Section C.


Sick leave will accumulate for each year of employment.


Section D.


Sick leave with pay shall be granted to employees only when they are incapacitated for the performance of their duties by sick- ness, injury or quarantine by health authorities.


Section E.


Sick leave will commence on tlie day notification of the illness is given by the employee, his family, or his physician. Such notifica- tion shall be given within one hour of the regular appointed start- ing time.


Section F.


For absence on account of sickness, the department head, or the appointing authority, may require evidence in the form of a physician's certificate for the necessity for absence, such certificate to give the nature of illness and the expected duration. If such certificate is not filed after request therefor, such absence may be applied, at the discretion of the department head, to vacation leave or leave without pay. The department head shall require such certificate at the end of two weeks of illness and subsequent certi- ficates may be required at the discretion of the department head or the appointing authority.


Section G.


Employees whose services are terminated shall not be entitled to compensation in lieu of any sick leave not taken. No sick leave credit for prior employment will be allowed to employees rehired or reinstated after a termination of service other than approved leave of absence.

Section H.


Every department of the Town shall keep a uniform attend- ance record on such form as approved by the Town Accountant for each employee showing sick leave both accrued and granted. The information on such record shall be transmitted by the head of the department to the Personnel Board upon request.


Section I.


If accrued sick leave cannot be computed, due to the lack of records, the employee shall be credited with eight working days for each year of service, not to exceed sixty-four working days.


Section J.


Part-time employees whose hours of work follow a regular schedule will be allowed such proportion of sick leave credit as their actual part-time service bears to full-time service.


Section K.


Employees injured on the job and receiving Workmen's Com- pensation may, upon request, be granted such sick leave allowance payment, as will, when added to the amount of Workmen's Com- pensation, result in the payment to them of their full salary, pro- vided they have such sick leave credit.


Section L.


Discretionary sick leave not exceeding fifteen days may be granted by the appointing authority provided all accumulated sick leave and vacation leave have been exhausted and shall be charged against future sick leave credit.


SECTION 15. MISCELLANEOUS.


Section A.


The lunch period shall not exceed one hour.


Section B.


An absence with pay, not to exceed three days, shall be grant- ed in case of death of immediate member of an employee's family. Immediate family means spouse, child, father, mother, sister. brother or grandparents. An absence with pay of one day shall be granted in case of death of an employee's in-laws or grand- parents of spouse.


Section C.


Any permanent employee of the Town called for an annual tour of duty with the armed forces shall be paid his usual salary for a period not exceeding two calendar weeks and shall also be entitled to the same leaves of absence or vacation with pay given to other like employees.


Section D.


A regular employee called for jury duty shall be paid an amount to bring his salary up to his usual rate of pay. Notice of service shall be filed with the department head upon receipt of a summons.


Section E.


Leave of absence with pay shall be granted veterans who are delegates or alternates to state or national conventions of the fol- lowing veterans' organizations: American Legion, AMVETS of

World War II, Disabled American Veterans', Legion of Valor, Ma- rine Corps League, Military Order of the Purple Heart and Vet- erans of Foreign Wars.


Section F.


All payments made for any absence, regardless of nature, will be so noted on the payroll and employee's attendance record. The department head shall be responsible for the accuracy of such record.


Section G.


In order to qualify for holiday credit, a regular employee shall have worked on the last regularly scheduled work day prior to, and the next regularly scheduled work day following such holi- day, unless it is an absence for which compensation is payable as provided under this By-Law. The following days in each year shall be considered as holiday credits:

Columbus Day Veterans' Day


Memorial Day

SECTION 16.


Nothing in this By-Law shall be construed to conflict with the General Laws of the Commonwealth of Massachusetts.

ADJOURNED ANNUAL TOWN MEETING, MARCH 20, 1957


Pursuant to the vote of adjournment of March 18, 1957, and written notices sent by mail by the Town Clerk, the town meeting members met in the Town Hall on Wednesday evening, March 20, 1957, to act upon the remaining articles set forth in the Warrant for the Annual Town Meeting.


Certificates were filed with the Town Clerk by the Chairmen and Clerks of Precincts 5, 7, 10 and 13, respectively, relative to meetings held on March 20 and of the elections to fill Town Meet- ing vacancies, as follows:

Precinct 5 - Robert E. Holian, 31 Park Street, until the next annual election, arising from the death of John C. Hennessy, whose term expires in 1958.


Precinct 7- Claire M. Allison, 57 Webster Street, until the next annual election, caused by the resignation of Hugh J. Mulli- gan, Jr. from the two year term to which he was elected at the last Annual Town Election.


