$100.00 to pay for said parcel or parcels of land and appur- tenances, and voted that the Town assume liability in the man- ner provided by Section 29 of Chapter 91 of the General Laws, as amended, for all damages that may be incurred by the work to be performed by the Department of Public Works for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, harbors, tide waters, in ac- cordance with Chapter 91 of the General Laws, and to authorize the Selectmen to execute and deliver a bond of indemnity there- for, to the Commonwealth, provided that the Town take under Chapter 79 and/or obtain proper easements and relief from claims against the Town of Southbridge from all adjacent prop- erty owners.


Article 43. The Finance Committee presented the follow- ing substitute motion. Said motion seconded and carried:


VOTED: unanimously in the affirmative to authorize the Board of Selectmen to purchase under Section 14 of Chapter 40 of the General Laws of the Commonwealth, and/or take by eminent domain under Chapter 79 of the General Laws of the Commonwealth a parcel or parcels of land and appurtenances, easements or rights therein, said parcel or parcels of land bor- dering, adjoining and contiguous to the Mckinstry Brook from the Quinebaug River northerly for a distance of 4,000 feet, said land to be sufficient in size to make possible the channel im- provement necessary to avoid damage to public property and health by rising waters, and voted to raise and appropriate from tax levy of 1956 the sum of $100.00 to pay for said parcel or parcels of land and appurtenances and voted that the Town as- sume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as amended, for all damages that may be incurred by the work to be performed by the Department of Public Works for the improvement, development, maintenance and protection of tidal and non-tidal rivers and streams, har- bors, tidewaters, in accordance with Chapter 91 of the General Laws, and to authorize the Selectmen to execute and deliver a bond of indemnity therefor, to the Commonwealth, provided that the Town take under Chapter 79 and/or obtain proper easements and relief from claims against the Town of South- bridge from all adjacent property owners.

Article 46. The following substitute motion presented, seconded and carried:


VOTED: unanimously in the affirmative that the Town use the two (2) parcels of land conveyed to the Town by deeds dated December 20, 1950 and June 27, 1951 and accepted by the Town under Articles 18 and 19 of the Special Town Meeting held December 18, 1950, as a public park to be known as "Dress- er Memorial Park" and to authorize the Park Commissioners to develop and maintain this land as a park and in furtherance of these purposes to raise and appropriate the sum of $5,000.00 to be used in connection with a similar amount to be donated by Dr. Richard Dresser.


Motion made and seconded to reconsider Article 46.


The following amendment made, seconded and carried un- animously in the affirmative: Voted instead of taking $5,000.00 from tax levy of 1956 that $4,893.82 be transferred from Insur- ance Loss Reimbursement Account and $106.18 be taken from the tax levy of 1956. Special Town Meeting APRIL 30, 1956


COMMONWEALTH OF MASSACHUSETTS


Worcester, ss:


To either of the constables of the Town of Southbridge, in the County of Worcester:


In the name of the Commonwealth of Massachusetts, you are hereby requested to notify and warn the inhabitants of the Town of Southbridge aforesaid qualified to vote in Town Af- fairs, to meet in the Town Hall of Southbridge on Monday, April 30, 1956, at 7:30 P. M., to act on the following articles:


Article 1. To see if the Town will vote to authorize the Board of Selectmen to purchase from H. J. Proulx the parcel of land located in West Dudley, Mass., south of the N. Y., N. H. & H. R. R. line, said parcel of land containing seven (7) acres, more or less, said parcel of land having deposits of sand and gravel needed by the Town, and raise and appropriate, borrow or transfer a sum of money to pay for said parcel of land, or act anything thereon.


Article 2. To see if the Town will vote to authorize the Board of Selectmen to purchase, for the consideration of one (1) dollar, a parcel of land and the necessary easements and right of way thereto, from the Southbridge Finishing Co., Inc., its successors and assigns; said parcel of land being located in Southbridge, in the rear of 381 and 393 East Main Street; said parcel of land having structures thereon for the control of wa- ters of the Quinebaug River; said parcel of land being approxi- mately square; the dimensions of said parcel being approxi- mately 100 feet each to the north and the east and the west and to land of others on the south; said distances being measured from a point established in the center of the existing dam struc- ture across the Quinebaug River, or act anything thereon.


