First division At a meeting of the propritors of the undivided common lands in Wenham on the 4th day of April in the year of our lord one thousand seven hundred and fifteen warned according to law in this case made and provided voted to choose the town clerk for the time being to be the propritors Clerk according to a former vote (William Rogers is the town clerk for the time being)

Voted to divide all our common lands that are undivided in Wenham and it is agreed upon to divide the several parcels of common lands hereafter mentioned into eight parts or divisions agreeing how many rights shall be in each part or division and to whom the rights do belong unto by name as near as we can for quantity and quality it not being convenient as formerly we have done to divide eight common rights in a division by reason of the land be- ing in so many pieces and small parcells, therefore it is agreed upon by said propritors to lay out to every pro- pritor his whole share together with more rights or less as the places well afford or allow for quantity and quality

as near as we can agree some having purchased several rights in the said common rights.
And it is agreed upon by said propritors that all that of land by Rice Knowltons shall be the first division
(the first division is as foloweth) and by estimation is 35 acres and it is agreed upon to be sixteen rights and is bounded as followeth,
Northerly by the Highway as the highway now goeth leav- ing said highway three poles wide to gravelly brook.
Easterly it bounds upon the first division formally laid out. Southerly by land of Samuel Corning partly and partly by a stone wall set up by William Dodge across the common Westwardly by land of William Dodge and the said di- vision is granted and confirmed by said propritors unto the persons hereafter named :
Viz: to Rice Knowlton one right in his own right and to John Gott two rights one in the right of his brother Wil- liam Fisk. one in his own right and one to Nathaniel Wal- dron one in his own right and one share is to the right of John Abbys living.
To William Rogers one in the right of Joseph Batchelder, one in the right of Nathaniel Brown.
To Capt. Thomas Fisk two rights, to Joseph Herrick one right. to Lieut. John Porter 3 rights one in his own right, one in the right of Mr. Newman living. one in the right of Samuel Fisks living.

And it is agreed upon by said propritors that all that parcell of common land by Longham shall be the second division.
And it is agreed upon by said propritors to be eight common rights and is by estemation about Ten acres boundeth as followeth.
Northerly by a stone wall; easterly by land of Samuel Corning Southerly by longham meadow. Westerly by land of William Dodge all within fence and the said division is granted and confirmed unto the propritors here- after named Viz: To Mr. Walter Fairfield one right in his own right and one in the right of Thomas White, one in the right of Daniel Claflin in the right John Sewert and one in the right of Tobias Trow. one in the right of John

Batchelder one in the right of Nathaniel Fairfield and one right is to Robert Cue's Living as may appear by purchase, Each to the right owner originally each to the persons above mentioned by name.
And it is agreed upon by said propritors that all that parcell of common Land laying by Mr. Daniel Dodges cider mill (shall be the third division) and it is agreed upon to be eight common rights and is by estimation about ten acres and is boundeth as followeth.
Northerly by land of Mr. Daniel Dodges leaving the high- way 3 poles wide as it now goith
easterly it bounds upon land of William Dodges.
Southwardly by longham Meadow fence westerly by land of Mr. Daniel Dodge
And the said division is granted and confirmed by said propritors unto the persons named hereafter Viz.
to Mr. Joseph Gerrish one in his own right and to Mr. Dan- iel Dodge one in his fathers right and to the widow Sarah Dodge administrator to her husbands estate three rights one in the right of the living she liveth on, one in the right of Henry Haggett and one in the right of Mordica Larcom. To Samuel Fisk one in his own right and to Mary Dodge one right for the living she liveth on and is to the living for the right owner of it and one to John Coys and it is agreed upon by said propritors that all that parcel of land upon Rocky Hill shall be the fourth division.
And it is agreed upon to be the ten rights of commonage and it is by estimation fifteen acres and it boundeth as fololweth,

Southerly by land of Benjamin Edwards
Westerly by land of Nathaniel Stone and partly by land of the heirs of John Dodge
Northerly by the edge of the hill within one poll of the high- way as it now goeth the town having liberty of digging of gravell to mend the highways withall as ocassion shall serve forever out of the north side of the hill and said division is granted and confirmed unto the persons hereafter named by the said propritors.
Viz. to Benjamin Edwards one in his own right and one in the right of John Dennis and one in the right of William Fairfield originally in the right Samuel Fisk Junr. and one in the right of Ephraim Kimball and to Thomas Edwards one right and one right in the right of William Knowlton and one in the right of Samuel Kemball Junr. one in the

It is agreed upon by the said propritors that all that parcel of common land by William Knowltons land or house shall be the fifth division and it is agreed upon by said propritors to be six common rights and is by estemation five acres and is bounded as followeth
Viz. Northerly by the highway leaving the highway three poles wide as it now goeth. And Southerly partly upon one acre of land laid out to Aron Jones and partly upon land of Widow Ruth Dodges and Westerly by her stone wall and said division is granted and confirmed by said propritors unto William Dodge one in the right of Deacon James Friend and one in the right of Ensign Samuel Kem- ball and two rights one the right of William Fairfields own right and the other in the right of said Fairfield in the right of Thomas Kilham and two rights in the right of Joseph Fowler one in his own right and one in the right of Mr. Smiths farm said Fowler having it by purchase as by purchase may appear to be said Dodges each to be to the original owners above said or to whom they of right belong to
And it is agreed upon by said propritors that all that parcel of common land that layeth adjoining to land of Samuel Kilhams and the land that was John Barrs and it is agreed upon by the said propritors to be the sixth division and it is allso agreed upon to be three common rights and it is boundeth as followeth.
It bounds Northerly upon the highway leaving said way three poles wide all along by said land and Southerly it bounds upon said Kilhams and Barrs land and is by es- timation about four acres and is granted and confirmed by said propritors to the persons here named Viz.
To Samuel Kilham one right beginning at the two acres layed out to him in his fathers right and by his own land untill it cometh even with the westerly end of his house leaving the highway three poles wide all along next to that one acre of land and is so one right leaving the highway three poles wide and the remainder of said land is to William Dodge in the right of John Barr leaving the highway three poles wide all along by said Common lands as the way goeth.
And it is agreed upon by the said propritors that all that

