WARRANT FOR ANNUAL TOWN MEETING


February 4-5, 1935

Barnstable, s.s :


To Harvey T. Moore, Constable of the Town of Eastham, in the County aforesaid : Greeting :


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said town qualified to vote in elections and town affairs, to meet in the Town Hall in said Eastham at 10 o'clock in the forenoon on Monday, the Fourth (4th) day of February next, then and there to act on the following articles in this warrant, and to meet in the Town Hall in said Eastham, at 10 o'clock in the forenoon on Tuesday, the Fifth (5th) day of February next, then and there to elect all necessary Town Officers.


Article 1. To hear the reports of the Selectmen and all reports and Committees and act thereon.


Article 2. To see if the town will elect a Town Direc- tor for the Cape Cod Extension Service.


Article 3. To see what sum of money the town will raise for the Public Library and make an appropriation for the same.

Article 4. To see in what manner the town will dis- pose of its refunded dog tax, and act thereon.


Article 5. To see in what manner the town will sup- port its poor for the ensuing year.


Article 6. To see if the town will appropriate the sum of $3,150.00 provided the State makes a satisfactory allotment for the upkeep and maintenance of town roads, under Chap. 81, Sections 26-29, General Laws as amended.


Article 7. To see in what manner the town will re- pair its roads and bridges, and raise and appropriate money for the same.


Article 8. To see if the town will give the Collector of Taxes the same power which the Treasurer has when Collector. :


Article 9. To raise such sums of money as may be necessary to defray town charges for the ensuing year.


Article 10. To see if the town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning Jan. 1, 1935, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Article 11. To see if the town will vote to raise and appropriate a sum of money for Memorial Day and the purchase of flags for soldiers' and sailors' graves and momument grounds.

Article 12. To see if the town will vote to raise and appropriate a sum of money for the prevention and sup- pression of forest fires.


Article 13. To see if the town will pay a bounty of 50 cents each for all woodchucks killed within its limits, after satisfactory evidence has been presented to the Treas- urer, and appropriate $25.00 for the same.


Article 14. To see if the town will vote to raise and appropriate a sum not to exceed Five Hundred Dollars ($500.00) for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass., for the care and treatment of persons certified by the Selectmen to be residents of the town and unable to pay for such care and treatment in accordance with Chapter 111, Section 74, of the General Laws, or take any action in relation thereto and act fully thereon. (By request).


Article 15. To see if the town will vote to raise and appropriate the sum of $500.00 for the purpose of continu- ing the plotting, surveying and making of Assessors maps of the Town of Eatham.


Article 16. To see if the town will vote to raise and appropriate the sum of $150.00 for free band concerts, to be given by the Junior Community Band during the en- suing year, or do or act anything thereon. (By request).


Article 17. To see if the town will vote to instruct the Selectmen to have town notices posted in the barn of Harry W. Collins. (By request).


Article 18. To see if the town will rescind its vote whereby it voted to pay a flat salary of $1500.00 per year

for the office of Town Clerk, Treasurer and Collector of Taxes, with offices of same to be in the Town Hall. Office hours from 9 to 12 A.M., and from 1 to 5 P.M., each week- day except Monday or do or act anything thereon. (By request ).


Article 19. To see what salary the town will pay for the office of Town Clerk, Treasurer and Collector of Taxes, or do or act anything thereon. (By request).


Article 20. To see if the town will vote to reconsider the reports of the town officers for the year 1933. (By request).


Article 21. To see what sum of money shall be taken from the free cash towards defraying the tax levy for 1935. (By request).


Article 22. To see if the town will vote to raise and appropriate the sum of $50.00 to be used for the mainten- ance of the Old Wind Grist Mill or do or act anything thereon.


Article 23. To see if the town will vote to accept all donations received in connection with the Old Wind Grist Mill, the same to be added to the Old Wind Grist Mill Operating Fund.


Article 24. To see if the town will vote to raise and appropriate a sum of money to be used by the local ERA or any succeeding government agency of like nature, for the purchase of material and general expenses.


Article 25. To see if the town will vote to establish a Road Machinery Account to which shall be credited all

receipts for the use or rental of road machinery, the pro- ceeds to be appropriated as voted by the town for road machinery purposes, or take any action in relation thereto.


