I am fully convinced as well by you[r] letter of the 24, as every other Acct of the very disagreable Situation of the County of Monmouth and heartily wish it was in my power to afford it farther assisstance. But was you to see Colo Taylor's Letter to me (whom I have directed to spare you as many troops as he possibly can) you will be of the opinion with him that considering the Number of his sick he cannot diminish his Detachment without exposing the Remainder to be daily surprised and totally captured.
There is not a single Post at which the State Regiment is placed, but the Inhabitants Complain that they have not their compliment and are constantly importuning me with their Letters for more Men. The Truth is that there is not a sufficient Number of Troops at any of them, nor can he get * * * [?] of 1000 Men and as I would to do equal Justice to all by having the Regiment proportioned to the Danger & Importance of their Respective Posts, I must in a great Measure leave the Matter to the Commanding officer who has the direction of the whole and who must be presumed by his constant attention to, and Intercourse with each, to be ac- quainted with all.
I would by no means have you to difmifs the volunteer Militia till Major Walton gets further Afsistance, and 'till Colo Haight send him his Compr of the State Regiment out of his Battalion. I have herewith directed the Colo to fend to Monmouth as many of the Militia of his Regiment as amount to the deficiency.
The Necessity of placing the Sufsex Part of the State Regiment in that County has considerably broken in upon the Arrangements settled in full council; and as the Afsembly will shortly meet when the Council will of course convene; if they advise any Alteration in that Arrangement in favor of Monmouth I shall Very cheerfully follow their advice.
When you have an opportunity please to communicate the contents of this Letter to Major Walten.

One Aaron Doan now under fentence of death in the gaol of the County of Efsex for a robbery, & who, according to his fentence, was to be executed tomorrow, produced upon his trial two witnefses to prove, who really did [* * *? ] that he was, at the time of the robbery with which he was charged, at another place. These witnefses were not believed by the Jury, & upon the evidence of the person who swore against the prisoner, he was found guilty, &, as I have been informed, to the Satisfaction of the Court, and the audience. Be this as it may, & whether guilty or not, of which I do not pretend to be a competent judge) I have this day re- ceived a Letter from the Cheif Justice of the 5th instant in which he informs me that the father of Doan had brought him to affadavits (which he sent enclosed in his letter to me) in order to prove that his son (the criminal under sentence of death) was in Penn. at the time the robbery was committed "And altho" (he adds) "the affadavits in their present shape and circumstances, are in my view, insufficient, yet in order "that he may have all the opportunity which the law affords to make his application to government for a "pardon, I have therefore respited the sentence of the said aron Doan to the 29th day of the present month "befere which time, your Excellency can, if you think it proper, convene your council to consider of the matter."
As the Cheif Justice has, & I think with great propriety, respired the execution of this man, to give an

opportunity to apply for a pardon upon the affadavits he received subsequent to the trial, & as a respectful attention ought to be paid to the application of the Supreme Court I think it my duty Sir, to call a council upon the subject to submit the matter to their consideration and thereupon wish you to attend as one of the Board on Wednesday the 23rd of this month at my house at 12 o'clock
Upon so serious an affair as life or death depending upon our decision, it is presumed that the gentlemen of the council summoned upon this ought to be punctual in their attendance unlefs prevented by obstacles sufficient to justify their non-attendance

147 PHILIP HOLMES, son of Daniel Holmes, 79, born May 1, 1770; died Dec. 26, 1810; married, first, Eleanor .. .. ; second, Ann Yale. He was Captain of a Militia Company, in 1807. He lies buried in the Mount Pleasant, N. J., Burying Ground, in the Vanderhoef plot, beside his wife, Eleanor, who was probably a member of this family. There is also here the grave of "Eydah," daughter of Philip and Eleanor Holmes, who died, MIch. 7, 1795, aged I year, 7 mos., 8 days.

1774, Dec. 21. Asher Holmes, son of Joseph Holines, of Shrewsbury, apprenticed, with the approbation of his uncle, John Mott, to Ward Hunt, of the city of New York, Joyner, to learn the trade of Joyner or Cabinet Maker, for the term of four years and two months. In July, 1776, his Uncle, Gershon Mott, wrote of him "Our poor Little Asher is drafted one of the City Battalions, he is satisfied with his * * * but I am not, he is too young to
