Report of the Committee on Claims.
Two suits have been brought against the town dur- ing the past year: Michael Dempsey vs. Town of Lin- coln and County of Middlesex; and Frank M. Dempsey vs. Town of Lincoln and County of Middlesex. These suits are petitions to the Superior Court of Middlesex county praying for the assessment of damages occasioned by the taking of land for the new road in East Lincoln. We have taken no action except to instruct counsel to enter an appearance for the town. It is not likely that any further action on our part will be necessary, because, as we explain below, the town has been relieved by the Supreme Judicial Court from liability for land damages, and the county must defend the suits alone.
The town instructed us by vote to take appropriate steps to reverse the action of the county commissioners in laying out the new road from Storey's corner to Mathew Ells- worth's, and also to procure such modification as might be possible of their decree, locating anew the road by the house of William S. Briggs from the Waltham line to the Concord line. We consulted the counsel for the town, who advised us that no informalities in procedure in either of these cases could be found, except that in the first instance the com- missioners had made a mistake in assessing the land dam- ages upon the town instead of upon the county. Accord- ingly a petition for a writ of certiorari was brought in the Supreme Judicial Court praying that the decree of the county commissioners laying out the road from Storey's corner to Mathew Ellsworth's be quashed and annulled.

The result was that the decree was modified so that the land damages should be paid by the county.
The suits of Charles S. Smith and F. Smith for damages occasioned by taking land on the shores of the pond to pro- tect the purity of the water have nearly reached a settle- ment. The suit of F. Smith for damages for taking of land to be added to the engine house lot will probably go to a jury.

Water Commissioners' Report.
The Water Commissioners herewith present their annual re- port.
The new works which were just completed at the writing of the last report have given good results during the year, and have fully justified the expectations of the commis- sioners.
A little over 213 gallons of water have been pumped per pound of coal consumed; this consumption of coal included the amount used in heating the building.
In 1900 no accurate account of coal could be kept, owing to the construction work, but in 1899 the amount pumped per pound of coal used was III gallons; thus the amount of coal used in pumping has been reduced one half. Had the coal used the last half of the year been as good as the ordinary run of Pocahontas coal the result would have been very much better.
On April 18 a test of the pump was made under the direc- tion of the engineer, Mr. Walter H. Sears.
It is sufficient to say that the test was entirely satisfactory. A copy of the engineer's report is included in this report. The guaranteed duty of the pump was 45,000,000 foot pounds per hundred tons of coal for a 24-hour test, or 33,000,000 foot pounds per hundred tons of coal for a two weeks' test, including banking. It will be seen by the statis- tics in the report that for the year the average duty, includ- ing banking, has been nearly 35,000,000 foot pounds.
The boilers have been insured for three years for $10,000 in the Hartford Boiler Insurance Co. at a cost of $90.00. This insurance includes inspection of the boilers at least four times during the year and oversight of the same.

GRADING.
As soon as the ground opened in the spring, work was commenced upon the grading of the Pumping Station lot. The work was laid out by William Connors of Concord, and under his direction Edward Dempsey had charge of the work, which was done entirely by the day by citizens of the town, at a total cost, including the building of the driveway and seeding of the lot, of $978.28. There still remains a pipe fence to be built along the roadside, which has been contracted for, including the setting of the same, for the sum of $165.00.
