I return herewith By-Laws adopted by the Town of South- bridge on April 30, 1956, under Articles 8 and 13, with the action of the Attorney General noted thereon.


Article II of the By-Laws adopted under Article 13 of the warrant is disapproved inasmuch as it conflicts with Article 8.


Article XXI adopted under Article 13 is disapproved in- asmuch as G.L. c. 40, s. 32 has preempted the field.

Special Town Meeting JULY 30. 1956 COMMONWEALTH OF MASSACHUSETTS


Worcester, ss:


To either of the constables of the Town of Southbridge, in the County of Worcester:


In the name of the Commonwealth of Massachusetts, you are hereby requested to notify and warn the inhabitants of the Town of Southbridge aforesaid qualified to vote in Town Af- fairs, to meet in the Town Hall of Southbridge on Monday, July 30, 1956, at 7:30 P. M. to act on the following articles:


Article 1. To see if the Town will vote to authorize the Board of Selectmen to purchase from L. Wilfred Pontbriand and Eva M. Pontbriand a parcel of land, and a proper right-of- way thereto, located in Sturbridge, Worcester County, Massa- chusetts; said parcel of land containing eleven (11) acres, more or less; said parcel of land having deposits of sand and gravel; all as per plan Number 1-3-140 of the Town Engineer; said

plan now on file with the Town Clerk; and transfer the sum of $3,000.00 from Article One (1) of the Town Meeting of April 30, 1956 to this Article; and rescind and make null and void the vote under Article One (1) of the Town Meeting of April 30, 1956, said Article One (1) having authorized the Board of Se- lectmen to purchase land from H. J. Proulx of Dudley, Worces- ter County, Massachusetts; or act anything thereon.


Article 2. To see if the Town will vote to transfer the sum of $1,000.00 from the Tuberculosis and Contagious Diseases Ac- counts to the Premature Births Account, or act anything there- on.


Article 3. To see if the Town will vote to transfer the sum of $40.00 from the Assessors' Extra Clerical Account to the Assessors' Travel Expense Account, or act anything thereon.


Article 4. To see if the Town will vote to transfer the sum of $688.18 from the State Reimbursement Flood Abate- ments Account to the Overlays 1955 Account, as recommended by the Division of Accounts. This amount was paid by the State as reimbursement on Real Estate and Personal Property taxes caused by the flood of August 19, 1955, or act anything thereon.


Article 5. To see if the Town will vote to amend Salary of the Three Registrars and Salary of Clerk of Board as voted under Article 8, of the Annual Town Meeting, said amendment to be retroactive to January 1, 1956, or act anything thereon.


Article 6. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $500.00 to the Dog Of- ficer's Account, or act anything thereon.


Article 7. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $6.11 for the Depot Parking Lot-Renewing of Water Service Account, or act any- thing thereon.


Article 8. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $374.10 to reimburse the Overdrawn Insurance Account, or act anything thereon.


Article 9. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $240.00 for the adjust- ment of sewer manholes on Eastford Road in conjunction with the reconstruction of Eastford Road under Chapter No. 90, or act anything thereon.


Article 10. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money for the recon- struction of a storm drain on the northerly side of Worcester Street, from the existing drain at approximate station 92+3150 of the 1934 layout of Worcester Street, thence easterly and

northerly along a curve to the existing catch basin on the southerly line of Henry Street for a distance of approximately 550', or act anything thereon.


Article 11. To see if the Town will vote to appropriate, borrow or transfer the sum of $2,285.00 for the legal advertis- ing of the Revised By-Laws, or act anything thereon.


Article 12. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money for the construc- tion of a sanitary sewer on Snow Street from the existing ter- minus opposite land now or formerly of Morris D & Clara Town, northwesterly for a distance of about 60 ft., or act any- thing thereon.


Article 13. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of meny for the construc- tion of a sanitary sewer on Dennison Drive from the existing terminus opposite land of Alfred Blair, southwesterly for a dis- tance of approximately 175 feet, or act anything thereon.


Article 14. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money to construct a san- itary sewer on Hillside Road from the existing terminus, south- erly and westerly for a distance of about 400 feet, or act any- thing thereon.


Article 15. To see if the Town will vote to raise and ap- propriate, borrow or transfer a certain sum of money for the construction of a storm drain from the existing drain on Mary Ellen Lane thence westerly along Mary Ellen Lane and north- erly along Judith Avenue to the Nuisance Brook at Dresser Field, a distance of about 400 feet, or act anything thereon.


