Report of the Committee on Claims.


The Committee on Claims herewith submits its fourth annual report:


1. The Town of Lincoln v. The County Commissioners of Middlesex.


There has been nothing done in this case since the last report.


2. Francis Smith v. The Town of Lincoln.


This suit, brought to recover damages for land taken next the old engine house lot, stands in the same situation as it did last year. It is not advisable to consider a settle- ment until the town has definitely decided what to do about a pumping station.


3. Charles S. Smith v. The Town of Lincoln.


This suit is about to be settled on the same terms that the Tarbell and Warren cases were settled in 1898. The Committee has caused a petition to be made to the present Legislature for an act enabling the proposed compromise and others like it to be made, and as soon as the act is passed the settlement can be consummated.


4. Two Petitions to the County Commissioners of Mid- dlesex for Relocating the Road from Concord to Waltham.


These petitions were explained in the last annual report of the Committee. The part of the road between the Con- cord line and the house of Francis Smith is covered by the petition of William S. Briggs and others, and the remainder of the road to the Waltham line is covered by the petition of Daniel H. Sherman and others. The hearings during the current year upon these petitions excited considerable pub- lic interest, and many citizens of the town, including a ma- jority of the petitioners themselves, remonstrated against any new location materially different from the old one; but the Commissioners and their engineer were decidedly of the opinion that it would be a waste of money to improve the

old location over the schoolhouse hill, and intimated that. instead of over the hill, they intended to relocate the road either through Mr. Wheelwright's land or through the val- ley from the Ellsworth place to Storey's corner. Mr. Wheelwright appeared by Samuel Hoar, Esq., his counsel. at a public hearing before the Commissioners. June 5. 1899. and earnestly opposed the proposed route through his land. His opposition was seconded by Mr. Storey, and there ap- peared to be a local sentiment in the East quarter of the town that of the two routes, if either were to be adopted. that through the valley was preferable. The Commission- ers acquiesced in this choice of routes, but called attention to the fact that, if they proceeded wholly under the Sher- man petition. all of the old road over the hill between the ends of the new strip would be discontinued by operation of law, and that. in such case, the residents along the hill road would be likely to claim substantial damages. On the other hand. if the hill road should be again laid out and this diffi- culty remedied. the town would immediately fall into an- other. for certain property owners would be sure to claim damages for such new laying out. The town was sure to be sheared both by the discontinuance and the new laying out. In such circumstances, in order to avoid dis- continuing the hill road. it was proper for some one to file a separate petition to lay out the road through the valley. Accordingly. Mr. William S. Briggs and others prepared and signed such a petition, and the Commissioners, after the customary hearings, acted upon it and laid out a new road from Ellsworth's land to Storey's corner. The Com- missioners have not yet made their final order upon the two original petitions covering the entire road from Concord to Waltham. but it is expected that they will make it before long. as their engineer has completed his surveys, and we understand that the boundaries have been staked.


The Committee, in view of the difference of opinion among the townspeople about the expediency of the work ordered or to be ordered by the County Commissioners, has pre- served throughout an impartial attitude. The only position

it has taken is to insist that if anything was ordered under the petitions mentioned, the county ought to share the ex- pense; and, as explained in the last report, it instructed the counsel for the town to present this view to the Commis- sioners. Accordingly, at every hearing on each of the peti- tions, counsel urged the reasons why the town should not alone bear the cost. The result of this course is now only partially known, as the Commissioners have acted on but one of the three petitions, that is to say, the one laying out the new road through the valley. For that part of the work the town was awarded $850.00, to be paid by the county. What sums, if any, will be similarly awarded for the other parts of the work the Committee has no present knowledge.


5. Petition to Lay Out a New Road from the Corner of Mathew Ellsworth's Land on the Old Road by His House to


the Corner of Roads Near the House of Moorfield Storey.


This is the petition mentioned above, brought by William S. Briggs and others to lay out a road through the valley in order to avoid discontinuing the old road over the hill. The petition was filed June 20, 1899, and after a view and hear- ing, the County Commissioners adjudged the road prayed for to be of common convenience and necessity. The new road was laid out by a return made November 11, 1899, fifty feet wide, with eighteen feet to be built for travel, and a grade not to exceed four feet in a hundred. The time set for its completion by the town is June 1, 1900. Damages were awarded as follows:

Report of Board of Health.


