Article 57 :


The Moderator declared Article 57 before the meeting.


Mr. Dutcher offered the following as a substitute mo- tion for the recommendation of the Finance Committee, which was duly seconded :


That the sum of one hundred and eight thousand four hundred (108,400) dollars be and hereby is appropriated for the construction of a building to be used for the purposes of the Board of Public Works as a plant for the disposal of rubbish and waste materials and otherwise, upon the land of the Town known as the Town Yard at Hobbs Court, in- cluding the cost of original equipment and furnishings thereof, substantially in accordance with plans, copies of which are contained in the report of the committee appoint- ed under vote of the Town passed under article 36 of the warrant for the Annual Meeting of 1936, article 3 of the warrant for the Annual Meeting of 1937 and article 39 of the warrant for the Annual Meeting of 1938, presented at this meeting; that for said purpose the sum of eighteen thousand four hundred (18,400) dollars be raised by general tax, and for the balance, ninety thousand (90,000) dollars, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow said sum of ninety thousand (90,000) dollars and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Section 19 of Chapter 44 of the Gen- eral Laws and all acts in addition thereto or in amendment thereof, so that the whole loan will be paid in not more than ten (10) years from the date of issue of the first bond or

note or at such earlier date as the Treasurer and Selectmen may determine; and further, that said appropriation be expended under the direction of the said committee with the addition thereto of the present chairman of the Board of Public Works, any vacancy therein to be filled by the Mod- erator, said committee to have full charge of said construc- tion and full authority so to construct said building within the sum herein appropriated.


After much discussion a vote was taken and the Mod- erator declared the substitute motion lost.


On motion duly made and seconded on recommenda- tion of the Finance Committee it was


Voted: That the Town do not now construct or alter any building upon the land of the Town known as the Town Yard at Hobbs Court; and that the Town take no action under Article 57 of the warrant.


Thereupon, it was moved and duly seconded that the matter be referred back to the committee for further con- sideration and that the sum of $500. be and hereby is appro- priated for its expenses ; and on being put to a vote the Mod- erator declared the motion unanimously carried.


There being no further business under Article 57 the Moderator declared it disposed of.


Article 52.


The Moderator declared Article 52 before the meeting, and called for a vote on the substitute motion of Mr. Lans- ing. A rising vote being taken, 53 voted in the affirmative and 89 in the negative, and the Moderator declared the motion lost.


On motion made by Mr. Knight and seconded, it was


Voted: That the Town do not amend Sections 2 and 3 of its Zoning By-Laws by striking out paragraph A. in each section and inserting in each place thereof a new paragraph A as described in detail in article No. 52 of the warrant for the meeting of March 15, 1939.

The Commonwealth of Massachusetts, Middlesex, ss.


To the Constables of the Town of Arlington, in said County :


Greeting :


In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the legal voters of the Town of Arlington, to meet in the Town Hall in said Town on Monday, the 9th day of October, 1939 at 8 o'clock, P. M., at which time and place the following articles are to be acted upon and determined exclusively by Town Meeting Members, in accordance with, and subject to, the referenda provided for by Chapter 43A of the General Laws.


Article 1. To hear and act upon the reports of the Finance and other committees heretofore appointed.


Article 2. To see if the Town will make an additional appropriation or appropriations for public welfare including Aid, Aid to Dependent Children and Old Age Assistance and for Soldiers' Relief and Burials ; provide for all or any of these appropriations by borrowing under authority of and in accordance with the provisions of Chapter 49 of the Acts of 1933 as most recently amended by Chapter 288 of the Acts of 1939, or the provisions of Chapter 72 of the Acts of 1939 as amended by Chapter 453 of the Acts of 1939, or by transfer or otherwise; or take any action relative to all or any the foregoing.


Article 3. To see if the Town will make an additional appropriation to be expended by the Board of Public Works for the removal of ashes, offal and rubbish, determine in what manner the money shall be raised and expended; or take any action relating thereto.

Article 7. To see if the Town will appropriate the sum of eleven thousand dollars ($11,000.) or sums totaling elev- en thousand dollars ($11,000.) for the purpose of establish- ing a minimum wage for laborers employed by the Board of Public Works at the rate of five dollars ($5.00) per eight hour day, said sum or sums to be raised by general tax and expended under the direction of the Board of Public Works.

Article 8. To see if the Town will amend its Zoning By-Laws by altering the Zoning Map therein referred to so as to include in a Business District the area now included in a single residence district, bounded and described as fol- lows :


Beginning at a point on the South side of Massachu- setts Avenue where the land of Houston and the land of Spaulding meet, thence running easterly on the south side of said Massachusetts Avenue about 140.01 feet to a point on said southerly side of Massachusetts Avenue; thence turning by a curve to the right at the junction of Burton Street and said Massachusetts Avenue and running by said curved line about 74.88 feet to a point on the westerly side of said Burton Street; thence continuing on the westerly side of said Burton Street in a southerly direction about 109.81 feet; thence turning and running northwesterly about 105.58 feet and continuing in a westerly direction about 20 feet to land of said Spaulding; thence turning and running in a northerly direction, about 91.71 feet to the point of beginning.

SPECIAL TOWN MEETING


Arlington, Mass., October 9, 1939.


Pursuant to the warrant of the Selectmen served ac- cording to law upon the inhabitants of the Town of Arl- ington, by a constable of the said Town and notices sent by mail by the Town Clerk seven days before the day of meeting to the Town Meeting Members duly elected and qualified to act in Town Meetings in Arlington, the Town Meeting Members met at the Robbins Memorial Town Hall in said Town on Monday, October 9, 1939, at 8:00 in the evening.


