and so much of Carroll avenue as lies between said Ash street and East street, as laid out by the Selectmen, and raise and appropriate money for the same.
Article Twenty-three .- To see if the town will purchase land of James Shine for a gravel pit adjoining the Town pit on East street.
Article Twenty-four .- To see if the Town will raise and ap- propriate money to build a drain across High street to drain Linden Place.
Article Twenty-five .- To see if the town will raise and ap- propriate money for the purpose of filling and raising the road- bed in the hollow adjoining the land of Amory Fisher and heirs of C. Capen, in Dedham woods.
Article Twenty-six .- To see if the Town will authorize the Superintendent of Streets to pay the men employed upon the highways as much as $2.00 per day.
Article Twenty-seven .- To see if the town will vote to au- thorize the Superintendent of Streets to fill the mudhole on Bridge street adjacent to land of A. W. Nickerson, and appropri- ate money for the same.
Article Twenty-eight .- To see what action the town will take upon the subject of establishing a grade and boundaries of the streets and highways, and of drainage and sewerage of the Town. ·
Article Twenty-nine .- To see if the Town will appropriate money to pay the bills of the Assessors for services rendered for the year 1885 to March 1, 1886.
Article Thirty .- To see if the Town will appropriate a sum of about eleven hundred dollars to cover expenditures made un- der the directions of the committee in celebrating the 250th anniversary.
Article Thirty-one .- To see if the Town will reimburse Moses Kingsbury, 2d, for taxes overpaid by him.
Article Thirty-two .- To hear and act upon the report of a committee appointed to revise the By-Laws of the Town, and to amend existing by-laws or adopt others.

Article Thirty-three .- To hear and act on report of Com- mittee.
Article Thirty-four .- To see what action the town will take with reference to printing the proceedings of the 250th anniver- sary, and if necessary, to raise and appropriate money for the same.
By-Laws of the Town require the polls to be open at 7 o'clock, and remain open till 30 minutes past four in the after- noon.
Hereof fail not, but make return of this warrant, with your doings thereon, unto the Selectmen, on or before said day and time.
Given under our hands, and the seal of said town, at Ded- ham, aforesaid, this twenty-fourth day of February, A. D., eight- een hundred and eighty-seven.

On the foregoing warrant the following return was made : Norfolk, ss. DEDHAM, March 5th, 1887.
By virtue of this warrant, I have notified and warned the legal voters of the town of Dedham, to meet at the time and place, and for the several purposes specified in said warrant, by post- ing attested copies thereof in each of the Post Offices in said town, and in twenty other public places in said town, seven days at least before the day of said meeting, and by causing an attested copy thereof to be published twice, before the time of said meeting, in the Dedham Transcript, a newspaper published in said town.

At a meeting of the inhabitants of the town of Dedham, in said County, qualified to vote in town affairs, held pursuant to the foregoing warrant, at Memorial Hall, in said town, on the first Monday of March (being the seventh day of said month), A. D., 1887.

The meeting was called to order at the time and place named in said warrant, by the Town Clerk, who presided at the choice of Moderator.
Article One .- Fred. J. Baker was appointed and sworn by the Town Clerk a teller to aid the Town Clerk in receiving and counting votes cast for Moderator.
Alonzo B. Wentworth was chosen Moderator by written ballot, in receiving which the check list was used.
Article Two .- Voted to choose the Selectmen Surveyors of Highways, and authorize and instruct them to employ a Superin- tendent of Highways.
Article Three .- Voted to take up this article and ballot thereon at the same time ballots are cast for town officers under article four, at which time the vote on said question was taken by separate ballots, and the result was as follows :- " Yes," four hundred and twenty-five ; " No," four hundred and forty-eight.
And March 8, 1887, the Town Clerk transmitted a true state- ment of said vote to the Secretary of the Commonwealth.
Article Four .-- Under this article Elisha Greenhood moved that the town proceed to ballot for five Selectmen, who shall also be Assessors, Overseers of the Poor, and Highway Surveyors ; three members of the Board of Health, a Town Clerk, a Town Treasurer, a Collector of Taxes, three Auditors, two School Com- mittee for three years each, and nine Constables, all on one ballot.
To this motion Alfred Hewins offered the following amend- ment, viz : - To choose five Selectmen, five Assessors, five Overseers of the Poor, five Surveyors of Highways, three members of the Board of Health, a Town Clerk, a Town Treas- urer, a Collector of Taxes, two School Committee for three years, three Auditors, and nine Constables, all on one ballot. Upon the vote taken on the amendment, it was voted in the negative and so declared by the Moderator, and upon the vote taken upon the original motion, it was voted in the affirmative, and so declared by the Moderator. The Moderator appointed as tellers to assist him in receiving, sorting and counting the ballots under this article, Howard Colburn, Fred. J. Baker, E. Scott Morse, Edwin A. Chase, Charles J. Hurley, F. F. Favor ; and the same were sworn by Town Clerk. At half past four o'clock in the afternoon it was voted that the polls be closed in ten minutes. Before the

