Voted that the town choose some persons as a committee to agree with any person that shall appear to take Henry More and his wife and to give fifty pounds in money the one half at or before the first day of December next and the other half within one year after the date hereof and to take security to secure the town from being at any charge about them as the poor of our town for ever. and Ensign Sam- uel Kimball Sargent Benjamin Edwards and Joseph Her- rick are chosen to perfect the bargain and to sell so much common land as to make five pounds towards said payment.

And Ensign Samuel Kimball William Rogers Samuel Kimball Junr. and Nathaniel Fairfield are chosen and fully empowered as agents (or any one of them) to appear at said Court to manage the said cause for them in the law to affect as the propritors might themselves do if present.
Wenham May 10th 1709-At a meeting of the Selectmen reconked with William Rogers for his services as a school- master for our town for all time past and for the year now present 1709 he serving for a school master for one year next after the date hereof, and allso do acquit said Rogers of and from the £3.8$.8d. which was due to the town upon reckoning in the year 1706 when he served as Con- stable

Augt 22nd 1709 A province rate was Committed to the Constables one to Nathaniel Fairfield amounting to fifty six pounds ten shillings £56 10s 0d besides Sufficient Allow- ance for his Collecting the same.
November 1st 1709 A town and County rate was made in one list for his ward amounting to thirty seven pounds and fourteen shillings £37 14s 0d with a warrant to collect the same and make payment to the town treasurer £36 6s 7d and to the County treasurer £1 7s 7d for the colecting where- of he is allowed Allso December 23ª 1709 a town rate Com- mitted to him amounting to nine pound five shillings and Eleven pence to Collect and pay to the town treasurer seventeen penny weight and with warrant| to perform the same.
August 22nd 1709 A province rate was made and com- mitted to Constable Nathaniel Brown amounting to sixty nine pounds ten shillings payable to the province treasuer and twenty seven shillings to the town treasuer with suffi- cient allowance for collecting.
November 1st 1709 A town and County rate was made and committed to Constable Nathaniel Brown in one list amounting to forty five pounds three shillings one penny, one pound ten shillings whereof was ordered to the County treasuer and forty three pounds thirteen shillings and 1 penny to the town treasuer with warrant to collect said list and make the above said payments with sufficient allow- ance for collecting the same

December 23rd 1709 A town rate was made and commit- ted to Constable Nathaniel Brown amounting to eleven pound five shillings and six pence seventeen penny money with a warrant to Collect the same and pay it into the town treasuer. 1
Constable Browns part of wood in his rate for the min- ister was 17 Cords and 6 feet and Constable Fairfield| part was 13 Cords.
We whose names are underwritten being a committee appointed by the town at their meeting on the tenth day of June 1709 to sell so much common land as would procure five pounds in money to pay for the keeping of Henery More and his wife and accordingly have made sale of two small parcels of land to Joshua Wallis containing near about two acres be it more or less as it is here after bounded, the one being that parcel of common land laying between his own land before his door and boundeth southeasterly with a straight line from the bound tree parting between Goodman Haggitt and said Wallis his land on the south to said Wallis corner on the north and on the north west it boundeth with running out the divisional line that parteth between David Maxeys land and the said Wallis's land on the south side of the way, straight to the said Wallise's land on the north side.
The other parcel being nine score pole of the common land and adjoining to the said Joshua Wallis's land laying on the north side of his house lot and extendeth westerly to the bounds parting between Nathaniel Waldrons land and his own and is six poles wide at each end and thirty poles long which two parcels we have sold and laid out to the above said Joshua Wallis for five pounds in money for the end above mentioned as witness our hands-|this 8th day of August 1709|

At a meeting of the Selectmen October 14th 1709 then laid out and sold to Josiah Dodge about two acres of land according to an order of the town herewith all recorded, to procure money to pay Thomas Edwards for his highway and to procure 40 shillings for the town agents in Samuel Porters case which land is bounded with a line from the corner bounds that passeth between Nathaniel Waldrons land and the said Dodges own at the west end so South- easterly to a rock 14 poles then turning a little more south- erly to another rock 18 poles then turning easterly 13 poles to another rock then turning five poles to the walnut tree which is the said Dodges easterly corner bounds formally Claflins and so it boundeth upon said Dodges land to the

All the five forementioned rights are bounded northeaster- ly on Manchester road 45 rods and on the westerly side with the third division to the stake and heap of stones on Bev- erly line; and Southerly are bounded by Beverly line forty and nine poles to a stake and heap of stones which is Wal- ter Fairfields bounds allso and are bounded by the westerly side of the said Fairfields eighth to a stake and a rock at Manchester road which five eighths the said Josiah Dodge and Daniel Stone have equally divided between themselves as followeth that is to say from a stake and heap of stones in the line, that part to the third and fourth division forty five poles from the stake and heap of stones standing in the Beverly line between the said third and fourth division and so on a straight line towards the white oak tree called the Wests bounds on the gravelly Ridge untill it cometh to the westerly side of the sixth eighth which is the said Walter Fairfields Lott and the said Josiah Dodges is part of the said five eighth is at the easterly end next Manchester road and the said Daniel Stone part of said five eights is that next to Beverly line the sixth eighth of the said division is laid out to Walter Fairfield as his right of said division being ten rods and two feet next Manchester road and at the southerly end it is on Beverly line is eleven rods or poles and it is in breadth running from the gravelly Ridge nine pole and one half and two foot.
the seventh eighth is laid out to Andrew Dodge in the right of John Barr and is in breadth at the easterly end next the Manchester road ten poles wide and at the south- westerly end at Beverly line it is eleven poles wide bounded with a stake and heap of stones and in the middle from the gravelly Ridge it is nine poles and one half.
the eighth eighth was laid out to Richard Hutton as his right and share in said division being sixteen pole and at the easterly end next the Manchester road and is bounded on the westerly side with a stake and heap of stones which is allso Andrew Dodges bound and on the easterly side with Capt West his land and is twenty poles wide on Bev- erly line from Andrew Dodges stake and heap of stones to a tree marked with B and W. and at the gravelly ridge one pole and one half wide.

