By virtue of this Warrant I have notified and warned the legal voters of the Town of Arlington to meet at the time and place and for the purposes herein specified by causing a printed attested copy of said Warrant to be left at every dwelling house in the Town, and by posting an attested copy of said Warrant at the doors of the Town Hall and in two or more conspicuous places in each of the fourteen precincts of the Town, seven days at least before the day of said meeting. A notice of the time, place and objects of the meeting was published in the local papers.

SPECIAL TOWN MEETING - NOVEMBER 4, 1957


Pursuant to the Warrant of the Selectmen served according to law upon the inhabitants of the Town of Arlington by a constable of said Town, and notices having been sent by mail by the Town Clerk at least seven days before the day of the meeting to the town meeting members elected and qualified to act in town meetings in Arlington under the provisions of Chapter 43A of the General Laws, as amended, and published in the local newspapers as required by the Town's By-Laws, the town meeting members met in the Town Hall in said Town on Monday, November 4, 1957, at eight o'clock, in the evening. The Warrant calling the meeting was the notice sent by mail by the Town Clerk.


Certificates were filed with the Town Clerk by the Chairman and Clerks of Precincts 1, 6, 10 and 11, respectively, relative to meetings held on November 4 and of the elections to fill Town Meeting vacancies, as follows:


Precinct 1- Charles C. Worth, 54 Waldo Road, until the next annual election, caused by the resignation of Edward H. Stacey, whose term expires in 1960.


Precinct 6-Sidney R. DeBlois, 41 Kensington Road and Wyman W. Smart, Jr., 27 Kensington Road, until the next annual election, caused by the resignations of Elinor I. Jennings and Malcolm H. Masters, whose terms expire in 1958.


Precinct 10- George H. Gennis, 29 Newport Street, until the next annual election, caused by the resignation of George F. Hatha- way, whose term expires in 1960.


Precinct 11- Ben R. Cole, 74 Oak Hill Drive and Sylvia K. Dreyfus, 74 Ridge Street, until the next annual election, arising from the death of William R. Bennett and the resignation of Richard D. Carney, whose terms expire in 1959 and 1960, respectively.

ARLINGTON TOWN REPORT


Lists of the duly qualified town meeting members were used at. the entrances of the meeting place and were in charge of Ann Mahon and Mary A. Farrington. The lists contained the names of two hundred fifty-one (251) town meeting members qualified to parti- cipate in and vote in town meetings in Arlington.


The check lists filed with the Town Clerk at the close of the. meeting by the checkers showed that two hundred thiry-two (232) elected members and eight (8) members-at-large (96% of total - 251) attended the meeting.


Philip H. Burt was sworn by the Town Clerk as Stenographer to impartially and correctly report the proceedings of the meeting to. the best of his ability.


The Moderator, Lawrence E. Corcoran, declaring a quorum present, called the meeting to order at 8:15 o'clock P.M.


The meeting was opened with the singing of "The Star Spangled Banner" by the assembly, accompanied by Mr. Augustus Mazzocca, trumpeter, and Mr. Walter E. Russell, pianist, both of the School Department, and prayer offered by Rev. Robert W. Bullock, Curate of St. Camillus Church.


The town meeting members who had not previously been sworn were thereupon sworn by the Moderator.


There being no objection to the request of Selectman Rawson, permission was granted by general consent for Messrs. Harris, Sorensen, Hurd and Greeley of the Board of Selectmen; Mr. Nicksay, Executive Secretary of the Board of Selectmen; Messrs. Cooledge and Wood of the Board of Assessors; Mr. Wells, Executive Secretary of the Board of Assessors; Messrs. Kelliher, Farrington and Fallon of the Personnel Board; Mr. Morris, Executive Secretary of the Personnel Board; Messrs. Dunn, Hooley, LaJoie, Ahern, Keefe, Guinan, Murphy, Sisson, Johnston, Richardson and Streng of the Finance Committee; Mr. Farrow, Executive Secretary of the Finance Committee; Messrs. Magnuson, Berg, Fox, Mirak, O'Hearn and Gilliland of the Arlington Development Commission and Mr. Purcell, Town Counsel, to sit within the town meeting enclosure.


