PREFACE


The Sonoma County Records Inventory Project, in 1978, undertook an item- by-item descriptive listing of the documents in all county documents by beginning with the holdings of the Office of the Recorder. That inventory was published in 1979.


In that same year, the Project began an inventory of the records of the Office of the County Clerk. Completed in 1980, the inventory is being published with funds granted to the Sonoma County Historical Records Commission by the Board of Supervisors. The Commission is closely involved with the Project and is working effectively to protect and promote the public history of Sonoma County.


Sonoma State University sponsors the Sonoma County Records Inventory Project under the direction of Sandra Walton and Tim Huston both of the Reference Department of Salazar Library, and with the cooperation of Dr. Dennis Harris of the History Department. A CETA Grant supplied staffing for the initiation and the continuing supervision of the Inventory Project.


The Sonoma County Records Inventory Project has had the benefit of a generous and dedicated corps of supporters in the community. Inventory Assis- tants, whose immersion in the nitty-gritty details is basic to the success of the Project, have come from the Sonoma State University History Department, the Sonoma County Genealogical Society and the Volunteer Action Center of Sonoma County. They contributed over 300 volunteer hours to the Project. A word of special thanks goes to Denise Ellestad who prepared the Leather Brand Exhibits drawings in the Appendix.


The County Clerk and the staff of the various offices supported the Project to the considerable extent of providing much direct aid, especially in regard to inquiries concerning documents and their inter-relationships and by reserving time for office supervisors to explain the use of documents. Eeve Lewis, County Clerk; Leanne Chipchase, Assistant County Clerk; and Dianne Anderson, Supervising Clerk, spent many hours reviewing the inventory items for accuracy.


The Inventory has had the great good fortune to have two talented, well- organized and hard-working women as coordinators of the Project. Virginia Garnot, Coordinator of the Inventory of Records of the Office of the Recorder, began the inventory of the Clerk's Office before CETA funding ended. She was succeeded by Helene Walton, who brought her own style, enthusiasm and dedication to the formidable job of coordinator, which was completed with the preparation of the final draft manuscript.


Word Processing Center of Sonoma County prepared the final copy of the manuscript for the printer. Their expertise, helpfulness with the final format and great patience during final editing and indexing by the Director have our respect and appreciation.


The Texas County Records Inventory Project shared instructional materials and published inventories that have proved an invaluable guide for this survey; their project became our model.

USER'S GUIDE


Definitions


Affidavit: A statement or declaration in writing sworn to or affirmed before an officer who has the authority to administer an oath.


Alcalde: Spanish for a mayor or chief magistrate.


Alien: One born out of the jurisdiction of the United States, and who has not been naturalized under the United States Constitution and laws. (See also: Declaration of Intention, Naturalization.)


Bond: (1) Legal - An obligation made binding by a money forfeit (example: bail bonds). (2) Legal - An agreement pledging surety against financial loss, if that loss is caused by the act or default of the person bonded, or by some other stated occurrence. For example, many businesses and occupations are required to file a bond with the Clerk's Office before engaging in public contract. (3) Financial -A document which promises to pay to the owner a specified amount of money (face value) on a definite date in the future (maturity date). It also promises to pay interest based on the face value on other specified dates (example: road and bridge bonds). (See also: Surety.)


Civil: Relating to controversies between citizen and citizen; civil suits enforce and redress private rights between private persons according to civil and private law.


Criminal: Involving an injury done to the State by the violation of a public criminal law.


Declaration of Intention: Statement by alien declaring intent to become United States citizen. (See also: Alien, Naturalization.)


Defendant: (1) Civil - A party sued in a personal action; a person required to make answer in a legal civil action. (2) Criminal - A person alleged to have committed a criminal offense. (See also: Civil, Criminal.)


Docket Book: A bound volume containing a record of cases within the jurisdiction of a particular court.


Execution: (1) the act of carrying out the final judgment or decree of the court. (2) The writ which directs and authorizes the officer to carry into effect such judgment.


Fee Book: A listing of all fees charged for cases heard in courts of law and of the disbursement of such fees to the various county offices.


Indexed in File: Self-indexed in the volume, filing drawer, etc.


Inquest: A formal investigation to determine cause of death and possible guilt.

Judgment: (1) A formal decision given by a court. (2) The obligation, especially a debt, created by the decision or decree of a court.


Ledger: Book of accounts in financial transactions.


License: Permission granted by competent authority to engage in business, occupation, or activity.


Minutes: The official record of the proceedings of a meeting or court action.


Naturalization: The process of conferring citizenship upon an alien. (See also: Alien, Declaration of Intention.)


Plaintiff: The complaining party in any legal action; one who seeks a remedy for an injury to his rights through personal action or lawsuit.


Probate: (1) The action or process of proving in court that a document offered for official recognition as the last will and testament of a deceased person is genuine. (2) The various proceedings within probate jurisdiction (Probate Court) including the establishment of wills, the settlement of decedent's estates, the supervision of guardianship proceedings, habitual drunkards and persons of unsound mind, and the control of the property of wards of the state.


Register: A written or printed record containing regular entries of items; a book for such a record, such as a register of births.


Surety: One legally liable for the debt, default, or failure of another.

Torrens Title: A system of registering land ownership with the Recorder, used from 1914 to 1955.

Items carry the title that appears on the cover of the document. Some titles are not fully descriptive of the contents. It is recommended, therefore, that the user read the full description of the item to use the inventory successfully.


Titles are always fully capitalized.

INTRODUCTION


Sonoma County, California, lies to the north of San Francisco Bay, its boundaries touching the Pacific Ocean on the west and mountains of the coastal range on the east. Diverse in its terrain and resources, Sonoma County's wealth derives from agriculture, including orchards, vineyards, poultry, cattle, and dairying; from timber and timber processing; mining; commercial fishing; industry; and recreation.


Within the last two hundred years, seven flags have flown over Sonoma County -- those of Spain, Britain, Russia, Empire of Mexico, Republic of Mexico, Bear Flag Republic, and the United States. Its variegated history includes the founding of Fort Ross by Russian fur traders in 1812; the colonization of Mexican settlers by General Vallejo in 1833; and the Bear Flag Revolt of American settlers in 1846. Following statehood in 1850, the first California Legislature legally founded Sonoma County.


The primary function of the Sonoma County Clerk's Office is to receive, analyze and process Superior Court and other legal documents. In addition, the clerk has other assignments which are important to the recorded history of the County. The manuscript divisions in the Inventory reflect the four functions of the Clerk:

Registrar of Voters


The records generated by these four divisions are handled in a variety of ways. Many old court documents and miscellaneous county documents were sent to the California State Archives. Before being sent, most were microfilmed as part of OLD MISCELLANEOUS SONOMA COUNTY RECORDS (180). The County has retained the indexes to those documents.


Certain categories of records, such as all Superior Court documents, are kept permanently; other records are transitory. Every filed document is microfilmed, except specific documents that State law says may be destroyed. After micro- filming, many original documents have been destroyed or they have been stored, in a rather haphazard fashion. However, documents are now being retained for review for possible acceptance by State or local archives.


The creation of the Sonoma County Historical Records Commission by the Board of Supervisors indicates the County's increased awareness of the historical value of public records.

State and county laws have assigned a variety of duties to the County Clerk beyond the constitutional and statutory requirements to serve as Clerk of the Court, Clerk of the Board of Supervisors, and Registrar of Voters. These miscellaneous duties are both archival -- the filing of specified documents for safekeeping, and administra- tive -- providing public services upon payment of fees.
