WARRANT FOR ANNUAL TOWN MEETING

To any of the Constables of the Town of Tewksbury, in said County:
Greeting:
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Tewksbury, qualified to vote in town affairs, to meet and assemble at Tewksbury Memorial High School in said Tewksbury on Saturday, March 6th, 1965 at 10:00 o'clock A. M. to act on the following articles, except Article 1, and you are also hereby further required and directed to notify and warn the said inhabitants of the Town of Tewksbury, who are qualified to vote on elec- tions and town affairs therein, to assemble subsequently and meet in town meeting at the polling places in said Town of Tewksbury, on Saturday, March 13, 1965 at 10:00 A. M. then and there to act on the following Article 1.
The polls for the election of Town Officers to be opened at 10:00 o'clock A. M. and to be closed at 8:00 P. M.

Quorum 327 voters March 6, 1965
The 1965 Annual Town Meeting was rapped to order at 10:00 A. M. by Moderator John A. Morrissey who declared two recesses for lack of quorum. At 11:15 A. M. the meeting convened at the Tewksbury Memorial High School with 337 votors present. The Invocation was offered by Father Barry of St. William's. Mr. Harold Patten was thereupon qualified to his appointment as Official Town Historian by the Town Clerk.
ARTICLE 1. To choose all necessary Town Officers, to choose by ballot, two Selectmen for three years, one member Board of Health for three years, two members Board of Public Welfare for three years, one Assessor for three years, one Assessor for one year, one Moderator for one year, one Park Commissioner for three years, one member Planning Board for five years, one Road Commissioner for three years, one member Planning Board for five years, one Road Commissioner for three years, two members School Committee for three years, one member Tewksbury Housing Authority for five years, two Trustees for Public Library for three years, one Trust Fund Commissioner for three years, one Water Commissioner for three years, and to vote 'yes' or 'no' on the following question: "Shall an act passed by the General Court in the year nineteen hundred and sixty-four, entitled 'An Act providing life tenure for Walter Doucette, incumbent of the office of tree warden of the town of Tewksbury,' be accepted"?
VOTED: Unamimously to adopt.
On voice vote two motions were then enacted by the assembly: (1) To waive the reading of the Articles by the Moderator as required by pru- dential by-law; (2) to consider the Articles of the Warrant in sequence.

ARTICLE 2. To see if the Town will vote to amend the By-Law by adding Article 10 as follows: Executive Secretary to the Board of Selectmen, Section 1: the Board of Selectmen shall appoint an executive secretary under the provisions of Section 23A of Chapter 41 of the General Laws, or take any other action relative thereto. -Board of Selectmen
VOTED: To adopt Article 2 by voice majority as moved by Finance. The Moderator's declaration that Article 2 prevailed was questioned and a count of standees for and against upheld the Moderator 166 to 149. (3-6-65 at 12:12 P. M.) The previous question had been accepted. On the motion to indefinitely postpone the voice majority was indistinct. The Moderator called for a standing vote that indicated 145 yeas and 154 nays. The vote was doubted; the recount revealed the same difference of nine votes against indefinite postponement - 156 to 165. Reconsideration of Article 2 by Finance failed 144 to 191 as the affirmative majority required 224 votes at this moment. (3:19 P. M.)
The Annual Town Meeting was adjourned at 12:25 P. M. for lunch until 2:00 P. M. The meeting did not reconvene until 2:40 when 429 voters were recorded in attendance.
ARTICLE 3. To see if the Town will vote to raise and appropriate the sum of $4,250.00 to implement the foregoing Article, or take any other action relative thereto. -Board of Selectmen
VOTED: To raise and appropriate the sum of $4,250.00 for the purposes of this Article. The move for indefinite postponement lost by a count of 47 in favor and 160 opposed when the voice majority could not be ascer- tained. Reconsideration did not carry 106 - 185, needing 194 affirmative votes to recall the Article.
ARTICLE 4. To see if the Town will vote to instruct the General Court regarding the disposition of House Bill No. 2051 entitled "Tewksbury Selectmen - Manager Act" or take any other action relating thereto. -Board of Selectmen
VOTED: To indefinitely postpone Article 4 by voice majority on Finance motion. The motion to amend by Mrs. Jackson was lost. (3-6-65 at 2:48 P. M.)
ARTICLE 4A. To see what sum the Town will vote to raise and appro- priate to employ a Town Accountant as set forth in a Special Act of the General Court passed in the year 1965 and accepted at the Annual Town Election, March 13, 1965. -League of Women Voters
VOTED: To indefinitely postpone on voice majority. No dissents.
ARTICLE 5. To fix the salaries of the various elective officers of the Town and determine whether such salaries shall be retroactive to January 1st. (Refer to Salary Schedule for Elected Officials.)