Lists of the duly qualified Town Meeting Members were used at the entrances to the meeting place and were in charge of Philip T. Robinson and James E. Sweeney.


The check lists filed with the Town Clerk at the close of the meeting showed that one hundred and forty-five attended the meeting.


The Moderator called the meeting to order at 8:20 P. M.


The Moderator asked if there were any Town Meeting Members who had not already been sworn; apparently all had been sworn.


Mr. Davis asked that Selectman Estabrook, Mr. Golden, the Secretary of the Board of Selectmen, and Mr. White, the Town Counsel, be allowed to sit with him, and his re- quest was granted.


The Town Clerk read the call and the Constable's Re- turn of the Warrant; the reading of the remainder of the Warrant was waived by consent of the meeting.

There being no further business under Article 2 the Moderator declared it disposed of.


Article 3 taken up. (Additional Appropriation for Re- moval of Ashes, Offal and Rubbish)


Mr. Loren Marsh offered the following substitute mo- tion which, on being put to a vote, the Moderator declared lost :


That the additional sum of eight thousand, six hundred (8,600.00) dollars be and hereby is appropriated for the removal of ashes, offal and rubbish and that to meet said appropriation the Treasurer, with the approval of the Se- lectmen, be and hereby is authorized to borrow said sum of eight thousand, six hundred (8,600.00) dollars, and to issue a note or notes therefor, all under the provisions of Chapter 49 of the Acts of 1933 as most recently amended by Chapter 288 of the Acts of 1939; and that said appro- priation be expended under the direction of the Board of Public Works.


On the recommendation of the Finance Committee it was unanimously


Voted: That the additional sum of thirty-six hundred (3,600) dollars be and hereby is appropriated for the re- moval of ashes, offal and rubbish; and that to meet said appropriation the Treasurer, with the approval of the Se- lectmen, be and hereby is authorized to borrow the said sum, and to issue a note or notes therefor, under the provisions of Chapter 49 of the Acts of 1933 as most recently amended by Chapter 288 of the Acts of 1939; and that said appropria-

Article 4 taken up. (Transfer of Appropriations- School Department)


On motion, duly made and seconded, it was unani- mously


Voted: That the sum of eighteen hundred fifty (1,850) dollars be and hereby is appropriated for the School De- partment, to be expended by the School Committee in con- nection with personal services as follows: Operation of School Plant, fourteen hundred (1,400) dollars; Mainte- nance of School Plant, one hundred (100) dollars; Auxil- iary and Other Activities, three hundred fifty (350) dollars; said sum of eighteen hundred fifty (1,850) dollars to be transferred from the unexpended amount of the appropria- tion made for payment of teachers, principals and super- visors under sub-item 2 of item 34 of the vote passed under Article 4 of the Warrant for the annual meeting of this year.


There being no further business under Article 4 the Moderator declared it disposed of.


On motion, duly made and seconded, it was, by rising vote, 90 voting YES and 38 NO.


Voted: To reconsider Article 4.


After reconsideration of Article 4, previously unani- mously passed, as above, the Moderator called for a vote thereon, and declared the motion lost.


There being no further business under Article 4 the Moderator declared it disposed of.


Article 5 taken up. (Exterior Lines: Spring Street to the Concord Turnpike)

The Finance Committee recommended the following:


Voted: That the establishment of exterior lines of a way from Spring Street to the Concord Turnpike, as made and filed in the office of the Town Clerk by the Joint Board of Selectmen and Board of Public Works and more particu- larly described in Article 5 of the Warrant, be and hereby is accepted, said lines established and said Joint Board authorized to take land for the purpose; and that the sum of three hundred (300) dollars be and hereby is appropri- ated for the purpose, including land damages ; and that said sum be taken from the unexpended balance of the appropri- ation made for the construction of ways by vote passed March 30, 1938, under Article twenty-three (23) of the warrant for the annual meeting of that year; and that said sum be expended under the direction of said Joint Board.


On being put to a vote the Moderator declared the motion lost. The vote was doubted and the moderator called for a rising vote which resulted in 56 voting YES and 56 NO, a tie; again a rising vote was requested with the result that 67 voted in the affirmative and 65 in the nega- tive, and the Moderator declared the motion carried.


There being no further business under Article 5 the Moderator declared it disposed of.


Article 6 taken up (Exterior Lines: Renfrew Street)


The Finance Committee recommended the following :


Voted: That the establishment of exterior lines of a way from a point about 290 feet northerly of Florence Av- enue to Dow Avenue as made and filed in the office of the Town Clerk by the Joint Board of Selectmen and Board of Public Works and more particularly described in Article 6 of the Warrant, be and hereby is accepted, said lines es- tablished and said Joint Board authorized to take land for the purpose; that the sum of two hundred (200) dollars be and hereby is appropriated for the purpose, including land damages ; and that said sum be taken from the unexpended balance of the appropriation made for the construction of

ways by vote passed March 30, 1938, under Article twenty- three (23) of the Warrant for the annual meeting of that year; and that said sum be expended under the direction of said Joint Board.


A vote being taken the Moderator declared the motion lost; the vote being doubted a rising vote was taken, 72 voting in the affirmative and 58 in the negative, the Modera- tor. declared the motion carried.


There being no further business under Article 6 the Moderator declared it disposed of.


Article 7 taken up. (Minimum Wage for Board of Pub- lic Works Laborers)


The Finance Committee recommended that no appropri- ation be made under this article.


Mr. Lansing offered the following substitute motion which the Moderator ruled out of order :


To see if the Town will appropriate the sum of twenty- five hundred dollars ($2,500) to be expended by the Board of Public Works, to equalize wages paid to employees within the department, under the various Civil Service Classifica- tions, determine in what manner the money shall be raised and expended, or take any action relating thereto.
