WARRANT FOR ANNUAL TOWN MEETING


February 1, 1932

Barnstable, S. S.


To Harvey T. Moore, Constable of the Town of Eastham, in County aforesaid, Greeting :


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and town affairs, to meet in the Town Hall in said Eastham on Monday, the First day of February next, at 10 o'clock in the forenoon, then and there to elect all necessary Town Officers for the ensuing year and to meet in the Town Hall in said Eastham at 1 o'clock on Tuesday, the Second day of February next, then and there to act on the following articles :


Article 1. To hear the report of the Selectmen and all reports and committees and act thereon.


Article 2. To see if the Town will elect a Town Director for the Cape Cod Extension Service.


Article 3. To see what sum of money the Town will raise for the Public Library and make an appropriation for the same.


Article 4. To see in what manner the Town will dis- pose of its refunded Dog Tax and act thereon.

Article 5. To see in what manner the Town will sup- port its Poor for the ensuing year.


Article 6. To see if the Town will appropriate the sum of $3075.00, provided the State makes a satisfactory allot- ment for the upkeep and maintenance of Town Roads, un- der Chap. 81, Sections 26-29 of the General Laws, as amended.


Article 7. To see in what manner the Town will repair its roads and bridges and make an appropriation for the same.


Article 8. To see if the Town will give the Collector of Taxes the same power which the Treasurer has when Collector.


Article 9. To raise such sums of money as may be necessary to defray Town Charges for the ensing year.


Article 10. To see if the Town will authorize the Treasurer, with the approval of the Selectmen, to borrow money in anticipation of revenue of municipal year begin- ning January 1st, 1933, an amount not to exceed $16,000.00.


Article 11. To see if the Town will vote to appropri- ate a sum of money for Memorial Day and the purchase of flags for Soldiers and Sailors graves and Monument Grounds.


Article 12. To see if the Town will vote to raise and appropriate a sum of money for the prevention and sup- pression of Forest Fires. (By Request).


Article 13. To see if the Town will pay a bounty of $1.00 each for all woodchucks killed within its limits, after-

satisfactory evidence has been presented to the Treasurer, and appropriate the sum of $50.00 for the same.


Article 14. To see if the Town will appropriate the sum of $200.00 for two or more Band Concerts, to be given by the Community Band during the ensuing year, or do or act anything thereon. (By Request).


Article 15. To see if the Town will vote to raise and appropriate a sum not to exceed $500.00 for the establish- ment and maintenance of a free bed in Cape Cod Hospital, Hyannis, Mass., for the care and treatment of persons certi- fied by the Selectmen to be residents of the Town and un- able to pay for such care and treatment, in accordance with Section 74 of Chapter 111 of the General Laws, or take any action in relation thereto, and act fully thereon. (By Request ).


Article 16. To see if the Town will lay out a road, be- ginning near the residence of Rose B. Nickerson and run- ning in a northerly direction to the Town Road opposite the residence of Abbott S. Knowles, and appropriate a sum of money for the same, or do or act anything thereon. (By Request).


Article 17. To see if the Town will accept the layout of a Town Way in the Village of Eastham leading from the State Highway near the house of Harvey T. Moore in a west- erly direction over lands of said Moore, Christine Sullivan and others to the Town Way called Mill Road near the resi- dence of Rose B. Nickerson, with the boundaries and meas- urements as reported and recommended by the Selectmen under date of January 20, 1932, and will authorize and in- struct the Selectmen, to take by purchase or eminent domain, in behalf of the Town, the land or interest in the

lands within the lines of said layout for said Town Way and for that purpose will raise and appropriate a sum not exceeding $100.00.


Article 18. To see if the Town will vote to appropri- ate the sum of $25.00 for the Community Christmas Tree, or do or act anything thereon. (By Request).


Article 19. To see if the Town will vote to accept the sum of $400.00, the same having been bequeathed to the Town by the late Juliette E. Perry.


Article 20. To see what action the Town will take toward building a new School Building, or do or act any- thing thereon. (By Request).


Article 21. To see if the Town will raise and appropri- ate the sum of $1,000.00 to meet payments under the Old Age Assistance Act, or do or act anything thereon. (By Request).

Meeting called to order by Moderator, the warrant was then read by the Town Clerk together with the return of the Officer who served the same.

Trueman F. Brewer and Cecil F. Moore were appointed tellers and sworn by the Clerk. Mr. Ralph A. Chase, newly elected Selectman, addressed the meeting and thanked those present for the support he received at the election. Upon his motion William B. Higgins retiring Selectman and Mrs. Nellie M. Dill, retiring School Committee, were given a ris- ing vote of thanks for their services to the town.


Article 1. Voted to waive the reading of the Town Report.


Voted to accept the report of the Selectmen and all reports and committees as printed with the exception of errors in printing.


Article 2. Voted to elect a Town Director for the Cape Cod Extension Service.


Elected Ralph A. Chase, Town Director.


Article 3. Voted to appropriate the sum of $25.00 toward the support of the Eastham Public Library.