VOTED: Unamimously to adopt all items in the salary schedule for elected officials not questioned for discussion. So marked were items 2 and 13. (3-6-65 at 2:53 P. M.)
Item 2: Voted the sum of $4,420.00 as moved by Finance. The motion by Mr. Nickerson for $3,420.00 lost when put to the assemby. (3:01 P. M.)
Item 13: Voted to set the figure at $6,591.00 on Finance motion, following acceptance of the previous question. The voice vote for $6,280.00 moved by Mr. Plante did not carry.
Voted that all salary items under Article 5, as moved by Mr. William Chandler, be made retroactive to January 1, 1965 by a counted vote of 212 yeas and 113 nays. The voice majority was not sufficiently definite to the Moderator. (3-6-65 at 3:11 P. M.)
Voted to refuse to reconsider Article 5 as moved by Finance with 144 votes against. There were no votes in favor. (3:25 P. M.)
ARTICLE 6. Item 42 - Fire Dept., Capital Outlay: On Finance motion it was voted 293 to 0 to expend the sum of $25,000.00 from the Stabilization Fund for the purposes of a new fire engine. The two-thirds vote required 196. (3-6-65 3:49 P. M.)
Item 58 - Board of Health, Expenses: The sum of $95,400.00 was voted unanimously as moved by Mr. Kevin Sullivan. This was an increase of $1,000.00 for measles vaccine.
Item 63 - Highway Dept., Capital Outlay: A secret ballot resulted when Mr. MacArthur moved for the sum of $18,106.00. Finance rec- ommended $14,800.00 and this sum was carried by the ballot vote of 179 in favor, 124 opposed.
Item 68 - Veterans' Benefits, Salaries & Wages: On motion by Mr. Ward Davis the sum of $2,488.80 was voted for this item. When called, after discussion, the sum of $1,600.00 moved by Finance was declared lost by the Moderator.
Item 90 - Water Dept, Salaries & Wages: The sum of $39,715.90 was approved by a secret ballot vote of 224 yeas, and 66 nays as moved by Finance. The motion by Mr. Merrill for $34,715.90 lost on voice vote. Motion by Mr. Charles Carter for $44,083.90 did not reach the assembly. (4:32 P. M.)
The motion by Mr. William Hurton of Finance to adopt Article 6 in its entirety as amended carried on voice declaration. No dissents. (4:33 P. M.)
ARTICLE 7. To see if the Town will authorize the Selectmen to institute suits on behalf of the town or defend any suits that are, or may be brought against the Town, and to sign any contracts or agreements in behalf of the Town. -Board of Selectmen
VOTED: Unanimously to authorize the Selectmen to act for the purposes of Article 7.

ARTICLE 8. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1964, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws.

