WARRANT FOR ANNUAL TOWN MEETING


February 6, 1933


Commonwealth of Massachusetts


Barnstable, ss.


To Harvey T. Moore, Constable of the Town of Eastham, in County aforesaid : Greeting :


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said town, qualified to vote in elections and town affairs, to meet in the Town Hall, in said Eastham, on Monday, the sixth day of February next, at 10 o'clock in the forenoon, then and there to elect all necessary Town Officers for the ensuing year and to meet in the Town Hall in said Eastham, at 10 o'clock on Tuesday, the seventh day of February next, then and there to act on the following articles.


Article 1. To hear the reports of the Selectmen and all reports and committees and act thereon.


Article 2. To see if the Town will elect a Town Direc- tor for the Cape Cod Extension Service.


Article 3. To see what sum of money the Town will raise for the Public Library and make an appropriation for the same.


Article 4. To see in what manner the Town will dis- pose of its refunded Dog Tax and act thereon.

Article 5. To see in what manner the Town will sup- port its poor for the ensuing year.


Article 6. To see if the Town will appropriate the sum of $3,075.00, provided the State makes a satisfactory allot- ment for the upkeep and maintenance of Town Roads, under Chap. 81, Sections 26-29 Gen. Laws as amended.


Article 7. To see in what manner the Town will repair its roads and bridges and appropriate money for the same.


Article 8. To see if the Town will give the Collector of Taxes the same power which the Treasurer has when Collec- tor


Article 9. To raise such sums of money as may be ne- cessary to defray town charges for the ensuing year.


Article 10. To see if the Town will authorize the Treasurer, with the approval of the Selectmen, to borrow money in anticipation of revenue of the municipal year be- ginning Jan. 1, 1933, an amount not to exceed $16,000.00.


Article 11. To see if the Town will vote to raise and appropriate a sum of money for Memorial Day and the pur- chase of flags for Soldiers' and Sailors' graves and Monu- ment grounds.


Article 12. To see if the Town will vote to raise and appropriate a sum of money for the prevention and sup- pression of forest fires.


Article 13. To see if the Town will pay a bounty of 50 cents each for all woodchucks killed within its limits,

after satisfactory evidence has been presented to the Treas- urer, and appropriate sum of $25.00 for the same.


Article 14. To see if the Town will appropriate the sum of $150.00 for free Band Concerts, to be given by the Junior Community Band during the ensuing year.


Article 15. To see if the Town will vote to raise and appropriate a sum not to exceed Five Hundred ($500.00) Dollars for the establishment and maintenance of a free bed in the Cape Cod Hospital, Hyannis, Mass., for care and treat- ment of persons certified by the Selectmen to be residents of the Town and unable to pay for care and treatment, in ac- cordance with Section 74 of Chapter 111 of the Gen. Laws, or take any action in relation thereto and act fully thereon.


Article 16. To see if the Town will vote to raise and appropriate the sum of $500.00 for the purpose of continu- ing the plotting, surveying and making of Assessors maps of the Town of Eastham.


Article 17. To see if the Town will accept the layout of a Common Landing on Great Pond in the village of East- ham over land of Freeman C. Hatch, between Pond Road so- called and the waters of said Great Pond, with the boundar- ies and measurements as reported and recommended by the Selectmen under date of January 1933, and will authorize and instruct the Selectmen to take by purchase or eminent domain, in behalf of the Town, the lands or interests in lands, within the lines of said layout of said Common Land- ing and for that purpose will raise and appropriate a sum not exceeding One Hundred and Fifty ($150.00) Dollars.


Article 18. To see what action the Town will take re-

garding the discontinuance of the Town Dump in South? Eastham.


Article 19. To see if the Town will vote to make an appropriation in excess of the Mosquito State Tax. (By re- quest).


Article 20. To see what action the Town will take in regard to the salaries of its officers and wages of its employ- ees, or do or act anything thereon. (By request).


Article 21. To see what action the Town will take on the proposed new school building, or do or act anything thereon. (By request).


Article 22. To see what action the Town will take re- garding the repairing of the Old Grist Mill and appropriate a sum of money for the same.


