BOOKS.


Section 1. Books, records and laws received by the town from the commonwealth shall be deposited in the public library building.


Sect. 2. It shall be the duty of the town officer by whom any book mentioned in the preceding section is received, to cause the same to be at once deposited in the public library building.


Sect. 3. Such books may be used by the inhabitants of the town within such building, and may be taken therefrom upon written receipt to the librarian for a period not ex- ceeding one day at any one time for use in any town meet- ing, or by or before any committee or official of the town.

ARTICLE VI.


SUITS AND CONTROVERSIES.


Section 1. The selectmen may compromise claims and suits to which the town is a party, provided that they shall act upon the advice of counsel when the amount claimed by or against the town exceeds $200.00.


Sect. 2. The selectmen shall have, unless it is otherwise voted by the town, full authority as agents of the town to institute and prosecute suits or other proceedings in the name of the town before any tribunal, to appear and repre- sent or defend the town before any tribunal in all suits and other proceedings against the town or in which the town has an interest, to employ counsel for the purpose aforesaid and for other purposes when it may be expedient to do so, and to take all necessary and proper measures for the pro- tection of the interests and rights of the town.


Sect. 3. If the town shall, at any meeting called for the purpose, choose, a committee on claims, such committee shall have and exercise exclusively all the powers and duties conferred upon the selectmen by the two preceding sections.


ARTICLE VII.


REPORTS AND PUBLICATIONS BY THE TOWN.


Section 1. The annual reports of the town officers, boards and committees shall be prepared in form suitable for printing on or before the tenth day of February in each vear. The selectmen shall cause such reports to be printed and distributed to the legal voters of the town seven days at least before the annual meeting.


Sect. 2. The selectmen shall cause to be printed and bound each year with the annual reports of the town officers, boards and committees, a copy of the records of the town meetings during the preceding year; a statement of all devises, bequests and donations to the town during the

preceding year; a list of all laws of the commonwealth ac- cepted by the town during the year; all by-laws adopted by the town since the preceding annual report; copies of the laying out, alteration, locating anew or discontinuance of any highway or townway within the limits of the town dur- ing the preceding year; and a statement of all outstanding bonds, notes and obligations of the town for the payment of money.


Sect. 3. The selectmen shall from time to time cause to be printed a sufficient number of copies of the by-laws of the town and shall incorporate therewith a list of the laws of the commonwealth which have been accepted by the town.


ARTICLE VIII.


TRUANTS.


Section 1. Any minor being an habitual truant, and any child between the ages of seven and fifteen years found wandering about the streets or public places within the town having no lawful occupation or business, not attend- ing school, and growing up in ignorance, and such children as persistently violate the reasonable rules and regulations of the public schools, may upon conviction thereof be com- mitted to the Middlesex County Truant School at Chelms- ford, Mass., or to any other place provided by the town within its limits, for confinement, instruction, and disci- pline.


ARTICLE IX.


PUBLIC REGULATIONS.


Section 1. No person shall coast upon any public street or part thereof after the selectmen have posted a notice prohibiting coasting upon such street or part thereof.


Sect. 2. No person, unless authorized by law, shall break or dig up any part of any street without a written permit therefor from the selectmen. Every person who

after obtaining such permit shall obstruct or render unsafe any public street, shall guard the same by a proper fence or railing, and by lights during the night time, subject to the approval of the selectmen. Such permit may be revoked at any time.


Sect. 3. No person shall be or remain in any doorway, or upon any stairs, doorstep, portico or other projection from any house or building, or upon or against any wall or fence on or near any street or public place, after having been requested by the owner or any occupant of the premises or by any constable or police officer to remove therefrom.


Sect. 4. No person shall make, write, print, paint, cut or post any indecent or obscene marks, words, figures or signs upon any fence, building, post, tree or other object exposed to public view.


Sect. 5. No person shall wilfully injure, mar, deface or destroy any fence, signboard, guideboard, lamp-post, lamp or lantern in any street or public place, nor extinguish any street light, nor extinguish or remove any light placed to denote an obstruction or a defect in any public street or way, without proper authority to do so.


Seet. 6. Any person who shall offend against any of the provisions of this article shall forfeit and pay, for each offense, a sum not exceeding twenty dollars."

ART. 6. To give in their votes by ballot in answer to the question, " Shall licenses be granted for the sale of in- toxicating liquors in this Town?" The check list shall be used as provided by Section 5, Chapter 100 of the Public Statutes.


Voted, Yes, 26 votes ; No, 56 votes.


ART. 7. To determine the manner of collecting taxes the ensuing year.


Voted, that they be collected in the same manner as last year, and that the collector be authorized to use all means of collecting taxes which a Town Treasurer when appointed Collector may use.


ART. 8. To determine the compensation of the Collector of Taxes for the ensuing year.


Voted, that the compensation of the Collector be 12 per cent.


ART. 9. To see if the Town will authorize its Treasurer under the direction of the Selectmen, to borrow money in anticipation of taxes of the current year, and to be paid therefrom.


