In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the Town of Lincoln, duly qualified to vote in town affairs, to assemble in Bemis Hall, on Saturday, May 18, 1901, at 7.30 o'clock P. M., to act on the following articles, viz .:
ARTICLE I. To choose a Moderator.
Chose Charles S. Wheeler.
ART. 2. To see if the Town will accept the provisions of Chapter 270 of the Acts of 1901, entitled "An Act to authorize the Town of Lincoln to lay out special town ways for the use of street railway companies."
Voted, (Unanimously) That the Town hereby accepts the provisions of Chapter 279 of the Acts of the year 1901, entitled "An Act to authorize the Town of Lincoln to lay out special town ways for the use of street railway companies."
ART. 3. To see if the Town will take action with refer- ence to the guarding or abolition of grade crossings on steam railroads.
Voted, That a committee of three be appointed by the Mod- erator to consider the subject of the guarding or abolition of grade crossings on the Fitchburg Division of the Boston and Maine Railroad in the Town of Lincoln, to report at some sub- sequent meeting of the Town. And the Moderator appointed the following persons as that committee, namely: H. E. War- ner, Dr. S. H. Blodgett and C. Lee Todd.
ART. 4. To see if the Town will release any lands or rights- or easements therein taken by the Water Commissioners for water purposes, or will take any action in reference to making such releases, under Chapter 148 of the Acts of the year 1900.

Voted, That the Selectmen are hereby authorized to accept in the name and in behalf of the Town such releases of lands or rights and easements therein as may be agreed upon by the Committee on Claims, and any person for the purpose of com- promising claims for damages occasioned to such person by reason of any taking of land by the Water Commissioners, such releases to be executed under authority of Chapter 148 of the Acts of 1900.
ART. 5. To see if the Town will make an appropriation for street lighting.

Extracts from Acts and Resolves of 1897, Chapter 144.
Sect. 3. Physicians and midwives shall on or before the fifth day of each month report to the clerk of each city or town a correct list of all children born therein during the month nex preceding, at whose birth they were present, stating the date and place of each birth, the name of the child, if it has any, the sex and color of the child, the name, place of birth and resi- dence of the parents, the maiden name of the mother, and the occupation of the father.
Any physician or midwife neglecting to report such list for ten days after it is due shall for each offence forfeit a sum not exceeding twenty-five dollars.
Sect. 8. Any parent, keeper, superintendent or other per- son required by Section 6 of this Act to give, or cause to be given, notice of a birth or death, who neglects to give the re- quired notice, or cause the same to be given, for ten days after it is due, shall for each offence forfeit a sum not exceeding five dollars.
In conformity with the requirements of Chapter 144, Sec- tion 17, of the Acts of 1897, the Town Clerk hereby gives notice that he is prepared to furnish to parents, householders, physicians and midwives applying therefor, blanks for returns of births as required by law.
DOGS LICENSED.
There have been 129 dogs licensed, 107 males, 22 females, and I kennel, for which $348 have been paid to the County Treasurer.

SELECTMEN'S REPORT.
The Selectmen herewith submit a list of the expenditures of the Town in the various departments for the past year. No unusual expenditures have been incurred except for that in connection with the laying out of a way for electric roads, and all departments have expended as little money as is consistent with a wise economy.
Electric Roads.
On account of suggestions received from persons in the north part of the Town, who have been most interested in the matter, the Selectmen have laid out a special way for an elec- tric line, north of the. turnpike, beginning at a point on the turnpike near the house of Mrs. Fitzgerald, and passing over a most feasible route between the turnpike and the State Road, to a point on the turnpike, near the Lexington line, which route we will submit to the Town, at the annual meeting. for their consideration.
Street Lamps.
The street lamps have been maintained, and the streets have been lighted from the Town Hall to Farnsworth's Corner for less than within the appropriation.
Tree Warden.
In addition to the amount expended by the Tree Warden as reported, we have received from the Hon. Charles F. Adams the sum of $147, which he presents to the Town as his contribution for the care of the trees.
Telephone and Telegraph.
We have received several petitions for locations and reloca- tions of lines of the New England Telephone & Telegraph

