Article 31 taken up. (Easements in Land)


On motion, duly made and seconded, it was unanim- ously


Voted: That the Joint Board of Selectmen and Board of Public Works be and hereby is authorized and em- powered on behalf of the Town, to purchase or take by eminent domain or otherwise acquire, easements in land adjoining the location of ways, the laying out of which is accepted at this meeting, consisting of the right to have the land of said locations protected by having the surface of such adjoining land slope from the boundaries of said locations ; that for this purpose the sum of fifteen hundred (1,500) dollars be and hereby is appropriated; said sum to be raised by general tax and expended under the direc- tion of said Joint Board.


There being no further business under Article 31 the Moderator declared it disposed of.

Article 33 taken up. (Claims or Charges of Symmes Arlington Hospital)


On motion, duly made and seconded, it was unanim- ously


Voted: That the sum of fifty two hundred nine and 93/100 (5,209.93) dollars be and hereby is appropriated to pay claims and charges of Symmes Arlington Hospital, including such claims and charges for aid, relief or care furnished prior to January 1, 1939, to persons falling into distress and standing in need of immediate relief; said sum to be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 33 the Moderator declared it disposed of.


Article 34 taken up. (Right of Way-Symmes Arling- ton Hospital)


On motion, duly made and seconded, it was unanim- ously


Voted: That the Board of Selectmen be, and hereby is authorized and empowered in the name and on behalf of the Town to grant, in such manner as it shall deem proper, to the Symmes Arlington Hospital, a corporation duly established by chapter 146 of the Acts of 1902 (here- inafter called the "Hospital") a full and free right of way in common with the Town and others at any time entitled over a portion of the Town's land shown as "New Private Way" upon a plan entitled "Plan of Land in Arl- ington, Mass., showing location of Old and New Private Ways to Symmes Arlington Hospital. Scale 1" = 40' No- vember 1938 James M. Keane, Town Engineer," filed in the office of the town engineer, and bounded according to said

plan southwesterly by the northeasterly side line of Sum- mer Street 70.44 feet; northwesterly by land of owners unknown 162.82 feet, and by other land of the Town on a curved line with a radius of 321 feet, 225 feet more or less ; northeasterly by land of the Hospital 45 feet, more or less, and southeasterly by other land of the Town on a curved line with a radius of 281 feet, 239 feet more or less, on a straight line 148.01 feet and by a curved line with a radius of 31.27 feet, 46.14 feet; and to release to the Hospital the Town's right of way over the portion of the land of the Hospital bounded according to said plan southwesterly by land of the Town 40 feet, more or less, northwesterly by other land of the Hospital 19.31 feet, northerly and north- easterly by other land of the Hospital on the southerly line of the "New Private Way" as shown on said plan, 102.37 feet, and southeasterly and southerly by other land of the Hospital on the southeasterly side line of "Old Pri- vate Way" as shown on said plan 88.52 feet; upon receiv- ing from the Hospital as a part of the same transaction a grant of a right of way over the portion of said Hospital's land marked "New Private Way" on said plan, and a re- lease of all the Hospital's rights in the portion of the Town's land marked "Old Private Way" on said plan other than the right to maintain water and sewer mains as at present located, provided always that no such grant or re- lease shall in any way affect the existing rights of the Town, except as herein expressly set forth.


There being no further business under Article 34 the Moderator declared it disposed of.


Article 35 taken up. (Transfer of Cemetery Funds)


On motion, duly made and seconded, it was unanim- ously


Voted: That the sum of one hundred ninety-six (196) dollars be transferred from (Mt. Pleasant Cemetery) Sale of Lots and Graves Fund to the (Mt. Pleasant Cemetery) Perpetual Care Fund; and that the sum of one hundred (100) dollars be and hereby is appropriated for the acqui-

sition of the southerly portion of Lot No. 133 on Centre Avenue or rights therein in said cemetery, said sum to be taken from Sale of Lots and Graves Fund; and that the Board of Cemetery Commissioners be and hereby is author- ized to do whatever may be necessary or proper to effectu- ate such transfer and acquisition.


There being no further business under Article 35 the Moderator declared it disposed of.


Article 36 taken up. (Transportation of Pupils)


On motion, duly made and seconded, it was unanim- ously


Voted: That no appropriation be made under Article 36 of the Warrant.


There being no further business under Article 36 the Moderator declared it disposed of.