Voted, that for the purpose of procuring a temporary loan to, and for the use of the Town of Lincoln, in anticipation of the taxes of the present municipal year, the Town Treas- urer is hereby authorized and directed to borrow from time to time, with the approval of a majority of the Board of Selectmen, a sum or sums not exceeding in the aggregate $15,000, and to execute and deliver the note or notes of the Town therefor, payable within one year from the time the loan is made. Any debt or debts incurred by a loan or loans to the Town under this vote shall be paid from the said taxes of the present municipal year.


ART. 10. To see if the Town will choose a Committee on Claims under the provisions of Section 3, of Article 6 of the By-Laws.


Voted, to choose three persons.

ART. 11. To see if the Town will adopt the provisions of Chapter 264, of the Acts of the year 1890, entitled " An Act relating to Public Cemeteries," and choose thereunder a board of three Cemetery Commissioners, one member for three years, one member for two years, and one member for one year, the said terms to expire with the end of the official year of the Town, according to the provisions of the said Act ; and to see if the Town will take any other action in reference to the matter.


Voted to pass over.


ART. 12. To see if the Town will appropriate any money to settle claims for damages for land taken for water pur- poses or for highways, and will authorize the Selectmen to execute any deeds or releases to persons claiming such damages in order to compromise their claims, or will take any other action in relation to the matter.


Voted to lay on the table.


ART. 13. To see if the Town will authorize the Water Commissioners to acquire any lands or rights therein for water purposes and to erect a new pumping station and to install a pumping plant therein, and to lay the necessary pipes and connections ; and to see if the Town will appro- priate any money for the said purposes ; and to see if the Town will borrow any money and issue bonds, notes, or script therefor, in the manner authorized by the Acts enab- ling the Town to borrow money for water purposes, or take any action in relation to the matter.


Voted, that the sum of $5,000, of the money heretofore advanced to the Water Commissioners in anticipation of the issue of bonds to be authorized, be repaid into the Treas- ury of the Town upon the issue of such bonds as soon as the same can be prudently negotiated, and that said sum when so repaid be and the same is hereby appropriated for the purpose of a Sinking Fund to meet the payment of the Town's note for $10,000, now held by the Middlesex Insti- tution for Savings, and that the Town Treasurer be author-

ized to make a partial payment therewith on said note if that can be done on satisfactory terms.


Voted, that the offer of Mr. Smith be referred to a com- mittee of five, two of whom shall be appointed by the Moderator, two by Mr. Smith, and these four to select a fifth, and that Committee to report at a meeting to be called within one month.


ART. 14. To see what action the Town will take with reference to the order of the County Commissioners made Nov. 11, 1899, laying out a road from the land of Matthew Ellsworth to Storey's corner.


Voted, Whereas, as appears by the Report of the County Commissioners an order has been made for the building of a new piece of road from near the Ellsworth property to near the houses of Wheelwright and Storey in the Town of Lin- coln, as a change of the existing road, and Whereas said existing road is used very little except by the residents of Lincoln, and there appears to be no demand for any such change from neighboring towns, and Whereas in the opinion of the citizens of Lincoln, in annual Town Meeting as- sembled, the existing road if properly repaired, will fully meet all requirements of public travel, and great expense both to the County and to the Town of Lincoln may be avoided if such new road is not built,


Voted, that the Committee on Claims be instructed to pro- cure, if possible, a reconsideration and recission of said order of the County Commissioners and to take such other and further proceedings as in their opinion will be for the interests of the Town in obtaining an adjustment of this matter.

WARRANT.

To Lorenzo E. Brooks, or either of the Constables of the Town of Lincoln, in said County :


GREETING :


In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the Town of Lincoln, duly qualified to vote in Town affairs, to assemble in Bemis Hall, Thursday, April 12, at one o'clock, P.M., to act on the following articles, viz. :


ARTICLE 1. To choose a Moderator.


Chose Charles S. Wheeler.


ART. 2. To hear and act upon the reports of any Town Committees, or Commissioners that may be ready to report.


The Committee to whom was referred the proposition of Mr. Smith in regard to the pumping station of the Water Works read a report, and a motion being made to accept the report and discharge the Committee was rejected by a vote of 28 yea, to 36 nay.


ART. 3. To choose any necessary Town Officers, Com- missioners, and Trustees not already chosen.


Chose Sinking Fund Commissioner, Samuel H. Pierce.


Trustee of Public Library, James L. Chapin.


ART. 4. To see if the Town will cancel the contract made with the Deane Steam Pump Co., July 19, 1897.


Voted, not to cancel the contract with The Deane Steam Pump Company.

ART. 5. To see if the Town will authorize the Water Commissioners to acquire any lands or rights therein for water purposes, or take any further action in regard to the construction of a new pumping station for the Water Works, procuring new machinery and other appliances therefor, and laying and constructing pipes for the purpose of connecting such pumping station with the present water pipes, and with Sandy Pond; and to see if the Town will make any appro- priation for any of the said purposes, or take any action upon any appropriation already made therefor, or take any other action in relation to the matter.