The Town Clerk read the Call of the meeting and the Con- stable's Return of the Warrant, the reading of the remainder of the Warrant being waived by consent of the meeting.


On motion of Selectman Rawson, duly seconded, it was


VOTED: That if all the business of the meeting as set forth in the Warrant is not disposed of at this session, when the meeting adjourns, it adjourn to Thursday evening, November 7, 1957, at S o'clock.

Article 2. (Amendment of Town By-Laws - Classification Plan.)


VOTED: (Unanimously) That Schedule A of the Classification and Pay Plan as established by Article 7 C of the By-Laws be and hereby is amended by adding the following classifications:

On the substitute motion of Daniel A. Healy, Jr. of Precinct S to amend the motion of the Finance Committee, which was seconded and was declared by the Moderator to have carried on a standing vote, 132 having voted in the affirmative and 93 in the negative, it was


VOTED: That the Town appropriate the sum of $12,501.83 for personal services of members of the Police Department and the sum of $17,031.90 for personal services of members of the Fire Department for the purpose of compensating the members of said Departments at salaries provided for by the vote of the Town of 106 in the affirmative and 91 in the negative at the adjourned session of the 1957 Annual Town Meeting held on March 20, 1957, under Article 27 of the Warrant for said Annual Town Meeting, if said vote shall be determined in the proceeding for a Declaratory Judgment or Decree of certain members of said Departments now pending in the Middlesex Superior Court to be legally effective to amend the Pay Plan established under Section 2, Article 7C of the By-Laws of the Town, for the period from the effective date of said vote to the end of the year 1957, said sums to be taken from available funds now in the treasury and expended under the dir- rection of the Town Manager.


There being no further business under Article 3, the Molerator declared it disposed of.


Article 4. ( Abandonment of Easement.)


VOTED: (Unanimously) That the following easement dated January 23, 1956, Taken for Sewer Purposes by the Board of Select- men of the Town of Arlington, duly recorded with the Middlesex South District Registry of Deeds in Book S658, Page 80, be and hereby is abandoned.


Said easement is bounded and described as follows:


Beginning at a point on the northerly side line of Yerxa Road, said point being 39 feet northeasterly of the westerly boundary line of Lot 10, thence northeasterly through said Lot 10 and Lot 41 a distance of 100 feet more or less to an angle point, thence northerly through said Lot 41 and on a line parallel to and 7.5 feet west of the boundary line between Lots 41 and 42 a distance of 120 feet more or less to a point on the southerly side line of Stone Road. thence easterly on said southerly side line of Stone Road, on a curve to the left with a radius of 415 feet a distance of 15 feet more or less to a point, thence southerly through Lot 42 and Lot 10 on a line 7.5 feet easterly of and parallel to boundary line between Lots 41 and 42 a distance of 127 feet more or less to an angle point, thence southwesterly through Lot 10 and on a line 15 feet southeasterly of and parallel to the first-described line a distance of 88 feet more or less to a point on the northerly side line of Yerxa Road, thence westerly on said northerly side line of Yerxa Road, on a curve to the right with a radius of 110 feet a distance of 21 feet more or less to the point of beginning.

Article 5. (Sale of Russell School Property.)


On the substitute motion of Arthur D. Saul, Jr. of the Finance Committee to amend the original motion of the Finance Committee, which was seconded and was declared by the Moderator to have carried, it was


VOTED: (On a standing vote, 148 having voted in the affirmative and 86 in the negative.) That the Board of Selectmen be and hereby is authorized and empowered on behalf of the Town to sell, convey or otherwise dispose of a certain parcel of land with the buildings thereon, hereinafter described, to the Roman Catholic Archbishop of Boston for the sum of ten thousand (10,000) dollars, subject to the following terms and conditions:


1. Said sale shall be completed within one year from the date when offered for sale by the Board of Selectmen of the Town of Arlington.


