ARTICLE 83. To see what action the Town will take with respect to the report of the committee on updating the Town By-Laws appointed under Article 93 of the 1962 Town Meeting, and make an appropriation therefor.


The Committee recommends favorable action, to continue the Committee, and an appropriation of $1,000.


Voted: That the Town continue the committee on updat- ing the Town By-Laws appointed under Article 93 of the 1962 Town Meeting, and to raise and appropriate the sum of $1,000, for the typing, printing and publishing the complete set of Town By-Laws; the Town Clerk to be authorized to distribute such sets at a price not exceeding $1.00 per set.


ARTICLE 84. To see if the Town will vote to adopt the proposed "Electrical Wiring By-Laws of the Building Code (By-Laws), as amended, of the Town of Plymouth" submit- ted by the committee appointed by the Moderator under Article 38 of the 1961 Annual Town Meeting.


The Committee recommends favorable action.


Mr. John Fillebrown's motion to amend Article 84 was lost.


Articles 84, 85 and 86 voted at this Meeting, all were reconsidered and voted on at the April 1st Meeting.

The Meeting was called to order by the Moderator at 7:38 o'clock P.M.


The number of Town Meeting Members present was 153, as per records of the checkers, Robert Marvelli and Arsene Strassel 2nd; the Moderator declared a quorum present.


Mr. Edward Barnes moved to reconsider Article 62 in order to complete the description of the land and easements and it was so voted.


ARTICLE 62.


Voted: (Unanimously) That the Town authorize the Selectmen to acquire by purchase or take by eminent do- main, for water purposes, land in Plymouth situated at Indian Hill at the northerly end of Shore Drive at the shore of Cape Cod Bay, bounded and described as follows: Beginning at a concrete bound in the northerly line of Lot 1 shown on Land Court Plan No. 11398B which bound is 79.92 feet Northeast- erly from the northeast corner of Shore Drive; thence run- ning N 73° 40' 10" E 8 feet, more or less, to top of bluff; thence southerly by the top of the bluff 138 feet, more or less, to Lot 3; thence N 84° 05' 01" W by Lot 3, 78 feet, more or less, to the northwesterly corner of said Lot 3; thence again N 84° 05' 01" W 15.00 feet; thence S 35° 54' 59" W 50.00 feet to a point in the westerly line of said Shore Drive which is 132.30 feet S 5° 54' 59" W from the northwest corner of said Shore Drive as shown on the above-mentioned plan; thence S 5° 54' 59" W in the westerly line of Shore Drive 32.70 feet; thence N 85° 05' 01" W 100.00 feet; thence N 5° 54' 59" E 124.09 feet, the last two courses being by remaining land of this grantor; thence N 73° 40' 10" E 108.05 feet to the northwest corner of Shore Drive; thence same course 43.22 feet by the end of Shore Drive; thence the same course 79.92 feet to the concrete bound at the point of beginning; con- taining an area of 28,690 square feet, more or less. ARTICLE 84.


Mr. Barnes moved that the Town adopt the proposed "Electrical Wiring By-Laws of the Building Code (By-Laws) as amended, of the Town of Plymouth," as shown in the printed report of the Advisory and Finance Committee on pages 63 through 66 inclusive; and submitted by the Commit- tee appointed by the Moderator under Article 38 of the 1961 Annual Town Meeting, and it was so voted.


ARTICLE 85. To see if the Town will vote to amend the Building Code (By-Laws), as amended, and adopted under Article 110 of the 1956 Annual Town Meeting, by adding under Section 8 "Electrical Wiring" the following paragraph: "All electrical wiring shall be done according to the Electrical Wiring By-Laws of the Building Code (By- Laws) as amended, of the Town of Plymouth."


The Committee recommends favorable action.

ARTICLE 86. To see if the Town will vote that the Inspector of Wires and Alternate Inspector of Wires be com- pensated for services and expenses by payment for each permit issued and consequent inspection made at the rate of 80% of the fee charged for such permit and inspection and appropriate the sum of $2,500 for compensation and expenses.


The Committee recommends favorable action and an appro- priation of $2,500; all fees for permits to be turned in to the Town.


Mr. Barnes moved that the Town compensate the Inspec- tor of Wires and Alternate Inspector of Wires for services and expenses by payment for each permit and consequent inspection made at the rate of 80% of the fee charged for such permit and inspection and appropriate $2,500.00 for com- pensation and expenses; all fees for permits and inspections shall be turned in to the Town, and it was so voted.


ARTICLE 87. To see if the Town will vote to adopt the proposed "Gas Piping and Gas Appliances By-Laws of the Building Code (By-Laws), as amended, of the Town of Plymouth" submitted by the committee appointed by the Moderator under Article 38 of the 1961 Annual Town Meeting.


The Committee recommends favorable action.