Article 16. To see if the Town will vote to change the name of Crops Road, which extends from Lebanon Hill to the Dudley Town Line crossing Route 93, to Tipton Rock Road, or act anything thereon.


Article 17. To see if the Town will vote to authorize the Board of Selectmen to purchase, for the consideration of $1.00 all or any part of the following described premises and the nec- essary easements and right of way thereto with reservations to the grantors regarding control of water, grantors to maintain the property and carry proper Liability Insurance, from the Southbridge Finishing Co., Inc., its successors and assigns; a parcel of land being located in Southbridge, south of the south- erly bank of the Quinebaug River consisting of the area known as the "Canal," beginning at the gates controlling the waters of the Quinebaug River and extending southerly and easterly to the westerly line of the State Highway layout dated February 16, 1954, of the Sandersdale Road, Route No. 131; said parcel of

land to include on the westerly side thereof, the land between the westerly bank of said canal and the land owned by the Madore Lumber Co., Inc., Southbridge Industrial Development Co., Inc., New York, New Haven & Hartford R. R., the Central Mass. Gas Co., Weld & Beck Farm Equipment Co., Inc., Frank & Frances Maciejewski, Joseph Cartier, Jr., and Frank Lenti; said land also to include on the easterly side of said "Canal" the land between the easterly bank of said "Canal" and the land now or formerly owned by Peter & Wanda Graf, New York, New Haven & Hartford R. R., and a strip of land owned by the grantors 10 ft. wide easterly of the parallel to the easterly bank of said "Canal" to the westerly line of said 1954 State Highway layout of Route No. 131; said parcel of land having structures thereon for the control of waters of the Quinebaug River and Lebanon Brook; in accordance with a plan on file with the Town Clerk, No. 1-4B-63 or revisions thereof entitled "Property of Southbridge Finishing Co., to be conveyed to the Inhabitants of the Town of Southbridge" and to see if the Town will raise and appropriate, borrow or transfer the sum of $1.00 for the aforesaid purpose, or act anything thereon.


You are directed to serve this warrant by posting up at- tested copies in four (4) conspicuous places within the Town at least seven (7) days before holding said meeting.


Hereof fail not and make due return of this warrant with your doings theron to the Town Clerk at the same time and place aforesaid.

Article 4. To see if the Town will vote to raise and appro- priate, borrow or transfer the sum of $1,000.00 for the Tubercu- losis and Contagious Diseases Account, or act anything thereon.


Article 5. To see if the Town will vote to transfer a sum of money to the Temporary Interest Account, same to be taken from Available Balances, or act anything thereon.


Article 6. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $990.00 to pay the rent for the Massachusetts National Guard quarters at 15 Goddard Street, Southbridge, to Metro Brothers, 333 Main Street, South- bridge, for the period July 1 through December 31, 1956, said sum of $990.00 to be reimbursed to the Town Treasurer by the office of the Commonwealth of Massachusetts State Quarter- master, 905 Commonwealth Avenue, Boston, Massachusetts. All as per letter from Colonel Ralph Noonan to the Chairman of the Board of Selectmen, or act anything thereon.


Article 7. To see if the Town will vote to hear, act on and accept the report of the Selectmen as to the laying out as a public way a certain street to be known as Jennison Street,

commencing at the westerly side of North Woodstock Road, thence westerly for about 497 feet, to the easterly side line of Old North Woodstock Road, or act anything thereon.


Article 8. To see if the Town will vote to hear, act on, and accept the report of the Selectmen as to the laying out as a public way a certain street to be known as Cleveland Street, commencing at the southerly line of Langlois Ave., thence southerly for a distance of about 237 feet, or act anything there- on.


Article 9. To see if the Town will vote to hear, act on and accept the report of the Selectmen as to the laying out as a public way a certain street to be known as Elmwood Road, com- mencing on the easterly side of Lebanon Hill, thence easterly for a distance of 477.47 feet, or act anything thereon.


Article 10. (None).


Article 11. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money for the removal of a large elm tree located on the east side of Elm Street, ad- jacent to the Elm Market, or act anything thereon.


Article 12. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $3,000.00 to establish a new account known as the "Land Damage Appraisal Ac- count," said funds to be used and expended to employ non-resi- dent, non-taxpaying real estate appraiser who are qualified to testify in the Superior Courts of the Commonwealth, said sum of money to be expended for appraisals of Land Damages caused by the reconstruction of Eastford Road, Charlton Street bridge, River Street bridge, Westville bridge, Mill Street bridge, Central Street bridge, Dresser Hill Road bridge, and any other Land Damages caused by proper vote of the Town, or act any- thing thereon.