Know all men by these presents that whereas the Com- mittee appointed by the town to lay out the acre lots did lay out to us the subscribers hereof our share in that divi- sion in partnership with Joseph Batchelder being accounted four acres according to the bounds thereof as they stand entered in the town book bearing date January 5th 1698 be the same more or less according as the bounds are en- tered do hereby sell allinate asign and set out unto Josiah Herrick of Wenham in the county of Essex and his heirs forever all our right title and interest in the said parcel of land for and in consideration that the abovesaid Joseph Herrick hath paid to each of us to our satisfaction the sum of sixteen shillings a piece which parcel of land is situated in the township of Wenham aforsaid in the swamp which was common near to the house of John Leach and in witness hereoff we have hereunto set our hands this 7th day of March in the year one thousand seven hundred and nine- 1709/10, as attest

We whose names are hereunto subscribed being propri- tors in the ninth division of our town Common land at the East end of our town have mutually agreed and divided the said division into eight single parts to each particular person his share and by this our agreement do make void the division of said lot which the committee entered in our town books January 19th 1707/8 and have altered their settlement and taken our lots by mutual consent as followeth
The first lot to Deacon Fisk bounded westwardly upon land of Rice Knowlton at the road to a fixed rock in the ground by the highway going to Manchester 20 poles from a stub oak bounded eastwardly upon the second lot to a walnut tree at Ipswich line.
The second lot to Samuel Kimball Senr beginning at a fixed Rock in the ground by the road going to Manchester 20 poles from the stub oak the corner bounds of the said division and so on upon the road 12 poles to a stump with a heap of stones about it thence turning Northerly 38 poles to a forked red oak and so on to Ipswich line to another forked red oak marked and sowesterly on Ipswich line to a walnut bush marked 24 poles which is the bounds of the first lot.
The 3rd lott to Daniel Claflin beginning at the forked red oak 38 poles from the road going to Manchester and thence easterly to a maple standing by the pond and so all the land belonging to the said division between the pond and Ips- wich line untill it cometh to the easterly end of the four acre lots formerly laid out.
The 4th to John Coy beginning upon the road going to Manchester at the stump which is the bounds of the second and so 38 poles to the head of Daniel Claflin's and so along upon his lot as it is above entered to the pond so taking the pond to said Coys fence for the bounds and then his fence to the road and along upon the road to the bounds first mentioned.
The 5th lot to Nathaniel Brown in the right of Capt Fisk Senr deceased beginning at a pine in Ipswich line near Daniel Claflins corner and so along upon Ipswich line 17

poles and one half to a white oak then turning Southerly to a Red oak by the pond and so by the pond 23 poles to a maple, so including all the land belonging to said division up to the east end of the four acre lots above mentioned.
The 6 lott to John Edwards bounding upon the Red oak by the pond last mentioned and so to the white Oak in Ipswich line which are Nathaniel Browns bounds and so on Ipswich 13 poles and one half then turning to the pond to a red oak 20 poles distant from said Browns Lott.
The 7th Lott to Josiah Dodge beginning upon Ipswich line at the White Oak which is John Edwards his bounds and so on said line 13 poles to a yellow oak then turning to a red oak near the pond being twenty poles distant from John Edwards lott, the lotts last mentioned all go down to the pond.
The eighth lott to Deacon James Friend bounding West- erly upon Josiah Dodge and easterly upon the pond partly and partly upon a acre lot and northerly upon the Acre lots formerly laid out by the town and bounds onward still upon the Ipswich line unto Josiah Dodge's bounds
And we do further agree with each other for ourselves and our heirs forever that it shall be lawfull for us or any of us our heirs or successors for ever hereafter to pass over each others lot for our necessary improuving of our divi- sions so as not to distroy the wood and timber growing upon said lots and in confirmation of what is above written with that on the other side we have hereunto set our hands this 6th day of February 1709/10 signed by

At a meeting of the Selectmen of Wenham this sixth day of March 1709/10 then the Selectmen laid out a highway for the accomodation of Freborn Balch of Beverly to his land and grant of meadow in Wenham for his use and those that shall succeed him in that land formerly Capt. Fisks being an antient house lot and the grant of meadow in said Balches possession formerly Thomas Scrugses which highway is laid out and staked eighteen foot wide begin- ning at the Country road bounding on the northwest side upon Mr Hulls fence as it now stands And so extending the above mentioned breadth towards the brook running out of the great pond and so to said Hulls east corner and so along 18 foot in breadth to the aforesaid Balch's land before mentioned at the lower end of the lot or lots between Hulls land and the said Balches all which highway was formerly improved and occupied as an open highway for the inhabitants of said town and of right beloneth to the town and their assigns and in confirmation hereof we have hereunto set our hands