Article 23. To see if the Town will appropriate the sum of $500.00, the same to be used by the Board of Public Welfare as wages, to be paid to applicants for aid who are able to work and who are given work by the Board on var- ious town improvements, or do or act anything thereon.


Article 24. To see if the Town will vote to lay out a Town Landing on the shores and on land adjacent to the Salt Pond, so-called, and appropriate a sum of money for the same, or do or act anything thereon. (By request).


Article 25. To see if the Town will vote to appropriate the sum of $25.00 for the Community Christmas Tree, or do or act anything thereon.


Article 26. To see if the Town will vote to take

$3,000.00 of the free cash now in the Treasury for the pur- pose of reducing the tax rate of 1933.


Polls will be open for voting on Monday, February 6, 1933, in the Town Hall, Eastham, Mass., from 10 o'clock A. M., until 3 o'clock P. M.


And you are directed to serve this warrant by posting attested copies thereof at the Blacksmith Shop of Chas. A. Feltis in South Eastham, the Post-Office in Eastham and the Post-Office in North Eastham, seven days before time of holding said meeting.


HEREOF FAIL NOT, and make due return of this warrant with your doings thereon, to the Town Clerk at the time and place of meeting as aforesaid.

Article 1. Voted to waive the reading of the Town Report and to accept the report as printed.

Article 2. Voted that the Town do elect a Town Direc- tor for the Cape Cod Extension Service and that the Town Clerk cast one ballot for Ralph A. Chase.


Elected Ralph A. Chase, Town Director of the Cape Cod Extension Service for one year.


Article 3. Voted to raise and appropriate the sum of $25.00 toward the support of the Public Library.


Article 4. Voted the refunded Dog Tax be used to- ward the support of the Public Library.

Article 10. Voted that the Town Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow money from time to time in anticipation of revenue of the municipal year beginning Jan. 1, 1933, an amount not to exceed $16,000.00 and to issue a note or notes therefor payable within one year, any debt or debts incurred under this vote to be paid from the revenue of said municipal year.


Article 11. Voted to raise and appropriate the sum of $75.00 for the purchase of flags and markers for Soldiers' and Sailors' Lots and Monument Grounds, to be expended under the Supervisor of Soldiers' and Sailors' Lots.


Article 12. Voted to raise and appropriate the sum of $200.00 for the prevention and suppression of Forest Fires.


Article 13. Voted to pay 50 cents each for all wood- chucks killed within the limits of the Town, after satisfac- tory evidence has been presented to the Treasurer and to raise and appropriate the sum of $25.00 for the same.


Article 14. Voted to raise and appropriate the sum of $150.00 for three or more Band Concerts to be given by the Junior Community Band in the town the ensuing year. Money to be paid to Mr. Chas. E. Ingersoll, Orleans, Mass., treasurer of said Band.


Article 15. Voted to raise and appropriate the sum of $100.00 for the establishment of a free bed in the Cape Cod Hospital, Hyannis, Mass., for care and treatment of persons resident of the town, certified to be residents by the Select- men and unable to pay for such care and treatment in ac- cordance with Chap. 111 Sec. 74 of the Gen. Laws. The Selectmen as a committee are instructed to confer with the

authorities of the hospital and make known that the Town will not pay over the amount appropriated unless they are first assured that should occasion arise the Town will re- ceive credit for the amount paid in.


Article 16. Voted to raise and appropriate the sum of $500.00 for the purpose of continuing the plotting, survey- ing and making of Assessors maps of the Town of Eastham.


Article 17. Motion to take 730 feet on the Great Pond over land of Freeman C. Hatch for Common Landing, amended to take 300 feet from the northerly boundary of Hatch's land southerly between the road and pond as out- lined in plan.


Motion withdrawn to take 730 feet for Common Land- ing on Great Pond on land of Freeman C. Hatch.


Voted that the Town accept the layout of Common Landing on Great Pond in village of Eastham over land of Freeman C. Hatch between Pond road so-called and the waters of the said Great Pond, from creek as shown in lay- out a distance of 300 feet south as reported and recommend- ed by the Selectmen under date of Jan. 30, 1933.


Voted that the Selectmen be authorized and instructed to take by purchase or eminent domain the lands or interests in the lands within the lines of said layout described in the foregoing motion in behalf of the town for a Common Land- ing.