Article 3. To see if the Town will vote to transfer the sum of $26,399.11 from the "State Reimbursement Flood Abate- ments" account to the "Overlays 1955 Account," as recommend- ed by the Division of Accounts. This amount was paid by the State as a reimbursement on Real, State and Personal Property taxes caused by the flood of August 19, 1955, or act anything thereon.


Article 4. To see if the Town will vote to raise and appro- priate, borrow or transfer a sum of money for the purpose of furnishing 85' of 12" pipe, 3' of 2" pipe, blind flange, and flange

flap gate to be included in the construction of the Charlton Street bridge to provide emergency overflow to inverted siphon to be built with the construction of this bridge, or act anything thereon.


Article 5. To see if the Town will vote to raise and appro- priate, borrow or transfer the sum of $34.84 to pay for the ad- ditional cost on the Town Annual Report, or act anything there- on.


Article 6. To see if the Town will vote to raise and appro- priate, borrow or transfer a sum of money in the amount of a large elm tree including roots, located on Town property near the Elm Street Fire Station, or act anything thereon.


Article 7. To see if the Town will vote to raise and appro- priate, borrow or transfer a sum of money in the amount of $1,000.00 to the Southbridge Library Alterations and Improve- ment Account, or act anything thereon.


Article 8. To see if the Town will vote to discontinue its voting precincts; and vote that subsequent elections within the Town shall be held as if no such division had been made; all as provided by Section 9 of Chapter 54 of the General Laws of the Commonwealth, or act anything thereon.


Article 9. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $2,000.00 to pay for additional street lights on new streets and the lighting of the Depot Parking Lot, said amount to be added to the Street Light- ing Account voted at Annual Town Meeting held March 12, 1956, or act anything thereon.


Article 10. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money in the amount of $190.00 for a proper mimeograph machine for the Selectmen's office and for use in various departments under the supervision of the Selectmen's office, or act anything thereon.


Article 11. To see if the Town will vote to amend the Zoning By-Laws and zoning map, by changing from Multiple Family District and Retail Business District, to General Busi- ness District, the following area, beginning at the present ter- minus of the General Business District on Olney Avenue, south- erly to the corner of Worcester Street and Charlton Street, then easterly along Charlton Street to the corner of Mechanic Street, then northerly to Olney Avenue, then westerly to the corner of Olney Avenue and Worcester Street, also on easterly side of Mechanic Street from the corner of Charlton Street, northerly to the corner of Randolph Street, or act anything thereon.

Article 12. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $1,000.00 to the Dam- age to Persons and Property Account, or act anything thereon.


Article 13. To see if the Town will vote to adopt and make such orders and By-Laws as proposed by the Town By-Law Committee, said proposed by the Town By-Law Committee, said proposed By-Laws now on file in the office of the Town Clerk, said proposed By-Laws being dated February 2, 1956, or act anything thereon.


Article 14. To see if the Town will vote to raise and ap- propriate, borrow or transfer, a sum of money to be used to pub- lish new or Revised Town By-Laws, as required by Section 32 of Chapter 40 and other provisions of the General Laws of the Commonwealth, or act anything thereon.


Article 15. To see if the Town will vote to establish a per- manent Town By-Law Committee, said Committee to be ap- pointed by the Board of Selectmen, to study and assemble all Town By-Laws and make annual suggestions and recommenda- tions for revision and amendments to existing By-Laws, and further, to see if the Town will vote to raise and appropriate, borrow or transfer, a sum of money to be used as compensation for said committee members, the expenses of said committee and/or compensation for a part-time clerk, or act anything thereon.


Article 16. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money to pay Albert Loomis, of 98 Charlton Street, for the removal of a building and for the purchase of approximately 1,400 square feet of land nec- essary for the building of the Charlton Street bridge, as shown on plan drawn by the Commonwealth of Massachusetts, entitled "Charlton Street Bridge Over Cady Brook," No. S-21-13, or any amendment or changes to be made to said plan on file in the Town Engineer's office, or act anything thereon.


Article 17. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money for the construc- tion of a sanitary sewer on Dennison Drive from the existing terminus opposite land of Alfred Blair, southwesterly for a dis- tance of approximaetly 175 feet, or act anything thereon.