Article 37 taken up. (Telephone System-High School)


On motion, duly made and seconded, it was unanim- ously


Voted: That the Town do not make an appropriation for the purpose of completing inside telephone system in the new high school building and altering system in old high school building, under Article 37 of the warrant.


There being no further business under Article 37 the Moderator declared it disposed of.


Article 38 taken up. (Repairs on Roofs-School Buildings)


On motion, duly made and seconded, it was


Voted: That the sum of five thousand (5,000) dollars be and hereby is appropriated for the purpose of meeting extraordinary repairs on the roofs of school buildings; said sum to be raised by general tax and expended under the direction of the School Committee.

Article 39 taken up. (Boiler Repairs-High School)


Mr. Stratton presented an amendment to the recom- mendation of the Finance Committee changing the words "one of the boilers" to "two boilers" and on being put to a vote the Moderator declared the motion carried; and on motion, duly made and seconded, it was unanimously


Voted: That the sum of sixteen hundred and fifty dol- lars ($1,650) be and hereby is appropriated for the purpose of installing new tubes in two boilers at the old high school building; said sum to be raised by general tax and expended under the direction of the School Committee.


There being no further business under Article 39 the Moderator declared it disposed of.


Article 40 taken up. (Committee on Plans for Comple- tion of High School Auditorium)


Mr. Stratton offered the following substitute motion, duly seconded :


That the Moderator appoint a committee of five, two members at least to be appointed from the School Com- mittee, to procure plans and specifications for the comple- tion of the high school auditorium, and estimates of the cost of same, said committee to report to the Town not later than the annual meeting of 1940; that the sum of five hundred (500) dollars be and hereby is appropriated for the use of such committee, said sum to be raised by general tax.


Mr. Bitzer moved an amendment striking out the words "That the sum of five hundred (500) dollars be and hereby is appropriated for the use of such committee, said sum to be raised by general tax." Before being put to a vote Mr. McManus offered an amendment "That the sum of $50.00 be and hereby is appropriated for the use of said committee, said sum to be raised by general tax." upon withdrew his amendment; a vote being taken on the amendment of Mr. McManus, the Moderator declared it carried.


Thereupon, a vote was taken on the substitute motion of Mr. Stratton as amended, and the Moderator declared the motion lost; and on motion duly made and seconded, it was


Voted: That no action be taken under Article 40 of the Warrant.


There being no further business under Article 40 the Moderator declared it disposed of.


Article 41 taken up. (Committe on Plans for School Construction)


Mr. Stratton offered the following substitute motion, duly seconded :


That the Moderator appoint a committee to procure plans and specifications for the construction of an addition to the Hardy School building, and estimates of the cost of such addition and of the original equipment and furnishings thereof and of the grading of the grounds of said school; and to procure plans and specifications for the construc- tion of new school accommodations to replace the Russell School, and estimates of the cost of such building and of the original equipment and furnishings thereof and of the grading of the grounds of such school building; said com- mittee to report to the Town not later than the annual meeting of 1940 ; that the sum of one thousand (1,000.) dol- lars be and hereby is appropriated for the use of such com- mittee, said sum to be raised by general tax.


On being put to a vote, the Moderator declared it lost.


On motion, duly made and seconded, it was unanim- ously


Voted : That no action be taken under Article 41 of the Warrant.

Article 42 taken up. (Kindergartens)


Mr. Lawrence Murphy offered the following substitute motion, duly seconded :


That the sum of one thousand four hundred and 00/100 dollars (1,400) be and hereby is appropriated for adding kindergartens to grade schools, said sum to be raised by general tax and expended under the direction of the School Committee substantially as follows :


Instructional Service $ 1,200.


Kindergarten Supplies 200.


$ 1,400.


There was lengthy discussion. Mr. Donovan moved the Previous Question and being put to a vote the Moderator declared it carried. A vote was then taken on the sub- stitute motion and the Moderator declared it lost. There being doubt a rising vote was taken and 18 voted in the affirmative and 138 in the negative, and the Moderator declared the motion lost; and


On motion, duly made and seconded, it was


Voted: That the Town do not now appropriate the sum of twelve hundred (1,200) dollars, or any other sum, for the purpose of adding kindergartens to one or all grade schools.


There being no further business under Article 42 the Moderator declared it disposed of.

Voted : to adjourn.

ADJOURNED TOWN MEETING


March 31, 1939.


Pursuant to the vote of Adjournment on March 29, 1939 the Town Meeting Members met in the Town Hall on Friday, March 31, 1939 at 8:00 P. M. notices having been sent by mail to the Town Meeting Members, and posted in the various precincts.