The Board of Health, to the Citizens of the Town of Lin- coln, respectfully presents its fifth annual report.


The membership of the Board was unchanged at the last annual town meeting and the organization of former years has been continued through the last year.


This Board has held numerous regular and casual meet- ings, as occasion seemed to require.


Early in the year a report reached the Board that certain parties contemplated the establishment of extensive slaugh- tering houses in the south part of the Town of Lincoln, and that they had bonded lands for that purpose; the experience of the past, as well as the fact that the parties had been urged to leave their former location, because of the offen- sive character of the business, led this Board, to take active measures against this innovation. A meeting of the citizens of the town was called to consider the proposition, which was promptly vetoed by a large majority of the voters pres- ent. The slaughter-house that has stood in the south part of the town for several years was within the line of the water-shed of the Cambridge water-works, and was so con- ducted as to induce the Cambridge authorities to purchase and destroy the same. Later, petitions from two different parties in the north part of Lincoln were presented to the Board of. Selectmen, praying for licenses to conduct slaugh- ter-houses in that part of the town. Both parties were re- fused, as being inconsistent with the higher interests of the town, as well as the rules established by the Board of Health.


At a meeting of this Board in March, Dr. Watson was ap- pointed to call upon all citizens of the town, and especially the public schools, to impress upon all the importance of vaccination and to vaccinate any and all who would con- sent, at the cost of the town. This commission was ac- cepted by him; the number of those who were not protected fully warranted our action. In April the Board procured

the service of a constable to give a legal notice to one of our citizens who had transgressed the rules and regulations of the Board; immediate compliance with the order resulted. The regulations of the Board have been revised and pub- lished, in which the aim is to allow the widest measure of freedom to all, consistent with the general welfare. In our investigation of places to see whether they were being used illegally for the slaughter of animals, we were in one in- stance refused admission to the premises, and the Board in October appointed as its agent each member of the Board and Mr. L. E. Brooks, with full powers to. act for the Board, that the execution of its regulations may not be obstructed.


As usual, the mortuary record for the last year fully sus- tains our claim, as the healthiest town in the State. Sixteen deaths are recorded, of which four were under fourteen months, four between seventy and ninety years, two be- tween sixty and seventy, one each fifty-six and fifty-eight, four between eleven and thirty-eight years. The average duration of life, including the four infants, was about forty years; excluding them. it is 52 years 9 months. Of infec- tious diseases the record shows two cases of typhoid fever, one of scarlet fever and one cerebro-spinal meningitis. One of the typhoid fever cases terminated fatally. All of the other infectious cases recovered.


The necessity for an efficient disinfecting apparatus led to the purchase of one reputed the best, at a small cost, in view of its indispensable necessity. The Board respectfully solicits the co-operation of all citizens in the great cause of public health.

The money appropriated at the last annual meeting for highways and bridges has been expended as follows: High- way surveyor, $350; bills of 1898, $90.65; for crushed stone, $153.30; for putting out the crushed stone, $37; scraping roads, cleaning out gutters and picking up stones, $358; re- pairs on Virginia road, $182; on Bedford road, $107; on the Turnpike, $17; from the Center to the Turnpike, $23; in the Center, $111; widening road west of Cemetery, $56; repair- ing road from the Cemetery to the Turnpike, $20; road from the Center to Lincoln street, Waltham, $335; from Lincoln street road to Winter street, Waltham, $32; from Lincoln street road to Plain road, $45; on the Plain road, $400; the Pond road, $30; road from R. R. Station to Cen- ter, $106; Tower road, $35; from Great road to Concord, $147; the Great road, $760; from R. R. crossing to Wayland, $60; for drilling and blasting, $78; removing stones, loam, &c., from the gravel pits, $158; drain pipe and repairing culverts, $30; building wall and railings, $23; for gravel, $147; repairing tools, $7.86; lumber, $48.21; mowing brush, &c., beside the highways, $20; repairing washouts and gen- eral patching up, $33.14; making a total of $4000.16. There has also been expended and paid from the contingency ap- propriation bills to the amount of $78.38, and for breaking out roads and snow work $1033.20.
