LAW PROPOSED BY INITIATIVE PETITION


Shall the proposed measure which provides that the present statutes which make it a crime punishable by fine or imprisonment knowingly to advertise, print, publish, distribute or circulate any matter containing reference to any person from whom or place where any drug, instrument or means whatever, or any advice or information may be obtained, for the purpose of preventing pregnancy, or to sell, lend, give away, exhibit, offer or advertise any drug, medicine, instrument or other article for the prevention of conception, or to write or print information of any kind stating when, where, how, of whom, or by what means such article can be obtained, or to manufacture or make such article, shall not apply to treatment.or prescription given to married persons for protection of life or health by or un- der the direction of registered physicians nor to teaching in chartered medical schools nor to publication or sale of medical treatises or journals, which was disapproved in the House of Representatives by a vote of 77 in the affirma- tive and 133 in the negative and in the Senate by a vote of 16 in the affirmative and 18 in the negative, be approved?

(a) If a voter desires to permit the sale in this Town of any and all alcoholic beverages to be drunk on and off the premises where sold, he will vote "YES" on all three ques- tions.

(b) If he desires to permit the sale herein of wines and malt beverages only to be drunk on and off the premises where sold, he will vote "NO" on question one, "YES" on question two and "NO" on question three.


(c) If he desires to permit the sale herein of all al- coholic beverages but only in packages, so called, not to be drunk on- the premises where sold, he will vote "NO" on questions one and two and "YES" on question three.


(d) If he desires to permit the sale herein of wines and malt beverages to be drunk on and off the premises where sold and in addition other alcoholic beverages but only in packages, so called, not to be drunk on the premises where sold, he will vote "NO" on question one and "YES" on questions two and three.


(e) If he desires to prohibit the sale herein of any and all alcoholic beverages whether to be drunk on or off the premises where sold, he will vote "NO" on all three questions.

M. and you will notify and warn the voters of the Town of Arlington to meet at the times and places herein specified by leaving at every dwelling house in the Town a printed copy of this Warrant and also by posting a copy of the same at the doors of the Town Hall and in a conspicuous place in each of the fourteen precincts of the Town seven days, at least, prior to the time of said meeting.


Hereof fail not, and make due return of this Warrant, with your doings thereon, to the Selectmen, on or before said day and hour of meeting.

By virtue of this Warrant I have notified and warned the legal voters of the Town of Arlington to meet at the times and places and for the purposes herein named by causing a printed attested copy of the same to be left at every dwelling house in the Town, and by posting an at-

tested copy at the doors of the Town Hall seven days at least before said day of meeting and by posting attested copies in two or more conspicuous places in each voting precinct in the Town. A notice of the time, places and ob- jects of the meeting was published in the local papers.'

Arlington, Mass., Nov. 3, 1942.


In pursuance of the foregoing Warrant the legal voters of the Town of Arlington met in their respective voting places in said Town on Tuesday the third day of Novem- ber in the year of our Lord one thousand nine hundred and forty-two at seven o'clock in the forenoon; the election officers, duly appointed by the Selectmen, having been previously sworn to the faithful performance of their duties.


The necessary ballots prepared for each precinct and all other paraphernalia for the proper conduct of the election was supplied by the Town Clerk and turned over to the officers of the various precincts.


The polls were declared open in each precinct at seven o'clock. in the forenoon and remained open until eight o'clock in the evening at which time, after due notice, they were declared closed.


The ballots were counted by the election officers and . encased in boxes, which were locked and sealed, and the same were delivered by direction of the Town Clerk to the Police Station where they were placed under police guard until after the expiration of the time within which a pe- tition for recount might be filed.


The returns and keys to ballot boxes from each pre- cinct were turned over to the Selectmen and the Town Clerk

CANVASS


Arlington, Mass., Nov. 7, 1942.


Pursuant to law Mr. William F. Burns of the Board of Election Commissioners of Somerville, and the Town Clerk of Arlington exchanged duly certified forms on November 7, 1942 for the purpose of canvassing the votes cast on the third day of November for TWO Representatives in General Court, for the Twenty-fifth Middlesex District.


The Canvass showed the following result of the votes cast in Arlington and Somerville.


In Arlington T. Edward Corbett had one thousand three hundred and sixty-three.


In Somerville T. Edward Corbett had three thousand six hundred and seventy-three.


In Arlington John F. Foster had one thousand and eighty-nine.


In Somerville John F. Foster had five thousand fifty- seven.


In Arlington Allan Roy Kingston had eight hundred and ninety.


In Somerville Allan Roy Kingston had four thousand five hundred and eighty-two.


In Arlington Angus M. MacNeil had one thousand one hundred and fifty-two.


In Somerville Angus M. MacNeil had three thousand one hundred and forty-six.


The Canvass showed that John F. Foster and Allan Roy Kingston had a majority of the votes cast.

Certificates showing the results of the election were signed by the Clerks, and one of the certificates was sent to the Secretary of the Commonwealth.


In the Twenty-eighth Middlesex District Nelson B. Crosby and Hollis M. Gott were duly elected, and each was notified, by Constable, of his election and presented with a Certificate thereof; copies of which were duly filed with the Secretary of State.