That the Town adopt the proposed "Gas Piping and Gas Appliances By-Laws of the Building Code (By-Laws) as amended, of the Town of Plymouth," as shown in the printed report of the Advisory and Finance Committee on pages 67

Mr. E. Robichaud moved to amend Article 1 so as to read as follows:


ARTICLE 1


Inspectors of Gas Piping and Gas Appliances


The Commission of Public Safety, in accordance with Section 3 (0) of Chapter 143 of the General Laws, shall appoint annually, in April, an inspector of Gas Piping and Gas Appliances and an Alternate Inspector of Gas Piping and Gas Appliances, each of whom shall hold office for one year, from the first of May in the year of his appointment unless sooner removed by the Commission and another qual- ified and appointed in his stead. Said Inspectors shall be citizens of the Town, to be appointed under the authority of Chapter 217, approved on April 3, 1963. No inspector shall inspect his own work or any building in which he has direct or indirect interest. Said Inspectors shall receive such compensations as the Town may from time to time deter- mine. The offices of said Inspectors shall not be placed under Civil Service. As used in these by-laws the words "Inspec- tor of Gas Piping" shall be construed to mean the Inspector or Alternate Inspector of Gas Piping and Gas Appliances.


Mr. E. Robichaud moved to amend Article 2 so as to read as follows:


ARTICLE 2


Code Conformity


All gas fitting shall conform to the requirements of the "Massachusetts Code for Installation of Gas Appliances and Gas Piping" as amended.


Mr. Robichaud's motions to amend Article 1 and 2 under ARTICLE 87, was so voted, unanimously.

ARTICLE 88. To see if the Town will vote to amend the Building Code (By-Laws), as amended and adopted under Article 110 of the 1956 Annual Town Meeting, by inserting between Section 9 and Section 10 the following: "Section 9A. GAS PIPING AND GAS APPLIANCES. All gas piping and gas appliances shall be installed according to the Gas Piping and Gas Appliances By-Laws of the Building Code (By- Laws), as amended, of the Town of Plymouth."


The Committee recommends favorable action.

ARTICLE 90. To see if the Town will accept the fund known as the "Frances Leach Bagnell Fund" pursuant to the Will of Luthera M. Leach, and provide for appointment of Trustees to invest funds and expend income.


The Committee recommends favorable action.


Voted: That the Town accept the fund which will be known as the "Frances Leach Bagnell Fund" pursuant to the will of Luthera M. Leach, such fund to be invested in savings banks by the Town Treasurer, the income only to be paid pursuant to the direction of the Plymouth School Committee to assist needy and deserving children, residing in Plymouth toward obtaining higher education.


ARTICLE 91. To see if the Town will vote to author- ize the Selectmen to transfer the care, custody, manage- ment and control of Lot 59, Plat 96 of the Assessors' Plans, consisting of 79.7 acres more or less, of woodland at Little Micajah's Pond, to the Conservation Commission for con- servation purposes.


The Committee recommends No Action.


Voted: That the Town take no action under Article 91.


ARTICLE 92. To see if the Town will vote to author- ize the Selectmen to transfer the care, custody, management and control of land at White Horse Beach, being Lots 87C and 88-I as shown on Plat 46 of the Assessors' Plans to the Conservation Commission, to be used as a public access to the beach.


The Committee recommends No Action.


Voted: That the town take no action under Article 92.


ARTICLE 93. To see if the Town will vote to accept Chapter 478 of the Acts of 1963 "An Act increasing the amounts of pensions and retirement allowances payable to certain former public employees."


The Committee recommends favorable action.

McGrath, the land now leased to them on the Town Wharf Lot, being Lot 17A and a 50-foot right of way to said lot; and in addition thereto sell to them so much of other town-owned land on the Town Wharf Lot as lies southeasterly of the northwesterly line of said Lot 17A and extending southwesterly to Water Street, all shown on a plan entitled "Land at Town Wharf, Plymouth, Mass., Scale 1" = 40 ft., dated September 1, 1962, Edward Chase, Town Engineer."

Mr. Barnes moved that the Town take no action under Article 95.


Mr. Hugh Maraghy moved that the Town authorize the Selectmen to sell to William A. Dearn and Ernest A. McGrath, co-partners, the land presently leased to them, being Lot 17-A on a plan entitled "Land at Town Wharf, Plymouth, Mass., Scale 1"=40' dated September 1, 1962, Edward Chase, Town Engineer" to be conveyed with a right of way in common with others entitled thereto from said

lot over a 50-foot way leading southwesterly to Water Street; at a price to be determined by the Selectmen but not less than $7,500.00, but the motion was lost.


The original motion was put before the Meeting and carried.


ARTICLE 96. Will the Town appropriate for and au- thorize the Moderator to appoint a Special Committee to study the planning and ultimate development of the Town Wharf and adjacent Town property located on Water Street, and also to study and confer with the Federal and State Au- thorities in relation to the Harbor Anchorage Basin proposed nearby, together with a study of the disposal of surplus harbor dredging.

The Committee recommends favorable action and an ap- propriation of $300.


Mr. Barnes moved that the Town appropriate $300 and authorize the Moderator to appoint a Special Committee of seven members to study the planning and ultimate develop- ment of the Town Wharf and adjacent Town property located on Water Street, and also to study and confer with the Federal and State Authorities in relation to the Harbor An- chorage Basin proposed nearby, together with a study of the disposal of surplus harbor dredging, and to report at the next Annual Town Meeting. This Committee shall hold hearings and shall make progress reports to the Town at least, at every Annual Town Meeting.


Mr. T. Jesse moved to amend Mr. Barnes' petition of Article 96, that the Town take no action under Article 96, and it was so voted.


ARTICLE 97. To see if the Town will vote to name as West Cherry Street that road leading southeasterly 1,400 feet from Nicks Rock Road and laid out in behalf of the Town by the Massachusetts Department of Public Works, on July 15, 1958.


The Committee recommends favorable action.