Article 4. Voted the refunded Dog Tax be placed to the credit of the School Department.


Article 5. Voted to leave the support of the Poor in the hands of the Board of Public Welfare.


Article 6. Voted to raise and appropriate the sum of $3,075.00 under Chapter 81 of the General Laws Sections 26-29 as amended, provided the State will allot to the Town the sum of $4,100.00.

Article 10. Voted to authorize the Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of revenue of the municipal year, be- ginning Jan. 1, 1932, in an amount not to exceed in the ag- gregate the sum of $16,000.00, and to issue a note or notes therefor payable in one year, any debt or debts incurred under this vote to be paid from the taxes of the said municipal year.


Article 11. Voted to raise and appropriate the sum of $100.00 for the observance of Memorial Day and for the pur- chase of flags for Soldiers and Sailors graves. To be ex- pended under the direction of the Supervisor of Soldiers and Sailors graves.


Article 12. Voted to raise and appropriate the sum of $200.00 for the prevention and suppression of forest fires.


Article 13. Voted to pay a bounty of $1.00 each for all woodchucks killed within the limits of the town, after satis- factory evidence has been presented to the Treasurer, and appropriated the sum of $50.00 for the same.

Article 14. Voted to raise and appropriate the sum of $150.00 to be paid to the Treasurer of the Junior Community Band, for two or more band concerts to be given by said band in the Town of Eastham during the ensuing year.


Article 15. Voted to raise and appropriate the sum of $100.00 for the establishment of a free bed in the Cape Cod Hospital at Hyannis, Mass., for care and treatment of persons resident of said Town certified by the Selectmen as persons unable to pay for such care and treatment.


Article 16. Voted to lay out a road under Article 16 and to raise and appropriate the sum of $50.00 for that purpose.


Article 17. Voted not to accept the layout of Town Way as outlined under this article.


Resolved: That the Selectmen be instructed to re- locate the road described in Article 17 of the Annual Town Meeting Warrant with due Consideration to the wishes of the abutters, and to report at a Special Town Meeting not later than April 1st.


Article 18. Voted to raise and appropriate the sum of $35.00 for a Community Christmas Tree, $10.00 to be used for an outside tree and lighting, $25.00 to be used by Christ- mas Tree Committee.


Article 19. Voted to accept the legacy of $400.00 be- queathed to the Town by late Juliette E. Perry.


Article 20. Voted to appoint a committee of five to investigate all details relating to building a new school building and to remodeling and otherwise making the old

school building suitable for use. Committee to be appointed by the chair and shall consist of at least three members hay- ing children attending school. Stanley M. Walker, Maurice W. Wiley, Daniel W. Sparrow, Charles A. Gunn and Leslie E. Chase were appointed on said committee, the report of the committee to be read at Special Town Meeting April 1st. Appropriated $100.00 for committee expense.


Article 21. Voted to raise and appropriate the sum of $1.000.00 for the purpose of carrying out the provisions of the Old Age Assistance Act.


Article 22. Voted to raise and appropriate the sums of $633.33 to cover deficit of 1930 and $916.03 to cover deficit of 1931.

Article 1. To listen to the report and recommenda- tions of the School House Committee appointed at the Annual Town Meeting, February 2, 1932.

Article 3. To see if the Town will vote to appropriate the sum of $150.00 for private moth work, or do or act any- thing thereon.

Nickerson, with the boundaries and measurements as reported and recommended by the Select- men under date of March 7, 1932, and will authorize and instruct the Selectmen to take by purchase or eminent domain, in behalf of the Town, the lands or interest in the lands within the lines of said layout for Town Way and for this purpose will raise and appropriate a sum not exceed- ing $100.00.


Article 8. To see if the Town will accept the layout of a Town Way in the Village of Eastham leading from Locust Road near the house of Abbott S. Knowles in a generally southerly direction over land of Julia D. Richardson to the Town Way called Mill Road near the residence of Rose B. Nickerson with the boundaries and measurements as report- ed and recommended by the Selectmen under date of March 17th, 1932, and will authorize and instruct the Selectmen to take by purchase or eminent domain in behalf of the Town, the land or interest in the land within the lines of said lay- out for a Town Way and for this purpose will raise and appropriate a sum not exceeding $50.00.

SPECIAL TOWN MEETING


March 31, 1932


Meeting called to order by Moderator at 8 o'clock, tellers appointed Arthur E. Brown and Ernest M. Moore and sworn by Moderator.


Voted to take up the articles in the order of the warrant.


Article 1. Mr. Stanley M. Walker, chairman of the committee appointed at the Annual Town Meeting, Feb. 2, 1932, to investigate the building of a new school building and all details, also to see what could be done to the present school to make it suitable for further use, reporting that after investigation it was found that a new school suitable for the needs of the Town would cost from $30,000.00 to $35,000.00, depending upon which building was chosen. The Committee found the cost of renovating the present school building amendable to State regulations would be from $10,000.00 to $12,000.00, which in their opinion, would be prohibitive, owing to the fact that it would not material- ly increase the floor space and in the end have an old build- ing which would soon become inadequate for our needs. Plans were shown of several buildings, a model was shown also. In view of the fact that the Town must of necessity, have more school room and sanitary conditions, the com- mittee recommended that the Town build a four room brick school, with assembly room and toilets in basement, cost not to exceed $35,000.00. Mr. Pratt, Superintendent of Schools, was allowed to speak on the question and gave some inter- esting views on the matter of school needs.