Voted, (44 to 22) that the Town instruct the Water Com- missioners to. erect the new pumping plant on the land already acquired by the Town.


ART. 6. To appropriate money for necessary and expe- dient purposes of the Town, and enact anything in relation thereto, and to see what action the Town will take in regard to money paid from the Town Treasury for Water Construc- tion in the last three years.


Voted, to reappropriate the sum of $500. for a Flagg-staff and United States Flag.


Voted, that the Town fund the money paid from the Town Treasury the last three years for Water Construction, and reimburse the Treasury ; and that the appropriations of money made for water construction this year be also funded.


ART. 7. To see if the Town will extend the water pipe from its present terminus opposite William S. Briggs' estate, to a point opposite the house of Bridget Roach, and make provision for the payment of the same.


Voted, that the Water Commissioners be authorized to extend the water pipe from its present terminus opposite the stable of William S. Briggs to a point opposite the res- idence of Mrs. Bridget Roach; provided, that before the work of construction is begun one or more persons whom it is proposed to supply with water by means of such ex- tensions shall file with the Town Clerk a bond with sureties

satisfactory to the Water Commissioners in the form and manner required by Section 10 of Article II of the By-Laws, and the rate on said bond shall be 4 per cent. instead of 5 per cent. and the sum of $800. be appropriated for the same.


ART. 8. To see if the Town will extend the water pipe from its present terminus opposite John A. Burgess' house to a point opposite the house of Geo. L. Cousins, and make provision for the payment of the same.


Vo'ed, that the Water Commissioners be authorized to ex- tend the water pipe from its present terminus opposite the residence of John A. Burgess, to a point opposite the resi- dence of Geo. L. Cousins : Provided, that before the work of construction is begun, one or more persons whom it is proposed to supply with water by means of such extension shall file with the Town Clerk a bond with sureties satis- factory to the Water Commissioners in the form and manner required by Section 10 of Article II, of the By-Laws, and the sum of $2,500.00 be appropriated for the same.


Voted, that the vote be modified to make the rate on the bond 4 per cent. on extension to Mr. Cousins' house.


ART. 9. To see if the Town will erect Drinking Fount- ains, and make any appropriation for the same.


ART. 10. To see what action the Town will take with reference to the order of the County Commissioners made Nov. 11, 1899, laying out a road from the land of Matthew Ellsworth to Storey's corner.

In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the Town of Lincoln, duly qualified to vote in Town affairs, to assemble in Bemis Hall, on Tuesday, May 1st, at 7.30 o'clock P. M., to act on the following articles, viz. :


ARTICLE 1. To choose a Moderator.


Chose Thomas L. Giles, Moderator.


ART. 2. To see if the Town will designate a location for the Flag Staff or discharge the present Flag Staff Committee, and appoint a new committee or designate a time when the duties of the Flag Staff Committee shall cease, or do or enact anything in relation to the Flag Staff or the Committee.


Voted, That the Committee be instructed to erect the Flag Staff on the Common between the south end of the Town Hall and the chestnut tree, and not less than 20 feet distant from the Hall.


ART. 3. To see if the Town will borrow any money by an issue of bonds, or otherwise, under the provisions of Chap- ter 341 of the Acts of the year 1897, for the purpose of replacing 'in the town treasury such sums as have been ex- pended for extensions of the Water Works and paid for under votes of the town by funds taken from the town treas- ury temporarily pending an issue of bonds, or take any action in reference to the matter.


ART. 4. To see if the Town will borrow any money by an issue of bonds, or otherwise, under the provisions of Chapter 341 of the Acts of the year 1897, for the purpose of providing funds for appropriations made at the meeting held April 12, 1900, for extensions of the water pipes, or take any action in reference thereto.

On Articles 3 and 4, Voted, Unanimously that the Treasu -- rer of the Town is hereby authorized to borrow the sum of $6,289.20, or any part thereof, which sum is the amount appropriated for extensions of the water pipes at a meeting held April 12, 1900, together with the sums heretofore ex- pended on the extensions of the water pipes and paid from the town treasury under appropriations heretofore made by the Town, providing that the same be paid from the treasury, pending an issue of bonds ; and for the purpose of borrow- ing the said sum of $6,289.20 the Treasurer is authorized to issue from time to time the bonds of the Town, in denomin- ations of not less than $1,000 each, each of which bonds shall be payable in thirty years from the date of issue. The said bonds shall bear interest payable semi-annually, at a rate not exceeding four per centum per annum ; shall be signed by the Treasurer of the Town and countersigned by the Selectmen, and the same may be sold at public auction or private sale, at the discretion of the Treasurer. The said bonds shall bear upon their face the words " Lincoln Water Loan." The issue and sale of the said bonds shall be made under and conform to in all respects the provisions of Chap- ter 341 of the Acts of the year 1897.
