(c) The title of each class, as established by the Classi- fication Plan shall be the official title of every position allo- cated to the class and the official title of each incumbent of a position so allocated, and shall be used to the exclusion of all others on payrolls, budget estimates and other official records and reports pertaining to the position.

(d) No position may be reclassified or no class may be assigned to a different compensation grade, until the Per- sonnel Board shall have determined such reclassification or such reassignment to be consistent with the classification and compensation plans.


Section 5. Compensation Plan


(a) The Compensation Plan shall consist of Schedules B through D in Section 8 which provide minimum and maxi- mum salaries or wages for certain of the classes in the Classi- fication Plan. The salary range of a position class shall be the salary range of all positions allocated to the class.


(b) All employees shall continue to be paid on an hourly, weekly, semi-monthly, annual, or other basis, as at present, except as provided in the compensation plan, unless otherwise authorized by the Personnel Board.


(c) No department head shall fix the salary of any em- ployee in a position so classified except in accordance with the compensation plan.


(d) No person shall be appointed, employed or paid as an employee in any position subject to the provisions of the classification plan under any title other than those appearing on Schedule A of Section 8.


(e) An employee in continuous full-time or part-time employment shall receive the increment between his present rate and the next higher step rate as follows:


(1) On January first provided he has completed thirty weeks service at the minimum or other rate if a rate other than the minimum is author- ized as the entrance rate.


(2) Thereafter one year from the date of his previ- ous increase until he attains the maximum rate of the range of the compensation grade to which his position class is assigned.


(3) Employees in continuous part-time employment eligible for increments under the provisions of this sub-section shall be those occupying posi- tions in classes for which compensation is pro- vided in Schedule B, B-1 or Schedule C of Sec- tion 8.

(f) An employee occupying a seasonal position in a class for which compensation is provided in Schedule B, B-1 or Schedule C of Section 8 shall receive increments as provided in the preceding sub-section on the basis of thirty weeks em- ployment constituting one year. This employment need not be continuous but to retain any rate above the entrance rate, the employee must work some part of each subsequent year.


An employee receiving a promotion to a vacant position or to a new position as defined in Section 4 (b) shall, upon assignment resulting from such promotion, receive the rate in the compensation grade of the vacant or new position next above his existing rate. If the resulting adjustment does not equal $100.00 for a position class assigned to Sched- ule B, B-1 or $.05 for a position class assigned to Schedule C, the adjustment shall be to the second rate above the existing rate but within the compensation grade of the vacant or new position.


(h) The employee receiving a promotion and adjust- ment in rate pursuant to the provisions of the preceding sub- section shall receive the next increment of his compensation grade effective the next January first following completion of thirty weeks at the rate resulting from the promotion.


(i) Each department head of a department to which is assigned an employee occupying a position in the classification plan shall include in his estimates required by the provisions of Section 59 of Chapter 41 of the General Laws a pay adjust- ment section setting forth in detail the amounts which will be required for anticipated pay adjustments during the en- suing year and shall furnish a copy thereof to the Board.


(j) The adjustments provided for in this section shall be subject to the availability of appropriated funds.


Section 6. Amendment of the Plans


(a) The classification plan and/or the compensation plan and/or other provisions of this by-law may be amended by vote of the Town at either a regular or a special Town Meeting. Requests for such amendments shall be made to the Board by signed petition. All signed petitions requesting amendments of the Classification Plan and/or the Com- pensation Plan and/or other provisions of this By-Law, must be submitted to the board no later than four months prior to a regular town meeting. Whenever such a petition is received, the Board shall promptly hold a hearing to consider

such proposed amendment, and the petitioners and the heads of the departments affected shall be given at least three days written notice. Prior to the next Town Meeting, the Board shall file with the Selectmen for insertion in the warrant for the next Town Meeting an article sufficiently stated to permit the Town to act upon the subject matter of any such petition. At the same time the Board shall file with the Finance Com- mittee a final report, with recommendations, pertaining to any such petition, provided, that no recommendation in favor of a proposed amendment shall be made except by an affirma- tive vote of two of its members.


(b) The Board may, from time to time of its own motion, hold a hearing to consider any proposed amendment. In the event said proposed amendment is supported by an affirma- tive vote of two of its members, the Board shall proceed ac- cording to the preceding sub-section to insert an article in the warrant and to report its recommendation to the Finance Committee.