Article 2. It was moved and seconded under this article by Geo. A. Smith and Chas. A. Gunn as follows :

Moved that there be raised and appropriated the sum of $35,000,00 for the purchase of land for and the construcion and reasonable equipment of a new school building, and to meet that appropriation, that there be raised in the tax levy of the current year the sum of $3,000.00 and that the Treasurer, with the approval of the Selectmen be, and here- by is authorized to hire $32,000.00, and to issue bonds or promissory notes on the town therfor, said bonds or notes to be paid in accordance with the provisions of Chapter 44 of the General Laws so that the whole loan shall be paid in not more than twenty years or such earlier date as the Treasurer and Selectmen may determine. This motion was put to vote and the result was 50 in affirmative and 32 nega- tive, as it must be carried by two-thirds vote the motion was lost.


Then voted not to remodel the old school.


Motion to continue the present committee for one month to bring in more definite figures on school building and price of school house was lost by vote.


Voted 67 in favor to 6 opposed to build a new school building.


Voted to reconsider vote under this article on the appropriation of money in the sum of $35,000.00, 48 in favor, 12 opposed.


Voted to raise and appropriate $35,000.00 as outlined previously in this article with the proviso, that the loan not to exceed $32,000.00, thus it is not mandatory that the full $32,000.00 be hired. 61 in favor and 19 opposed.

Voted to build the new school on or near the site of the present school building.


Voted that the original committee be asked to serve as Building Committee and that Harvey T. Moore serve also as a member of the committee.


Voted that the building committee be asked to start at once to construct new school as voted.


Article 3. Voted to raise and appropriate the sum of $150.00 for private moth work.


Article 4. Voted to leave the matter of equipping the Town Hall with Fire Extinguishers to the judgment of the Selectmen.


Article 5. Voted to indefinitely postpone.

Article 7. Voted to lay on the table.


Article 8. Voted not to accept the layout of Town Way under Article 8. Balance of Article laid on the table.

Article 1. To see if the Town will vote to postpone all action, financial or otherwise on the New School Building to the Annual Town Meeting of February 1933. (By Request).


Article 2. To see if the Town will vote to provide suitable toilets for the schoolhouse, or do or act anything thereon. (By Request).


Article 3. To see if the Town will vote to appropriate a sum of money as salary for the Moderator, dating from Election Day 1932 to Election Day 1933.

SPECIAL TOWN MEETING MAY 5, 1932


Meeting was called to order at 8 o'clock P. M. by the Moderator. Lewis W. Collins and George R. Wiley were appointed tellers and sworn by the Moderator.


Article 1. Under this article it was moved as follows :


I move, we postpone all action, financial or otherwise on the proposed new school building to the Annual Town Meeting Feb. 1933. Signed by Albion F. Rich and William B. Higgins.


After much desultry discussion the motion was put to vote. Result of vote 77 in favor, 58 opposed, the motion was carried.

Article 2. Discussion upon this article started immed- iately, whereupon Ralph A. Chase rose to a point of order, stating there was no motion before the house. Mr. Chase's point was sustained by the Moderator.


Motion was made that the Board of Health be instruct- ed to provide suitable toilets at the present school building. Amendment "at a cost not to exceed $100.00." Vote on the amendment, 57 in favor, 23 opposed, voted on the amended motion 65 in favor, 37 opposed.


Article 3. Voted to raise and appropriate the sum of $25.00 for Moderator's salary, from Town Meeting Feb. 2, 1932, to Annual Town Meeting 1933.


Under Article 2 the Treasurer protested the action which the article called for in postponing all financial action relation to the new school building, inasmuch as the com- mittee duly authorized by the Town had already incurred expense in an amount of $1,000.00.

Meeting called to order by the Moderator and Albion F. Rich and Charles W. Smith were appointed tellers and sworn by the Moderator. At the time of calling meeting to order it was found that the required number for a quorum were not present. The Moderator then declared a recess

until 8:30 P. M., to endeavor to obtain the 10 per cent of the voters of the town to constitute a quorum as required by the Town By-Laws.


At 8:25 P. M. the required number being present the meeting was resumed.


Article 1. Voted to accept the recommendations of this article and transferred the sum of $2,000.00 from the New School House appropriation to the following accounts, in the amounts as stated below :


$150.00 to Officers Salary and Expense Account. $200.00 to the Assessors Account. $150.00 to Town Hall Account. $100.00 to the Suppression of Crime Account. $500.00 to the Board of Health Account. $900.00 to the Board of Public Welfare Account.
