Article 52. To see if the Town will amend Sections 2 and 3 of its Zoning By-Laws by striking out Paragraph (a) of Section 2 as it now reads and inserting in place thereof the following new paragraph: (a) Any industry, trade, manufacturing or commercial purpose, or any private or public use which would be injurious, obnoxious, or offensive to a neighborhood, by reason of noise, vibration, smoke, cin- ders, odor, gas, fumes, dust, chemicals, or other objection- able feature or dangerous to a neighborhood through fire, explosion or for any other cause; and by striking out Para- graph (a) of Section 3 as it now reads and inserting in place thereof the following new paragraph: (a) Any in- dustry, trade or commercial purpose, or any private or pub- lic use which would be injurious, obnoxious or offensive to a neighborhood, by reason of noise, vibration, smoke, cin- ders, odor, gas, fumes, dust, chemicals, or other objection- able feature or dangerous to a neighborhood through fire, explosion or for any other cause.

To see if the Town will vote to alter its Zoning By-Law and Map therein referred to so as to change the area bounded and described in the following from a Single Residence District to a new district to be known as Residence C District. PROPOSED BY-LAW CHANGES


SECTION #1 ESTABLISHMENT OF DISTRICTS


In the third line of this paragraph change the words "districts of six classes to be known as" to "the fol- lowing districts" and add to the latter part of this para- graph the words "Residence C districts", so that this portion of the paragraph will then read as follows; "For the purposes of this by-law, the Town of Arling- ton is hereby divided into the following districts :


Single residence districts


General residence districts


Residence C districts


Semi-Residence districts


Business districts Industrial districts


Unrestricted districts


SECTION # 3 Incorporate in the Zoning by-law an additional section to be known as Section 3B, Residence C districts.


In the residence C districts, no new building or part thereof shall be constructed or used and no building or part thereof shall be altered, enlarged, reconstructed or used, for


(a) Any industry, trade, manufacturing or commer- cial purpose


(b) Any purpose except one or more of the following :


1. Dwellings designed to have not more than eight rentable suites.


2. Such accessory purposes as are customary or usual in connection with any of the foregoing purposes speci- fied in this Paragraph (b) and are incidental thereto, including a private garage and a private stable.


(c) Provided, however, that if permission of the Se- lectmen is obtained in the manner provided in Section

16, buildings may be constructed, altered, enlarged or reconstructed, and used for one or more of the follow- ing purposes ;


(a) Public or semi-public institution of a philan- thropic, charitable or religious character, hospital, sani- tarium, or other medical institution, but not a correc- tional institution or place of detention.


(b) Such accessory purposes as are customary or usual in connection with any of the foregoing purposes and are incidental, thereto, but not for any industry, trade, manufacturing or commercial purpose.


HEIGHT-Section 9. Add to this line the words "Residence C District" so that it will then read :


Section 9. Single Residence, General Residence, Resi- dence C, and Semi-Residence Districts.


Paragraph A. Add at the end of paragraph A the fol- lowing :


"In the Residence C Districts no building shall be con- structed, altered, enlarged, reconstructed or raised up so as to contain more than two stories, or so as to ex- ceed a height of thirty-five feet except as otherwise provided in this Section."


AREA-Add a new section to be known as Section 12-B. This section will then read.


SECTION #12-B Residence C Districts.


A. In the Residence C Districts, no building or build- ings including garages shall be constructed, altered, enlarged, reconstructed or moved unless there be pro- vided for each such building at least three (3) square feet of open unoccupied space for each one (1) square feet of gross floor area of the building. The gross floor area shall be deemed the sum of the areas of horizon- tal sections through each story of all parts of the build- ing used for residence, exclusive of basement. In com- puting gross floor area, the area of horizontal sections

shall be that area enclosed by the outside faces of all exterior walls. Interior courts and open passageways may be deducted from this figure.


B. No part of any building measured between the out- side face of nearest foundation or pier and the lot line except uncovered steps, shall be constructed, altered, enlarged, reconstructed or moved, so as to be less than twenty-five (25) feet from any street lines, or less than fifteen (15) feet from the line of any adjoining lot or nearer than thirty (30) feet to any other building on the same lot.