(c) In the case of urgent necessity, the Personnel Board, with the approval of the Finance Committee, may anticipate the formal action of the town meeting by adding a new classification and the salary or wage thereof to the classi- fication and pay plan and such addition will be effective sub- ject to early ratification by the town at a town meeting.


Section 7. Continuing Review


(a) The Board from time to time of its own motion, shall investigate the work and standard rates of salaries or wages of any or all positions subject to the provisions of this by-law. Such reviews shall be made at such intervals as the Board deems necessary and, to the extent which the Board considers practicable, shall include all occupational groups in the classification plan.


(b) The Board shall consider changes in departmental organization structure, operating procedures or work load which may result in service rendered by an employee occupy- ing a position changing from intermittent or casual to con- tinuous employment. Such a change may be the basis of a recommendation by the Board to amend the compensation plan so that a position class found to require continuous em- ployment would be moved from Schedule D to Schedule B or Schedule C of Section 8.

Section 12. Fringe Benefits and Working Conditions


(a) Pursuant to the authority contained in Section 108C of Chapter 41 of the General Laws, certain fringe benefits as set forth in subsequent sections of this by-law are hereby granted to employees occupying positions in the classification plan. The fringe benefits are considered to be a part of the compensation plan and the monetary value thereof shall be extended to eligible employees in addition to rates set forth in the appropriate salary or wage schedule.


(b) Additional fringe benefits and/or working condi- tions may be added to the by-law or fringe benefits and/or working conditions may be amended from time to time by vote of the Town at a Town Meeting.


Section 13. Initial Application of the Compensation Plan


(a) Upon the adoption of this by-law, salary and wage rates for affected employees shall be adjusted as follows:


(1) Retroactive to the first of the year of adoption if at the annual Town Meeting.


(2) Effective the beginning of the month following adoption if at a special Town Meeting prior to the establishment of the tax rate for that year.


(3) Effective the January first following adoption if at a special Town Meeting later than the estab- lishment of said tax rate.


(b) The rate of each employee occupying a position, the compensation of which is provided for in Schedule B, B-1 or Schedule C of Section 8 shall be adjusted, based on his prior service in said position, according to the formula set forth in Section 5 (e) or 5 (f).


(c) The rate of each employee occupying a position, the compensation of which is provided for in Schedule D of Sec- tion 8 shall be adjusted to the rate for his position class as set forth in this schedule.

(d) If an employee's rate at the time of the adoption of this by-law is in excess of the maximum rate set forth in his appropriate compensation grade in Schedule B, B-1 or Sched- ule C of Section 8 or is in excess of the rate set forth for his position class in Schedule D of Section 8, this rate shall not be reduced but shall become a personal rate applicable only to said employee as defined in Section 2.


(e) The adjustments provided for in this section shall be subject to the availability of appropriated funds.

Section 15. Overtime Compensation


(a) Clerical Group


An employee shall be compensated at the hourly rate set forth in Section 9 which corresponds to his step rate desig- nation in the corresponding compensation grade on Schedule B, Section 8, for hours worked in excess of those constituting his work week as set forth in Section 14 except for attendance at evening meetings which shall be considered as part of the basic work week of 37.5 hours.

(b) Library Group


An employee shall be compensated at the hourly rate set forth in Section 10 which corresponds to his step rate desig- nation in the corresponding compensation grade in Schedule B, Section 8, for hours worked in excess of those constituting his work week as set forth in Section 14.


(c) Custodial Group


Positions classified in this group may receive compensa- tion at the hourly rates set forth in Section 11 for hours worked in excess of forty-four weekly.


(d) Labor Group


An employee shall be compensated at one and one-half times his regular hourly rate for hours worked in excess of those set forth for the department to which he is assigned, incorporated in Section 14 by reference.


(e) Public Safety Group


(1) An employee in full-time employment called back for duty on his scheduled day off shall receive one fifth of his weekly rate for such duty provided the duty consists of an assigned shift of not less than eight hours.


(2) An employee of the Fire Department in full- time employment who responds to a box alarm pur- suant to the administrative rules of the department may be compensated at an hourly rate determined by the Public Safety Commission which rate shall not exceed one-fortieth of the employee's weekly rate.


(3) An employee of the Police or Fire Departments in full-time employment who is required to work more than one hour beyond his scheduled tour of duty may be compensated at an hourly rate deter- mined by the Public Safety Commission which rate shall not exceed one-fortieth of the employee's weekly rate.