Company. A location from the Trapelo road to the house of Mr. DeNormandie has been granted.
Fire Department ..
The hose carriages have been remodeled and improved s. that besides being more convenient for use, they will be much more efficient than formerly, especially if the captains of the hose companies call their men together for practice often.
Town Hall.
The Town Hall is, we are sorry to say, in bad condition, which is due, we believe, to faulty construction. To what ex- tent repairs should now be made, we are not at this time pre- pared to state. We believe that in the near future extensive repairs will be necessary.
New Road.
We quote the following from the Commissioner's report : (272.), (301.) These two cases, disposed of by decrees in 1899 and 1900, required certain construction to be performed on the old road from Waltham to Lincoln, from the Cam- bridge reservoir to near Matthew Ellsworth's, and a new road constructed from the latter place to near Mr. Storey's. The Town of Lincoln asked the Supreme Court to grant a writ of certiorari and annul the proceedings in laying out the new road. In June the Court made the following decree :-

Town of Lincoln vs. County Commissioners of Middlesex. Decree.
The said cause having come on to be heard upon the petition and answer, and a writ of certiorari having been ordered to issue, and the record of the respondents having been certified to this court, now therefore, upon full hearing thereof and the arguments of counsel thereon, and consideration thereof, it is hereby ordered, adjudged, and decreed that so much of said record as provides for the payment of land damages directly by the Town of Lincoln be quashed and annulled and ren-

dered of no effect; and it is further ordered and decreed that all land damages be paid from the County Treasury. And inas- much as the respondents ordered and determined the sum of eight hundred and fifty (850) dollars to be a fair and just pro- portion of the expenses of the alterations decreed by the re- spendents to be paid by the County, it is therefore ordered, adjudged, and decreed that the respondents shall deduct the amount of the land damages paid by the County from said sum of eight hundred and fifty (850) dollars, and shall draw their warrant upon the Treasury of the County in favor of the Town, only for balance, if any, remaining after said land dam- ages have been deducted; and if the amount of said land dam- ages shall exceed the said sum of eight hundred and fifty (850) dollars, the said Town shall pay to the county the amount of such excess; and if it shall refuse to do so, the same proceed- ings shall be had to enforce the payment thereof as are pro- vided by law in case of expense of making highways by the County Commissioners, where cities or towns neglect to make the same.

This disposed of all questions relating to the sufficiency and legality of the Commissioners' proceedings, and the decree of the Commissioners, as corrected by the above decision, made it necessary that the road be built in accordance with the order. The time fixed for the completion of the roads expired, and the board proceeded to make contract for the completion of the work ordered. Mr. W. H. Wales, of Everett, was the lowest bidder, and the work has proceeded during the past few months. Payment has been made to the contractor of $5,021.51, the same being eighty-five (85) per cent. of the value of the work completed. The road is not finished, and will require some attention in the Spring.
The following letter has been received from the County Commissioners :
East Cambridge, Dec. 6, 1901.
The work of building the road in the east part of Lincoln has been nearly completed by the contractor. Some fence re- mains to be erected, but when this has been done the work will probably be completed.

The account of expense has been carefully kept, and the total will be between six and seven thousand dollars, not in- cluding land damages.
The total of the county's share of the expense is $850 on account of the new road and $1,000 on account of the old road, which amounts are payable when all damages are settled. The portion of the old road built was all that our decree required with respect to construction on the old road, although the lines were laid from the Cambridge reservoir to Walden street near Francis Smith's, except the portion covered by the new road,-and nominal damages were estimated for small takings throughout the whole. We have paid the contractor to date $5,021.51, which sum is 85 per cent. of the value of the work completed.
You will recollect that the statute requires that the Town repay the County its proportion of the expenses with 10 per cent. interest. We wish to suggest that the sum of $5021.51 be paid the County by the Town at this time to obviate the necessity of the interest charge to be made the Town, and to reimburse the County for its expenditure. The amount of the land damages to be borne by the County under the de- cree of the Court and the remaining amount to be paid the contractor will fully take care of the amount of the County's share of the expense.
We make this suggestion because we believe we shall save the Town a considerable interest charge (as final accounts may not be settled for some time), and to reimburse the County for an expenditure which really belonged to the Town. We accordingly present a statement for the amount due.

Report of the Overseers of the Poor.
In February of the last year, Patrick Kenna, who has been supported by the Town for many years in the Worcester Insane Hospital, died.
After his death, until May, the Town had four persons re- ceiving full support, all of whom are in insane asylums, viz .: Jere Burrett, Mary Curry, Marianne Souza and Mary Craven. In May, application was received for aid for two persons, viz .: David T. Lynagh and Helen Lynagh. In the outset some as- surance was given by members of the family that at least a part of the expense would be paid by them, but the Town has paid for their support since May. We now have six persons receiving full support from the Town, all of whom are insane.
We recommend that an appropriation of twelve hundred dollars be made for the support of poor the current year.