VOTED: As amended, to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1965 and the financial year beginning January 1, 1966, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44 of the General Laws. (Voice majority, no dissents, 3-6-65 at 4:35 P.M.) Move to amend by Mr. William O'Neil to delete January 1, 1964 and insert "January 1, 1965 and the financial year beginning January 1, 1966" was carried unanimously.
ARTICLE 9. To see if the Town will vote to authorize the Selectmen to sell, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the Town at least fourteen days before the sale, property taken by the Town under tax title procedure, provided that the Selectmen or whosoever they may authorize to hold such public auction may reject any bid which they deem inadequate, or take any action relative thereto. -Board of Selectmen :
VOTED: Unanimously to adopt as moved by Finance.
ARTICLE 10. To see if the Town will vote to authorize the Board of f Selectmen and the Treasurer to foreclose, either through the land court or by affidavit of the Commissioner of Corporations and Taxation, any tax title held by the Town for more than two years, and vote to raise and appropriate the sum of $3,800.00 therefor. -Board of Selectmen
VOTED: On voice vote to raise and appropriate the sum of $3,800.00 for the : purposes of Article 10.
ARTICLE 11. To determine what sum the town will authorize and direct the Assessors to take from available funds to reduce the tax levy for the current year, or take any action relative thereto.
VOTED: The motion by Mr. Hurton, Finance Chairman, was carried to transfer the sum of $78,000.00 from the E & D account to reduce the tax levy for the current year. A count of 134 against and 100 in favor was recorded on the motion to table this Article after the voice majority on this vote had been doubted. (4:42 P. M.)
ARTICLE 12. To see what sum of money the Town will vote to raise and appropriate and/or transfer from Overlay Reserve for a reserve fund, pursuant to the provisions of Chapter 40, Section 6.
VOTED: To raise and appropriate the sum of $6,500.00 and transfer the sum of $9,500.00 from Overlay Reserve as moved by Finance for the purposes of a Reserve Fund.

ARTICLE 13. To see what sum of money the Town will vote to transfer from E & D to the Stabilization Fund under the provisions of Chapter 40, Section 5B of the General Laws.
VOTED: Unanimously to transfer $3,000.00 from the E & D Account to the Stabilization Fund as moved by Mr. Hurton of Finance.
ARTICLE 14. To see if the Town will vote to raise and appropriate the sum of $1,000.00 to purchase and install safety signs and markers.

ARTICLE 15. To see if the Town will vote to adopt the following resolution:
WHEREAS the General Court sitting as a Constitutional Convention, did on July 16, 1963, give initial approval to a Home Rule amend- ment to the state Constitution, and
WHEREAS this bill of rights for local governments requires a second approval by the members of the General Court during this legisla- tive session, and
WHEREAS we, as members of this Town Meeting, feel competent to handle the affairs of our town without strict supervision by the Commonwealth of our every act and deed.
NOW THEREFORE BE IT RESOLVED that this town meeting hereby instructs its representatives to the General Court to vote in favor of the Home Rule proposal (H 1384 of 1963 as revised) when it comes before them.

Moderator John A. Morrissey called the adjourned meeting to order at 8:00 P. M. with a quorum of 455 seated.
Votes recorded on the following Articles of this Warrant were recorded upon motions initiated by Mr. William Hurton, Chairman of the Finance Committee and properly seconded unless otherwise indicated under specific Articles and this certificate is herewith made a part of such Articles by reference.
ARTICLE 20. To see if the Town will vote to raise and appropriate, or transfer from available funds, the sum of $10,000.00 for the purpose of completing the grounds and to build playfields for various school sports at Memorial High School, and to authorize the School Committee to employ professional consultants, expend such funds, call for bids, and to execute and sign all contracts, vouchers, and legal documents, incidental and necessary to carry out the purposes of this article, or take any action in relation thereto. -School Committee
VOTED: Motion to indefinitely postpone carried by voice vote.
ARTICLE 21. To see if the Town will vote to raise and appropriate the sum of $22,641.14 to satisfy the judgment and execution secured against the Town by Armando DeCarolis, et ux in the land damage action against the Town, Middlesex Superior Court Docket No. 247745, which amount includes interest to May 1, 1965, or take any action in relation thereto.

VOTED: To raise and appropriate the sum of $22,641.14 for the purposes of Article 21 to satisfy the court action on the well field off North Street, taken by eminent domain from Mr. Armando DeCarolis.