2. Said land shall be used by St. Agnes Catholic Church and School of Arlington for High School purposes only and said school shall be in operation within five (5) years from the date of transfer of the land, or title to same shall revert to the Town of Arlington upon reimbursement to the grantee of the purchase price.


3. The Town of Arlington shall not be held liable for any damages suffered by the grantee in the use of the land.


Said parcel of land is bounded and described as follows:


Beginning at a point on the northwesterly side line of Medford Street said point being 164.0 feet northeasterly of the northeasterly side line of Mass. Avenue, thence northwesterly through said Russell School property a distance of 145.09 feet to a point of curve, thence northwesterly, northerly and northeasterly on a curve to the right with a radius of 18.5 feet a distance of 23 feet more or less to a point of tangency, thence northeasterly through said Russell School property a distance of 38 feet more or less to a point on the divi- sion line between said Russell School property and the Russell Common, thence northeasterly by said Russell Common a distance of 324 feet more or less to a point on the southwesterly side line of Chestnut Street, thence southwesterly by land of the Roman Catholic Archbishop of Boston a distance of 178 feet more or less to an angle point, thence southeasterly by said land of the Roman Catholic Arch- bishop of Boston a distance of 19.0 feet to an angle point, thence southwesterly by said land of Roman Catholic Archbishop of Boston a distance of 77.25 feet to an angle point, thence southeasterly by said land of Roman Catholic Archbishop of Boston a distance of 127.89 feet to a point on the northwesterly side line of Medford Street, thence southwesterly on said northwesterly side line of Medford Street a distance of 117.37 feet to the point of beginning and containing approximately 27,700 square feet, all as shown on a plan entitled "Parking Study, Arlington Centre, dated October, 1957, by W. H. Roby, Town Engineer".


There being no further business under Article 5, the Moderator declared it disposed of.

Article 6. (Procuring Plans and Estimates for Razing the Russell School Building.)


VOTED : That no action be taken under Article 6 of the Warrant.


There being no further business under Article 6, the Moderator declared it disposed of.


Article 7. (Acquisition of Land - Russell Common. )


Following discussion, a voice vote was taken on the motion of the Finance Committee favoring the acquisition of such land by the Town, as requested under Article 7 of the Warrant. The Moderator, being in doubt, called for a standing vote. On the standing vote, 70 voted in the affirmative and 84 in the negative, and the Moderator declared the motion lost.


There being no further business under Article 7, the Moderator declared it disposed of.


On motion of George J. Remmert of Precinct 4, duly seconded, it was


VOTED: (On a standing vote, 91 having voted in the affirma- tive and 56 in the negative.) That the meeting adjourn.


The meeting thereupon adjourned at 11:40 P. M., Monday, No- vember 4, 1957, until Thursday evening, November 7, 1957, at 8 o'clock.

Pursuant to the vote of adjournment of November 4, 1957, and written notices sent by mail by the Town Clerk, the town meeting members met in the Town Hall on Thursday evening, November 7, 1957, to act upon the remaining articles set forth in the Warrant for the Special Town Meeting of November 4, 1957.

Article 9. (Constructing Islands, Bumpers and Protective De- vices in the Muncipal Parking Area.)


VOTED : That no action be taken under Article 9 of the Warrant.

Article 10. (Procuring Plans and Estimates for Public Improve- ments.)


VOTED: That the sum of five thousand (5000) dollars be and hereby is appropriated to procure preliminary engineering plans, data, estimates of construction costs, and other costs that would be involved in implementing certain recommendations contained in the Benjamin Report of 1955, or such other recommendations as may be made by the Arlington Development Commission relating to public improvements, including the relocation of existing public ways and the laying out of new public ways and the construction of

Article 11. (Acquisition of Land.)