(4) Nothing in the preceding sub-section shall be construed to permit the payment of such overtime rate for court appearances on the part of an em- ployee during other than his assigned shift.

(5) An employee in other than the Police or Fire Departments shall not receive overtime compensa- tion. However, nothing in this sub-section shall be construed to deny compensation to an employee on an hourly rate in the group at his hourly rate multi- plied by the number of hours worked and approved by his department head for any designated pay period.


(f) Administrative and Supervisory Groups


(1) Employees occupying positions classified in these groups are not entitled to overtime compensa- tion as set forth in Section 14, except as provided in the paragraph below. However, compensatory time may be granted an employee at the conveni- ence of his department head for hours worked and approved in excess of forty in any one week.


(2) Highway foremen shall during snow plowing, sanding or snow removal operations, be paid for hours worked in excess of forty in one week at 11/2 times the hourly rate appearing in Compensation Grade W-10. If the employee's regular rate is Step 3 or below in Compensation Grade S-12, he shall be paid at 11/2 times the minimum rate of Compensation Grade W-10; if above Step 3, he shall be paid at 11/2 times the appropriate rate above the minimum.


Section 16. Paid Holidays


(a) The following days or dates shall be recognized as legal holidays within the meaning of this by-law:

(b) Every employee in full-time or continuous part- time employment shall be entitled to these designated holi- days on the following terms:


(1) If paid on an hourly basis he shall receive one day's pay at his regular rate based on the number of hours regularly worked on the day on which the designated holiday occurs;


(2) If paid on a weekly, semi-monthly or annual basis, he shall be granted each designated holiday without loss in pay.


(c) Payment under the provisions of this section shall be made provided the eligible employee shall have worked on his last regularly scheduled working day prior to and his next regularly scheduled working day following such holiday, or was in full pay status on such preceding and following days in accordance with other provisions of this by-law.


(d) An employee in continuous employment, occupying a position in other than the Public Safety or Supervisory Groups who performs work on one of the days designated in sub-section (a) shall be paid at his regular rate for such day or fraction thereof (except as provided under sub-section (g), following) in addition to the amount to which he is entitled under sub-section (b).


(e) At the request of the employee, he may be granted compensatory time off at the convenience of the department in lieu of payment provided under sub-section (d).


(f) An employee in continuous employment, in other than the Police or Fire Departments, who, because of a rota- tion of shifts, works different days in successive weeks shall be granted, in each year in which the number of holidays falling on his regular days off is in excess of the number of holidays in that year falling on Saturday, additional days off equal to the excess.


(g) An employee in continuous employment, who per- forms scheduled inspection or maintenance work for part of one or more of the days or dates designated in sub-section (a) shall be entitled to one additional day off each year if he is required to perform duties on three such days or dates in a period of twelve months.

(h) Whenever one of the holidays set forth in sub- section (a) falls on a Sunday, the following day shall be the legal holiday.


Section 17. Vacation Leave


(a) An employee in continuous service shall be granted two weeks vacation with pay provided he has completed thirty weeks of service prior to June first.


(aa) An employee with less than thirty weeks of con- tinuous employment as of June 1st shall be granted one day of vacation for each full month of continuous service com- pleted prior to June 1st but not to exceed one week of vaca- tion.


(b) The employee eligible for the vacation allowance provided under sub-section (a) must complete this allowance within fourteen consecutive calendar days beginning on a scheduled work day or within two periods of seven consecu- tive days each beginning on a scheduled work day.


(c) Exceptions to the requirements of sub-section (b) permitting an employee to schedule his vacation allowance in a different manner may be made with the approval of the employee's department head if his scheduled work week is Monday through Friday or part thereof.


(d) In addition to the vacation allowance provided in sub-section (a), each employee who has (or will have) com- pleted ten years of service shall, in the year during which this length of service has been or will have been completed, be granted additional vacation with pay at the rate of one day for each year in excess of nine years of completed service up to a maximum allowance of fifteen days to which the em- ployee shall be entitled in the year during which fourteen years of service has been or will have been completed.


(e) Vacation allowance granted under sub-section (d) shall be taken separately from that granted under sub-sec- tion (a) unless approved by the employee's department head and the Personnel Board.


(f) Upon the death of an employee who is eligible for vacation under these rules, payment shall be made to the estate of the deceased in an amount equal to the vacation allowance as accrued in the vacation year prior to the em- ployee's death but which had not been granted. In addition,