Lists of the duly qualified Town Meeting Members were used to check attendance at the entrances of the meeting place and were in charge of Philip T. Robinson and James E. Sweeney; they were filed with the Town Clerk at the close of the meeting and one hundred and seventy-one attended the meeting.


The Moderator called the meeting to order at 8:05 P. M.


There were no Town Meeting Members to be sworn by the Moderator.


On motion of Mr. Davis, duly seconded, it was unanim- ously


Voted: That if all the business of the meeting as set forth in the Warrant is not disposed of at this session, when the meeting adjourns, it adjourn to Monday evening April 10, 1939 at 8 o'clock.


Mr. Bitzer moved that Article 40 be reconsidered, and a vote being taken the Moderator declared the motion lost.


The Moderator declared Article 43 before the meeting.


Article 43 taken up. (Publication of Book-"Arling- ton Citizenship.")


On motion duly made and seconded it was unanimously


Voted: That no action be taken under Article 43 of the warrant.

Article 44 taken up. (Amendment of the Building Code )


On motion duly made and seconded, it was


Voted: That Divisions 12 and 13 of Article 15 of the Town's by-laws, known as the Building Code, be and here- by are amended by adding thereto, substituting for por- tions thereof, and striking out a portion thereof, all as particularly set forth in Article 44 of the warrant, and that the sum of fifty (50) dollars be and hereby is ap- propriated for the publishing of said amendments, said sum to be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 44 the Moderator declared it disposed of.


Article 45 taken up. (Amendment of Town By-Law- Re-Contracts and Purchases)


Mr. Gaddis moved that Section 1 be amended by taking out the word "issue" in the third line and inserting the word "require," and a vote being taken the Moderator declared the motion unanimously carried; and on motion, duly made and seconded it was unanimously


Voted: That the Town's by-laws be and hereby are amended by inserting after Article 7 a new article, num- bered Article 7-A, as particularly set forth in Article 45 of the warrant; that its by-laws be also amended by num- bering the present Article 7-A as Article 7-B, and that the sum of fifty (50) dollars be and hereby is appropriated for the publishing of said amendments, said sum to be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 45 the Moderator declared it disposed of.

Article 46 taken up. (Expenses of Officers and Em- ployees-Fire Department)


On motion duly made and seconded, it was.


Voted: That the sum of $15.90 be and hereby is ap- propriated for the purpose of paying expenses of officers and employees of the fire department incurred outside the Commonwealth prior to January 1, 1939; said sum to be raised by general tax and expended under the direction of the Board of Selectmen.


There being no further business under Article 46 the Moderator declared it disposed of.


Article 47 taken up. (Revision of Boundaries of Vot- ing Precincts)


On motion duly made and seconded it was unanimously


Voted: That the Board of Selectmen be and hereby is directed, under the provisions of Section 3 of Chapter 43A of the General Laws, to review and if need be, wholly or partly revise the boundaries of voting precincts 4, 6, 8 and 10 of the Town, bordering on the Concord Turnpike, in December of this year; that the sum of fifty (50) dollars be and hereby is appropriated for the use of said Board for this purpose; and that said sum be raised by general tax.


There being no further business under Article 47 the Moderator declared it disposed of.


Article 48 taken up. (Rescind Authorization of Trea- surer to Borrow-Re Hurricane Damage.)


On motion duly made and seconded it was unanimously


Voted: That the authorization of the treasurer to bor- row any sum in excess of forty thousand (40,000) dollars, contained in the vote of the Town passed October 3, 1938 under Article 2 of the warrant for the meeting of that date be and hereby is rescinded; and that said vote be and here- by is modified by substituting the words "forty thousand

(40,000) dollars" for the words "forty-five thousand (45,- 000) dollars" wherever they appear.


There being no further business under Article 48 the Moderator declared it disposed of.


Article 49 taken up. (Sewer Connection-Arlington and Lexington)


On motion duly made and seconded it was unanimously


Voted: That the agreement by and between the Town of Lexington by its Board of Selectmen and the Town of Arlington by its Board of Public Works, dated December 5, 1938, referred to in Article 49 of the warrant, be and hereby is ratified to take effect when ratified by the town meeting of Lexington.


There being no further business under Article 49 the Moderator declared it disposed of.