By consent of the meeting, the motion of the Finance Committee was considered withdrawn, and on the new motion of Arthur D. Saul, Jr. of the Finance Committee, which was seconded, it was

Article 12. (Widening of a Portion of Pleasant Street.)


VOTED: (Unanimously) That the Board of Selectmen be and hereby is authorized and empowered to use a strip of land, now a part of the Old Burying Ground on Pleasant Street for street pur- poses in conjunction with the widening of a portion of Pleasant Street.


Said land being bounded and described as follows:


Beginning at a point on the northwesterly side line of Pleasant Street, said point being 334.75 ft. southwesterly of the southwesterly side line of Mass. Avenue, thence southwesterly on said northwesterly side line of Pleasant Street, a distance of 222 ft. more or less to the division line between the Old Burying Ground and land of the New England Telephone & Telegraph Company, thence northeasterly through the Old Burying Ground a distance of 240 ft. more or less to the wall on the division line between the Old Burying Ground and land of the Unitarian Church, thence southwesterly by said land or the Unitarian Church on an irregular curve to the right on said division line a distance of 20 ft. more or less to the point of beginning and containing 580 sq. ft.


There being no further business under Article 12, the Moderator declared it disposed of.


Article 13. (Amendment of Town By-Laws - Re: Voting.)


VOTED: That no action be taken under Article 13 of the Warrant.

Article 14. (Amendment of Town By-Laws - Re: Excavations.)


VOTED: (Unanimously) That Article 12 of the By-Laws en- titled "Miscellaneous" be and hereby is amended by inserting after Section 8 a new section to be known as Section 9 of Article 12 of the By-Laws, said Section 9 to read as follows:


"Section 9. Owners of land which has been excavated shall be required to erect barriers or take other suitable measures to protect persons from damages incident thereto, within five days after such owners have been notified in writing by the Selectmen, that, in their opinion, such excavation constitutes a hazard to public safety. The penalty for violation of this By-Law shall not exceed two hundred (200) dollars."


There being no further business under Article 14, the Moderator declared it disposed of.


Article 15. (Amendment of Town By-Laws- Re: Wire De- partment. )


VOTED: (Unanimously) That Section 9 of Article 13 of the By-Laws be and hereby is amended by striking out the words "one hundred and thirty-two feet apart" in the first sentence of Section 9 and inserting in place thereof the words "one hundred and eighty feet apart" so that said Section 9 shall read;


Section 9. Where possible, all poles must be uniformly spaced, and of a uniform height, and shall not be more than one hundred and eighty feet apart. No pole less than thirty-five feet long shall: be set in the streets of this town, excepting poles for trolley span wires and poles used as ornamental lighting standards. All poles, except those used for ornamental lighting, shall be set not less than five feet in the ground under ordinary soil conditions and shall be stepped commencing eight feet from the sidewalk, such steps to be parallel with the sidewalk curbstone. Deviations from this rule may be permitted by the Inspector of Wires. Poles shall be set on lot lines or in positions which will cause minimum interference with private driveways or walks. Extensions must not be made on any pole without the approval of the Inspector of Wires. The first gain on every pole which in accordance with the provisions of the National Electrical Safety Code would be designated for Class C circuits shall be reserved for the use of the signal wires of this town.


There being no further business under Article 15, the Moderator declared it disposed of.


Article 16. (Advertising Town By-Laws.)


VOTED: (Unanimously) That the sum of one hundred sixty- five (165) dollars be and hereby is appropriated for the purpose of defraying the expense of advertising and other costs relating to the By-Laws voted at this meeting; ninety-six and 25/100 (96.25) dollars to be taken from the appropriation made under Article 84 of the Warrant for the 1957 Annual Town Meeting, and sixty-eight and 75/100 (68.75) dollars to be taken from available funds in the treas- ury; said sum to be expended under the direction of the Town Clerk.