C. Distances less than those set forth in paragraph B of this section, but not less than those required by the Building By-Laws or other provisions of law, may be used in specific cases where because of difficulties of construction the Selectmen may give permission for such less distances, such permission being obtained in the manner set forth in Section #16.


Section 17-A. Add between sections 17 and 18 a new section to be known as Section 17-A. Special Restric- tions-


A. In the Residence C districts, all buildings must be of second class construction except where the build- ing law requires them to be of first class. All buildings must be so designed that each group of two suites shall be separated by a fire-wall if of second class construc- tion. No building in Residence C districts may have more than three such fire-walls.


B. In the Residence C districts, no basement or other part of a building with a floor level more than four (4) feet below the finished grade immediately adjacent may be used for dwelling purposes.


C. In the Residence C districts no pent house shall be used for dwelling purposes.


D. In the Residence C districts, at least one garage

or private parking space must be provided for each family, but no garage may be attached to or otherwise made a part of any dwelling.


E. In the Residence C districts any road and its side- walks shall have the approval of the Board of Survey. The above roads and sidewalks as well as all sewer, water, hydrants and drainage mains shall be installed at the expense of the developer according to the Town's specifications.


The above facilities shall be completed before the final approval of any building for occupancy shall be granted. F. All land included in a Residence C district shall be used in accordance with the restrictions for that dis- trict and if after completion of one or more group houses the owner wishes to sub-divide the remainder this part must be re-zoned as provided in Section #22 -Amendment and Repeal of the Zoning By-Law of the Town.

Article 54. To see if the Town will construct a build- ing to be used as a public field house upon land of the Town known as the Arlington Heights Playground adjacent to the Boston & Maine Railroad; determine in what manner the money shall be raised; or take any action relating thereto.

Article 55. To see if the Town will appoint a com- mittee to consider the amendment, alteration, repeal or re- vision of, or addition to Article 15 of the By-laws of the Town of Arlington, particularly with reference to that por- tion of said By-law relating to Tenement Houses, Apart- ment Houses,. Hotels and Lodging Houses or other portions relating thereto, and to report a draft of any such changes at the next Annual Town Meeting; and that the sum of $200. be and hereby is appropriated for the use of said com- mittee; said sum to be raised by general tax.

Article 56. To see if the town will appropriate the sum of four hundred dollars ($400.00) to be expended under the direction of the Board of Selectmen, for the purpose of providing suitable headquarters for Arlington Post 1775, Veterans of Foreign Wars of the United States, in accord- ance with Chapter 40, Section 9, under the General Laws of Massachusetts, said sum to be raised by general tax.

Article 57. To see if the Town will construct a build- ing or buildings to be used for the purposes of the Board of Public Works and any other Town boards, officers, or committees, for use as a Reclamation plant or for the dis- posal of rubbish and waste materials or for any municipal purpose or purposes, upon land of the Town known as the Town Yard at Hobbs Court or upon any other land; will alter or add to the present building or buildings on said land; make an appropriation or appropriations for such construction, including the cost of original equipment and furnishings, and for such alterations and additions; deter- mine in what manner the money shall be raised and ex- pended; or take any action relating to all or any of the foregoing.

Article 58. To see if the Town will acquire by pur- chase, eminent domain or otherwise for the disposal of ashes, refuse and rubbish or for any other municipal pur- pose any land within the Town or any interest in any such land; will make an appropriation for such acquisition; de- termine in what manner the money shall be raised and ex- pended; or take any action relating to anything herein- before mentioned.

In pursuance of the foregoing Warrant the legal voters of the Town of Arlington met in their respective voting places in said Town on Monday, the sixth day of March, in the year of our Lord one thousand nine hundred and thirty-nine at seven o'clock in the forenoon.

The necessary ballots prepared for each precinct and all other paraphernalia for the proper conduct of the elec- tion was supplied by the Town Clerk and turned over to the officers of the various precincts.


The polls were declared open in each precinct at seven o'clock in the morning and remained open until eight o'clock in the evening at which time, after due notice, they were declared closed.