parcel of common land lying by Joshua Wallis's land shall be the seventh division and it is agreed upon by said pro- pritors that all that parcell of common land shall be twenty common rights and is by estimation about eighteen acres and is bounded as followeth.
Easterly partly by land of Phineas Dodge and partly upon the two acres layed out to Samuel Kilham.
Southerly by land of Andrew Dodge.
Southwestly by Henry Haggitt stone wall
and West or Northwesterly by Joshua Wallis land or stone wall as they now stand.
Northerly or Northeasterly by widow Sarah Dodges land leaving the highway 3 poles wide as it now goeth all along by or through said land and allowing liberty to Henry Haggitt a way for passing at time and at all times forever to come into the road or highway to pass with cart or sled or as occasion may be the way to be eighteen foot wide he said Haggitt having liberty of mending said way to make it passable he passing through gates or bars as ocasion may be.

which includes all the parcel of land as appears by pur- chase to him said Rogers each to the persons originally to whom they belong before mentioned.
The 8th division it is agreed upon by said propritors that all that parcel of common land on the back side of the great meadows next Topsfield Common be three common rights and is the eighth division and is boundeth as foloweth. North or northwesterly by Topsfield line
Southerly by the great meadow as the meadow goeth and is by estimation 4 acres
and that part of it next the causway and the swamp is two rights and that part next Deacon Fisks meadow is to said Deacon Fisk for his right.
the other half of it is to Benjamin Fisk for his right and all that parcell of land next to John Gotts meadow and William Rogers meadow as the upland goeth is to William Rogers in the right of Samuel Porter as by purchase each to the right owner.
Voted a confirmation in full of all the above particulars mentioned, the propritors in general to be borne indam- nified by any particular purchase that is made by any per- son or persons if their deeds dont appear to be good or have no such right as is pretended by any but to be the right owners.
Voted. that upon the request or desire of five of the said propritors to the propritors clerk, he shall give notice for a meeting mentioning the occasion thereof by a notification posted in some public place in our town, mentioning the time and place from time to time as occasion may serve.
At a meeting of the Selectmen April the 6th 1715 at Wenham William Rogers being town Clerk for the time being and was chosen propritors clerk at the propritors meeting on the 4th of April Instant of the undivided land of Wenham and he was sworn to said office of propritors clerk on the 6th day above said before said Selectmen. Have met and renewed the bounds at the maple, beginning at the maple so as the brook runs to a little island to a stake in the brook then from the stake in brook to the river having reference to the settlement agreed upon by our towns in 1694 as on record and from said maple towards the causway the bounds mentioned in the agreement 1682 having reference to that agreement made between our towns at that time to a tree marked as witness our hands on the day above said.

John Putnam Junr Isreal Andrews Joshua Buffum and Samuel Pope Junr appointed by the Selectmen of the town of Salem and Joseph Herrick John Gott and Thomas Tarbox three by the appointmen of the Selectmen of Wenham being met together this 25th of April 1715 to perambulate and renew the bounds as followeth beginning at a white oak at the northerly end of Wenham Causway marked with S. W. and T. with a heap of stones about it to a stake and heap of stones so on to a dry black oak with a heap of stones about it from thence to a white oak marked S. At a legal town meeting of the inhabitants of Wenham duely warned and convened on the 19th of September 1715. Mr. John Gott chosen moderator for the meeting.
Voted to raise one hundred pounds to defray our town debts and charges arising in the town.
Whereas the great and general Court have been pleased upon the petition of thirty two of our inhabitants have ordered a partial Session to come to Wenham and the town to have the charge. The petetioners renewing their pete- tion dated August 24th 1715 mentioning in their petetion that if it is the courts pleasure let the faulty party

bear the charge which was after the town and Selectmen had agreed.
The question being put to the town whether the town will choose a person to be an agent for our town to join with the late selectmen to petetion to the great and general court that the faulty party may bear the cost, the petetion- ers urgeing the same in the petetion if it be the courts pleasure.
Voted on the afirmative to choose a person.
Voted to choose Mr. John Gott for the service abovesaid.
Allso voted that our town treasuer for time past and for time to come upon their reckoning and being aquited by our selectmen in that office shall lodge all the orders and re- ceipts with the town clerk of our town.

To Constable Thomas Kemball a list amounting to the sum of £40 4s 9d whereof he is to pay unto the country treas- uer as by his warrant he is directed the sum of £34 00$ 00d and he is to pay into our Selectmen or their order £5 11s 5d for the paying a county rate 13 shillings and 4 pence and the remainder £0 13s 4ª is allowed him for the collecting
