Report of the Committee on Claims.
The Committee on Claims which was chosen for the third time at the last annual town meeting, presents the following report :
Few new matters have come before the committee during the past year, and almost all of the old matters have been finally disposed of. The suits to recover damages for land taken around Sandy Pond have all been settled with the exception of those of Francis Smith and Charles S. Smith. It is likely that one at least of these cases can be settled, and the determination of the other depends upon the final action of the town in locating the engine house. There have been no new developments in regard to the claims of Concord to the waters of Sandy Pond.
The following is a detailed statement of matters now pending upon the docket of the committee, and matters which have been finally disposed of :
PENDING MATTERS. .
1. The Town of Lincoln v. The County Commissioners of Middlesex.
This case stands in the same situation in which it did when we made our last report.
2. Francis Smith v. The Town of Lincoln.
This suit is to recover damages for taking a lot of land adjacent to the lot occupied by the present power station of the water works. No action has been taken in this case toward bringing it to trial or settlement, for the reason that the location of the new power station has not been finally determined by the town. It is obvious that neither the petitioner or the town can come to a sat- isfactory adjustment of the case until it is known what land will be needed for the new power station.
3. Charles S. Smith v. The Town of Lincoln.
This was a petition for the assessment of damages for land taken for water purposes. The land is woodland on the westerly shore of Sandy Pond ; and as it has been suggested by the peti- tioner that he is willing to settle the case in substantially the same