polls were closed, John R. Bullard presented the following protest :
Whereas it was declared by the viva voce vote of a majority of voters present and voting, before balloting for town officers began, that "the Selectmen should serve as Assessors, Overseers of the Poor, and Surveyors of Highways," and whereas the Mod- erator of this meeting has ruled that under said vote the town is bound to elect the same persons to all these offices, and that bal- lots cast for different persons for said offices shall be of no effect as to some of said offices, and that the same shall not be counted as legal votes therefor : Now, the undersigned, legal voters who have cast their ballots for different persons to fill said several offices, hereby protest against said ruling because it is wrong in law, and deprives them of their constitutional and statutory right to ballot for different persons to fill said several offices, hereby demand that said votes shall be counted as legal votes, that their number shall be declared to the meeting, and that, if the persons named on said ballots have a majority of all the votes cast for candidates for any of said offices, said persons shall be declared elected. And they further demand that all ballots cast at this meeting be sealed up and preserved, and that this protest be made part of the record of this meeting.

In receiving the ballots cast at this meeting the check list was used. At forty minutes past four in the afternoon the polls were closed, after which the Moderator appointed as the Com- mittee under the By-laws of the town, to whom were referred the remaining articles in the warrant, the following persons :- A. After the ballots for town officers had been counted, the Moderator made declaration that the following persons had been elected by the town, viz :
For Selectmen, Assessors, Overseers of the Poor, and High- way Surveyors :- Andrew J. Norris, Michael Smith, fAlonzo B. Wentworth, Isaac Wallace White, and Willis C. Fuller.
For Board of Health :- John W. Chase, Andrew H. Hodg- don and Preston R. Mansfield.
For Auditors : - Daniel A. Lynch, Frank M. Bailey and Edward C. Paul.
For Town Clerk :- Don Gleason Hill, and said Hill was sworn into said office in open town meeting by the Moderator.
For Town Treasurer :- Lewis H. Kingsbury.
For Collector of Taxes :- Thomas J. Baker.
For School Committee for three years each :- George W. Cooke and Robert J. Johnson.
For Constables :- William F. Drugan, Martin J. Barrett, Charles O. Haynes, Daniel W. Bonney, James J. Gaffney, Eustis Baker, J. Varnum Abbott, John Dean, and John J. O'Reilley.
Before the balloting began, the Moderator ruled and an- nounced to the meeting, that all ballots must be in conformity with the vote passed by the town on the motion of Mr. Greenhood, afore- said, and that the same persons must be named thereon for said offices of Selectmen, Assessors, Overseers of the Poor and High- way Surveyors, and that any ballots containing the names of more than five different persons in the aggregate to fill all said four of- fices, were not in conformity with said vote, and legally could not be counted ; and the ballots cast at the meeting which were not in conformity with said vote and ruling were not treated as legal ballots for said offices, and were excluded from the count.
In declaring the result of the balloting, the moderator an- nounced as follows :
Sept. 8, 1887, Thomas P. Murray was duly sworn by the Town Clerk in the office of Selectman, Assessor, Overseer of the Poor, and Highway Sur- seyor, to which he had been elected for the ensuing year, as determined by the Supreme Judicial Court in the case of Attorney General vs. A. B. Wentworth, in the County of Norfolk.