Article 50 taken up. (Zoning)


Mr. Knight presented the report of the Planning Board, and on motion duly made and seconded, it was voted that it be received.


On motion of Mr. Knight, duly made and seconded it was unanimously


Voted: That the Town make the additions to and changes in the Zoning By-Law as described in Article #50 of the Warrant for the meeting of March 15, 1939.


There being no further business under Article 50 of the Warrant the Moderator declared it disposed of.


Article 51 taken up. (Zoning)


Mr. Knight presented the report of the Planning Board, and on motion duly made and seconded, it was voted that it be received.

Voted : That the Town do not alter its Zoning By-Law and Map therein referred to so as to change the area as bounded and described in Article #51 of the Warrant for the meeting of March 15, 1939, from a Semi-Residence District to a new district to be known as Residence D. District, and that the Zoning By-Law be not changed by adding this new district likewise shown in detail in this same Article #51.


There being no further business under Article 51 the Moderator declared it disposed of.


Article 52 taken up. (Zoning)


Mr. Knight presented the report of the Planning Board, and on motion duly made and seconded, it was voted that it be received.


Mr. Knight offered the following motion.


That the Town do not amend Sections 2 and 3 of its Zoning By-Laws by striking out paragraph A in each section and inserting in each place thereof a new paragraph A as described in detail in article #52 of the Warrant for the meeting of March 15, 1939.


Mr. Lansing offered the following substitute motion :


That Sections 2 and 3 of the Zoning By-Laws be and hereby are amended by striking out Paragraph (a) of Section 2 as it now reads and inserting in place thereof the following new paragraph: (a) Any industry, trade, manufacturing or commercial purpose, or any private or public use which would be injurious, obnoxious, or offen- sive to a neighborhood, by reason of noise, vibration, smoke, cinders, odor, gas, fumes, dust, chemicals, or other objectionable feature or dangerous to a neighborhood through fire, explosion or for any other cause; and by striking out Paragraph (a) of Section 3 as it now reads and inserting in place thereof the following new paragraph : (a) Any industry, trade or commercial purpose, or any private or public use which will be injurious, obnoxious or offensive to a neighborhood, by reason of noise, vibration,

smoke, cinders, odor, gas, fumes, dust, chemicals, or other objectionable feature or dangerous to a neighborhood through fire, explosion or for any other cause.


After much discussion it was moved and seconded that Article 52 be laid on the table, 91 voting in the affirmative and 54 in the negative, until Article 57 was disposed of.


Article 53 taken up. (Zoning)


Mr. Knight presented the report of the Planning Board and on motion duly made and seconded it was voted that it be received.


On motion of Mr. Knight, duly made and seconded, it was unanimously


Voted: That the Town do not alter its Zoning By-Law and Map therein referred to so as to change the area more particularly described in article No. 53 of the Warrant for the meeting of March 15, 1939 from a Single Residence District to a new district to be known as Residence C. Dis- trict and that the Zoning By-Law be not changed as also described in detail in this same article No. 53.


There being no further business under Article 53 the Moderator declared it disposed of.


Article 54 taken up. (Public Field House at Heights Playground)


Mr. Knight, on behalf of Mr. Patterson, Chairman of the special Park and Playground Committee, asked that no action be taken at this time on this article. There was lengthy discussion. The Previous Question was moved and seconded and unanimously carried; and on motion duly made and seconded, on the recommendation of the Finance Committee, it was


Voted: That the sum of twenty-five hundred (2,500) dollars be and hereby is appropriated for the construction of a building to be used as a public field house upon land of the Town known as the Arlington Heights Playground ; said

There being no further business under Article 54 the Moderator declared it disposed of.


Article 55 taken up. (Committee on Amending of Town's By-Laws: "Building Code")


On motion duly made and seconded it was unanimously


Voted: That the Town do not appoint a committee to consider the amendment, alteration, repeal or revision of, or addition to Article 15 of the Town's By-Laws relating to Tenement Houses, Apartment Houses, Hotels and Lodging Houses or other portions relating thereto, under Article 55 of the warrant.


There being no further business under Article 55 the Moderator declared it disposed of.


Article 56 taken up. (Annual Rental for Arlington Post 1775, V. F. W.)


On motion duly made and seconded it was unanimously


Voted: That the sum of four hundred (400) dollars be and hereby is appropriated for the purpose of providing headquarters for Arlington Post 1775, Veterans of Foreign Wars of the United States; and that said sum be raised by general tax and expended under the direction of the Board of Selectmen.