ARTICLE 22. To see if the Town will vote to amend the Zoning By-Laws by adding the following paragraph No. 2 to Section 19:
Par. 2. The Board of Appeals herein provided for shall also have jurisdiction under Chapter 41 Section 81-Z to hear appeals from the Planning Board as therein provided and as provided in Section 81-Y of said chapter, and any other pertinent sections of Chapter 41. -Planning Board
VOTED: To indefinitely postpone following the affirmative vote on the previous question.
ARTICLE 23. To see if the Town will vote to strike out the vote under Article 14 of the Special Town Meeting May 15, 1956 and substitute the following:
"To see if the Town will vote to adopt the following regulations in accordance with the authority granted by Section 8 of Chapter 61 of the Acts of 1951: 'No water main extension shall be made on existing ways without a specific vote of the Town for such exten- sion. Water main extensions may be made into subdivisions with- out such specific vote, under the authority of the Installation Account, provided such subdivision conforms to the present Zoning By-Law and has been approved by the Planning Board' or take any action in relation thereto. -Planning Board
VOTED: Indefinite postponement as moved by Mr. Shea carried 298 to 181. The counting of the vote was ordered by the moderator as the voice majority was questioned. The previous question was ordered by the assembly, so the first vote on this Article - to amend and delete the last sentence, substituting therefor ... "Water Main Extensions may be made into subdivisions without such specific vote under the authority of the Installation Account, provided such subdivision, or any land to which water access is thereby given, conforms to the minimum lot requirements of one acre and 150 feet frontage as delineated in the presently existing Zoning By-Law and in addition thereto but not alternatively thereto has been approved by the Planning Board or take any other action in relation thereto" - lost when asked of the assembly. Reconsideration of the vote taken was refused by the assembly 230 to 0.

ARTICLE 24. To see whether the Town will vote to raise and appropriate a sum not to exceed $245,000 for the purpose of constructing, originally equipping and furnishing a new fire station and to determine how any such sum shall be raised, whether by taxation, by transfer of available funds, by borrowing or otherwise, and if by borrowing to authorize the issuance of bonds or notes of the Town or take any action relative thereto. -Municipal Building Committee
VOTED: The amendment to Article 24 moved by Mr. Noftle of the Municipal Building Committee and requiring 354 votes to carry was refused by the assembly with 298 in favor and 232 opposed. This vote in effect killed Article 24 since the amendment encompassed the Article. The amend- ment is offered as recorded:

That the sum of Two Hundred Forty-five Thousand Dollars ($245,000) be and it hereby is appropriated for the purpose of construct- ing, originally equipping and furnishing a new fire station; and that to meet said appropriation, the sum of $5,000 shall be transferred from the Excess and Deficiency Account , the sum of $80,000 shall be transferred from the Stabilization Fund and the Treasurer, with the approval of the Selectmen, be and he hereby is authorized and directed to borrow the sum of $160,000 by the issuance and sale, at one time or from time to time as one or more seperate issues, of general obligation bonds or notes of the Town under and pursuant to clause (3) of Section 7 of Chapter 44 of the Massachusetts General Laws (Ter. Ed.), and other applicable provisions of law, each such issue to be paid in not more than ten years from its date, provided, however, that if and to the extent that a grant or grants of federal or state funds shall be received prior to the sale of said bonds or notes, such grant or grants shall be applied to the cost of the project in lieu of the proceeds of notes or bonds and the amount of the loan hereinbefore authorized, to the extent that it shall not have been issued or sold, shall be reduced accordingly; that the aforesaid appropria- tion shall be expended by and under the supervision of the Municipal Building Committee appointed by the Selectmen pursuant to vote adopted under Article 19 of the Warrant for the 1964 Annual Town Meeting, which Committee, in addition to the authority previously granted, is hereby authorized to enter into all contracts and take any other action necessary or convenient to carry out the construction, original equipping and furnishing of said new fire station; and that said Municipal Building Committee be authorized to make application for and accept in the name and in behalf of the Town any grant or grants of federal or state funds that may be available in connection with such project.