Article 26. To see if the town will vote to appropri- ate from funds available the sum of $1,000.00 to establish a Road Machinery Fund for the purpose of purchasing, re- pairing and operating road machinery.


Article 27. To see if the town will vote to raise and appropriate a sum of money to be used for the improve- ment of the Common Landing at the Salt Pond, or do or act anything thereon.


Article 28. To see if the town will vote to raise and appropriate a sum of money to be used for the improve- ment of the Common Landing at the Great Pond, or do or act anything thereon.


Article 29. To see if the town will vote to adopt a by-law to provide a finance committee, as required by Sec- tion 16, Chapter 39, General Laws.


Article 30. To see if the town will vote to raise and appropriate a sum of money to be used for the protection of shellfish, or do or act anything thereon.


Article 31. To see if the town will vote to appro- priate a sum of money to be used for the improvement of the Hemenway Road, or do or act anything thereon.


Polls will be opened for voting on Tuesday, February 5, 1935, in the Town Hall, Eastham, Mass., from 10 o'clock A.M. until 3 P.M.

And you are directed to serve this Warrant by post- ing attested copies thereof at the Packing House of Bern- ard C. Collins in South Eastham, the Post office at Eastham, and the Post Office in North Eastham, seven days at least before the time of holding said meeting.


HEREOF FAIL NOT, and make due returns of this Warrant, with your dongs, to the Town Clerk at the time and place of meeting as aforesaid.

ANNUAL TOWN MEETING


February 4, 1935


Meeting called to order at 10 o'clock by the Town Clerk, warrant calling meeting duly read together with the return of the officer that served the same. Fred P. Turner and Riley H. Parker were appointed tellers and sworn by the Town Clerk.


Article 1. Ralph A. Chase, Chairman of Selectmen, read the report of Committee on Dutch Elm Disease, also notified the meeting of appointment of assistants to High- way Surveyor for snow removal, in South Eastham, Henry E. Clark, in North Eastham, Frank King, all persons must report to the Highway Surveyor or his assistants before time will start that they may be honored by Town Officials as to payment. Unless otherwise ordered, no work on snow removal shall begin before 8 o'clock A.M. Minors under sixteen years of age are prohibited by law from this work.


Voted to waive the reading of the Town Report and to accept the report as printed with corrections and omissions noted. (Page 15, Town Clerk's report, number of male dog licenses 46 instead of 42. Selectmen's report, Warrant for 1935, Article 31 omitted).


Article 2. Voted to elect a Town Director for the Cape Cod Extension Service, Albion F. Rich, Jr. Elected to that office.


Article 3. Voted to raise and appropriate the sum of $100.00 toward the support of the Public Library. (By unanimous vote).

Article 4. Voted that the refunded dog tax be turn- ed over to the Public Library Account.


Article 5. Motion to raise and appropriate the sum of $2,000.00 for the employment of needy persons, $1,000.00 to be used in February and $1,000.00 in March, any person with dependents shall receive not less than 24 hours work per week, all work to be under the supervision of the Select- men, except work on highways, which shall be in charge of the Highway Surveyor, was lost by vote of 34 to 23.


Article 6. Voted to raise and appropriate the sum of $3,150.00 under Chapter 81, Sections 26-92 as amended, provided the State will make a satisfactory allotment to the town for the same. (By unanimous vote).


Article 7. Voted to leave the care of the Town's roads and bridges in the hands of the Highway Surveyor, and to raise and appropriate the sum of $200.00 for the same. Vote 20 to 3.


Article 8. Voted to give the Collector of Taxes the same power which the Treasurer has when Collector of Taxes.


Article 9. Voted to appoint a committee of five to recommend appropriations for the ensuing year. Voted that no heads of departments shall serve on this committee. Charles F. Atwood, Harvey T. Moore, Clayton O. Horton, Capt. Abbott H. Walker and Albion F. Rich, Sr., appointed on said committee. Voted at 1:30 P.M., to declare a re- cess until 2:15 P.M., to allow committee to prepare budget, at 2:15 P.M., an additional recess was declared, the com- mittee not being ready to report. At 3 o'clock P.M., the

committee reported the following list of appropriations which were unanimously accepted plus the appropriations of this meeting.