Precinct 10 - Kenneth H. Joel, 68 Grand View Road, until the next annual election, caused by the resignation of Thomas P. Conlan, whose term expires in 1959.


Precinct 13 - Francis J. McCarthy, 298 Forest Street, until the next annual election, caused by the resignation of Robert J. Croak, whose term expires in 1958.


Lists of the duly qualified town meeting members were used at the entrances of the meeting place and were in charge of Philip T. Robinson and James E. Sweeney. The lists contained the names of two hundred fifty-one (251) town meeting members.


The check lists filed with the Town Clerk at the close of the meeting by the checkers showed that two hundred three (203) members and eight (8) members-at-large (84% of total - 251) attended the meeting.


The Moderator, Lawrence E. Corcoran, declaring a quorum present, called the meeting to order at 8:15 o'clock P.M.


The meeting was opened with the singing of "The Star Spangled Banner" by the assembly, accompanied by Mr. Augustus Mazzocca and Mr. Walter E. Russell of the School Department, and prayer offered by Rev. John Heidt, Pastor of the Pleasant Street Congregational Church.


The town meeting members who had not previously been sworn were thereupon sworn by the Moderator.


On motion of Selectmen Rawson, duly seconded, it was


VOTED : That if all the business of the meeting as set forth in the Warrant is not disposed of at this session, when the meet- ing adjourns, it adjourn to Friday evening, March 22, 1957, at 8 o'clock.


The Moderator declared Article 24 to be the first item of business before the meeting.


Article 24. (Amendment of Town By-Laws - Classification and Pay Plan. )


A substitute motion favoring the amendment to the Classifica- tion and Pay Plan, as requested under Article 24 of the Warrant, was offered by Joseph L. Keefe of Precinct 9.

Considerable discussion ensued and, after Mr. Keefe's motion to substitute had been declared to have carried, a voice vote was taken on the motion of the Finance Committee as substituted. The Moderator, ruling that a majority of the entire town meeting membership was required to amend a by-law, in accordance with Robert's Rules of Order, asked for a standing vote. On the stand- ing vote, 119 voted in the affirmative and 70 in the negative, less than the majority of the entire town meeting membership of 251, and the Moderator declared the motion lost.


More than twenty town meeting members rose to request a roll call, which was thereupon taken by the Town Clerk. On the roll call, 122 voted in the affirmative and 80 in the negative, less than the majority of the entire town meeting membership of 251, and the Moderator declared the motion lost.


Thereupon, on the motion of the Finance Committee, it was VOTED: That no action be taken under Article 24 of the Warrant.


There being no further business under Article 24, the Modera- tor declared it disposed of.


Article 25. (Amendment of Town By-Laws - Classification and Pay Plan. )


VOTED : That no action be taken under Article 25 of the Warrant.


There being no further business under Article 25, the Modera- tor declared it disposed of.


Article 26. (Amendment of Town By-Laws - Classification and Pay Plan. )


VOTED : That no action be taken under Article 26 of the Warrant.


There being no further business under Article 26, the Modera- tor declared it disposed of.


Article 27. (Amendment of Town By-Laws - Classification and Pay Plan. )


A substitute motion favoring the amendment of the Classifica- tion and Pay Plan, as requested under Article 27 of the Warrant. was offered by Daniel A. Healy, Jr. of Precinct 8.


Considerable discussion ensued and, upon the motion for the previous question being carried, a voice vote was taken on the motion to amend. More than five voters having questioned the vote, the Moderator called for a standing vote. On the standing vote, 95 voted in the affirmative and 98 in the negative, and the Moderator declared the motion lost.

More than twenty town meeting members rose to request a roll call, which was thereupon taken by the Town Clerk. On the call of the roll of members, 102 voted in the affirmative and 100 in the negative, and the Moderator declared Mr. Healy's motion to substitute to have carried.


On the standing vote then taken on the motion of the Finance Committee as substituted, 106 voted in the affirmative and 91 in the negative, and the motion was declared lost by the Moderator for the reason that it was lacking of a majority of the entire town meeting membership ruled necessary to amend a by-Jaw, in accordance with Robert's Rules of Order.


Thereupon, on the motion of the Finance Committee, it was


VOTED: That no action be taken under Article 27 of the Warrant.


There being no further business under Article 27, the Modera- tor declared it disposed of.


Article 28. (Amendment of Town By-Laws - Classification and Pay Plan. )