Voted that the sum of $150.00 be appropriated for this purpose.


Article 18. Voted to discontinue the Town Dump in

South Eastham, that refuse be cleaned up, burned or buried. That the Town do not sell the land.


Article 19. Voted unanimously to raise and appropri- ate the sum of $200.00 for Mosquito Control. to be paid to the Treasurer of the Cape Cod Mosquito Control Project. This appropriation is in addition to the State Levy.


Article 20. Voted to take no action under this article. Article 21. Voted to indefinitely postpone.


Article 22. Voted to raise and appropriate the sum of $400.00 for repairs of the Old Wind Grist Mill, beginning with first replacing the shaft and continue with repairs as far as the money will allow so to do.


Article 23. Voted to raise and appropriate the sum of $500.00 to be used under the direction of the Board of Pub- lic Welfare, to aid those persons of the town, able to work and who have applied to the Board for aid.


Article 24. Voted to petition the Selectmen to survey a Town Landing on the shores and on land adjacent to the Salt Pond so-called, beginning south of the clam house where the original fence stood. thence northerly along the shore and land east of the road to the boundary of the land of the heirs of Maurice II. Richardson, and to raise and ap- propriate the sum of $75.00 for the same.


Article 25. Voted to raise and appropriate the sum of $25.00 for the Community Christmas tree.


Article 26. Voted to use $3,000.00 of the free cash now in the Treasury for the purpose of reducing the tax levy of 1933.

ORDER OF TAKING FOR A COMMAN LANDING PLACE


By the Selectmen of the Town of Eastham


We, Arthur W. Parnell, Edward D. Penniman and Ralph A. Chase, as the duly elected and qualified Selectmen of the Town of Eastham, a Municapl Corporation located in the County of Barnstable, in the Commonwealth of Massa- chusetts, acting for and on behalf of said Town of Eastham, under the Provisions of Chapter 164 of the Acts of 1930 and all other statutes in addition thereto, and under the power conferred upon us as such Selectmen by vote of the said Town of Eastham while acting under Article 17 of the Warrant for a Town Meeting of the inhabitants of said Eastham, duly called and held on the Seventh day of February, 1933, as will more particularly appear by reference to the records of the Town Clerk of said Eastham, and by virtue of every other power us hereto enabling, having complied with all the preliminary requirements prescribed by law, do adopt and decree the order of taking and do hereby take a public easement of a Common Landing Place by eminent domain on behalf of said Town of Eastham under the provisions of Chapter 79 of the General Laws and Acts and amendment thereof or in addition thereto, in the land situate in said Eastham on Great Pond, so-called, more particularly bound- ed and described as follows :


Beginning at a point on the west side of the Town Way called Pond Road in the middle line of a ditch at Registered Land now or formerly of Arthur C. Chipman and Abbie F Stuart, thence running in a generally southerly di- rection by the west side line of said Pond Road 340.81 feet to

land of Freeman C. Hatch ; thence running south 87 degrees, 19 minutes, 40 seconds west by said Hatch 1 and 41 and more feet to the waters of said Great Pond; thence running: in a generally northerly direction by the waters of said Great Pond 300 feet to the middle of line of the aforesaid ditch at the southwest corner of said Registered Land of said Chipman or Smart; thence running in a generally northeasterly direction by the middle line of said ditch and said Registered Land 58.26 and more feet to said Pond Road at the first mentioned bound or place of beginning. Said. land contains 9.810 square feet and is the same marked "Land Taken as per Vote of the Town" as shown and Delineated on a plan made by Nelson Bearse, Surveyor, en- titled "Plan of a Common Landing on Great Pond in the Town of Eastham laid out by the Selectmen under date January 30th, 1933, to be recorded with this "Order of Taking" in the Registry of Deeds for said County of Barn- stable. Any trees or Structures upon the land above de- scribed or affixed thereto are not included in this taking and the owner is allowed to remove such trees or structures from the land above described on or before April 1st, 1933. And we award as damages to Freeman C. Hatch, the owner of the land for the Taking of this Public Easement of a Common Landing Place therein, the sum of One Hundred and Fifty ($150.00) Dollars.