Article 10. Article 20. Voted to reconsider the vote whereby the Town accepted the report of the Town Officers for the year 1933. After lengthy debate it was voted to accept the report of the Town Officers for the year 1933. (By unanimous vote).


Article 21. Voted to use $5,000.00 of the free cash in the treasury to reduce the tax levy of 1935. (Vote 20 to 2).


Article 22. Voted to raise and appropriate the sum of $50.00 for maintenance of the Old Wind Grist Mill. (By unanimous vote).

Article 23. Voted that the Town accept all donations received on account of the Old Wind Grist Mill and that the same be added to the Old Wind Grist Mill Operating Fund.


Article 24. Voted to raise and appropriate the sum of $700.00 for material and general expenses in connection with the ERA or any other governmental agency of like nature. (By unanimous vote).


Article 25. Discussion on this question was heated with many ideas being advanced both for and against. Motion to establish a Road Machinery Account was lost by count of votes 23 to 11.


Article 26. Indefinitely postponed.


Article 27. Voted to raise and appropriate the sum of $150.00 for improvement of Common Landing at the Salt Pond. (By unanimous vote).


Article 28. Voted to raise and appropriate the sum of $100.00 for improvement of Common Landing at the Great Pond. (By unanimous vote).


Article 29. Voted to adopt By-Law establishing a Finance Committee in accordance with Section 16 of Chap- ter 39, General Laws.


By-Law adopted under Article 29, Annual Town Meet- ing, February 4, 1935 :


Section 1. There shall be a finance committee for the Town to which shall be referred all articles in any warrant thereafter issued for a town meeting. The Selectmen, after-

drawing a warrant for a town meeting, shall immediately forward a copy to each member of said committee, which shall consider all articles in the warrant and make such re- port, in print or otherwise, to the town meeting as it deems for the best interest of the town. The said committee shall consist of nine persons to be appointed as provided in the following section :


Section 2. The Moderator of the town meeting when this by-law is adopted shall, within thirty days after such by-law becomes effective, appoint from the citizens of the town, three persons whose term of office shall expire at the adjournment of the first annual town meeting following the time when this by-law becomes effective, three whose term of office shall expire at the adjournment of the sec- ond annual town meeting following the time when this by- law becomes effective, and three whose term of office shall expire at the adjournmnt of the third annual town meet- ing following the time when this by-law becomes effective. Annually thereafter the Moderator presiding at the close of an annual town meeting shall, within thirty days, ap- point three members whose term of office shall expire at close of the third annual town meeting after their appoint- ment. Said Committee shall choose its own officers and shall, with the exception of the secretary, serve without pay.


Whenever a vacancy occurs in said committee, said vacancy shall be filled by said committee by the appoint- ment of a person to serve until the close of the next annual town meeting, when the Moderator thereof shall appoint in the same manner as the original appointment, a succes- sor to fill out the unexpired term of the person whose office has been vacated.

Voted an additional appropriation of $50.00 for pro- tection of shellfish other than Constable's salary. (By unan- imous vote).

In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabi- tants of said town, qualified to vote in elections and town affairs, to meet at the Town Hall in said Eastham on Thurs- day, the Twenty-fifth day of July next, at 8 o'clock in the evening, then and there to act on the following articles :


Article 1. To see if the town will vote to accept as a gift from the Eastham Grange No. 308, a bandstand to be erected on a site satisfactory to the town, or do or act any- thing thereon.


Article 2. To see what action the town will take to obtain a PWA grant to be used in the building of a school house, or do or act anything thereon.


Article 3. To see if the town will vote to appoint a committee which will be known as a School House Site Committee, to look up available site for the erection of a new school house thereon, acquire all details thereto and be ready to report at a meeting to be held not later than two months from date of this meeting.

And you are directed to serve this warrant by post- ing attested copies thereof at the Packing House of Bern- ard C. Collins in South Eastham, the barn of Harry W. Collins in South Eastham, and the Post Offices at Eastham and North Eastham in said town, seven days at least be- fore the time of holding said meeting.
